ainsley: we are live at liberty state park in new jersey. see new jersey behind us. not sure if you got any sleep. six states we still don't have the final results. so we don't know who is going to be the next president. will president trump stay in the white house or will joe biden move in. brian: $300 million that the trump team put into ground game and seems to have paid off. they are very much in contention right now taking the presidency. although this is far from finished this thing is going to be lasting at least another couple of day fuss consider pennsylvania. steve: sure, one of the ones

that the president would really lining to win is wisconsin. in the last hour, the milwaukee results came in of 169,000. i think they are right now in wisconsin they are -- foxnews.com, you know, down looted app. they are reporting 95% of the precincts reporting with joe biden just ahead by a little. they are waiting for green bay right now. and you know why they don't have the green bay numbers? because apparently the vote count in green bay was delayed because one of the vote counting machines ran out of ink. so they had to go down to city hall. they got more ink and now they are counting them. brian: other states stopped counting. yeah. we are going to call it a night. ainsley: is green bay democrat or republican leaning? steve: not sure. looks like democrats are going to keep the house and looks like republican also probably keep the senate. susan collins won. well it hasn't been called yet but she is far ahead. joni ernst won.

thom tillis called it for himself. lindsey graham and john cornyn. steve: and john james is ahead in michigan which would be a big upset. griff jenkins is live in delaware. we heard from the former vice president last night. he came out and said i'm optimistic but we are not going to light up the fire crackers yesterday. griff: good morning. both candidates spoke but for our viewers waking up. let's catch them up with this race stands. have to get to 270 to be the next president. here is where they are in the overall electoral college vote. biden in the front with 238. trump 213. now here is how it went last night. first big surprise when florida went toe president trump. winning by some 3 points in the sunshine state. then came the big lone star state 38 electoral votes there we were told that would be a close one. that's a near 6 point margin in that one.

first swing state of the night ohio going as well to president trump. but then a blow dealt to the president. joe biden picking up arizona. the grand canyon state. then another pickup for biden in minnesota, which went blue. so, what's really turning out to be pretty clear at this point is, you guys are talking about wisconsin. the rust belt trio of pennsylvania michigan and wisconsin may determine the outcome of this elections. all of them are outstanding. cacan you see them here separatd and very close many of them and in pennsylvania it's likely going to take the rest of the week at the earliest to figure out who won. you talk about former vice president biden speaking in this parking lot behind me a little after 12:30 a.m. talking to the people in their cars saying is he pretty optimistic about the results he is seeing. watch. >> we're confident about arizona, turn around. we also just called it for minnesota and we're still in the game in georgia.

[horns beeping] >> that's one why weren't expecting. we are feeling good about wisconsin and michigan. by the way, it's going to take time to count the votes. we are going to win pennsylvania. griff: but then an hour or so later the president spoke from the white house. and here's what he had to say. >> this is a fraud on the american public. this is an embarrassment to our country. we were getting ready to win this election frankly we did win this election. we did win this election. [cheers and applause] griff: afterwards biden's campaign manager jen o'malley dillon calling the president's statements outrageous and correct. we repeat what the vice president said tonight donald trump does not decide the outcome of this election. joe biden does not decide the outcome of this election. the american people decide the outcome of this election and the democratic process must and will continue until its conclusion

those wisconsin numbers are going to be very interesting indeed. if you add up, wisconsin, michigan and pennsylvania amount and what it could mean, guys that would be a total of 46 electoral votes. we'll just have to see when we get those. in and also keep your eye on georgia. our own karl rove saying last night in the wee hours it's all about georgia, georgia, georgia. we will see what happens. brian, ainsley, steve? ainsley: i heard him say that so far the numbers in georgia -- thanks so much griff -- 55 for trump and 58.3 for boyden not all the votes have been counted so it's a toss-up. director of the fox news decision desk been on all the shows and a wealth of information when it comes to these states. good morning to you, arden. >> good morning to you. thank you for having me nevada

say they are going to be counting more votes starting at 9:00 a.m. local time, which is roughly noon in the east. i think that wisconsin is also going to be getting more vote reported today. i also think that georgia, particularly the suburban counties around atlanta will be getting additional vote reported today. and so it's possible. brian: let's start with georgia. what do you see? it's with a 1.5 between them. what should we know about what's left and where? >> we know that some of the outstanding vote is in the atlanta area which tends to be more the atlanta suburbs sort of the places in -- one of the places in the country that swung from romney to clinton. so it's possible that former vice president has an advantage there. it's also possible that some of those suburban counties have gone back to trump since their performance in 2018. but the other thing that we don't know and this is the mystery about this entire

election is how many outstanding early and mail-in votes are to be counted? the most -- the unique thing about this election is for whatever reason, republicans this year said i need to vote in person on election day. democrats were much more adamant or as adamant saying i need to vote early or by mail in this election. and what you saw was huge differences between the way the early mail-in vote came in and the way the election day vote came in. so, on election day, yesterday, president trump may have won every state on election day with the exception, possibly, of the deep blue states of new york and connecticut. on the other hand, if you just look at the early and mail-in votes. joe biden probably won almost every stated with the exception of the dakotas. i mean, he got more early mail-in votes in places like mississippi and alabama, place that we knew from the get-go

were going into trump's column. brian: right. >> when we look at the votes. that's the stuff that may be remaining. that's the stuff that the states haven't totally reported. steve: right. indeed. i'm looking at the foxnews.com interactive map. it shows that the dakotas, to your point, the president is in the 60's, mid to upper 60's in vote totals. if why could put up michigan for just a moment. i know that according to foxnews.com, with 84% of the votes counted, the president is ahead 51.4 to joe biden's -- there are the very latest numbers right there. what's interesting, as i look at the senate race, an none, it looks like john james, the challenger to the democrat, gary peters, john james actually is outpolling the president. >> yes. i think there is a lot of indication that james was going to outperform the president. and so right now it looks like he has a really good shot of

defeating the incumbent and making that the second turnover for the republicans. of the evening. we're going to have to wait and sees a michigan continues to count the vote and particularly as we find out how many really outstanding mailing votes there are before we can make a call in that state. brian: if i can ask you real quick why do you think john james has a better chance to win than the president. >> i think is he outpolling the president when you look at the actual numbers. brian: what about the separati separation? >> i think the difference is a little greater for james right now. but, listen, i'm not ready to call either one of those races. i want to see more vote in michigan. last night it looked like the president had a strong lead in wisconsin. right now wink has turned into a toss-up. same with georgia. which is, clearly as trump has a slight advantage.

