todd: 5:00 am in the east end this is the fox news alert. moments ago joe biden taking the lead in georgia, historically red state won by donald trump in 2016. it is important to note the race has not yet been called, these are just the latest numbers into the fox news decision desk. 16 all electoral votes still up for grabs. jillian: we will follow that throughout the hour. in the meantime the trump campaign is on the ground in several states announcing legal battles to ensure a safe and

fair election as some states are still tallying, could have results today. todd: we are live as america washes and waits to see who wins the white house. jillian: with that, good morning, you are watching "fox and friends first" on a busy friday morning. todd: three days into the election still no winner. we await results in battleground states, margins narrowing, joe biden, slight lead in georgia, that just came down moments ago. jillian: north carolina, nevada and pennsylvania very close. griff jenkins live in wilmington, delaware with the latest on the lawsuits when the state are expected to call the race and all the news is unfolding. >> reporter: we have news, this race is still too close to call, things still stand where they did yesterday, biden needs one win and trump needs to win the table to put arizona back in play.

the news out of georgia really amazing and an interesting change in this race. in georgia joe biden is just taken a narrow lead by 917 votes with 99% reporting, that is a state where democrat hasn't carried the white house since 1992 and bill clinton. pennsylvania, that race is tightening, the president leads by 0.3% with 97 person reporting, donald trump leading by 18,000 votes. in nevada biden up by a point with 84% reporting, biden leading there by a little over 11,000 votes. in north carolina the president of by a point and a half, 94% reporting, donald trump leading with 76,000 votes. in arizona, stakeholder biden, up by a point and a half, 90%

reporting, late last night maricopa county trump supporters protesting and shouting stop the illegal vote. the battles continue on two trump's, and losing in georgia and michigan, and last night at the white house donald trump accusing democrats of trying to steal the election. >> if you count the legal votes i easily win. if you count the illegal votes they can try to steal the election from us. >> reporter: and nevada the trump team filed a lawsuit they had a list of thousands of people who voted illegally because they were not legal residents. >> the fact is we are filing a federal lawsuit to protect legal voters. it is unacceptable in this country to have illegal votes counted. that is what is happening in

the state of nevada. >> reporter: the trump campaign has yet to provide evidence of such lists of names but they say they will do so today, in wilmington, joe biden was urging patients. >> democracy is sometimes messy. it sometimes requires a little patience as well. we have no doubt when the count is finished senator harris and i will be declared the winners. i ask everyone to stay calm. the process is working. >> reporter: as the sun comes up, counting continues in these four states. at varying times we may have final results out of georgia at some point. heartbreaking news when we started this, important to note a few hours ago donald trump was up by 400 points. in georgia you have biden up 917. we will bring you the latest as we get it.

todd: thanks. jillian: as joe biden grabs the lead does this mean he will flip the predominately red state? todd: joining us to discuss the overnight breaking news, media reported joe can'ta. why are we seeing what we are seeing in georgia? >> reporter: we got a preview a couple years ago when we had a gubernatorial race, stacy abrams losing by a very narrow margin and you could see georgia may be trending in that direction. the reason we are seeing joe biden take a small lead is because predominately votes are coming in from urban areas around the atlanta area. we see that in philadelphia. as far as pennsylvania is concerned with trump, these late votes all breaking for biden and obviously if joe biden captures georgia he captures the presidency but since these votes are so close in pennsylvania, in georgia, in

north carolina and wisconsin they will have recounts. we will have a winner in terms of biden perhaps, these recounts will extend the final final confirmation of that for weeks or even when you are sitting around for christmas dinner. jillian: the last updated information there were still ballots to be counted in georgia. we are in no way saying joe biden has won georgia, he has taken the lead and a slim lead at that. to that point to this conversation why do you think this is happening? there are states in this country where donald trump has outperformed what was expected of the polls whatever you think of them. donald trump has outperformed in some areas but so has joe biden. arguably this is one of those areas.

do you think it is the messaging? what happens? why is joe bored biden outperforming expectations? >> demographics are changing as they are in texas as they are in arizona, people from california moving to arizona for example and that state flips. that state hasn't gone red since 1996. when georgia went red in 1992 that was bill clinton but he didn't get 44% of the vote because ross perot was putting it. this is a situation where joe biden could get 50% of the vote. more people are voting. this election has been incredible. donald trump got 15 million more votes than ronald reagan in 1984. reagan captured 49 states that year. the last two elections donald trump has gotten more votes than any other gop candidate in history. joe biden surpassed barack

obama in 2008 as far as being a presidential candidate to get more votes than any presidential candidate. that is because of mail in voting, easier for people to vote and more people engaged. you have more votes in the pot than you can flip states like georgia and arizona. it is incredible, of all things we have more votes than we haven't quite some time if not in history. todd: with that voter turnout in mind i want to stay in georgia and focus on the senate race. if these current voter trends we've just seen continue, more urban areas continue the vote it is likely we will not just have one the two runoffs for senate in georgia. i'm looking ahead to january, nobody can predict what the covid-19 situation will be in january but we can predict donald trump will not be on a ballot in january.

