hinging on for battleground states. president trump leads in north carolina and georgia. if he wins pennsylvania and arizona or nevada, president trump would get four more years. but, brian, to your point, joe biden really close. ainsley: very close. he just needs six more electoral votes and with four states hang not guilty balance we will have to see how that goes for him. griff jenkins is riffe in joe biden's home town of delaware. as trump team gears up for a legal fight. >> good morning. and you are right. both candidates fighting it out. one has increasingly longer shot than other. simply biden wins one is he there us a mentioned, steve, the president basically needs to run the table or a combination of the other decides plus arizona where he believes he has won. the latest maricopa county counting results showed the president picked up 10,000 ballots; however, h he still trails behind biden by just over

4 points with 84% of the precincts reporting last night trump supporters were protesting and demanding to watch the ballot counting. now, let's go to those state race boards to show you in nevada biden leads by barely over half a point. in georgia, president trump leads by about half a point. in north carolina though, trump leads by roughly a point and a half. and in pennsylvania, the president is leading by more than 2.5 points. currently he has lawsuits in three states. michigan, georgia, and pennsylvania. that's where the governor and the president's attorney rudy giuliani are simply at war. >> these attempts to subvert the democratic process are simply grasm. >> not a single republican has been able to look at any one of these mail ballots. they could be from mars as far as we are concerned. or they could be from the democratic national committee. >> meanwhile, here in wilmington, joe biden was expressing confidence yesterday here at the chase center.

>> my friends, i'm confident we'll merge victorious and there will be no blue states and red states when we win. just the united states of america. griff: here are the deadlines for ballot counting in pennsylvania it's november 10th in nevada. november 12th and in north carolina in georgia it's november 13th a friday, mind you. now, as far as rules we might see at some point this morning, it seems that georgia is pretty close. only two counties left now we wait and watch. brian, ainsley, steve? brian: thanks, griff. get warm. take a look if georgia, north carolina, pennsylvania and nevada come in for the president. he wins. nevada has 6, pennsylvania 20. north carolina 15, georgia has got 16. keep in mind, too. north carolina has another weaning to post their results. they are the one where the president has got to feel the most confident perhaps. the president still leads in georgia but there is a belief that most of the ballots left

could be tilting since they are mail-in ballots in over 70% of the mail-in blatz g ballots go r biden. .04% of the ballots and weekend get something by noon eastern time today as a result. >> as you know, guys, this is the first time they have ever said we are doing it all mail. in they did this just a few months ago. they decide on a dime to change that raised eyebrows with the president almost immediately. sure enough it is a key state if the president is going to get to 270. >> rudy giuliani, we just saw him a moment ago talking about, you know, we don't know where these things are from. they could be from mars. he is alleging that they have taken these lawsuits into the various states to stop what they referred to as rampant corruption. although it is unclear exactly what they are talking about. clearly what they are trying to say is with these lawsuits, we want to make sure that all the votes are legitimate, which is,

of course, fair. karl rove had this observation with sean hannity last night right here on the fox news channel. >> i trust a system that allows for partisan ove oversight. i have been through this twice in philadelphia. and twice in wayne county. have you got to have poll watchers and lawyers and treat it seriously. i don't believe there is massive fraud where millions of votes are being taken but i do think there is a problem in these big cities where you better be looking at them or something bad may happen. steve: right. one of the things they are worried about in pennsylvania, the trump camp is, remember, it was last friday when the pennsylvania supreme court said, you know what? we're going to kind of -- while the legislature said one thing, we will allow mail-in ballots that are postmarked by midnight on election night to be counted right through the afternoon of friday. also, you know what, if the signature on it doesn't match the signature we have got on

file, it doesn't matter. those are some of the things that the trump campaign is concerned about. brian: i also think the postmark is an issue, too. i didn't think they would have to clarify the postmark before november 3rd. that had the supreme court everyone wondering why the supreme court punted on it. ainsley: north carolina, to your point, brian not going to update the vote count until november 12th or 13th. there are 117,000 mail-in ballots there. once they are all in and received, then they will finish the count. we might not know what happens with north carolina or won't know for at least another week now. steve: officially. ainsley: when the other states come, in the president might not even need north carolina or it might not even make a difference. the trump campaign as we were mentioning files these lawsuits. eric trump says it's a shame that we have to do this but they are trying to cheat us out of this. rudy was saying not a single republican has been able to look at any of the ballots. jeremy worcester is a poll worker no way to know what's happening. we're supposed to be observing. we are at least 100 feet away