but it's pretty clearly a toss-up really right now. steve: all right. an none see you later. >> thank you very much. ainsley: you are welcome. let's bring in corey lewandowski and david bossie senior advisers of the trump campaign and co-authors of the book the president suck sides against all odds. good to see you both. >> good. >> good morning, ainsley. ainsley: good morning. corey, the president spoke in the middle of the night. is he upset with how this is all playing out. we know his complaints about what's happening in pennsylvania. when you look at what's happening there, and you think about the american people, we still don't know the results. and, look, i know we are used to waiting. this has happened before. when people wake up this morning they wanted to know who the next president of the united states is going to be. when you have some states that are saying look, you can vote early for six weeks, you can vote early for a week. then after the votes are cast, then we are going to take a view days to vote is that fair to the american people and how do we

know that this is all legitimate that these counts are legitimate? >> you know, ainsley, as you look at where we are right now in this race, there is a number of states that we believe donald trump has already won. you look in michigan. donald trump is up by 200,000 votes. i heard what your expert just said before this. but the truth is that race should be called. the same is true in georgia. the same is true in north carolina. we believe donald trump has already won those races. look at the battleground state of pennsylvania. donald trump is up almost 700,000 votes in the state of pennsylvania right now. we believe that state is a win for donald trump. you put all those together, donald trump is the president of the united states. and he was reelected last night. brian: corey, the problem is and david, you might want to pick up after this 1.4 million votes still out there. so if you have 1.4 million and 600,000 lead. even though it would take an inside straight to do it you should really wait for that, don't you think? >> well, brian, i think that

everyone wants every legal vote to count. it's that to make sure that they are not stuffing the ballot boxes, brian. this is about the integrity of the election. that on the day after the election are ballots going to be found and collected and counted. and that's a deep concern by our campaign. i can tell you right now that the lawyers are warming up in the bullpen, and they are going to make sure that it's one vote for one person. and that's what this process has to be. and i think the american people demand it. but to corey's point is, we are winning this election. and the president is going to get to 270. you know, your so-called expert who was just on just said that no one saw this massive red wave that the president told everybody about for the last several weeks. so, maybe he was the only one who didn't get that but the

point is, we knew that our people in every piece of data that we collected and so did everyone else understand that the republicans were going to vote on election day. and that's what happened here. and that's why you saw these massive swings when absentee ballots and the literal vote were counted early, that same day voting, yesterday's voting made us win. and win by huge margins, guys. in florida, and ohio. they were massive margins much bigger than the 2016 margins that president won by. brian: texas, too. >> and texas well. steve: earlier we had an none on a couple of times he said president trump won every state except the super deep blue california. i just have to laugh, yesterday

going into election day, you know, you watch the polls and they all said trump was going to lose by a landslide. and joe biden was way up. as i look at the state of florida on the interactive map right now it, sounded like -- i saw a number of polls that showed joe biden was going to blow the president out of the water. right now with 96% of the ballots in, the president is leading substantially, 51.3 to joe biden's 47.9. how did the polsters get it so wrong it appears right now. >> steve, not only did they get it wrong in florida which donald trump won largest margin statewide candidate in the last 10 years in florida is a complete blowout. we knew those numbers were accurate at 9:00 p.m. but most of the polsters and pundits refused to give donald trump the credit he deserved by winning florida by such huge margin. he won by a bigger marger than rick scott and marco rubio and

bested his numbers in florida by three times the last time. his numbers in florida were massive. this wasn't a surprise. anybody could count knew this is exactly where we were. but look at where we are in the battle ground states in north carolina, in georgia. in michigan. donald trump is winning by insurmountable margins in those states and yet these so-called experts refuse to call it. they were wrong again in this election just like they were wrong four years ago. there has never been accountability for these people. most of them should be fired to be very honest with you. >> it's exactly right. to quote yogi berra it's deja vu all over again. we saw this in 2016. this is ridiculous. look, in north carolina as an example. we are leading by 77,000 votes. there is virtually no way for joe biden to take the lead there, yet, we are not having that state counted in the trump

column, which it will end up being. the drawing out of what they did last night in calling these states, look, florida we were dominant in, and they called california before florida? it was just -- it was a surreal thing to watch to be quite honest. our leads were so massive and they still were not called for president trump. and we just don't understand why. we will get into that after we win. but president trump is on track to get to 270 electoral college votes because that's the game. and he's going to win whether he wins all of pennsylvania and michigan and wisconsin today or in coming days. this is over in our opinion. this is -- president trump has been reelected president of the united states. ainsley: corey, one word answer, when will we know? what day? >> today. ainsley: okay. all right. thanks so much guys for coming on with us. their book is called "trump, america first."

>> thank you. ainsley: you are welcome. thank you. all eyes are on the white house but voters were also weighing in on the issues from minimum wage to magic mushrooms. jillian mele has some of the most interesting ballot measures that passed in some states. hey, jillian. jillian: good morning. that's right. magic mushrooms on the ballot in some states. oregon became the first to legalize them as a form of mental health treatment administered by facilitators at licensed centers. voters in d.c. passed a measure dropping magic mushrooms to quote the lowest levy of law enforcement priority. meantime voters in south dakota passed measures to legalize marijuana. south dakota making history as the first state to pass recreational and medical use of pot at the same time. and florida voters approving a $15 minimum wage. the measure will gradually hike the starting rate for workers by 2026. and for the first time in 126 years, mississippi will fly a

ainsley: he rose to national prominence with stunning primary win back in june and then gained national attention at this summer's republican convention. now 25-year-old madison cawthorn winning the north carolina race to fill mark meadow's former seat becoming the youngest member of congress there he is standing for the flag at the rnc. joining us on the heels of his very busy exciting night north carolina republican congressman elect madison cawthorn. good morning to you. >> ainsley, good morning. what an incredible morning for the entire country. you know, it's such a question of who is going to be the president. i believe it's going to be donald trump. i'm so just -- i can't express my emotions that i'm feeling right now. ainsley: first we will start with you and your race. what time did you find out last night and what your thoughts this morning? >> we actually -- we had to find out very early. i was surrounded by family, volunteers. friends. we had a really big celebration

party outside but back stage. my 50 closest friends and family members in the world. and politico called it first right around 9:30. so first thing we gained is bowed our head and gave all the glory to the lord and started celebrating. what a whirlwind. what a ride and what an honor. ainsley: you know, madison, i'm so proud of you. you were in a car accident and lost the use of your legs. we saw you standing for the flag and getting out of the wheelchair. so special and very emotional. you got engaged. you are getting married next summer. you will be a part of congress next year. things have really worked out for you. we are so happy about that. the seat was vacated by mark meadows that was not planned either n your life. when he vacated to become chief of staff at the white house. why did you want this so badly? >> i believe it's time for a new republican party to rise. you know, i don't think we just need to have a bigger tent.

we need to have a bolder tent. i think for too long the republicans have acted with timid at this on issues where we should be leading. i'm looking forward to having a republican party that can lead on issues and bring people all races religions and creeds together to work for a better america that's what the future is about. people who love freedom and liberty and willing to work together to achoir it. ainsley: i know mark meadows called you last night to congratulate you. i want to hear about that conversation and tell us what you want to do in d.c. what are your priorities. >> former congressman meadows and debbie meadows. they were both mentors of mine growing up they were debate coaches of mine it was great to be able to have them talk to me. they shaped a lot of my values. it was a real treat. ainsley: that's great. what are your priorities in washington, d.c. washington? >> well, two fold effect there.

one, when it comes to policy, i literally want to lead on healthcare. i would love to be the face or the real advocate and catalyst for healthcare reform on the side of the republicans something that i care very much about myself. i think we need to deregulate that market significantly. i also believe there is a cultural battle to fight as well. political divide we see in our country right now, ainsley, is something that really bad. there is so many americans that just hate one another because of a d or r beside their name whereas i know been said often but let's come together as americans rather as republicans or democrats. healing that partisan divide will be a major priority of mine. ainsley: i think that's a priority for all of us so go and do that please, madison. our country needs that one word answer, will president trump win in north carolina? >> yes. he will. he will win north carolina. i have antidotal and empirical today back that up. i generally believe he will.

