bench? >> there is been a challenge to the pennsylvania law as it was amended by the supreme court of pennsylvania. the court in the last ten days or so refused to hear the case on a four floor vote. what was issued then was to stay the court's ruling, changing the election law. now the parties are back in court because what they are asking is just for a ruling on the merit that what the court did violated the law in the constitution and that could come up. they are imploring the court to decide the case before the election and i happen to think it's very important that they do that. if they decide before the election, it's just that they are setting the rules under which the election will proceed. i'm worried if they wait for chaos after the election it will look like the court is choosing the president. >> bill: and you want clarity.

let me show you the calendar. second debate never happened, we are on the 26th of october here, obviously election day as the late eight days away. but let me show you a different calendar. these are ver various states, ny of knowing what happened in the state eight days from now but humans in pennsylvania. as the law stands right now if you mail in a valid as a 5:00 on election day that's supposed to count and yet they added up on friday the 6th of november and there are similar laws in iowa, minnesota, nevada, north carolina and the state of ohio. so what do you see it play legally here? if you have a contested result in one of those battleground states? >> they are asking for trouble here because congress has set by statute a single election day which is november 3rd.

if you encouraged accounting to go on beyond november 3rd, while the results are being reported by the national media, it's an invitation to all kinds of shenanigans and it becomes worse as they have in pennsylvania if you can't prove a ballot was postmarked before election day. so you have the prospect of people voting after election day when the results being reported all over the country, even though the election was supposed to have been over on novembe november 3rd and that obviously infectaffects the integrity of e results and invites about a fraudulent activity. >> bill: we could put other states on the calendar but we chose these because we have considered them the margin of

error. the laws say you have to have it in by election day but the counting of the issue. you have to have a postmark on a mail-in ballot. but that all goes back to election day. the point is you may have to deem what is voter intent? is the postmark? did the stamp match up? signature match up? all of that would be or could be contested if you really have a razor-thin margin for the outcome. >> and also who gets to decide, the constitution says these rules are supposed to be set by the state legislatures and not the state court.

bills that are out there. be able to safely open up our schools. it will cost $200 billion to do it, but it is worth doing it. we should do if your lower class sizes, ventilation, sanitation. the business is to be able to be open. if we provide the same kind of help, which we said we would do. there is so much more to do. testing. we should be pouring billions of dollars into determining how we get a rapid testing. rapid testing. so you know within hours whether or not the test is negative or positive. many places, you have to have to wait sometimes up to six or seven days. he is not doing what needs to be done. look, folks, i promise you this. i'm never going to give up. you know, mr. president, you have to have a little bit of shame. just a little bit of shame because people are dying.