embarrassed polsters and the media again. brian. brian: i see the political magazine and they write today that donald trump actually win or lose has done better now more impressive in 2020 than 2016. those who you just heard said dragging down in texas, really in the blue wave never happened. they increased won by 5 or 6. it wasn't a toss-up. they didn't pick up any congressional seats. when it comes to people like i don't know maybe the so-called moderates who didn't have any future in the party like susan collins she was not winning in any poll. she got a concession speech yesterday from her opponent she won by about 6. joni ernst winning in one poll the weekend before and she won handily in the end. in the end you had senator thom tillis who despite a sex scandal by cal cal cunningham not officl yet doing something he didn't do in any polls he is actually leading now. you see they picked up five

seats in the house and the president got more votes than ever. if you look at the fact that ohio went the president's direction again. it wasn't the russians. if you look at florida, the diverse community, went to the president again. he wasn't indeed trailing by two. look it at iowa where the president was upside down he won by 6 or 7 again. what is the problem that people just don't understand that people actually like the president and aren't running away from conservatives in this country. i do not understand, steve, why that is so hard for these polsters and pundits to understand. steve: well, did they have an agenda? some people are wondering whether or not that's the case. let's bring in joe concha, media reporter for the hill on this thursday morning essentially it's 2020 plus two days now. joe, you know, ainsley was holding up the pundits, the press, the polsters all wrong, wrong, wrong. why is that? why did they get it so wrong? i was reading one analyst who said it would be really hard to

get it as wrong as they got it unless something was up. >> well, i look at methodology first, steve. it's as antiquated as my blockbuster card and ocasio watch which cassiowatch. 6, 8, 10 points skewed toward democrats. they did it in 2016. you would think they learned their lesson. they did it again. look at the results we saw. cnn had biden plus 12 nationally. had them plus 12 michigan. plus 8 wisconsin. you had the "new york times" giving joe biden a 70 percent chance of winning florida. had him up 10 in iowa. plus 9 in ohio. the president won those states quite easily. and then obviously that "the washington post," abc news final poll in wisconsin, joe biden up 17 points in that state. and we go over to the senate and the house. we heard that republicans were going to lose seats in the

sort of consequences around that and we have seen cancel culture actually take these people out. so, yeah, why does this happen? is it to create an allusion that perhaps that joe biden had this huge lead and why bother going out. almost like a psychological suppression of votes in these situations to say, okay, look, joe biden is up 17 in wisconsin. why even bother, right? these are the consequences as results. ainsley: so i'm glad you brought up cancel culture because the gap they put a picture on twitter of a hoody. part of it was red, part was blue you zip it up and comes together. they wrote the one thing we know is that together we can move forward. they ended up having to take it down. and their statement was it's too soon for message. we remain optimistic our country come together to drive for all. what do you think of them taking this down? >> people have to realize twitter is not the real world. the social media is not the real

world. when the mob comes for new those places. do not give up. this is just a message of unity. we saw with the girl scouts of america they congratulate you had amy coney barrett for being named to the supreme court and showed her with four other women that were named to the supreme court and saying see if you are a little girl can you accomplish anything. thinthey had to bow to the cancl culture and woke mob. certain people on the left, not all, they don't want compromise moving forward. the compromise that joe biden talks about as he did yesterday in that speech. they want control over the power over thought and over basically what you think and what you say and every time this happens you have got to be more like the goyaceo when he praised president trump he's praised president obama. no, i'm not backing down i'm sticking to my guns. don't listen to social media and the bots, if you have a positive message that's great thing and don't worry about what these trolsz have to say.

even punching an nypd chief in the face. police also found lap bands and loaded magazines during arrest. in detroit protesters were furious over the lack of access to the ballot counting process. officials ended up padlocking doors so they couldn't get. in protesters were chanting stop the vote following news of the president filing that lawsuit in michigan and a riot was declared in portland because of widespread violence. and then in philly. the protests were two fold. they were calling for racial and political justifiable that follows the release of body camera footage and the police shooting of walter wallace jr. listen. >> put the knife down. get him. stop put the knife down. >> move, move, move. and following that release, thousands are demanding those officers involved be arrested. there were also protests in maricopa county, arizona, that's where the protesters were also