>> back with a. -- what are they protesting. in d.c. burned american flag and launched fireworks. lucas tomlinson where several arrests were made overnight. what are they protesting that they are in this country. >> brian, i think they want this president out of office and about 10 minutes prior to sunrise over the white house where those protesters are expected to return here today. as you mentioned protests stemming across the country here in the nation's cap tall out west to portland. [shouting] you better this get that [bleep] camera out of here. >> the majority of the protesters against president trump were peaceful in the district last night many were

very vocal. some protesters even wore body armor and gas masks. tensions rose at times leading to just three arrests. before election day, fences was added to the perimeter of the white house. businesses across d.c. have boarded up making it feel like a hurricane is coming. things got much more heated out west. in los angeles, police in riot gear dispersed hundreds of people near the staples centers homes and lakers arresting fifth people on charges of failing to disperse after ignoring orders by police. arrested 50 people on charges of obstruction to at least one assault on a police officer. with no winner in the presidential election. expect those protests to continue, brian. brian: all right, lucas, thanks. here to react maybe when we get a verdict we will be talking about this a lot about the protests and some of the unrest across the country that we're preparing for is our great panel. the host of rob smith is problematic rob smith. along with former director of jocial justice for the 2016 bernie sanders campaign tezlyn figaro and can a redd-it foster is here an independent voter who

has her own consulting company. first off, can a redd-it, let's start with you. what people are angry we get it. this is not the way we handle it. this is not the way to -- have your rage but channel it in a way that brings people together. how about volunteering in under served neighborhoods. not contributing to destruction and disarray this is not going to help people with anything. we got to do better. brian: rob, i do not think any of those people burning the flag wanted to serve uzidi in a homeless shelter. if you don't have a verdict, can't you pause your fake anger until you actually know what you are angry at? >> i don't think so. look, these cities and these businesses were boarded up over

the past week. we saw this happening in beverly hills. we saw it happening in new york city. we saw it happening in d.c. and they were not boarded up because they thought trump voters were going to revolt. they were boarded up because of biden voters. we have seen this stuff over the past few months how they reacted with all of this rioting and all of these different cities. they have been trained to react if they don't get their way in this violent way and they, you know, thought that things weren't going their way last night. brian: right. can i go to you, tezlyn. let's talk about kenosha. we know about the riots. we know the president went there and know these cities were destroyed because of the shooting that took place and we see where this went. kenosha seems to have gone heavily for the president the united states. technically it's under his watch but is he not in control of every city, tezlyn. do you think the voters digested it that. >> first i'm an independent voter i think that's important to say. the same way you say it happened on his watch. that's the same thing we are happening with the other protesters the peace and not

control kenosha also not in control of what happened right now on the west and that goes the same for the left is also not in control of people exercising their right to protest. as a veteran, i would say that people certainly have the right to protest. whether people agree with the timing of the protests or not is another conversation reality is people do have a right. it's a handful of people. millions of people voted last night. i'm not buying into this fear factor that there is going to be a civil war that starts tomorrow. the bottom line is most americans will be clocking in to work like they normally do in on twitter during their break so they can pay their bills next week. this is not some massive disarray about to happen across the country there will be people who are upset because fear has been stoked on both sides of the republicans as far as democrats. brian: i want to work my way around here. there is no blue wave. there is a battle for the senate. it's going to be raiser then if

thrazorthin. you want to take that karith, are you surprised about what didn't happen even though there is a lot we still don't know? >> listen, there is a lot we don't know. i'm here in dallas, i'm in texas and i will be honest. i was very surprised by the amount of biden signs that i saw almost as many -- as many trump signs. i'm not surprised. because, you know, the democrats, god love them, they need to get their message under control. there is a reason why so many people especially people of color are leaving the democratic party. i also am an independent. we have a problem right now with bringing people together and to just assume that you would have all of the votes of people from a certain demographic as i mentioned yesterday, that's really dangerous. and it's ininsensitive. they are learning the message. they're hearing the message.

brian: 20 seconds real quick, rob it. doesn't look like the american people wanted a revolution. >> the blue wave was a pipe dream. i don't know what anybody was smoking when they thought texas was going to flip blue. the polls were all wrong like they were in 2016 there is a lot 6 levies to learn here and we'll learn them over the next few days. brian: tezlyn it, looks like whether it's president biden or president trump they are not going to have the votes in the senate to add states to overthrow the electoral college and get rid of the filibuster. >> well, there is going to be a lot of stuff that's not going to happen. the votes are still out. i hate to speculate. i any that's a part of your job to see how things shake up. like was just said people didn't know what they were talking about like in 2016. have to wait to get these votes. in when they do rest assured i have a whole list of things that i can point out that went wrong as far as on the left side of things. we will just see how it shakes

that's what matters. brian and steve, good morning to you as well. let's go right to the race boards and show you where that road to 270 stands. it is joe biden who is leading right now 238 to trump's 213. now, here's the states we know so far. the first big surprise of the night florida going to president trump. the sunshine state's 29 electoral votes. then came a bigger prize the lone star state, 38 electoral votes in texas. we were told by the way that would be close. that's a near 6 point margin. and then our first swing state of the night ohio going to president trump. but then, a blow dealt to the president, joe biden picked up surprisingly arizona. then another big pick pick-up for brian minnesota going blue. what's not yet called and likely to determine the outcome of the election rust belt trio michigan, pennsylvania and wisconsin. can you see the numbers there pennsylvania may take days to call before we know exactly what happened there. now, biden, shortly after 12:30

the president's statement tonight about trying to shut down and counting of duly cast ballots was outrageous, unprecedented and incorrect. now, guys, we are also waiting the outcomes of three more possible swing states, nevada, north carolina, and georgia. karl rove said it's all about georgia. and we can tell you just some breaking news now fox news decision desk in the senate race there the special senate race to place retiring senator johnny isaacson two year remaining term it is going to be a run-off between republican incumbent kelly loeffler and democrat challenger warnock. it's going to be a two-way race. won't know the answer to that runoff until later in december. brian, ainsley, steve? brian: thanks, griff. if senator purdue stays above 50% he won't need a runoff on his side of georgia. georgia means so much not only for the president but as you see for the balance of power in the

