weekend it. is saturday, november 7th. maybe coincidentally the date of the 2016 election. this one looking different and going to last a little bit longer. and we are covering every single angle this morning. i'm sure we will have thoughts on it, too. the presidential race stuck in limbo as we await results from four key states. nevada, georgia, pennsylvania, and north carolina. still counting ballots amid a wave of lawsuits. will: the supreme court getting directly involved. as alito separate late ballots. legal ballots didn't stop joxd. hjoebiden. >> a number of americans all faiths religions chose change over more of the same. they have given as you mandate for action. jedediah: president trump tweeting that biden should not quote claim the presidency as legal proceedings are just beginning. bryan llenas is tracking the

legal angle in pennsylvania. griff is live in delaware. griff: good morning jed will and pete. here we are the race still too close to call. joe biden feeling he has a mandate. he sees a clear victory, he thinks to 270. is he widening his lead. he has 28,000 in pennsylvania. 4,000 in georgia. and 22,000 in nevada. although president trump leads by 76,000 in north carolina. the campaign was late in the night for one of those states to go his way to they could come out and declare victory it. never came. he did come out and talk about the things he wants to do. listen. >> let's put the anger and demonization behind us. time to put come together as a nation and heal. it's not going to be easy. we have to try. my responsibility as president will be to represent the whole nation. we have serious problems to deal with covid to the economy to racial justice to climate change. we don't have any more time to

waste on partisan warfare. griff: he is not waiting around putting together a transition team led by ted kaufman served on his staff for more than twentd years. president trump show nothing signs to concede. tweeting quote joe biden should not wrongfully claim the office of the president. i could make the claim also. legal proceedings are just now beginning. and the campaign statement as well that says quote we believe the american people deserve to have full transparency into all vote counting and election certification and that this is no longer about any single election. this is about the integrity of our entire elections process. as we know, those legal challenges continue out in nevada over possible illegal voting. although the campaign has yet to provide any evidence of such claims and then in pennsylvania. over ballot access. now, we don't know exactly when the next ballot drop will come. trout morning, as we get it guys, we will bring it to you right here.

will, pete, jed? will: thanks, griff. pete: thank you, griff. ballot drops. biden's lead in pennsylvania has been growing as a legal battle just begins, ensues. bryan llenas is live in pennsylvania with the latest. brian, good morning. >> yeah. good morning. all eyes are on pennsylvania. former vice president joe biden's lead continues to grow in the keystone state as mail-in ballots, military absentee and about 100,000 provisional ballots continue to be counted. as of right now, biden's lead over president trump is about 28,000 votes in pennsylvania. if he wins the commonwealth 20 electoral vote he wins the presidency. there are about 89,000 mail-in ballots left to be counted. the majority of these remaining ballots are in the democratic strongholds of pittsburgh and philadelphia. now, biden has been winning about 77% of the mail ballots in the commonwealth. most democrats chose to vote by mail. most republicans chose to vote in person, same day. the count is taking so long

because, by law, they couldn't start processing the 2.6 million mail-in ballots until election day morning. meanwhile, on the legal front yesterday, the u.s. supreme court issued an emergency order ordering county election boards in pennsylvania to follow the state guidelines and segregate and secure all late mail-in ballots that arrive within three days of election day. republicans claim they were unable to get at least 25 counties to confirm that they were in fact following the state guidelines. last night justice alet toe issued an order making sure not only are late mailed in ballots segregated but they need to be counted separately and not included in the general count. trump attorney jay sekulow made it clear last night they don't believe these late ballots are legal. they hope that the u.s.s. supreme court will take up that issue. >> this was a glaring constitutional error in pennsylvania. the merits of it will stillable

addressed we believe later on. this gets the status quo protected. >> bottom line is we don't know how many late ballots there are. though the secretary of state believes the e7bsd result will not actually change the course of the race in pennsylvania. provisional ballots that were cast because people made technical mistakes on their mail-in ballots that could have disqualified those ballots. those provisional ballots do count. republicans were making the argument that they should be thrown out. guys? will: brian, thank you this morning. we are talking about an election, jedediah and pete with razor thin margins in multiple states. provisional balloting and military balloting. all irregularities in my mind, every vote, every provisional ballot should be counted this is where i and the american deserve

