ohio. i saw a great enthusiasm there, but the points beyond that. the binding campaign has been fully compliant with cdc guidelines while the trump campaign has splattered that. up to a serious degree. if you cite a recent study nonpartisan, a scientific study that shows nearly 30,000 individuals that attended a trump rally in the past six months since the covert outbreak have come down with the virus. hundreds of individuals have succumbed to the virus. it shows how the trump campaign is willing to put their supporters in harm's way. >> i don't have the stats in front of me not you quoted, but i'm asking you again you look at the picture, people showing up to the rally. i wanted to ask you again, do you think it correlates to a vote? are you concerned about it at all? >> i don't think it necessarily corresponds as you are seeing the trump campaign and the

president's remarks are geared toward his base, certainly his base is engaged with him this cycle. they are fired up and they wait hours at a time to see him. that speaks volumes again to his base engagements, but that is it translate to real votes both in the early votes and seeing tomorrow than anyone's guess. you're also seeing the enthusiasm with the donations. the vice president released numbers at 5.5 million individual americans have donated to the campaign. compare that to the millions more in the trump campaigns also in terms of actually americans stepping up and giving to a campaign, you're seeing a lot more enthusiasm with the vice president's campaign. >> i want to switch from personality to the pandemic and policy. does the pandemic outbreak policy in the dash what will drive voters now? is it better suited to get us out of the pandemic or who is

what we see a repeat? >> it's a supreme court decision to actually change the rules in the middle of the campaign is rather stretching the law. the loss pretty clear in pennsylvania, they should have been able to get the votes mailing pellets by election day. the supreme court their extended three days extra and in fact, not just postmarked but no discernible postmark, those two would be accepted. now, the supreme court of the united states has weighed in at least initially and hasn't ruled yet on this, but they did say they would look at the issue if necessary. >> okay, they did not issue a final ruling. it's not as if -- you can't appeal to a supreme court decision but they have not made one yet. >> they haven't made one yet but in the meantime, pennsylvania is keeping those ballots that are received after election day separated from the rest so this

way they can be subject to scrutiny and the legal later on. one other point i want to make about this about pennsylvania, this idea of a lot of mail in ballots creates a lot of issues around having voters met all the technicalities of the mail in ballots. sign the secrecy envelope and et cetera. pennsylvania, the supreme court of pennsylvania said that voters who used mail-in ballots cannot have an opportunity. if they fail to sign a male invalid or the secrecy envelope, they cannot cure it. that's one thing that's decided. but there is counties in pennsylvania that are allowing them to cure issues with their absentees and their male ends, which, by the way, totally unfair. if that needs to be across the whole state both republican counties and democratic counties.

let's bring in richard st. paul, civil wrote back voting rights attorney who worked on several federal election cases. thank you for being with us this morning. to be clear, a lot of people have mailed in votes and have voted early and now we have a lot of challenges to the whole situation. how ugly and complicated mate and get? >> good to be with you. first of all, we live in unprecedented times and because of covid there's a lot of opportunities to mail in your ballots. as lonthe laws have changed allr the country to make it easier to follow during covid. we see a lot more mailing ballots these days. the bottom line is, the litigation team is out there to ensure that the election is a fair process. and everybody has an opportunity to vote, but they vote their correct way. whether by mailing ballots or in person. if it's a mailing ballots, the ballot has to feel he might be filled out correctly for the particular vote to count.

counsel for the are in c. key battleground state of pennsylvania allowing mail in ballots to be counted through friday if postmarked by election day, the trump camp is promising to fight this. do they have a solid argument? >> that is -- there is not a clear indication where that is going to go but most recent, yesterday judge emmet sullivan from federal district court in washington dc order the postal service executives to take what he said were extraordinary measures to make sure ballots were delivered on time. that will mean for pennsylvania, wisconsin, michigan, these battleground states that postal service is going to have to do everything they can including using i guess priority metal delivery standards to get the

ballots delivered as soon as possible and then any sort of changes in terms of when they can be counted are going to have to be determined with pennsylvania still up in the air. >> delivering them is one thing and counting them is another and there are hundreds of lawsuits across the country. what are the odds we see a repeat of tallahassee in 2000, weeks to finalize the results? >> i wouldn't be surprised if that happens in either house or senate races. for the presidential race that is a very low likelihood. to have the florida situation happen again you've got to have it all come down to one state and the counting system in that state and that is not terribly likely. that being said - i would just

note - eric: hard to have a conversation but my next question was going to be what are the odds we will know who won tuesday night? >> very slim. in michigan for example secretary of state and governor have said don't plan on having results until friday. that i think is good advice for any of these battleground states that are not used to counting mail in ballots and for the first time have to count millions of ballots in a way they never counted before. if we don't have results on tuesday night that just means it is a close election, doesn't mean anybody has done anything wrong, just means the counting is taking a little longer. >> appreciate you getting up earlier staying up really late for us tonight this morning. thank you.