senate. bring in arnon michigan fox news decision desk. that's an important card that he has. things are beginning to change. if we can, we are looking at pennsylvania, north carolina, michigan, wisconsin, georgia, nevada. by 9 power invested in me i would like to start with michigan. take a look it. is closing a little bit. and i wonder if you could take a look at that it looks like it is 50.5 to 48.3. we will take a look -- excuse me 49.8 to 48.6. do you know what counties are coming in. >> it's not so much what counties are come in. although we do know that the detroit area and that is come in. and this is one of the reasons why former vice president biden kind of closed some of the gap with the president. in michigan where, last night a couple of hours ago, it looks like the president had a very large lead. that lead has been reduced significantly. and, in fact, in our models

right now, it's basically a toss-up. i mean, it is an knowable toss-up but it's clearly a toss-up. the thing about michigan what we are waiting for is not the election day vote. we are waiting for the early and the mail-in vote. we know that the early mail-in vote this year was really strongly democratic. just as the election day vote was strongly republican. the early mail-in vote was strongly democratic. and that's the vote we are waiting for. so right now michigan is a toss-up. and this is very important for the president. because even if the president wins georgia, where they almost tied right now. he has a slight edge. north carolina where i think he has an edge, we are not ready to call it but he has an edge. and pennsylvania, still winds up at 268 electoral votes. and so he needs either michigan or wisconsin or nevada. i don't think is he going to get nevada. it's sort of very strongly leaning trump. he needs either michigan or

wisconsin in order to close the deal and win re-election. and right now both michigan and wisconsin are looking increasingly toss-up. and that's significant news. brian: could michigan be done today? could michigan be done counting today? >> that is clearly within the range of possibility. we are not going to call it until we are convinced that one side or the other has certainly won. but, given the way michigan has been counting, it's very possible that they could -- we could have counted enough vote to be confident in a call one way or the other. as i said right now. it's a toss-up. steve: right. and if we could look real quickly at north carolina, you mentioned that. according to foxnews.com, we got the interactive map and it's fantastic. something like 94% of the ballots have been returned and as you can see the president is up by that much. 94%. and then you look at georgia as well.

also, 94% and the president is up -- it locks substantially -- it looks substantial to us. arnon, they both have 94% in. how much more do you need before you declare a winner? >> the thing is that the remaining vote even in the southern states which are really good about counting the early and election day vote much better than the northern and rust belt states which have little experience in it even in the southern states the last vote -- or last tranche of votes to be counted is likely heavily early and mail-in vote. that's the vote that tilts to biden. actually it doesn't tilt to biden. it swings to biden in terms of what it compared to the election day vote. which very much swings to the president. and so we're not ready to call georgia. north carolina is looking a little better for the president. but georgia is clearly, you know a slight edge for the president but really when i say slight, i mean slight. steve: okay. ainsley: arnon, what can rust belt states learn from a state like florida that had their

acted together that did this smoothly and got results in last night? does the american public have a right to know immediately and the nominees too or the candidates? >> well, the candidates for sure have a right to know and the american public certainly has a right to no. i mean, look, if you are in my business, there is a beauty in the vote counting process. there is a beauty in watching democracy be -- and the vote be counted i have got to tell you. it would be nice if it were to go faster. i do think if the northern states in these rust belt states moved to much more early and mail-in votes the southern states and western states have embraced wholeheartedly then, yes, they have got to get better at it and decide whether or not they can start counting the vote earlier than that. make for shorter election nights. so i can get some sleep. brian: yeah. arnon, can i imagine that there are going to be challenges either side because there is 1% separating michigan, north carolina, and georgia.

did you imagine that, too. there is going to be a challenge being that the whole presidency is at stake? >> yes. my sense is that both these parties have raised hundreds of millions of dollars to prepare for legal challenges in all of the states where the vote is close. and so and i think the president said so yesterday. and i think that the -- we know that the biden folk are also funding lawyers. steve: okay. go get one more cup of coffee. we're going to talk to you and pick your brain in one hour. arnon, thank you very much. brian: they are all moving. they are counting votes now. steve: indeed they're not in pennsylvania. although i think they started at 7:00. so they have been counting for 11 minutes. mike huckabee has been counting the moments until he could pop up on our air. there he is right now. governor, we don't no a lot. what are your observations this morning? >> well, i think it's going to turn from attention to the voters and now it's going to be

all about the lawyers and the courts. you know, as we were just hearing. it's going to be a donnybrook. i don't care there is any doubt about it. one thing that's interesting, florida was a national embarrassment in terms of thousand counted votes. now it's the national model of efficiency. and it's been proven that they knew how to do it. i wish the other states would take a lesson. ainsley: do you ever worry though about these states? i understand why some of these states are not doing it. i prefer the florida model. but when you look at these other states, they don't want to count until election day or that night or maybe the next day because if word got out who was winning so far, then that might influence voters. >> well, but i think there is a bigger concern. look at the polling. i mean, i think polling is now as obsolete as an 8 track tape and worthless as a milk bucket under a bull. never hear about polling anymore. it's worthless. all it did was cause some people

to think oh well there is no point in going to vote because it's already a 10 point biden lead or 10 point trump lead. i think we have got to get to a place where we don't depend upon very unscientific methods of polling both proven to be horribly wrong in 2016 and 2020. one of the things a tragedy in pennsylvania. philadelphia was the birthplace of liberty. and if a lot of these votes, you know, sort of suddenly get found and get counted days after the election, it would be a real shame if philadelphia became the place where liberty also died. brian: governor, 67 million americans eligible americans came out to vote. that's a stunning number. for the longest time we beat each other up saying 60% show up. this time 67% do show up. that's one thing i'm going to salute the american people. 15 appearances in 72 hours. almost single-handedly with the

great ground game forced something which would be a second stunning now this time unimpeachable victory if can he pull off the states is he leading in right now. >> well, nobody can say the president didn't really want this. that he didn't work hard for it. i have never seen any presidential candidate or for that matter any candidate for any office work as hard, put as much into these final days as president trump did. the rallies were stunning. and it's a whole new model for getting a message out. because he was grossly outspent. and, let's not forget donald trump has faced the head winds of the national media plus the opposition party for four long years. they have been blowing in his face at 200 knots an hour and it's been stunning. yet, he continuing to march on one of the reasons supporters are for him he is willing to

fight against insurmountable odds. okay, governor, stand by. because we want your opinion about this next story because we're taking a live look right now at philadelphia because you just mentioned that where elections workers have been counting ballots apparently around the clock at that particular facility. ainsley: but we still might not know who wins pennsylvania's 20 electoral votes until at least friday. brian: did i not know they were counting through the night. jillian mele live with more as handful of counties counting mail-in ballots this morning. and the president enters today with a lead in pennsylvania. jillian: you are exactly right. at least 8 counties put off counting mail-in ballots until today. right now president trump as brian mentioned is leading with over 55% compared to joe biden who is over 43% of the vote. but the legal mess has already begun with two republican led lawsuits over ballot counting. the dnc already filing a motion against one. the bigger question though is will this ultimately land in the