to be, jedediah. there has been well-earned skepticism across this country for almost every institution over the last several years. the benefit of the doubt has been torched. trust has been broken from allegations of a russia collusion to usps conspiracy theories to a media that only ever tells you one side of the story, skepticism has been earned render for everyone out there. what does it mean to irregularities? we go into it open ear, listen, investigate every irregularity investigate it until trust can be restored. once it is then the results will be accepted. they should every single one of them be pursued. jedediah: yeah. i think you make a great point when you say every vote should count. obviously you are talking about every legal vote that has been a key point that a lot of people have made. as people voted under the allusion that their votes would count, each with those three day

extensions in a place like pennsylvania, a lot of people voted and said well, you know what? as long as i get my ballot postmarked by election day it will count. that is going to be a point brought up in legal proghtsdz. another point to make up separately is, when you look at the number of people that have voted in this election, it's extraordinary. i mean, you are looking at popular vote numbers of 70 million for the president. it could be even more. 75 million for joe biden. that is what you want to see across the board. you wants an engaged electorate. you want people who feel passionate about issues. this is what you hope to see. why have often talked in elections past well the turnout wasn't so great. are people engaged? do they care about the issue? one thing remains clear in this election. people are engaged, they do care and they did make their voices heard. the outcomes remain to be seen. this is a very passionate electorate and in my opinion that's a very good thing across the board. pete: yeah, guys, this thing is far from over. the networks don't declare a

winner the count does. all these challenges legitimate and fruition. outsider won the white house in 2016 and the opposition spent the next four years trying to deem that legitimate win illegitimate. now here we are in unprecedented election in 2020 with more mail out mail in ballots. these ballots were mailed out and mailed in with unprecedented reduction in guardrails. people in places like pennsylvania didn't require a matching signature anymore. certain postmark requirements being tossed out. and yet we are being told hurry up, hurry up. we have to decide for the sake of our republic. they call it a democracy but it's a republic. we need to certify and acknowledge joe biden won. we don't need to do that in four days or four weeks. we need to let every single challenge play out. what happened with alito in pennsylvania is critically important. segregating those ballots may end up being an important aspect of the legality ultimately of

this outcome. i got a good friend sean parnell in pennsylvania 17. people say there is no evidence of voter fraud or voter irregularity. get on the phone with a candidate who has watched the numbers move in ways -- watch the voting stop. watch 13 previously unreported ballots dumped in in the middle of the night. this is what candidates have seen who pay very close attention to this. i don't care what people are saying about philadelphia. those walchers were not allowed within six feet which the court ordered. talked to the campaign. they were blocked at every turn to watch the process. they have every right to watch. that's why karl rove who has been on our network and talked -- i will play karl rove jed jump in after that. jedediah: go right ahead. >> our country is finding itself in a contentious moment in a time of pandemic. if anything is needed more than at any other time in recent years, it is calmness among our political figures and a belief in the ultimate ability of the american people to sus stable our republic by having confidence in the outcome of the

democratic elections that lie at the heart of it. so, please, everybody, let's step back. let the process work. let people have their access to the courts. resolve these situations as rapidly as possible. let the votes be counted and let that moment of counting to end and then the declarations of defeat or victory follow after that. jedediah: i agree with that wholehearted buy with respect to counting the votes and letting the process play out. with respect to voter fraud, pete, just one point. i don't think the accusation that there is no voter fraud. i think andy mccarthy points out some degree of voter fraud never election. the concern is accusation or allegation of widespread voter fraud that, you know, president trump and the team is coming out and saying that could potentially affect the outcome of the election. as we know with election law, there can be voter fraud. if that voter fraud is not significant enough to affect the outcome of the election. then nothing really changes. i think there is a fear that our democratic institutions are

under attack and that people will afraid that things don't play out properly in this country. i stand the skepticism and concern and need for this to play out in court if there are indeed things brought up, cases of legitimate widespread voter fraud. that is an enormous problem obviously but i think that people do need to have a degree of trust -- pete: in milwaukee and philly. jedediah: it needs to change the outcome though. it does. pete: state legislatures said election law and governors and courts making changes in an extra constitutional way. jedediah: yeah in pennsylvania. pete: that can lead to widespread changes in the outcome. jedediah: that absolutely can be challenged it. has to effect the outcome in order for it to be something that's going to be spoken about in large quantity. yes, can you take that issue up in pennsylvania and many feel that the court usurped the state legislature's power. that's legitimate. the problem is that people voted, voted in good faith feeling that they had that three-day window. that is going to be something