demanding to get inside to watch those ballots be counted. steve, ainsley, brian? brian: wow, thanks so much, ashley. it's incredible. imagine if we actually had a decision how different would it be? steve: we will eventually. brian: 16 minutes now after the hour. jillian mele back in studio with her she has been holding down the fort. jillian: you were missed. the u.s. topping 100,000 cases of covid-19 in one day for the first time. nearly 103,000 cases were reported on wednesday. the u.s. is averaging more than 86,000 cases a day over the last week. that is a new record. there are just under 9.5 million total confirmed cases with more than 233,000 deaths. senator gary peters will hold on to his seat. fox news projecting the michigan democrat has fended off a tough challenge from republican john james. peters winning by over 75,000 votes to earn a second term. it was called shortly after joe biden was declared the winner in michigan.

sleep celebrated at the waffle house where it all began. tell us about that story. >> we sure did. election night was like a roller coaster. up and down all night. ap finally called the race at 2:00 a.m. i got an hour of sleep so exhilarating and overwhelming. yesterday 10:00 a.m. waffle house where i had my first job. i wanted to finish where all of this started for me 25 years ago. it was very exciting moment great for south carolina and the low country. not just democratic women who are breaking barriers. republican women are doing it all across the country this election year. ainsley: i know that area very well. usually a republican area for the last 40 years it had been for 2018. will will you are a republican and flipping it back to red. how important is that? >> very important. not only in south carolina we had a red wave even with the

hundreds of millions of dollars being spent by jamie harrison 8 house seat and senate races and congressional district. we made possible what so many people and polsters said was impossible flipping the seat back. it's purple it leans democrat. we proved them wrong. we worked really extremely hard. no one worked harder than i will. we had a grassroots and ground game like anyone has seen. if you work hard can you win. ainsley: you are taking one of those blue seats in congress. nancy pelosi lost five of those seats. they went to republicans. what are you going to do in d.c.? >> well, i want to get to work. my work starts right now before i'm even sworn. in there is so much work to do on jobs and the economy. the state of south carolina our unemployment rate is 5%. much better than nationally at 8%. we have a lot more work to do especially with covid-19 and healthcare issues. everyone is trying to figure out what's going to happen with

>> the state of oregon made his industry first state to decriminalize hard drugs, including heroin and co-and meth. all legal now. todd piro joins us live with that state's new policy and the reaction. todd? >> steve, good morning. the new policy is calling for humane, cost effective and health approach to drug use. only a small amount of drugs are being criminalized one grasm heroin or mdma commonly known as mollie or ee extoes. two grams of cocaine or meth. 12 grams of magic mushrooms and 40 doses of lsd, oxycodone or methadone.

our lawyers. we are going to file suit. >> this is among one of the most anti-democratic things i have ever seen or encountered. it's not just here in philadelphia. this is going on all over the country. brian: most predictable contentious state out there. do republicans have a case? let's bring in law professor jonathan turley. jonathan, we talked about this. when the supreme court puppetted on allowing ballots to come in without enforcing even the postmark, yo, you knew this was going to be a problem. guess what? it's a problem. does the trump team have a case? >> well, first of all, that's a live torpedo in the water all that chief justice roberts accomplished by making that a tied vote is that the matter was not resolved it. may come back to the supreme court but now there are nine members of the court. and the question is are they allowed to do this counting at all for some of these ballots? that's important. because it's a categorical challenge it. means it can effect a large

number of balloting -- ballots that have been counted. so, most of the challenges you see in presidential elections are really a game of inches not feet. you can grab a few votes here a few votes there. we look in states where the margin is very, very thin. that obviously is the case with pennsylvania, nevada. states like michigan where that could make a difference. when we look at pennsylvania, there are legitimate objections that observers this is not like seeing denali from 100 miles away. you have to see the ballots there is a good point to be made there. the other reason the lawsuits are brought stabilize the patient. stop the counting until a court can get involved we can all agree on how this count can go

forward. brian: the governor came out never seen something so outrages he wants to count all the ballots. did the ballots get in on time. where are they coming from? are you going to throw out signature-matching. there are rules you can't fill out a ballot any time in the vicinity of election day, right? >> right there. are rules. we don't have evidence of widespread fraud. we have irregular glats. error rig glarts. we havirregularities.will you wg conditions or releasing conditions. all of that is likely to end up in the court. we have had challenges in past elections. that's nothing new. so, this system will survive. we will survive. courts will get involved. and we will resolve these questions. brian: so they are going to -- they want a recount in wisconsin. it's within 1%. are they going to get that recount? >> yeah. as long as it's within 1%.