supreme court? last week the supreme court denied a gop request to fast track a ruling upholding the state's mail-in ballot due date extension. the court's conservatives warning they could take up the gop appeal again after election day. for now though both sides feel good about taking the keystone state. >> going to take time to count the votes. we're going to win pennsylvania. i'm really encouraged by the turnout. >> we are winning pennsylvania by a tremendous amount. >> it's going to be almost impossible to catch up. jillian: some democrats ready to call pa for joe biden. senator bob casey releasing a statement overnight saying quote when all the votes are counted, vice president joe biden is going to win pennsylvania and be well on his way to necessary electoral votes to win the presidency. that echos the state's attorney general josh shapiro who tweeted saturday if all the votes are added up in pa trump is going to lose. updated numbers just as of a few minutes ago. so far the pennsylvania

department of state reports at least 1.1 million mail-in ballots have been counted. that though is less than half. send it back to you guys. >> all right. that means there is at least a million to go. thank you very much, jillian. let's bring back in mike huckabee. governor, the president has suggested that he wants to make sure there is no shenanigans but the way the law is written in pennsylvania, is that as long as your ballot is postmarked midnight last night. they are going to give the post office three days to get it to them. so it can be legally counted. and that's why it's so frustrating because we would like an answer right now but we might not know until friday. >> i do think everybody wants every legal vote to be counted. and if it takes three days it takes three days. it's not what we want. we would like for it all to be over on tuesday night. let's remember. this the key here is legal votes. let's make sure that people

didn't drop off votes that were not legitimate and that's what i think the republicans want to make sure of is that these are identifiable votes from legitimate, legal voters. and if the president loses on that front, then he loses. that's life. but, look, america is still a great country. i salute the fact this many people went out to vote. it's a great affirmation of our process. i hope we have learned some things through it. but maybe the best lesson of all is that we get to choose our leaders and if we don't maybe get the way that we wanted it to go, i hope we do, but that's life. and we live to fight another day and our country goes on. and we need to make sure that we do it without taking to the streets and clubbing each other. we win by ballots, not by bullets. and we got to keep reminding ourselves of that. ainsley: it would be a different morning as a conservative though if democrats got the house, the senate, and the presidency and

you don't have to sign anything. now, of course you have to sign something to get your documents. you have to show your i.d. and so this is happening across this country by any means necessary even if we have to do crooked things. i think that i'm glad that we are finding out that some people have been doing things against this election, against the rights. you know, i want my religious freedom. i want to keep it. ainsley: um-huh. so, you know that area of georgia or all the areas. when you look at the map of the votes that still have not been counted or not come in yet, what do you expect? do you think trump will pull this off there? he is ahead. he has 50.5% and biden 48.3. >> what i'm say something this. religious freedom it's time to pray. we have been praying. that's what i'm doing. i'm fraying. i didn't stay up all night anxious and sick and stomach all

think it's going to be president biden. it's going to be exactly the map you and i discussed the hillary map of '16 plus arizona, wisconsin, michigan, and nebraska one to get to 270. i'm cautiously optimistic and the betting markets are there as well. with respect to the economic recovery, i think with the republican majority in the senate, democratic majority in the house and the democratic president, you're going to have debates much different than we have had. it's going to be about deficit spending versus deficits. it's going to be did b. stimulus vs. tax reform. there is no clear cut vision for the way that this economy and this recovery is going to work. it's going to have to be a real what i would say bipartisan effort to really get things passed and we're going to have to do it because we are still in a tough, tough time during this recovery and covid. steve: all right. so, stephen moore, worse case

scenario for you if the president were to lose, by robert's assessment, it would be a deal where if joe biden is president there is a republican senate which essentially would be a fire wall to keep the democrats from changing taxes and a whole bunch of stuff. >> well, joe biden is not going to be the next president. donald trump is going to be reelected. we feel very confident in pennsylvania and michigan and north carolina and georgia. but, i think robert's predictions are about as accurate as the polls were. look, the markets clearly clearly want donald trump. last night when he surged into the lead, i don't know if you noticed, steve, the stock markets just went through the roof just as it did by the way the day after the election exactly four years ago when the market went up 700 points. i think it's clear voters think that trump is much better for the economy. that was very evident from the exit polls and investors also think trump is better.

and i think that's ultimately when he wins it will be because he is better for the economy. steve: all right. lightning round. robert, now that the election is passed, can nancy pelosi make a deal with steven's friend, mr. mnuchin so that the folks out there who are hurting can get some stimulus? >> i think absolutely. i think you will see mcconnell come to the table, pelosi and mnuchin. especially with mcconnell keeping the senate. i think everyone knows there needs to be a cares act 4. my gut tells me it will be somewhere near 2 trillion. it's going to have to get passed. no one is going to want to go into the new year with this time of overhang of 10 million unemployed and one in five businesses closing and the government sitting on their hands. steve: all right. steven, final word? >> i think the reason trump won this race and will precisely because the economy is so red hot right now. we saw last week 33% growth in the economy. we are seeing, you know, very

dramatic reductions in unemployment. i don't -- the economy needs another stimulus frankly. we need to do the smart things. robert, somehow a 4 trillion-dollar tax increase tax reform? that's called a massive tax increase not called tax reform. >> are you asking me the question? do i have time to answer? >> i did. tax reform is fixings tax system that doesn't do that. >> well, it is tax reform. can i explain it to you. some of the people will be getting interest earned tax credits. they will be getting tax credits for schooling for elder care, there is a loft things they will be getting. and it's going to be tax reform because we are going to change the idea of how it works for the minimum that companies have to pay a 15% minimum if you are adding billion plus dollars of revenues. but either way, steve. it's unlikely that's going to happen. right? your senate is not going to pass it even though president biden will want to.

like, are going to keep the senate, democrats the house. brian: city pelosi lost -- nancy pelosi lost seats in the house, she promised more. they spent millions of dollars, they got nothing. give general since is live in wilmington, delaware, with the breakdown. >> reporter: good morning. if just waking up, exactly as you guys said, no winner yet, and nothing matters more than that number of 270. let's show you where they stand. joe biden holding a lead, 238, to president trump's 213. now, here's the states that we do know. florida going to president trump. the sunshine state's 29 electoral votes, but some 3 points he won. then came the lone star state, 38 electoral votes for president trump. we were told it would be close, but that was a 6-point margin, so they got that one wrong. the first swing state of the

night, ohio, also going to president trump. but then a blow dealt to the president, joe biden surprised everyone, picking up arizona. then another big pick-up for biden, minnesota going blue as well. here's what's not yet called and likely e to determine the outcome of the election, that rust belt trio, michigan, pennsylvania and wisconsin. pennsylvania likely to take days, even into next week to call it. totaled together, all that would be 46 electoral votes. now, biden spoke first last night short lu after 12:30 a.m. to a parking lot full of supporters sitting in their cars. here's what he said. >> we're confident about arizona to turn around. we also just called it for minnesota, is and we're still in the guam georgia. in the game in georgia. although that's not what we expected. and we're feeling real good about wisconsin and michigan. and, by the way, if you take time to count votes, we're going to win pennsylvania.

