anchor chris wallace. good afternoon to you. the margin in arizona is about 40 or 41,000 right now. where do you think we are as we should point out the fox news decision team is standing firm and said they made the right call on arizona. no intention to retract it, and now i'm looking down here 13,373 vote puts him up over that 270 mark and it seems inevitable, whether it's pennsylvania, georgia, nevada, arizona, or some combination of them. if you get some while he ends up with 306 electoral votes which is exactly what donald trump had in 2016. it seems inevitable that in this initial vote count that joe biden is going to win and

welcome back everyone. it appears joe biden will make a statement tonight, we are closely watching throughout the day. let's check in with the biden team. i'm jacqui heinrich's live in wilmington and delaware. what are you hearing now? >> it feels like groundhog's day out here. just like they did around this time yesterday, but there is one key difference we do expect joe biden and kamala harris to
12:27 pm
take the stage tonight around 8:00. and that will be what a lot of people are feeling will be a victory speech. their margins are holding in key battleground state, they didn't even hold a press briefing today because yesterday's information still holds. we talked to the campaign's foremost lawyer bob bauer and he says there is zero worried that any of these lawsuits delay the process because the cases have no merit. he referenced in this case and explained yesterday as an example. >> the trump campaign requested that georgia counties separate any and all late arriving ballots. that's interesting because that's what election officials are already doing because that's what the law requires so you have a position that is expressed as the basis for a lawsuit demanding what election officials do that what election officials are already doing. >> the campaign watch the president's remarks again last night and one person told me over text that it's a sign it's
12:28 pm
getting desperate and these claims are baseless and they called it a sure sign that he knows he's losing. they are also the campaign reminding folks of the president can be evicted from the white house if he refuses to accept the results of the race after he indicated today that he doesn't expect to concede even when the race is called. the campaign's books mean told me as we set on july 19th the american people will decide the election in the united states government is it's perfectly capable escorting trespassers out of the white house. they are waiting on the boat to be counted before making any sort of declaration but he does fully expect to become president-elect. >> bill: election officials meanwhile in pennsylvania still counting ballots, 20 electoral votes in that state. from the fox business network, connell mcshane is live. >> the trend certainly has not been president trump's friend here in pennsylvania. the lead of the state he had early on was built with very
12:29 pm
strong support from his supporters who came out on election day itself and voted in person. but as these mail-in ballots have been counted the last couple of days, that leader earlier today eventually turn into a deficit with former vice president biden moving ahead. here in pennsylvania and other states we've been watching especially the votes as they are counted in philadelphia. mr. biden there has been taking in more than 80% of the vote in philadelphia county. in harrisburg the state capital, a small group of pro-trump protesters on the capital today expressing some displeasure. we also had republicans that sued the secretary of state in pennsylvania over some of the provisional ballots. a judge had a ruling earlier today saying some of those ballots would have to be segregated, and the trump campaign does continue to pursue a number of other illegal challenges as well. big picture so far, no evidence
12:30 pm
of any kind of widespread voter fraud has emerged here. and we join an existing case in the united states supreme court. there was some news made on that last night and the comments made by a secretary of state, she came out and said that although she doesn't know the total number of ballots that will be arriving, she does not expected to be a very large number. she has an impact on the results there. >> bill: and we will get back to you if there's more on harrisburg. still awaiting results by some of these critical states, we will bring that to you in a moment. what's karl rove thinking about at this hour? we will talk to him live in a moment, after this.