now, you have to keep in mind these recounts often result only in a few hundred votes being changed one way or the other. so we separate these questions of things that are more incremental like wonderful recounts and things that are categorical like we might see in pennsylvania that can effect groups of ballots. brian: it is so close in nevada. we could get a verdict around noon today. it's within .04% between like 8,000 votes. jonathan, this is the first time they really did massive mail-in ballots and it matters so much with the six electoral points president's fortunes. if you are the trump team, how do you approach this? >> well, before the election, i said that i was looking at three states. nevada, michigan, and pennsylvania. because they were all states doing some new things or at least doing it on an order of magnitude that was new. they were all expected to be close. and they all had changes in practices or rules with regard

to elections. and that's largely where we are ending up. we are looking at those states. nevada is going to be key. it is razor thin. there have been allegations. particularly in the las vegas area about how ballots were handled. the discrimination of signature recognition machines. there is a lot of these issues that have popped up. and then there is some weird issues. you know, like the hanging chad's of 2020. one is that hand theismaner affected some machines off voters. that's got to be a unique 2020 issue. brian: yes teach that to your law school class watch out for sthirgz. the president needs georgia, nevada and you called out there would be a problem. the biden team would be here if they lost by razor thin margin but they could not afford to

and also lying to people and making them think that, you know, i mean this is one of the reasons why people have concerns about things like voter fraud is because, you know, on the left they have this view that donald trump is literally worse than hitler and they will tell that you if you ask them. and so if that's the belief they have about the president you have to worry if they are in charge of counting ballots, for example, how is that going to go when they think they are trying to get rid of literally hitler. that's the attitude a lot of people have and gotten that impression from the media of course it's absurd. ainsley: democrats are losing five seats centrists are saying maybe it's time for change when it comes to leadership. they told the hill this time for democrats to elevate a new generation of leadership in both the house and the senate. americans are clearly afraid of socialism. want safe streets and neighborhoods to vote for people who they believe will help put more money in their pockets. what do you think about that? should nancy pelosi be nervous

race. brian: joe biden would be fighting in the same way with different lawyers for the same thing especially last night. arizona, which they called, it seems that donald trump picked up 11,000 votes last night. so we're going to see what happens. and you have a recount that could be underway in wisconsin because that is so close. your thoughts an what i said can you pass if you want. >> certainly joe biden's team would be doing the same thing. when donald trump won in 2016 they spent months -- actually years questioning his actual. brian: four. >> four years to be exact. i don't think they ever accepted the results of the 2016 election. one thing is clear this race has not been completed in terms of a final winner they have got to make sure they count every ballot. one of the other things big stories of elections day that hasn't been talked about a lot. donald trump is the person who

actually expanded the republican base. he is the one that brought in a new voting demographic for republicans working class whites, blacks, hispanics. he has done historically better. that is a huge story of the night. he will continue to be a force in american politics no matter what happens. he is still the leader of this party. he still has a strong passive ph arizona for the next four years. steve: we have learned so much about different states' election laws because every state has different rules because they are passed by the legislature. one of the things that has upset a number of people who voted for donald trump and the trump team itself is the fact that the laws in pennsylvania were the laws as written until last friday in the supreme court in pennsylvania said you know what? you don't need to have a positive id to drop off

something into one of those drop boxes. you know what? we are also going to change the legislature's law where you have got to have the ballots in by election day. we're going to take them until friday. august sorts of things like that. i can understand the problems with it. at the same time we have never been in a pandemic before. >> there are certainly unprecedented challenges. you also have to keep in mind no is in charge of the counting and process someone who is unapologetically a hater of donald trump and has posted many times publicly on social media just how much. brian: the attorney general. >> how much they hate this president. that does create a problem for pennsylvania. i think that's another reason that we have to have transparency in this process. we have to make sure that there are members of both campaigns that get to be part of and make sure that each ballot that is countside a legal vote and

should be actually added to the final tally. it's important we have that transparency particularly pennsylvania. ainsley: it seems our country is so divided and a lot of people looking forward to the election being over to we can come together as a country. the gap posted picture of this sweatshirt one side red and one side blue. the tweet said one thing we know is together we can move forward. they decided to take it down. steve: they got a lot of blow back. ainsley: exactly. just too soon for this message. we remain optimistic that our country will come together to drive positive change for all. maybe it was too soon. this is a sign that the cancel culture not going away. if you don't agree with us. we don't like your opinion, then we don't want to hear it? >> you know, i think that's incredibly sad. i don't think there is ever a bad time for a country to come together that doesn't mean that there aren't certainly political divisions. i think they most certainly exist and we have seen that over

