reports from the biden team trey gowdy has analysis but john roberts leads our reporting. he is live there in nashville tennessee today. john? >> bill, good afternoon to you. up until now story about abandoned laptop. orphaned hard drive legally blind computer technician and rudy giuliani. today the story taking a new twist now focusing on tony b. >> bhmplet ulinski decorated navy veteran. company hunter biden and uncle jim biden and the partnership with a chinese energy firm. now, for the past few days fox has been focusing and reporting on an email that was found on hunter biden's laptop that detailed the percentage split of this partnership of $10 million with this chinese firm and the 10% of that would go to, quote: the big guy. and the statement to fox news bobulinski saying the reference to the big guy in the much

publicized email is in fact a reference to joe biden. hunter biden called his dad the big guy or my chairman and frequently referenced asking him for his sign-off or advice on various potential deals that we were discussing. the senate homeland security and governmental affairs committee and the senate committee on finance have requested documents relating to bobulinski's affairs with the bidens which he has provided. fox news has obtained all of that information. included in it is a text message from early may of 2017 in which bobulinkskis thanks jim biden for arranging a meeting with joe biden at the beverly hilton hotel. in there there was also a document which includes possible domestic contacts for the business venture. the list includes a number of prominent democrats including kamala harris, andrew cuomo. chuck schumer, bill de blasio of new york, klobuchar and about gavin newsom and also includes

florida republican senator rick scott. however, nothing in the documents to suggest that any of the people on that list were ever contacted or were ever involved in the business venture. the president expected at the debate tonight to bring all of this up. here's the white house communications director alyssa farrah. >> i do think we are going to whether it's asked or has the opportunity to bring it up, he is going to get into this issue of hunter biden. the american people need to know if the biden family in any way is beholden to china. this is our biggest geopolitical adversary the fact that the mainstream media is refusing to cover this story is gravely concerning. the president is willing to bring it up himself if necessary. >> joe and hunter biden critics have been saying what hunter biden was really doing because he didn't have any expertise in energy was selling access and influence in that statement to fox news as we see the president and the first lady deplaning from air force one. what bobulinski said in that

joe biden spent the last four days at home preparing for face-off tonight with president trump who has promised to grill him on allegations surrounding his son hunter's business deals and questions of to what extent, if anything, joe biden was involved. now, after that man identifying himself as hunter biden's foreign business partner came forward dumping new documents, emails and text messages, the biden campaign referred me back to the former vice president's tax returns which they cited as proof that biden didn't take in any of this money as suggested in those emails identifying him as the big guy. the fact the campaign is citing the former v.p.'s tax returns is significant. if you lie on your taxes, it can be a felony. in his first comment acknowledging the allegations, joe biden called it garbage from rudy giuliani. president trump's henchmen and another smear. on his way to the debate, biden said he only hopes president trump follows the rules. >> we will have plenty of time to talk when this is over.

focuses in on that, you know, joe you said. this it's not true. we know it's not true. where else are you lying? then i think it can be a winning argument for him tonight. >> bill: okay. so after tonight, where is this going? there seems to be this drip, drip, drip on the inside of it. >> you know, bill, it depends. i really don't think the bureau and the department of justice are going to do anything between now and the election. so who provides oversight in our culture that's not criminal. that would be the media. and i have seen more stories. i wish i had not. i wish i could unsee the stories of rudy giuliani or jeffrey tubin or the fly on mike pence's head. i have seen a lot more stories about that than the substance, the substance of whether or not these emails are accurate and whether joe biden was truthful. so only if the media decides that it's relevant. keep in mind, bill, president trump was impeached for misconduct, alleged misconduct involving a foreign country. if you should be removed from office wouldn't it be relevant

to decide whether or not you should be in office in the first place? >> bill: that is the legal side of it. let's talk about the political angle. how hard does the president go with this tonight? what would you recommend? >> yeah. i would recommend that he wait. i mean, when you know something is coming up. when you know something negative is coming up, then you are always on guard for it. i wouldn't bring it up first. i would make him stumble through other things knowing in the back of his mind look i have got to address hunter at some point. i would not lead with it. it's best if the moderator brings it up. so, the president doesn't have to. but i would not come out of the gates with it because biden expects you to. he has prepped more on this question than anything else. do not do what he expects you to do. wait a little while. >> bill: why do you think he stayed home all week? >> because he thinks he is winning and he doesn't think he has to questions and he doesn't think he has to do anything. and he has got, you know, what they claim to be the most charismatic person on the planet

error. it would appear you are behind at the moment. how do you see it? >> i have been on the ground for several weeks. i have got to tell you the momentum is on our side. there is great enthusiasm for this president and as we know with polls, some polls show the president tied. some polls show the president leading in our internal data and so what we are so looking at right now is the fact that we have got an incredibly strong ground game. you are talking about over 2.5 million volunteers who are helping us out throughout these states getting out the vote and also 100 million voter contacts in this cycle. so we have a very sophisticated ground game right now. something that i haven't seen in republican politics for a long time. >> bill: if i could just interject. just back in those four states, suburban women, all right, our polling finds this: you are down 35 points in michigan, 18 in ohio, 29 in pennsylvania, and

21 in wisconsin. if that's anywhere close to being right, how do you overcome that? >> i was just with the ivanka trump in wisconsin. and in michigan. and i got to tell you it's a large number of women who come out and are supporting the president the issue that we keep talking about that the president is focused on is that of economic growth and prosperity, opportunity for all americans and as well as safe communities. the president being a president of law and order. we know that that is a priority for this president as we know he has received some endorsements from the law enforcement community and i think for you is burr ban moms as we go ought and speak about what the president has accomplished in such a short period of time how he is combating coronavirus through operation warp speed ensuring that we have a vaccine that's getting developed. that we have the therapeutics at hand. those are critical actions the president has taken to save lives and that's the message that we're talking about.