>> president trump: i challenge joe and every democrat for illegal votes. i think they should use legal votes. each ballot must be counted. so it sometimes a little patience as well. >> bill: we are still waiting on a winner, joe biden increasing his lead in nevada although this past hour is gotten closer. it's currently ahead in pennsylvania meanwhile and he's got a margin of 1500 votes in georgia. at the trump team mounting legal challenges and we don't know when we can expect this. first jonathan hunt is live on the ground in las vegas and we have some new numbers.
12:36 pm
jonathan, let's start with you as to where we are in clark county. >> we are looking at increasingly bleak fall numbers in nevada. a new numbers almost effectively doubled the lead for former vice president joe biden to around 20,000 and with the vast majority of outstanding votes coming from here in a heavily democratic clark county, there are many smart political minds here is saying there is no way for president trump to come back, get even and pull ahead. although the even smarter minds on the fox news decision desk have not made that call as yet. so then we get to the republican lawsuit that is about to be heard in court here in just around an hour and a halftime. that lawsuit i described yesterday as something of a grab bag of issues and that is indeed as it has turned out. now, it has been formally submitted.
12:37 pm
there is a claim of nonreliable signature verification and that's based on the experience of one individual. there is a claim on lack of transparency and that is based on the experience of that one individual. the much meatier part of this federal lawsuit is the republican claims that they have found 3,062 votes cast by people that they say do not actually currently live in nevada and therefore, they say those votes are illegal. now the democrats have intervened in the lawsuit and they have described it to the judge as meritless. they got some backing today for and people who are not actually resident in nevada would still have the legal right to vote here. >> you don't have to live here in a order to be eligible to vote here. this is a military town.
12:38 pm
we have nellis air force base and several students. it's not out of the ordinary at all for somebody not to live your book be eligible to vote here. >> now the first court hearing on that case will be heard by judge andrew gordon, appointed by the way by president obama back in 2012. that hearing is coming up at 5:00 p.m. eastern. >> bill: we will be watching. i think you jonathan hunt in las vegas. i want to bring in karl rove right now. we haven't talked a lot about north carolina but you wanted to so let's go ahead and figure out what's happening there in the tar heel state. >> i just think it's not being talked about because it's not controversial. 5% of the vote to be counted but trump is up by 12%. red counties, blue counties, so whatever happens in the remaining 5% is not likely to affect his 77,000 vote lead.
12:39 pm
but the others -- >> bill: show us what you see. >> georgia is less than 2%. biden is up by 1,582 votes. if this ends up less than half a percent between them and i think that's what is likely to be then a recount could be done upon request. and at this point i wouldn't be surprised if we didn't see a recount request. arizona, seven present is out, biden is up 1.3 and this number has been dropping today. tonight at 9:00 p.m. they will have more numbers. one of the reasons it's dropping as we are getting to the end of the mail-in ballot that are being counted. they verify them sequentially starting with the earliest to the latest. what happens in arizona is it's a practice that people take their mail-in ballot and go to their polling place, so their
12:40 pm
driver's license, i.d., and drop the ballot off. it's safer than mailing it and don't have to wait in line for a machine to open up. the election day melons that are at the drop in votes tend to mirror what the election dated in the election day was pretty good in most places for president trump. this day is likely -- whether there was enough out in 7%, and then i have a critical question about congress. >> biden up by 0-2, and it's tough to get the 20,000 votes because what's left out is generally current county. you have a senate battle here in georgia where david perdue's .2 percentage points between 50
12:41 pm
plus one which means that goes to a runoff. that goes with the other race in georgia that the runoff and that is january 5th. that would be for the control of congress, would it not? how do you see that? >> there are 50 republicans in the senate's day, 48 democrats and would be a result at who controls the congress. full disclosure, i've been asked to lead a fund-raising effort on behalf of the two republicans which i will do but i think it's going to be a barn burner that's going to cost a lot of money and it will go to january 5th. i think they have had the upper hand. >> it's two tenths of a point. quickly caught up. >> no, two one-hundredths. i think it's for 9.98. >> bill: it might be, we got
12:42 pm
for .98, but this things been going back and forth. if you see two senate races and joe biden is the president-elect, you have to be sworn in and you have the balance of power hanging out there in congress. if you have all these issues about socialism in the far left, how do republicans and conservatives in the middle-of-the-road's feel in georgia about that potential and possibility? >> i think a lot of people would like -- a lot of biden's problem is, and a lot of his vote was against trump and not necessarily for him, and have a compass their task and i think those voters are going to be a little bit more inclined, marginally more inclined to stay home on election day. republicans are going to be more energized to turn out. >> bill: it regardless whether it's trump or biden, it will be something to watch. thank you, nice to see you this week. speaker pelosi trying to unite her party after republicans picked up some seats in the house. plus control of the senate as we mentioned awaits.

slip, some moderate democrats from swing districts blast liberals and abigail's bamberger barely wanted to democrats discussing socialism and defunding the police as white democrats lost. progressives argue they are the one to help boost joe biden against president trump. now bill, here is a key thing. democrats are going to have more liberals in their majority going forward and that will be key here. you think they'll be able to pass more liberal legislation but because the numbers are going to be so reduced, that's an issue. you can't pass these big progressive bills when you don't have much of a turning radius. >> bill: control of the senate is still up for grabs. let's bring in josh holmes, a host of the aggressive progressive podcast which is a great name but it doesn't beat
12:49 pm
bill hemmer time. >> if you got that right. >> the rnc is looking for money to help with this legal battle at the moment. you have democrats in the house who apparently had a rather heated meeting yesterday. where will that go? >> i have to tell you. the funny thing about nancy pelosi's leadership in the house and basically what she has asked her moderate members to do throughout the course of 2020 is completely try to underestimate the intelligence of the american people. basically her theory of the case was you could do entirely left-wing things and you could have completely unattainable coronavirus packages. you could try to run national debt up trillions and trillions and hope that american people basically weren't paying attention and ultimately they would just blame everything on trump. lo and behold she found out on tuesday that's not the case and her members are certainly unhappy about it. the biggest challenge...
12:50 pm
got going forward as child mentioned in the lead up is the governing coalition in the house looks an awful lot different than it did in 2020 and she will have some challenges. >> bill: we heard those. abigail's bamberger as a democrat from virginia. this is her comment on that phone call. >> the number one concern, that people brought to me was defunding the police and that will get torn apart in 2022. >> defund the police is a dumb statement for p.r. purposes and electoral purposes. you want to reform the police, you want to modernize a place, that's a different than defunding the police.
12:51 pm
that scares people in suburbia and that's never going to work as an electoral strategy. people are out in the street talking about that and that's not what they need either. anything you have to translate as bad and like you always say, if you are explaining you are losing. i think the seats in georgia will be very competitive and we will see what happens, this will be the first major election post trump and we will see with them turn out looks like. georgia has been changing for years and i think stacey abrams deserves a lot of credit for the organizations she put together in georgia, and we will see what happens in january. i'm excited. the one you have 8,000 in military ballots. come back to chris's points. and when it comes to defunding socialism attacks, you won't
12:52 pm
make that go away, you'll make it less effective. we go on to say she spent more money online in the final week of the campaign. how will this bridge itself? >> she's basically aligned with nancy pelosi and her take. that's anything social, and they believe that that is not a good idea. she's not really to founding that there is political danger, she thinks there is political danger. they don't put very much inside paid media, and it was basically like, this is politically

perilous for you all the let's get better at masking our true intentions which, again, the american people are -- >> bill: it seems as if the story is moving in that direction. chris, make it quick, thank you. >> i don't think that's the case at all. i think there is a messaging problem on that end and there are a lot of progressive things that most americans believe in. sometimes this rhetoric seems extreme, and democrats have to take that on headfirst. he is right, we do need to spend more money on digital media and less money on traditional television. i hate to say that on tv but that's true. >> bill: i think you guys. something was born today, remember that. still ahead on this election week, we will all go back to the board on where we are now and where we might be heading next. ♪