that's going to be brought up. those votes are legitimate. those are legal votes that should count. will: we will be talking about that throughout the morning and legitimacy of each and every one of these claims. importantly, we will be talking about the lessons we can take from the past week when it comes to the voice of the american people and what they wanted. for now, let's turn to our headlines with jillian mele. good morning, jillian. jillian: good saturday morning. a fox news alert now. white house chief of staff mark meadows has tested positive for covid-19. at least four other white house officials and trump campaign senior adviser have also reportedly tested positive for the virus. it's not confirmed when meadows and the officials were diagnosed or where they contracted covid-19. a white house official confirmed meadow's diagnosis to fox news and says he is doing well. a protester who was arrested for spitting in an nypd officer's face interned for democratic congressman and house judiciary chairman jerry nadler. regina singh was caught anti-trump protest in mantz

todd: amidst the concerns october jobs report. 638,000 new hires in october and unemployment rate plummeting to 6.9%. that jobless rate is the lowest since march when the covid-19 shoutdowns begin. joe biden says he is the man to bring the economy back. >> more than 20 million people are on unemployment. millions are worried about making rent. and putting food on the table. our economic plan will put a focus on a path to a strong recovery. todd: here to react brian brenberg fox news contributesser and a professor at kings college in manhattan. hey, brian, let's put this in the context first if we can.

638,000 jobs in october. 6.9% now is the unemployment rate. i just want to give you a few more. that means the unemployment rate in the black community is down to 10.8%. the hispanic unemployment rate down to 8.8%. what is this? this is clearly, as people describe it i would think a v-shaped recovery. help me understand the extent that we're witnessing here of an economic recovery. >> let me put some of those numbers you just gave in context as well the black and hispanic unemployment rate this past month came down faster than the average unemployment rate. so the gains were bigger for minorities this past month than for anybody else. that top line number of 638,000 it's simply, you know, except for the past few months where the numbers have been even bigger, it's one of the biggest job numbers in a month that we have seen in history. you just played a clip a minute ago by joe biden talking about his plans for the recovery. if you look at the obama-biden recovery, after the great recession it took them more than four and a half years to get

unemployment back down to 6.9%. so, all of that into context. all the signs of a v-shaped recovery. people ought to be encouraged by that especially in a moment where you see cases surging and we don't have a vaccine yet. this is good news. the question is with all this election uncertainty potentially power changing hands, it we keep that up? i think that very much hangs in the balance right now. it depends a lot on the senate. and, look, it depends on the presidency as well there is a lot that can change if you get a biden administration vs. a trump administration. >> that's also amidst severe restrictions and lockdownness places like new york and california looking at this kind of economic recovery. we will have to get to this next time, brian. wall street at least likes the idea of divided government should joe biden go on to win this election. we will have to talk about that next time because unfortunately, brian, we are tight on time this morning. thanks for being here, man.

chairwoman ronna mcdaniel are calling for investigations into still unproven voting irregularities across the state. >> they want to ignore clear irregularities, rush to call states as won. and end the elections. we will not stand for that we will fight every irregularities to the very last because every voter deserves their vote to be counted and they deserve to know whether or not these irregularities mean fraud. >> overseas and military ballots had to be postmarked by election day but could arrive as late as close of business yesterday. because sent to different counties it's not immediately clear how many of these 8410 outstanding ballots arrived by deadline. state election officials say the march discipline georgia's presidential race is smaller than the student bodies of some high schools. >> with a margin that small,

and georgia resident joey jones and great american that was missed in the title. joe ysh, thanks for being here. >> good morning. pete: it's difficult to get those votes in properly. what's your take on 9,000 ballots and the impact from the military that it could happen v. on those races in georgia. >> yeah. you know, the only real news here is these are ballots that could be sitting in precincts not fully counted. what people are misunderstanding here is that 25,000 military personnel that are residents of the state of georgia stationed overseas requesting these absentee ballots it's still their responsibility to fill them out get them in the mail and send them back. these 8,000 ballots could very well be service members stationed overseas and never sent them back. we just don't know. now, so i don't think that there is a box of 8,000 ballots sitting in an airport somewhere that someone forgot to put on the plane. that's how it was reported for