will democrats get that same turnout for not donald trump when it comes to the january runoff/runoffs or will republicans just run away with it because democrats will not be able to mobilize their base and other anti-trumpers because trump isn't on the ballot? >> everything you just said. when you take trump off the ballot there is no voting against trump. i didn't know people were so much for joe biden there behind the biden message because i don't know what the joe biden bumper sticker was, where a mask? i am a nice guy and that guy is bad? i don't know what the joe biden message was. take trump out of the equation you have a straight up election in georgia. all i know is i will be perpetually annoyed for the next two months, from vote your ossoff. todd: the senate race in georgia, john ossoff running

an alleged plot to attack the pennsylvania convention center where votes are being counted. philadelphia police arrested two armed men near the building, police pulling over a hummer after receiving a tip about the end driving from virginia. police not saying what their intention was but there is no active threat. the count in pennsylvania will continue as the trump campaign puts up a legal fight, the president's team claiming election protocols not being followed. >> reporter: the president's legal team want to stop account in pennsylvania until poll watchers were allowed to move closer, the campaign won a ruling thursday that stated observers could move within 6 feet of the ballot counting. they were originally campaigning for 16 to 100 feet away. one observer telling fox news he couldn't see anything. >> i started watching and said wait a second, you can't see

anything. the closest desk was 30 feet. the farthest desk was 150 feet. when people ask questions they went and answered. you said to yourself something is wrong here. jillian: hours after the ruling the trump team said the legal order was not being enforced. campaign advisor corey lewandowski sharing this video of him and pam bondi confronting election officials, the trump campaign, a ruling that ballots without voter id should be set aside. the president's lead remains razor thin. secretary of state promises a strong process in place to ensure voter integrity. >> voters have to apply checks again social security database, to protect against the record to make sure qualified voter and who they say they are, to counter ballot and checked again. >> reporter: it is still happening in philadelphia this

morning, a winner could be declared in the state today. todd: thanks. let's go to aaron bellmore who has lived in philadelphia for 20 years, joined me live to break down the legal fight waging in the keystone state. a little bit of a global view here. why is election transparency not the bipartisan default? white legal action needed for something that should be the norm everywhere? >> philadelphia is a democrat stronghold and has been, they think they can do whatever they want and force their will on the people when in all actuality voters deserve to see their ballots being counted. why don't we have maximum transparency? they have no reason to be doing this. it could change the outcome of the entire election and to be

honest you have massive corruption by people who feel they can steal the presidency and people will sit idly by and let it happen. todd: let's listen to more from pam bondi. >> there is a reason they are suppressing the election results, because they will not let us look at the ballots. whether you are a democrat or republican you should care about this. they are trying to suppress our voices now and they will not do it. todd: people against trump are going to say now you can get within six fee. i'm within six feet of jillian and i can't read a word on any of her papers. how will we accept six feet just because it is told? >> reporter: another measure to control the narrative, control the process, control the outcome of this election. in pennsylvania i believe the

damage has already been done the toothpaste can't be put back in the tube but the president has legal fights going on in several states and fraud allegations all over the country whether it is dead people voting, we have evidence of that, shockingly and surprisingly and terrifyingly large voter turnout in wisconsin the doesn't add up. several issues we are looking at across the country. todd: listening to your answer, do you think joe biden wins pennsylvania when the dust settles? >> at this point the margins for donald trump are razor thin and it is all hinging on these mail in ballots, the democrats pushed mail in ballots, you reap what you so because you wanted this, now we are dealing with what it looks like but regardless of who wins the presidency this legal fight, these allegations of fraud will shape the future of the country

gather outside the election center to protest the ongoing ballot count. >> how many votes didn't count here. >> all canceled ballots from the elections office. todd: protests come as donald trump claims major problems with ballot counting where joe biden is leading, they will release the next batch of results this morning. jillian: the process of simplifying election results underway in milwaukee county, wisconsin. a team will review the election process in all milwaukee county wards with no plans to do this over the weekend. with milwaukee hitting 78%. donald trimble request a recount in wisconsin after joe biden won the state. todd: markets of closing their fourth straight day of gains

thursday. jillian: why the markets are staying optimistic. >> markets looking to clock in the best week since april, you would think that would be a market negative. the weight is shaping up, would be a good thing for market. it means a little bit of gridlock going on so investors, don't have to worry about corporate tax rate. and don't have to worry about changes, healthcare and more regulation. what is going into election day, 63% of investors change portfolios, the blue wave that we never got.