we're going to fight in these states where we are seeing voting irregularities in michigan they kicked out our poll watchers and put up boards so we couldn't watch. i mean the amount of -- i would say cheating, i mean i think it's wrong for them to kick out our folks so we can't watch the process is really unprecedented around the country. and then finding 35,000 ballots in the dead of night in the city of detroit. something is going on and we are going to get to the bottom of it. steve: you are just asking for transparency which seems fair. both sides should have that. >> absolutely. we need both sides to feel confident in the election. and to kick our republican poll workers out have them sitting outside and then to put up boards so we can't watch the election process, this is not okay. of course we don't hear the democrats saying this is wrong. we don't hear joe biden and kamala harris say let the poll watchers in and let the process take place as it should. these are the types of things we are seeing across the country

where republicans are not being given access to have the surety in election integrity that we deserve. steve: sure. while the president had that flurry of rallies over the last couple of weeks, behind the scenes for the last couple of years, the rnc has been working on a get out the vote ground game. and, you know, by all metrics, yours was super successful because on election day, according to our director of analysis, apparently donald trump won the election day balloting, people who cast their vote on election day all across the country from every state except new york because so many people showed up that day, thanks to your door knocking and getting out the vote methodology. >> yeah. it worked. we kept senate seats. we picked up seats in the house which no one expected. we won a governor's race. we flipped a state legislative chamber and kept all the chambers they thought they were going to flip. republicans turned out and they

did for president trump, too. that's how we are going to pursue these legal challenges. not just because we support president trump but we support the voters that stood hours in line that feel like they are being disenfranchised by votes being found in the middle of night. we just had it happen in georgia. some of our poll watchers are seeing suspicious activity. we need to understand that these clerks and these poll watchers should not be able to shut the door and shut down transparency. that creates unrest. those are the types of things that are wrong. we should all be able to watch the process so we can go back and say this was a fair election. and that's why we are suing in these states. steve: sure. on the other side, they spent hundreds of millions of dollars trying to unseat republicans and, you know, nancy pelosi she thought she was going to have a bigger margin. but, as it turns out, what the republicans picked up five more seats in the house. and now some centrists democrats are saying, you know what? it's really time for a change. not only in the house but the senate as well, which would be bad for chuck and nancy.

catching flack yet again under estimating the president's support and for the most parted republican support both nationally and in key swing states. i want to break this down right now with new york columnest miranda devine. polster ted cruz chris wilson and commentary writer tiana lowe. start with you miranda, the cover of the "new york post" says "wrong, wrong, wrong. no matter who wins the polls the pundits and the press were all wrong." first off, your overrule view what are they missing and what did they miss again? >> well, lock, they mixed the trump voter. the quiet or shy trump voter who treats the polsters just likes a if they were fake news media. that's the way they see them. they are not inclined to share their opinion. they think there may be some social being attached to being a trump voter. brian, i also think there is no consequences for the polsters. they are just doing what their

pay masters want them to do. they are associated mainly with media organizations and they provide anti-trump media narrative that has fed the media for the last four years. those polls justify what the media has been doing. brian: right. and have you been writing about this too. chris check this out trump vs. biden look at the polls. go back and give them a break. up until two days before the election. they thought biden was going to win by 7-2. i saw most said over 10. as of now less than 2 points. this is pretty consequential stuff, chris. because it affects the voter. why do i bother? it's raining. i don't need to veto right now. why should i bother voting for somebody that's going to lose anyway? >> y. it's a point. the difference is you have got to divide sort of the polling community. the media polsters which is who miranda referenced and those who work for campaigns. for instance i saw it was

written about this morning that susan collins was never up in a single poll. one fairly substantially on election day. that's the differences. >> those people who do it for the campaigns, if they get it wrong they don't work again. the media polsters who put all those surveys out will. [broken audio] [they are going to be working next cycle. important to point out not every polster got it wrong. saultzer was mocked by the national media when she if you want it looks pretty prescient right now. look beyond sort of the media bias polsters did have errors it's going to look more like 2012 than 2016. what happened is polsters settled on a voter rural and blue collar voters had higher turn out in 2020 than 2016. did the same thing in 2012 when they missed the high black turnout other thing we saw polsters under sampling wrong sample to hispanics. election night how well donald