pompeo has done the last 24 hours. what is this the crackdown media companies out of beijing. what's that all about? >> thanks for having about that bill. basically what we are trying to do is make sure that the american people and everyone around the world know exactly what the chinese communist party is up to. and essentially to boil it down, what china will do is bring quote, unquote, media organizations to the united states. and these are actually not media organizations. they are not journalists. they are propaganda outlets of the chinese communist party. what we continue to do is to hold them accountable. we are now saying that these quote, unquote, media organizations, propaganda organizations have to register as foreign agents. this is important here. this is a part of the process here at the state department of us naming and shaming the chinese communist party and bringing to light the actions that they pursue around the united states. we have done this with, you know, secretary deboss and secretary mike pompeo when they issue to american universities and k through 12 schools be careful of confucius institutes.

trey gowdy said don't bring up the hunter biden thing let it linger out there for a period of time. let's see how that goes. back to "60 minutes." joe biden asked about packing the u.s. supreme court, how he might change the u.s. legal system intriguing answer let's hear it. >> if elected, what i will do is i will put together a national commission of bipartisan commission of scholars, constitutional scholars, democrats and republicans, liberal, conservative, and i will ask them to over 180 days come back to me with recommendations as to how to reform the court system. because it's getting out of whack. >> bill: i don't know what's out of whack. he went on to say about a number of alternatives other than packing but did not flat out dismiss it. norah o'donnell said so it's a live ball and he pretty much said it is, katie. this still is an issue. >> it's still annual issue because joe biden still has not answered the question. to put off the responsibility of

whether you will are will not pack the court to another commission in washington, d.c. citing constitutional lawyers and attorneys and experts. the late justifiable rudy giuliani was a constitutional expert. and she said that the court should stay at 9. we have a process for this. the senate vets and consents the nominee that the president puts up and the president is responsible constitutionally for appointing somebody to the supreme court. so we already have a system in place. joe biden is avoiding the question. he is avoiding the question because it is bad for democrats in terms of the polling, the vast majority of americans do not believe that the supreme court should be packed and notice how democrats have changed their language joe biden by going from court packing to court reform. it's the same thing. >> bill: he said he is going to take recommendations, juan. what's that going to look like? >> juan: typically, you know, in washington, d.c. those kind of commissions and panels where good ideas go to die. people can say what they want

but usually if you want to do something, you do it. so i think that what he is doing here is kind of, you know, to be fair to him, thoughtful, sober response to the fact that republicans really have changed the structure of the federal judiciary at this moment. especially given what is going on with amy coney barrett and the fact that they have rushed this through. they have now got a 6-3 majority because they denied an opportunity to the last president to have a nominee in the last year of his presidency. >> bill: you know, i'm just thinking. >> but going ahead with president trump. >> bill: when is the last time we had a commission to debate our legal system? when was that? >> not debating the legal system. there have been. >> bill: 1935. >> juan: no, we have had different numbers of people on the court. it's not about the legal system. it's not denying the authority of the supreme court over the law. it's not a challenge to that. it's a challenge to the idea that one party has distorted the political structure and politicized the court.

and i think that undermines the of the court to many people. >> bill: katie, go ahead. >> katie: first, i would agree with juan that all good ideas in washington, d.c. a number of them are very few go to commissions to die. we agree on that. but the idea that republicans have somehow politicized the court filling legitimately empty seats whether it's federal, judiciary seats on the federal bench or whether it's supreme court seats by simply replacing someone by voting in senators who want constitutionally guided judges is not a restructuring of the judiciary. it's simply a constitutional duty that republicans -- >> bill: i'm sure juan would agree with you on that. >> juan: no, no. >> bill: i was kidding. i want to know why barack obama was in philadelphia yesterday and joe biden was a 40-minute car ride away and they weren't seen together. and now over the weekend we hear that obama will be back on the trail in florida. when are these guys going to do an event together? it's been eight years, juan, together in the west wing.

alex azar says, you could get a vaccine for certain vulnerable groups of people. how do you read that, doc? >> well, i think that he is giving away the order in which this is going to be approached, bill. vulnerable people means those with pre-existing conditions like obesity or in close contact with people with covid. people that are most at risk. the elderly, but those most at risk. and then right after that you are going to see by january healthcare workers and seniors get it and then by march or april, the vast majority of the population. all of this, bill, hinges on whether we get a vaccine that works and is safe. that's not a given yet. we're in the stages of clinical trials of six vaccines and pfizer for one is about to present information to the fda but they still don't have the safety data yet. it looks pretty promising. now, i spoke yesterday to the head of the nih dr. francis collins, who says that he thinks these message rna vaccines, the top geneticists in the world,

bill, he likes the way the vaccines work the messenger rna ones where they send a message to your cells to make the proteins that are on the virus. the immunity we are seeing with those vaccines is pretty impressive. the last point that the virus itself is not changing very much. and not changing in a way where the vaccines won't work. very, very important information. >> bill: sounds like all good news. we listened to azar yesterday and he sounded very confident by the end of december that you are going to have something that you can work with now. i'm going to move to brazil and talk about this volunteer who died during a trial. was this person taking experimental vaccine or placebo. >> bill, inside sources on that say it was the pl placebo. continue a meningitis shot rather than the covid-19 vaccine. let me be clear on this. it would be beyond astounding if someone died taking the actual vaccine and they didn't halt the trials. they did not halt the trials in brazil. they have not halted them in the united kingdom or south africa.