todd: with the markets like the football a little too soon? i'm not making calls on the purdue potential runoff, one of the races in georgia in a runoff and it does look more likely than not that republicans will hold the senate. >> i know what you are saying. we were saying this the morning after on mornings with maria that it looks like the senate was going to stay red. at this point it does but having those two runoffs in georgia will be disconcerting. i don't think the markets are focused on it yet. the question is what happens with the presidency. we are seeing pressure in the markets. we had the best market numbers

jillian: 3 days after the election and still no winner as we await results from four battleground states, joe biden adds 264 electoral votes, the president at 214, it takes 270 electoral votes to win. todd: joe biden taking the lead in georgia, historically red state won by the president in 2016, vital to note this race is not been called, 16 electoral votes still up for grabs. jillian: joe biden up by roughly a point in arizona, a state called for joe biden, up with a point and a half. todd: in pennsylvania donald from leading by bus than half a point, the president claiming he won the state after his legal team fights many battles for access to ballot counting. thousands of people voted

moving on with updated numbers. and an unknown number of absentees that may arise. what constitutes a legal vote, we will sit in suspense until week out. todd: let's switch to the senate race. for republicans watching this program, let's call it what it is, a little anxiety what is happening in georgia where it does appear those two races could go to a january runoff. how confident are you tom tillis has this thing won? >> tom has a big margin. not big in terms of percentages. i see no reason to expect his votes to change but many of us are very active. there are concerns the president articulated, to articulate suspicions when you see a lot of things, the

polling indicating a blowout everywhere including in my race, i won by 11 points, supposed to be a nailbiter, then you see issues of access and weird things going on in the president articulated suspicions. i'm concerned about it. i'm active in north carolina to see to it the vote is counted legally and fairly. jillian: the breaking news we are following an early morning hours what is happening in georgia as you can see on the side of the screen right side of the screen joe biden has taken the lead by a little more than 900 votes. this is not done in georgia. official numbers put out, there are votes to be counted. that is what we know is at this point the president could still come back and take georgia but the fact that it is this close what is your reaction to what

is happening in georgia? >> i'm not on the ground in georgia, don't have top connection to the details that makes me curious was the president in congressional races across the country, republicans have not lost a single seat, expect to pick up double digit seats, appear to be on course to hold the senate, the president provided all the energy to get us there seems to be doing well on election night and then drifts away. i'm all years. i want the explanation why the pattern is playing out in georgia the way it hasn't all these other places where disturbing allegations are being made about being denied access, we have to see but i can't figure that one out. todd: appreciate your time, live from the tar heel state. extreme weather, tropical depression eta regaining

todd: congresswoman elect, the individual we spoke to yesterday, has to be good, to those who say the republican party is old men how do you respond? >> we proved them wrong tuesday night. we had a record number of women elected to congress. i get to washington and get started. jillian: what is it about women rising in all forms, when you look at congress, these huge roles, women are shining stars, what do you attribute that to? >> we've been advocates holding leadership positions but we didn't think of ourselves in the political realm and in the last several years you've seen so many women running for higher office and for me that was the case, i ran in the oklahoma state senate in 2014 having never thought about running for office before.

it is an opportunity to show that we can rise to higher levels and represent our state in a tremendous way. todd: why did you run? >> a lot of reasons. my team had an incredible team around me, but i also have a proven track record, tackled some big initiatives here, things like criminal justice reform, economic development opportunities and i showed voters in congressional district i was ready to get to work for them in washington and they gave me that opportunity. jillian: we will see what you do with it. appreciate you joining us to talk about the role of women in congress, thank you for sharing your time with us. todd: still ahead president bush's former speechwriter bill mcgurn and let's see what is coming up on "fox and friends".

jillian: breaking overnight joe biden taking the lead in georgia. the former vice president up by 917 votes. todd: live outside with at lantern with the latest. >> the lead has expanded a little bit, up to 1096, new numbers from the folks at the accounting facility in georgia just south of atlanta. these people battled all night long to get through the absentee ballots, 4300 they were trying to process, said they would get it done and did,

finishing up an hour or so ago, when the final total started to go into the system. this would be historic in georgia. they do not vote for democrats for president and haven't in a long time, last one being bill clinton in 1992 but it does appear possible joe biden will have a shot at changing all of that and if he does that would be enough to make him the next president of the united states but donald trump says he believes this is not a legitimate count. >> if you count the legal votes i easily win. if you count the illegal vote they can try to steal the election from us. if you count the votes, so much evidence, so much proof, we want an honest count.