trump did with hispanics not just florida cube begans, latinos hispanic, other parts of florida and other states high expanding populations like nevada. that's a big deal that affected a lot of polling samples. i do think you have got to divide between the two though and senator mcconnell's adviser put out most polling he saw ended up being pretty accurate. brian: joni ernst winning in one poll des moines register and ended up winning. that's the one that counts. sports commentator and asked to do predictions, espn or fox sports would have fired them. they are disrespecting the voter. if the campaigns can get it right internally, they are disrespecting us. >> yeah. i think that, you know, that there were broad trends that were reflected in the national polling correct magnitude trump overperformed with latinos in comparison.

steve: griff jenkins in wilmington, delaware. what will happen today? griff: will one of the candidates hit 170. the president, though, sees a path, he needs to pretty much run the table in four remaining undecided states or a combination with arizona, maricopa county results, election results show that the president picked up about 10,000 votes but still trails biden by 4 points and there's 84% of the precincts reporting there, last night maricopa trump supporters demanding. biden leading by barely over half a point but in georgia where they are getting close of getting the results the president leads half a point. in north carolina trump leads by

kellyanne conway, good morning, kellyanne. >> good morning. ainsley: they are counting all of the ballots, we have the lawsuits, what's the president's path forward? >> for north carolina and georgia to hold and be called for him. that's 31. you add pennsylvania where he is ahead and we are patiently waiting for all the votes -- all the legal votes to be counted there. that's 51. arizona is going the other way. i know you're one of the only places in the world that called it for him. many networks and anticipate trump papers haven't called it yet so -- i know the campaign feels very good about at least the maricopa results overnight that the president hit his marks. he needed roughly about 59, 57% of those ballots to go his way and, indeed, they have and, of course, nevada is still outstanding, alaska is 3 outstanding, 3 votes, that puts the president over the top. let me also say that we spent 3 years, they spent 3 years investigating the president, impeaching the president, we can't wait 3 hours, 3 days, 3

weeks to get a result in our democracy as to who the president will be? what's the rush all of a sudden? there was no blue wave. there was no early night. there was no democratic progressive realignment. in fact, the democratic down ballot disasters carried all the way to state legislatures as well. the democrats did not flip a single state legislature and, in fact, the republicans flipped the house and senate, for example, to new hampshire where they have a republican governor. that's solid now. they did similar thing in montana, the governor there lost the senate race. the democratic governor and we have the legislature as well. so you know the 7 races that were either -- the 7 races that are flipped that are brand-new republican pickups as leader mccarthy noted and others are saying, those were all carried by a woman, a minority candidate and/or veteran.

that means the candidate recruit meant the republicans were doing, their message, that really carried them forward and nobody was paying attention to that and all phoney national polls, biden is up by 10, by 12. when i took campaign manager we did zero, zero national polls from down point forward. they are not relevant. they tell you trends that don't dig into the college electoral map. electability, it's outdated, electoral college is how you do or don't win and that's why the state polls were so much more important. susan collins won reelection in maine. they were wrong. a lot of them were media polls and academic polls. we need to hold the same people to account. not a single poll in the state of maine showed susan collins, she won by almost 9 points. brian: joni ernst same

>> when other people are getting emotional, that tends to trigger you, so what you have to do if you see someone else that's getting emotional, take a step back and try listening to what they are saying and try to find some common ground, something that you can have an actual discussion. steve: at some point in the future we don't know if it's later today or a couple of days or a couple of weeks before we know -- this thing goes to the court system ultimately, one side is going to be very disappointed and a lot of people are just going to be super frustrated and angry. but it's hard to go through life like that. >> yeah, well, again, what you need to do is -- whichever side you're on, if you're the side that loses, instead of being angry of what happened, what you do you take a look at yourself and say, okay, what do we need to change, how can we get our message out more clearly, how can we bring people together so we can win next time. steve: but it's hard to bring people together when they have

such diametrically opposed points of view. >> yeah, if this person has a view that you can't relate you will never have find common ground or influence on someone that doesn't respect you. you have to build respect, the way you build respect is giving respect. you to listen to what they have to say and actually absorb what they are saying and actually find common ground. i know it's challenging but that's the solution from a leadership perspective. steve: i think 3 or 4 thursdays from today is going to be thanksgiving. a lot of people will be seated, socially distanced at a large dining room table with people who do not share their opinion and, you know, one side of the table won and the other side of the table lost. >> well, you know, you learn when you're a little kid when you win, don't gloat. once again, this is about