steve: thank you very much, griff, somebody who knows all about georgia and the other states, is the director of fox news' decision desk, he is literally the man behind the curtain. [laughter] he's the guy that gets to make the big calls and tell us exactly who the winners and losers are. you know, as we look at it, still too early to call, pennsylvania, north carolina, michigan, wisconsin, georgia and nevada which griff kind of detailed right there. i know you're not a pollster, you're an analyst. but isn't it clear that the so-called shy trump voter was pretty much impossible for the professional pollster to figure out which way they were going to vote? >> well, before we start doing a deep dive and an autopsy on the polling this year, i'd like to get the final votes in. i think that, you know, the key thing this year that made it so so different was you had election day vote and the election day vote in person was

clearly republican. and then you had early vote and mail-in vote, and that was clearly democratic. and the skew was enormous in both cases. i think biden was winning the early vote by 25 points, trump was winning the election day vote by 25 points. trump won almost every state on the election i day, biden won almost every state with the exception of north dakota in the early and mail-in vote. trump, i think, may have lost new york on the election day vote but nothing more. and so before we get it, let's get all those votes, particularly the early and mail-in votes which are the ones that get counted last. that's what we're looking in michigan and wisconsin in particular. that's what nevada is counting right now. that's why georgia, you know, trump is ahead. but, ooh, it's tough. so right now what we're looking at is a place where in order for the president to win reelection, he's going to need to win

georgia, which i think is very doable, north carolina, which i think is almost likely for him right now and pennsylvania. who knows. even if he gets all those three, he's still at 268 electoral votes. and in order to win, he's going to have to win either michigan or wisconsin. and as you look at the vote right now, those are, if anything, frankly, let's put it this way, when i look at michigan and wisconsin right now, we are nowhere near calling it, but in those states i'd rather be joe biden than donald trump. in north carolina and georgia, i'd rather be donald trump than joe biden. that's how i'd put it. and in pennsylvania, i don't know who i'd rather be. ainsley: what if pennsylvania, what if they don't finish counting all these votes until the end of the day friday the or maybe even next week? would we, if trump does get georgia and north carolina and biden gets nevada, that means wisconsin and michigan. if wisconsin and michigan go to trump, would he be the winner at

that point, or would we have to wait on pennsylvania? >> if the president wins both wisconsin and michigan, north carolina and georgia, he's the next president. if biden wins nevada, wisconsin and michigan, he's the next president. we all think that pennsylvania's ground zero. it might not be. it may be wisconsin and michigan. brian: what distance do they have to be this pennsylvania to not be waiting on them to count every single ballot? right now to the layman, trump's up pretty substantially, 600,000 votes, 55-43. and we're kind of trying to avoid them counting ballots with no postmark on 'em for the next couple of days. what distance do you need, what lead do you need to make it secure? >> for the president, that's the $64,000 question. historically we look at the vote that's come in and we say, well,

the next votes are going to look like that. this year we may new that the president has a lead, but it doesn't mean he's got a lead in the state. he's got a lead in the election day vote, and what's left to be counted is the early vote and the mail-in, and that's what pennsylvania has shown itself somewhat lackadaisical in counting. we saw that in the primaries, we're seeing that now. we anticipate it could take days in pennsylvania to count the early and mail-in vote. and it's not my job to decide which votes should count or not count. that's the job of the courts and the state and primarily state legislatures. my job to follow those, whatever regulations they have and say who's going to win in that. that's my team's job. brian: sure. steve: and right now in pennsylvania, according to your team, fox news, only 64% of the vote it is in. so back to work. thank you very much. >> thank you for having me. steve: let's bring in jonathan turley, george washington university law professor. professor, good morning to you.

you know, the president last night said he was optimistic but then again suggested that, you know, he wanted to make sure that what goes on from this point forward is completely legit, and he might go to the supreme court. our question is what could he possibly go to the supreme court and say? >> well, i'd be surprisedded if some of these challenges do not make it back to the supreme court. you know, in presidential elections we've waited for the wave of litigation that came at the end of the election day or more often than that day. in this election we started in the red zone. we've already been to the supreme court. we've seen challenges in all of these swing states. many of these cases were placeholders. many of them were challenging practices and causes in the state -- in case the state

turned to be nail-biters. of well, that's happening, our worst case she is scenario e happening. we're looking at states that, quite frankly, are a mess. i mean, pennsylvania is a mess. it's had a lot of previous litigation that tore apart these election rules. is so you have these controversies. in pennsylvania they will take ballots after, you know, election day with the postmark. but even if they're postmarked and you can't clearly see when they were postmarked, they're going to give the benefit of the doubt to the voter. even if their signatures don't match, once again, that will not bar ballots. all of those types of issues raise the integrity of the voting process. but they also raise the role of the court in changing state election law. so all of that is ripe for challenge. so in the next few days, we will focus on counting the vote.

but after that we will focus on keeping the votes. that's where litigation gets quite intense. we do not have at this time the type of blowout that would make litigation largely irrelevant. ainsley: what was your reaction when you found out that republicans, it looks like, will take the senate? because there was that worry from conservatives that they would try to stack the court and add more supreme court justices if the democrats won. >> well, the threats against the supreme court were a source of really deep concern for many of us, and, indeed, i think that was a blunder of the first order i by joe biden. many americans would vote for him but would have serious trouble voting for anyone -- brian: right. >> -- who wassing willing to consider taking action to the supreme court. but months ago i who that if donald trump prevails in this election, the people most responsible, i think, would be

the media, you know? we have this just unrelenting level of negative coverage from the media. a lot of voters were turned of off by it. they certainly under the off the news. brian: yeah. the impeachment was the good old days. the pandemic was all his fault, and after a while with twitter and facebook freezing his account and putting money into everybody against him and republicans, i think the american people stood up and said something. my last question to you, jonathan, is in these states that look like they're going to be decided by 1% -- wisconsin, michigan, maybe pennsylvania, perhaps georgia -- if you don't like the outcome, do you have a legal right to challenge it especially with so many absentee ballots, early absentee ballots, go in and just look at all these ballots and make sure there are signatures, make sure they're filled out correctly, make sure they shouldn't be provisional --

ainsley: legitimate? >> absolutely. this is a target-rich environment for litigation. there's every right in the world for both camps to challenge the counting of these ballots. there are conditional and provisional balloting, there's controversy involving how the ballots were sorted and stored. all of that can legitimately be brought to the court and will be by both parties. so this could very well be decided in the court. and the onlied good thing is that -- only good thing is that all of my political commentator friends will be taken off the television in favor of legal analysts who should have appeared all a along. [laughter] brian: it's all about you, jonathan, all about you. there you go. [laughter] steve: all right. jonathan turley -- brian: face time for the legal experts. steve: let's bring in newt gingrich, speaker of the house for a while, also author of the