the last week. i have spoken to people here on the ground. senior officials and g.o.p. and that's basically where we are with these 8,000 ballots more than likely these are ballots that military personnel never turned back in. pete: more than likely a lot of those ballots would go for president trump and in a statewide race that's very, very close it could still have a lot of meaning. for vets, we for this. military voting has been a problem for a long time. ballots alive late and often aren't a part of the official tally. and so we will see where this plays out to make sure they get counted is the most important thing. but i got to get your take on this as well. if you remember, new york never called up the national guard during the summer rioting and looting in new york city. now governor cuomo is increasing the national guard presence at new york airport. they are going to stop travelers from coming into this state unless they have a negative covid-19 test. the guards not stopping looting but they are going to stop you if you are traveling in. >> yeah. you know.

governor cuomo up there must know some things the rest of us doesn't. he put out a book how he defeated coronavirus he has got to call in the troops to help him keep things under control. it's been pretty bad up there it really has. just the overall narrative coming to the rest of the country. you would think that this coronavirus is something in new york that people can't overcome in any way, shape, or form. so it's lock down and catch people at the border before they bring it in. i live in georgia. and i know the numbers that are reported what they say but i don't even personally know anyone. i know one person that has gotten the virus in my daily life. and so we stay away from one another. we wear a mask if we feel like we need to and we are responsible people. i don't know why new yorkers can't be the same. i would ask governor cuomo why he has such little faith in his citizens in his state at least to do those things. because i believe they will and

j.b. the very best of the democratic party. he was so ignored during the primaries. he has these two rare qualities that we don't see very much in politics and party sobriety. he understands that throughout his campaign he said let's talk about more what the party is for than what it's against. he wanted to focus on the economy and taxation and trade and law enforcement and automation and gun policy. you go down the line. this is somebody who wanted to talk about the things that people talk around their kitchen tables about. and instead we had a media and particularly cnn would have these singular town halls, i don't know if you remember them. they were marathon town halls on climate change and issues that are social issues primarily and never talked about those issues these candidates would have to talk about those issues way down the list in terms of priorities instead of the things that

people what people think about most and matters most at the ballot box. will: no doubt he is right. the democratic party is not just the coastal elites but the faculty of the oberlin. park of twitter. the question is can they change or is it going to be more cow bell? because when i scroll through twitter what i see is oh 70 more races across this country. i'm curious can they change or do they just stay with the same condescension red, black, white, working man next four years. >> you just won saturday. you more cow bell reference 2003 "saturday night live" skit with will farrell and christopher walkin'. right? you got to have more cow bell. but before we go off on a tangent. look. i love a quote from yang where he said the more we act like donald trump is the cause of all of our problems.

there. a lot going on in a way because we still have the tropics going and we are also talking about these really incredible temperatures you know what we have been having all this really nice weather across the eastern seaboard enjoy it got it here a little bit. the west where you have been baking for so long has had a big cooldown. in fact first winter storm of the year, i don't think we are going to see a ton of these this year but even whether you have a la nina season drier south that doesn't mean you don't get some storms. we have this one coming here right now a lot of moisture. really good news. we are getting some mountain snow and rain right across parts of the four corners areas which is where the worst of our drought has been going on for much of this summer and it's going to continue but any break we can get is good. out across the east everything is looking good. take a look what's happening in south florida, moisture here this is from what is now a tropical depression eta. it had been hurricane eta and made landfall in nicaragua a category 4 hurricane this week. brought tons of destruction and

thousand cases reported yesterday. third day in a row new cases surpassed 100,000. here what this means to combat covid-19, fox news medical contributor dr. nicole saphier joins us now. dr. saphier, if you don't mind, just go through this with us a little bit. these case numbers look hijackers concerning. talk to a us a little bit about hospitalizations and how concerned we should be. >> well, good morning, jedediah, and absolutely, i'm going to break it down the good the bad the inevitable. start with bad news and move on to good news. bad news is yes we have record breaking new case numbers. not just in one region it is widespread throughout our country. we are seeing in urban settings and rural settings new cases in older and youngser populations at this point widespread. as we have rising cases we are seeing a rise in hospitalizations which of course is a concerning trend 4% rise nut last week. 20 states reporting over 1,000 people being hospitalized with covid. can i tell you new jersey alone is at a spot where we have as