>> these small totals and margins will lead to a recount, anything went in half of one person deals with recount issues in the state of georgia, it seems extremely unlikely that whoever those end up on top will go above that margins so you can expect there will be a recount in georgia but at least for now joe biden is ahead in the peach state. clayton county, georgia, fox news. jillian: joining me to react is fox news contributor bill mcgurn. good to see you. there is a lot to react to this morning. you hurt our affiliates reporter say of georgia goes blue this is going to be historic. what is your reaction?

>> they are right. georgia doesn't vote for democrats, hasn't since 92 but georgia may be the spoiler for donald trump. if he loses georgia it is hard to hang in in the other states. it would be very difficult. he is contesting the other states, the same way the odds have been against the president after it election night, you have to hold more states than biden, the same way of challenging the state, they are planning on challenges but the question is whether the courts will take them and what the evidence is. jillian: your general reactions what has transpired over the course of the last 3 days. a lot of people are not surprised this will take some time, people expected that but there are surprises in certain

states where the president has outperformed expectations. >> it was an incredible elections this way. i believed the president would be a lot closer if not triumphant on election day. it is a very close race. what troubled me from the outset especially since the supreme court upheld the ability of the pennsylvania state court to alter the election rules, that bothered me because i don't think the american people want their election decided in the courts, they want to decide on the ground where the vote happens. the danger when we go to the courts, the more you move from the norm of voting on election day unless you have a really good excuse not to be in town are getting a tally the more we move from that the more you are

likely to see lawyers come in and the danger is the bitterness this creates because people feel they not only lost but even if they don't have hard evidence that is a terrible thing to have in our country. it doesn't mean it was but to believe that, when you look at pennsylvania, and keeping out poll watchers it is very troubling. jillian: when you look what happened in 2000 in florida specifically the 537 vote difference between bush and gore a lot of people making the comparison, the lessons we learned in florida after that happens, what is transpiring in 2020 what do you think of this? >> we should get back to getting as many votes counted at once, before the fight was

over the recount because the margin was so low there was automatic recount but the question is which votes would be counted in the recount, the supreme court had to weigh in on that. i remember the time was chaotic, the hanging chads, people gathering in the back room, we will look at that is child's play compared to this. let's fix our state machine, florida did a good job of this. two years ago it was a disaster and they have come around. it can be done because the truth is most states do it. it can be done. i think we are inviting a lot of bitterness. jillian: thank you for spending time giving us your insight. todd: the president taking legal action in battleground states, a member of the

states out there litigation ongoing michigan and wisconsin. we believe there is massive fraud in and there are irregular glargts in the turnout numbers as well as irregularities other as speculation of the vote count in wisconsin. so depending on the outcome of all of these races, you may see continued legal battles in some these states i mentioned. jillian: harmeet two states being sued by the trump campaign includes pennsylvania and nevada. you mentioned those states and what's going on there i want to focus on pennsylvania for a second. philadelphia specifically. you know, look, there have been a lot of frustrations. your biggest concern, even some of our reporters who are on the ground in philadelphia who have been inside where ballots are being counted have said that yes, observers have been allowed in there that are in there. but the problem is the room is so big you can't actually see everything everything up close that's going on is that one of your concerns. >> it is. typical election what have you

is you have a republican and democrat observer within 6 feet of and able to see clearly what is happening as poll workers open ballots, verify if somebody is on the voter roll, fix a ballot with the consent of both watchers and a sign al-jaafari. that's not happening. we are being kept 30, 40, 50 feet away. it's functionally meaningless at that point. we would be better off if we had drones overhead and see from outside than what we have. that's not legitimate. and you are going to continue to have conservatives very concerned about the legitimacy of this election. which is not good for any americans. we should all be able to feel county in the results and accept the results that. would be the american way. rob: harmeet dhillon we know you are on the case for the president. you will keep us posted as to developments when they transpire. harmeet dhillon, we appreciate your time. jillian: thank you. >> thank you. jillian: if you are just joining us this morning we have been following breaking news that has developed throughout our show