book "trump and the american future." mr. speaker, good morning. >> good morning. steve: oh -- >> a wild night. steve: yeah, no cudding. brian: not over. steve: sounds like it's going to be a couple of days before we know about pennsylvania. but right now in wisconsin with 95% of the vote in, joe biden is leading by just a little, and then over in michigan with 90% of the vote in, joe biden is trailing the president by a little. so where are we on this wednesday morning? >> well, you know, former attorney general of nevada warned suggestion or eight weeks ago that the -- six or eight weeks ago that the democrats in nevada were setting up the state to steal it. i was born in harrisburg, and everybody knows philadelphia's the center of vote theft and that the governor did all he

could to maximize the opportunity to steal votes in pennsylvania. is so i think what you're going to see is when you sit around and you watch, you know, all evening long six states in which trump is ahead, you're asked to believe none of that counts. and you watch decisions to make other states where biden is barely ahead go into his column, giving him a psychological boost, and you just wonder, you know, what is going on? i will say i was particularly happy last night that susan collins survived a wave of money -- brian: yes. >> and i'm flighted that senator mcconnell -- delighted that senator mcconnell is going to be the majority leader of the senate again. and kevin mccarthy, i think he already the largest number of latino, black women: in history, so you're going to have a very weakened nancy pelosi in the house, a solid republican majority in the senate.

and now we're in a running fight because i think from the president's perspective, this looked like a setup to steal the presidency city by the democrats -- presidency by the democrats and is a very deliberate model of, you know, you send in ballots after the vote, they don't have to be, have a suggest, they don't is have to have a witness -- a signature, they don't have to have a witness. it's an invitation for vote theft. ainsley: i know all of us who do this for a living, our friends are texting, you're texting with your friends, i'm sure, getting on the phone with all these people that have so much knowledge about each of these states. if you look at the bottom of the screen, the last state on there is georgia, and that's a state you represented in the house. when you look at these states on the bottom of the screen, the ones that are still up for grabs, what are you hearing from the experts who are lawmakers from these states, and what do you have to say about georgia? what do you think will happen? >> well, i mean, the truth is -- [laughter] yeah. this has been so chaotic that i'm, i hesitate to rely on

anything. the pollsters i relied on turned out not to be totally accurate. they were less inaccurate than the traditional mainstream pollsters, but nonetheless, they didn't get it all right. in georgia the people i trust most believe that in the end that senator perdue will be reelected, that the president will carry the state and that we will go into a runoff and kelly loeffler will win that in jan january. but frankly as a historian, this reminds me of 1876. this is not like, you know, this is not like florida where you have one county with one particularly bad registrar in 2000. this is nationwide all sorts of things going on. a media which is unbelievably hostile to trump. brian: right. >> and so if you're a conservative, you look at all of this, you cannot as a conservative look at this and not feel that the democrats have have done all they could to

steal the presidency and that the legal fight the president's going to wage is exactly right. brian: the pollster profession is dead. they have to redo how they do this stuff. everything from 538, the great nate silver who said biden's going to win florida by 2. oops, that didn't happen. i'm going to spend enough money and finally get our point across to the american people. hundreds of millions gone and very little gained, and they're in a death match for the presidency. you know that illegitimate president that didn't really win in 2016 because the russians hacked in and gave him the victory? well, he replicated it is and is on the cusp of doing it again. if you're advising the president on how to handle these situations tactically, not emotionally, what do you advise him? >> i advise hum, first of all, to ask senator mcconnell and senator graham to have the judiciary committee in the senate open up investigations on

all these different states. as i said, they've been begging people to realize how much nevada was set up to be stolen by the democrats. philadelphia is notorious for a place that steals votes. all of those pluses ought to be looked at by the law enforcement side, first of all, because those are crimes. second, i think he should be prepared as jonathan you are the the -- jonathan turley said, the president should be prepared to file suit in every single state, and he ought to go back and look carefully at arizona. he shouldn't aassume automatically that was legitimate, and i think he has to continue. the other thing i would say is the more he can be presidential and not candidate-like, the more disciplines he can be in going into this, the better off he's going to be because the country is tired, the country's now frightened. and yet the country, you said it yourself, the country repudiated

analyst lawrence jones joins us live from our headquarters. lawrence, what do you make of that? >> well, good morning. you know, this is lazy commentary. as you know, steve, i came on here quite frequently with my reporting on the ground, and i indicated there was a shift with the latino vote and hispanic vote in florida. it's not only because of the socialist policies, but it's because they did not trust joe biden. and so to see pundits and journalists get on national tv and not criticize the strategy of joe biden, it's just mind-blowing to me. the joe biden camp did not hire as many latino consultants, they looked at all hispanic voters as the same. they did not invest into a ground game with the hispanic vote in florida. not only that, they decided they were going to direct ad at them not really trying to understand the difference between the cuban population to the puerto ricans. so this was a failure of strategy. typically when that stuff

happens, you go and you reevaluate. but now they're just saying it was just a lie. steve: yeah. so, lawrence, what do you make of where we are right now? because millions of people are waking up all across the country, and they're turning on the tv, and they see this little box under you, and it shows that joe biden is ahead of donald trump. you need 270. there are a number of states that at this point so many votes have not been counted. we don't know who the next president of the united states is going to be. will it be joe biden, or will president trump continue to have the keys to air force one for another four years. so what do you say to those people who were so anxious and so frustrated and worried about the election, and now they're essentially in purgatory for a little longer? >> well, it's not the best news, but it is what i feel like we as people with platforms that cover this for a living have to tell our people, and that's we've got

to wait, guys. i i -- we cannot afford to get this wrong. i would prefer to have all the information before declaring races prematurely. and i understand that it's frustrating. i will note that it's frustrating for me because i feel like there's such an efficient way to do this. we've proven in some states that there is an efficient way, and the fact that some states choose not to do that is just mind-blowing to me. now, i understand we live in a republic and local government and states have a lot of power, and they should keep that power. but i think their voters in their states should question them on why they can't get this done more efficiently. steve: right. but you know given the fact that, we broke down the michigan map a little while ago, it could be so incredibly close. four years ago trump had a substantial margin of win. this could be so close, the losing side will never accept

it. >> well, they're not, and that's the sad part of it. but, again, this is why i think it was so crucial for pollsters and pundits to get this right. because going into this race, everyone thought this was going to be a blowout. and i kept telling people, you know, what i hear on the ground is much different from what we see on these polls. i'm not saying i know who's going to win it, but what i'm saying is that there is no way that joe biden is blowing donald trump out because i see on the ground a much different story. they said we were wrong and we were, you know, 2016 was different. so i think we could have prepared the american public for this moment if we would have did our jobs better. and i think as the days -- i know some people think that the pollsters are right, and i don't know how they could, but there is going to be some analysis and some soul searching with the people that do this for a living. and i think we have to say, well, they screwed up on it. can and should we be trusting