many people hospitalized now as we did in may. this is extremely concerning. however, i want to move on to some good news, jedediah. when you look at the death rates from covid-19 we have made marked improvements may and april 20% chance of i do going you were hospitalized with covid-19. now that death rate has increased to 7.6%. that is because of early detection, early interveterans and our great treatment however 7.6 is extremely high. much higher than the common other infectious diseases much higher than the flu. as we head into the hollywood holiday season this is where the inevitable comes. in we need to make sure we keep our hospital beds open. as we head into thanksgiving and christmas and the holidays we usually see a rise in stroke, cardiovascular disease suicides and other reasons that people need a hospital bed would have to do our part to decrease

spread of infection to make sure our house of representatives can take care of patients. where we are seeing positive cases are from our home gatherings. it's not schools it's not schools or places of businesses. it's from people trying to get together. you bring up an important point there and you mention the holiday season which has been critical and on people's mind. on that note, governor cuomo in new york is set continue to crease national guard presence ought new york airports to stop untested travelers from entry. this is largefully responds to increase that we'll see in holiday travel. what do you make of that call? >> well, so there is a little bit of fear mongering there when you hear national guard you get a little nervous. this is something i have actually called for the everyiest i said it on tv was in april. mind you he didn't call the national guard for the riots and protests and all the other things. better late than never. here's the thing. if we are not going to call interstate travel, then we have to make sure that we are not continuing to bring the virus all across the country it. doesn't make that big of a

difference now because it's widespread. really in the beginning is when it should have happened it. really should have kept it halted in a region. i think if you want to be on an airplane, if you want to be on a train. if you want to be in these close contained spaces maybe you should have a test within 48 hours. i don't think that's unreasonable. you know, the armed guard presence, i don't want it to turned into that country or that situation where people have fear i do think the responsible thing to do if you travel and meet other people make sure you don't have covid-19. until we have that vaccine, which good news, we are probably going to have multiple approved candidates early 2021 thanks to operation warp speed, until then, we need to be responsible and do what we can as individuals. jedediah: personal responsibility comes into play here. big time. thank you, dr. nicole saphier. appreciate it as always. still ahead, twitter is taking on the president flagging some of his election tweets. now a new social media company

the totality of social media including the president's northd felt like north korea stuff as far as the suggestion there was impropriety. couldn't have a free and open conversation. are they going to get away with this? >> thank you for having me. in terms of getting away with it, i think there is a lot of pressure on these companies right now to kind of change their behavior. and i think we're going to see more and more pressure, you know, fall on to them for what they're doing. and i don't think it's possible for twitter to say with 100 percent fact that there is not one mistake in the election and that there is not one fraudulent vote. so fact checking the president on all of this is pretty ludicrous. part of elections process to allow to us check the results and recounts. what they are doing is really irntsd fearing with what he is trying to say. people should be able to listen and judge for themselves.

>> yes. jedediah: one of the concerns that people have with twitter is that the information seems to be very selectively flagged. it's not across the board that misinformation is flagged. it's just what certain people i'm curious with rush hour role as ceo of parler how do you view parler? do you flag any misinformation even if it's misinformation that can absolutely be said this is false? how do you handle those snickers. >> well, we believe in the idea of community fact-checking. what that is a comment section for people to talk to one another. it's kind of like a novel thing allowing people to communicate and discuss things on their own. so, really no, we don't fact check. we don't get involved. there is no reason. to say actually, if we were to behave like a platform, which is what we are a platform. and not a publisher, like what twitter and facebook are doing, we would -- we just allow free conversation. that's how we are supposed to act as a neutral body who is just providing a service for people. will: you brought' pressure.

28,000. and in georgia, where a recount has likely been determined, biden increasing the narrow margin to just over 4,000. in nevada, out west, biden ahead by more than 22,000. that's 87% reporting. so a ways to go there and in north carolina president trump is maintaining his lead of roughly 76,000 where it was yesterday. finally, out in arizona, where fox has called the race for biden, he leads by nearly 30,000, which is roughly 1 percentage point. we will see where that goes later today. the campaign, by the way here, biden's campaign waited late into the night waiting for any state to call to put him over the top. itner came. so he took to the mic here at the chase center and urged patience and says he has a mandate now. watch. >> record number of americans of all races, faiths, religions chose change over more of the same. they have given us a mandate for action. >> biden is not waiting.