our business climate like california. i don't see why this would be a compelling message to win. and they spent hundreds of millions to try to flip it. almost single candidate, every republican was outspent by democrats and that was stopped in its tracks. steve: at the very last presidential debate, in the last 3 minutes joe biden revealed he was interested in transitioning from fossil fuels and 10 million americans making a living particularly in texas. right now the president and his team filing suit in a number of states because they say that the voting and rather the voting was okay, but the vote tabulation, they're a little worried about whether or not it's accurate.

>> this is why the integrity of our elections and the system that we use is so important. right, you h have to trust the rules of the game. i was outspoken on this on the months leading up to this and everybody changing voting laws and this is dangerous, as bill barr said this is playing with fire. it cannot rely on the opinions of election officials or politicians saying, no, don't worry, it's fine. you don't have to have a conspiracy theory, you don't have to worry about this. don't worry about the discrepancies and irregularities. the system needs to be self-evident that it is secure, right, which means the process has to be simple and the rules have to be strict and strict deadlines and they have to be transparent. these -- these should not be controversial topics, right? to experiment with this low integrity voting process that many states have in one of the

most divided times in the country's history is playing with fire. it was the worst thing that they could have done to our country and now we are paying the price and we all saw this coming. ainsley: what does the future of the house look like, centrists that are democrats that are saying nancy pelosi needs to step down or she doesn't need to be the leader anymore. this is what they told the hill, it's time for democrats to elevate a new generation of leadership in both house and senate. americans are clearly afraid of socialism, want safe streets and neighborhoods and devote for people who they believe will help put more money in their pockets. what do you think will happen in the house? >> yeah, the irony of the statement is that the new generation of democrats are socialists. i'm not so sure what they mean by that. look, i'm not a fly in the wall inside the caucus meetings but it will be entertain to go see them fight this one out. what is very clear is that nancy pelosi lost and she lost big. she's a very good fundraiser, again, they outspent us in every single possible way and yet they

lost in every possible way. it looks like we will keep the senate and gained quite a few house seats as well. confirmed at least 7 flips, i'm hopeful that we see more than that. you know who would take her place, though, that's a fascinating question and hard for me to answer. i will say that nancy pelosi makes a great opponent for republicans, though, so we -- we enjoy that a little bit. but curious to see what happens. ainsley: what happens in this race, does trump -- he obviously has a path, anything can happen, it's not over yet, but do you think he will win? >> you know let's just be hopeful that he does. there's clearly a path. you know, we are counting the ballots in arizona right now. it's -- it seems like pennsylvania is on a good track as well and georgia. so i -- you know, i'm glued to my screen just like you guys. brian: southwest texas where he benefited. you know what i've been heartened by, the persona of nancy pelosi tearing up the

state of the union address, the way she just dismisses the president, acts like he doesn't exist, i think they much like the idea of the statesmen like paul ryan in that slot and no matter, what party is, she's like a professional wrestler. >> right, i mean, and you see this across many states. you see, you know, congressional candidates perhaps outperforming the president, you know, americans do tend towards split government. you know, you see the stock market start to rise when it believes it has a split government because it means government will do less. this tells you something about the disposition of where americans are at and where they are in political beliefs and we don't need the federal government telling us what to do and total control of our lives. let us thrive and do your purpose of government to pursue our happiness, that's the whole point and i think americans understand that. brian: you have to get big things done and immigration reform done and it's going to take compromise and i'm just

wondering when that's going to happen at some point. >> well, yeah. you wander when immigration reform is going happen, me too. i think if we will go down the immigration reform path. the first thing that has to happen is border security and i will say under this administration we have made a lot huge strides along that -- along those lines. they are a little bit underreported but illegal immigration coming across our border has massively, massively dropped because of the steps this administration has taken, but in terms of just enforcing the law, building infrastructure, working with méxico, working with guatemala and honduras, el salvador, you know, huge strides, so, you know, one of the worst case scenarios a biden presidency takes over and reverse all of these great policies and then we are right back where we start where had no compromise can ever happen. steve: exactly, congratulations on your win a couple of nights ago. >> thank you very much. so it was exciting, it was a lot of fun.