these folks? maybe they need to change their methodology. i don't think it's fair to i say they got this right. steve: you know, if i had a nickel for every time in the last two weeks i read the word landslide, i'd have about $1.50, just saying. >> i would be rich. and some major ones still remain up in the air. here with more, fox news contributor tammy bruce along with the federalist publisher ben domenech. good morning to both of you. >> good morning. ainsley: tammy, i'll start with you. what's your take on what we're going through this morning without, without knowing who the president's going to to be? >> well, it's frustrating, obviously, and the president was frustrated. he expressed that last night. even his approach last night being misrepresented when it comes to his sense of this race and what we all saw unfolding which were massive leads in many of the states which were not being called, states that were being called that were being called too early. of and, you know, it's understandable considering we've dealt with four years with an establishment that has been willing to lie and cheat and prepresent fake russian dossiers and lie to the fisa court in an effort to change the outcome of

that election. so maybe this is all the new insurance policy, who knows? but we've got to remain, i think, vigilant. i trust the president's decision in how to pree.d this is going to be the first time that the democrats see a republican who's willing to fight back. this is an extremely important election, we all know that. the polls were extraordinarily wrong, almost like they were wish cast. and, of course, people are concerned that vote counting stopped overnight, ballots being moved to various places. and it's understandable that the american people are suspicious if of the process and want to see transparency e and want the system -- perhaps like in the year 2000 -- to be used in the way it was meant to be used to make sure this election legitimate and accurate and fair. awps indiana ben, how about you? what's your take? what's the headline this morning? >> i think the headline this morning is that the system that was supposed to tell people what

was going to happen in this election utterly failed them. the pollsters, the data geeks, all the people who were asserting the way that things were going to happen, they turned out to be wrong, and they turned out to be wildly wrong. this, i mean, we have a situation now where the last poll that we got from abc and the washington post about wisconsin a 17-point lead. yeah, you're only off by 16 or 17 points, guys. that's great. this is a total failure s. and what we saw after 2016 was a lot of these media organizations, they doubled down on the idea that donald trump was a fluke, that he didn't represent something new that was going on in the republican party, and they refused to change any of their approaches. "the new york times" in their runup to this election did, went weeks without publishing any kind of support for the president whatsoever. and i think, the idea that they can just ignore the opinions of millions and millions of americans, it's just insulting. and i think that, look, after 2016 the media, i think, failed to or refused to learn any of the lessons they needed to

learn. this time around they'll probably try to do the same thing, and the american people, i think, shouldn't allow that to happen. in the short term, as tammy said, this is a situation that's not going to be like richard nixon in 1960. i think the president's going to fight this and fight it hard legally. we're going to see what happens particularly in these midwestern states. but i think the concerns being raised are absolutely legitimate, and we can't have any confidence in the media to report on these things9 accurately either. we're going the need people on the ground paying attention to what's really going on. this isn't just like florida, it's much bigger than florida, and that deserves, the american people deserve to have confidence of in what comes out of it. ainsley: absolutely. >> can i add -- ainsley: out of time guys. real quickly. >> just the seltzer poll in iowa shows you pollsters can do the good job when they want to. it's the difference between getting it right because you want to versus getting it wrong because you want to. ainsley: yeah, that's the des

phil? >> reporter: three words with, brian, miami-dade county. that's the big difference between trump winning florida by 1.2% last time and winning it by 3.4% this time. miami-dade, florida's most populace county and historically a democratic stronghold, but cuban-americans came out and voted for trump in far much larger numbers than they did for him four years ago. in little that van a that last night, they were -- that van a that, they were partying it up. it appears trump's boost in husband e panic support in miami-dade cut hiss 2016 vote deficit in the county by a whopping 200,000 votes. enter the cuban community is for trump. you can see it here. you can see it. all the support to donald trump. >> we won states that we weren't expected to win. florida, we didn't win it, we

york, jonathan turley on deck as our democracy coverage rolls on, on this wednesday morning day after election day 2020. join us for "america's newsroom," top of the hour. brian: all right. ballot counting still going on in georgia and pennsylvania. you can go on our web site and watch with a live update. here with how the next week could play out, dave rubin. dave, i understand you, like many americans, went to bed, and it looked like the president virtually locked this up, and it looks like joe biden might be enroute to a perfect inside straight. is that tough for you to get your head around? >> well, brian, as you know, i'm here in los angeles, so it's pacific time right now. it's not even six a.m. i went to bed about one a.m., and trump was with leading seemingly comfortably in a bunch of important states that you guys just mentioned. now, look, everyone wants every legal vote to be counted, they

should count mail-in ballots, they should count every vote that was submitted yesterday. we don't want votes to be counted if they suddenly magically are appearing right now. i mean, something -- the thing is i've been talking about this for a few months now that we really are in a war on reality at this point. that depending on what news you watch, depending on what twitter feeds you follow and what pundits you follow, you're going to see the world in a very different spot. and in a certain way, it seems like this is exactly how it was going to all end, that i we would end in this mucky, murky nothingness where now we're going to have to trust that the states are going to do it right in a place like pennsylvania where literally two or three days ago the attorney general, shapiro, was saying that biden was going to one. i mean, the attorney general was saying it before election day. so we're sort of left with this, oh, can you trust the institutions? i'm not so sure anymore. and then, of course, it goes without saying we don't have have a mainstream media, a

network news media that anyone trusts. and in many ways, this election was far more of a referendum on that than it was even about trump or biden. so, you know, if this ends up in the courts and we have weeks of this, i just don't know how long the average person can tolerate this. people have bigger problems between the pandemic, the economy and everything else. brian: people did speak. they sent a billion dollars to house members and senators, and the democrats fell flat on their face. they wanted to prove the president was unpopular and not legitimate, and this thing the is down to the wire. pennsylvania, it is still a 7-point lead for the president. north carolina, the president's got a full point and a half lead. in michigan the president has got a .5 lead. and then in georgia the president's leading with over 50. nevada, he's within a point in nevada. so this illegitimate president that count belong is -- that

doesn't belong, it's funny, the american people seem to feel differently. >> yeah. well, that's a good point because, you know, the pollsters -- and, again, if you had listened to mainstream media, this thing was basically going to be a blowout. there were bigger margins than last time although, let's remember, last time they got pretty much everything wrong, and this time they got it wrong again. so no matter what happens here, and it seems like we're going to be in for a long fight and both sides are going to dig down and get ready for that fight, and there's going to be a lot of lawyers and the rest of it. but no matter what happens, this is a major, major blow to the pollsters and to all of the mainstream pundits who just repeat the same thing over and over. brian: yes. >> it is very obvious that whatever coalition trump has put together here that it is far more diverse than mainstream wants people to believe it is. and the fact that more people showed up -- and, you know, putting all of this aside and putting all the partisan stuff aside, a lot of people voted. so if trump is the one that ultimately got more people