will: thanks, griff there are two steps to this process, counting, calling and certifying the votes in these states. seeing which of these states survive a legal challenge. let's go to todd piro live in the news room to break down the legal limbo in these states. >> lawsuits have been filed in three of those states. but only one has seen direct involvement from the supreme court. justice samuel alito ordering pennsylvania to separate all mail-in ballots received after 8:00 p.m. on election day. the order a big win for republicans. weren't so lucky in nevada with a federal judge denying an emergency motion change the tally due to clark county's verification system. the judge saying there was no evidence the system affected votes new testament georgia a judge tossing out a trump campaign suit claiming late ballots were mixed in with valid ones. still the campaign and rnc chairwoman ronna mcdaniel vowing to keep fighting the alleged irregularities in that state. >> they want to ignore clear

irregularities, rush to call states as won. and end the election. we will not stand for that we will fight every irregularity to the very last because every voter deserves their vote to be counted and they deserve to know whether or not these irregularities mean fraud. todd: north carolina has not seen a suit from the trump campaign or the g.o.p. instead a voter rights group is suing a local police department for voter intimidation accusing officers of pepper spraying them during a march. back to you. will: thanks, todd. pete: huge distinction in my mind is counting votes versus counting legal votes. and the trump campaign is not just arguing individual instances here. they are arguing irregularities in the process have been systemic. that in places where the legislature should be determining the parameters of an election a governor or a judge took the guardrails off the process when we needed more safeguards because we were going to get an unprecedented number

of mail-in ballots. so instead you loosened the signature requirement like they did in pennsylvania or you sort of put a lot of gray area into post marks when ballots come in whether they are countered or not. that becomes the difference between a ballot and a legal ballot. you will look sideways when you see things like oh it's just a glitch in michigan that changed 6,000 votes from president trump to joe biden. it issues me an irks me and irkf people there is dossier that must indict the president. never say it's unverified and salacious. yet when it comes to fraud and media and big tech and everywhere else it's unverified or sun substantiated every single legal vote should be counted. that's why i'm not ready to turn the page and a lot of people aren't. make sure there is integrity in a system that was overwhelmed and you had an opposition that never saw the president as

legitimate and we are going to do anything they could to prevent him from coming back to the white house. jedediah: to be clear, the allegations that the president's legal team is making is for widespread voter fraud. not instances of fraud. pete: systemic. jedediah: widespread voter fraud that would impact the results of the election. that may appear. i don't know what the legal team is holding. we shall see. they will bring that to the courts where it should be. as of right now there is no evidence of widespread voter fraud that would impact the outcome of the election remains to be seen though we will see. pete: alito chiming in is very important chiming in ballots that came in late. is that legislation or a governor that could be deemed irregular. jedediah: still depends on how many of those ballots came in late from. what i'm seeing in the numbers even though ballots came in late i don't know if that would be enough to sway the election. that remains to be seen. but as of right now and we can have questions for people who

come on with those allegations later in the show and ask them what the numbers look like in terms of what they are finding. i think that's information that people want to know and need to know in terms of evaluating what actually happened in it this election. are the numbers there? what is going on. a lack of specificity right now certainly isn't helping anyone. of course that will ultimately be decided in the courts. one thing that has been brought up when we have brought up on the show is this idea of a mandate, right? if, in fact, joe biden were to win the white house, and of course those results need to remain to be seen. does he have a mandate to acted and to implement far left policies? well the "wall street journal" editorial board has an op-ed it, says joe biden's non-mandate. he may win the white house, but his party and progressive ideas lost. this is the take from that article. here's the quote there was no blue wave and certainly no mandate for progressive change. if anything, the fevered democratic election drove more voters to turn tout to stop it. mr. biden barely mentioned the agenda his age developed with

bernie sanders and the press barely asked him about it. they left his party and radical ideas behind. now, will, honestly the word mandate to me seems very odd given the high number us of popular vote that both candidates are getting. i think if it were a land slide election win for either candidate you would be able to claim a mandate. but, when you have got 70-plus million potentially for president trump, 75 million potentially we are looking at for joe biden, that doesn't seem like a mandated election to me. what say you? will: democratic party that lost seats in the house, it looks although it will come down to georgia as though republican also retain the senate. it's hard to peer through this and find a mandate. we'll talked about this earlier andrew yang sounded the warning call for democrats because they have become the party of coastal elites. not just that but the party of faculty lowngs at liberal arts colleges buried somewhere in the northeast. they have become the party of looking down your nose at the working man. but i think we shouldn't stop there.

will: all eyes in pennsylvania. legal battle ensues. pete: bryan llenas is live in pennsylvania with the latest. >> the counting, the waiting the legal challenges are all here in pennsylvania. it's continuing here. biden's lead is growing. it's about more than 28,000 votes over president trump right now. if he wins the commonwealth, 20 electoral votes, he wins the presidency. there are about 89,000 mail-in ballots that are left to be counted. they also have to count military and absentee and about 100,000 provisional ballots. the majority of these remaining mail ballots are in the democratic strongholds of pittsburgh and philadelphia. biden has been winning about 77%

of the mail-in ballots in the commonwealth the entire commonwealth. democrats voted overwhelmingly more by mail than republicans did. meanwhile, the biggest legal question in pennsylvania is the issue over the late mail-in ballots. under state guidelines, mail-in ballots arrived up to three days after election day are supposed to be segregated and counted separately. pennsylvania republicans filed suit in the u.s. supreme court claiming that at least 25 counties could not confirm that they were actually doing this. so, yesterday, u.s. supreme court justice alet toe issued an emergency order affirming that the pennsylvania counties need to segregate and need to separately count the late arriving ballots. republicans believe that these late-may in ballots are unconstitutional. they hope the u.s. supreme court will take up the case when all the counting is done. justice alito for now deferred on the republican's requests to hold the ongoing count of these late ballots. here is pennsylvania's

>> that's a great question. every election do you see irregularities and there is sort of an acceptance that there is some degree of fraud in every election that we have. and the question always comes is the race close enough that those cases of fraud that we expect in every election are those cases enough to changes outcome of the race? this is a race that is very close closest race we have seen since 2,000. president trump discounted by all the experts said he had no chance whatsoever. he won 70 million votes. that's 8 million more than he won last time. again, at a time when everybody discounted him. and he won in all these states that everybody said tha that hed no way of winning. the race is that close. and because it is that close. the -- and you are right. the onus is on the president and his team to present those cases

and to make their cases for why we should go back and look at the allegations of fraud. and they have to make all that very clear. but, by all means, he should execute -- he should pursue every legal option that he has because exactly what you said because of the closeness of this race. pete: yeah, trump camp is arguing that the irregularities are systemic drawing difference between counting votes and counting legal votes. that is what that is at stake here this is academic question but honest question what's a good faith argument the democrats could be in philly blocking poll watchers and not see close enough to see the ballots. feels like time and time again you see things like that that should raise eyebrows. >> absolutely. i cannot think of any. i spend my entire life trying to think of what the good faith argument is on the other side.

i cannot come up with any good faith argument on the other side. you know, perhaps they could say okay, well, it's disruptive to have somebody standing over my shoulder while i'm counting. well, that's not the way this works. that's the way we do elections in this country. that's how we ensure elections are fair and honest in this country is that everybody is watched very carefully. we believe in trust but verify. mainly verify. because that's how the entire system works. and as soon as you break that down, everything falls apart. and here's another thing that i think is kind of curious about this. we have a lot of these allegations, you know, examples that we hear from all over these different states about problems all of the problems go in joe biden's favor. that's a real problem for me. will: that's a great points, charlie. i don't know whether these are systemic issues but talking about a razor thin margin of error everything should be vetted for perfection.

election president saying legal challenges just beginning. >> we are still counting. we don't know the numbers yet. we have watched in arizona the president gained seats. we have watched in these others become so close you are now going to a recount. have you more americans vote than in any time in our history. but they didn't just vote normally. more voted by mail not because they were requested but because ballots were sent to them. many of these states are not used to that. every county was not treated the same. some voters were able to correct their ballots. some counties we find are allowing to you have a ballot after the election. these are questions not for republicans or democrats but for all americans. we want to make sure we trust. there are transparency, there is accuracy there are reports not just reports but we watched it with our own eyes they were not allowing observers from either party in to watch. putting ply booed up so you couldn't look in.

will: wisconsin is now canvassing votes to certify the election. the state is facing a two week led dine as president trump's campaign calls for a full recount. jedediah: mike tobin joining us from milwaukee with the latest. mike? >> good morning, gangs. at this stage wisconsin is largely on auto pilot. the canvassing began two days ago and it needs to be completed by november 17th. some of the small counties are completing their canvassing rather quickly. the larger counties like milwaukee county, brown county where green bay is located, they may need all of that time. but only once it's completed

county election commission certify the result. only once it's completed county trump campaign officially request the precount provided the split here remains less than 1%. wednesday morning many of you woke up to posts on social media claiming wisconsin had more ballots than registered voters. that is not true the voting population is 4.5 million. 3.6 million people are registered. 3.2 million cast a ballot. giving 72 or 89% turnout depending if you use population or registered voters. the claim of a ballot dump in the middle of a night is the result of absentee ballots largely in milwaukee, democratic strong hold, they were totaled at 3:30 a.m. and added to the mix. same with green bay and those votes favored joe biden. largely what we saw here with the vote mirrored what we saw in 2016. no one switched from left to right. what we saw is at same vote with the volume turned out. you had more people coming out. you saw the population centers in milwaukee county and dain

county favored joe biden as they were expected to do. the rural counties favored president trump. in the end the democrats were simply get more people off the couch to the tune of 40,000 voters turning what was a 20,000 vote deficit for hillary clinton into a 20,000 vote win for joe biden. guys, back to you. will: all right. thank you, mike tobin. as the trump campaign mounts legal battles in some key states, some on the left are calling for the president to accept defeat. jedediah: but our next guest who sounded the alarm on potential chaos months ago said it's time to let the election process play out. pete: fox news contributor and washington examiner chief political correspondent byron york joins us now. byron, legal battles across the spectrum. the president contesting this. even in places like milwaukee, pennsylvania, what should think be doing? what's happening? and what's the state of the race? >> well, the state of the race is it's saturday morning and it

hasn't been decided. we don't know who the next president will be because it is so close. it's clear that joe biden is very, very close to winning the presidency. but, we still don't know. and a lot of people predicted that this kind of drawn out process would happen. i wrote about this in september. the house judiciary committee and oversight committee republicans on those committees published a report and said this is going to be a mess because a number of states, including some of those that are now in contest, decided to change their election laws. and then state election boards decided to change the laws that the legislature had written. and in pennsylvania, clearly, we are seeing a result of that the legislature had said votes have to be received by election day. and then the state supreme court said no, we can make it later than that.

maybe three days, maybe six days. the u.s. supreme court declines to intervene in what a lot of republicans thought was a big mistake. but now we are seeing what happens, which is this extended period of uncertainty. will: byron, you were writing about in this september talking about changes to election laws most of which or all of which pushed by the democrats. although it's not an issue in pennsylvania. it is an issue in nevada. i want to hone in on one of the things you were talking about. that is mass mailout mouthing and then the ability for individuals, political operatives to go out and collect mass amounts and bring them in. this has got to be something, byron, i would think is rife for abuse. >> it's something that everybody is concerned about you will something everybody should be concerned about. there was all this talk about how the president during the campaign was denigrating mail-in voting and he did indeed do a lot of that he later kind of focused his opposition not to what we call absentee voting

where a voter sends in an application for a ballot, receives the ballot and then sends in the ballot. but what are called these mass universal mailouts of ballots, which occurred in several states over the election. it flooded the states with blots. some of them were used. some of them were not. but there just a lot of ballots sitting around. now, in addition, other states, including nevada, allowed what's called ballot harvesting. normally by law, when you go to vote, you hand in one ballot, your own there are some provisions that if you have, say, a close family member who is disabled, you could hand in a ballot for him or her. but what these laws allowed in nevada and especially in california, they allowed third parties, even people working for campaigns to collect dozens of ballots from people say at a nursing home or some other

institution, and then go hand them in. so here's my vote and by the way here is 50 other votes for people -- from people who gave them to me to give to you the election board it. is really really ripe for problems. jedediah: you mentioned that ballot harvesting. are we seeing instances of that occurring in large numbers in terms of the allegations that are being made, the losses that are being brought up? are you seeing large quantities of this being brought forward when it comes to ballot harvesting. when it comes to poll watching, when it comes to any of these issues that have been made public in the last few days? >> well, poll watching is an issue that has come up in these days because there were some areas where democrats were not allowing republicans to observe the counting of the vote. that's a pretty open and shut case. both parties should be allowed to observe the counting of the votes as far as harvesting. it's the kind of thing you find out later. we saw it big time in california, which allows this as

>> let's begin with the president's tweets, that he believe these legal fights not only in pennsylvania but nationwide could make all the difference in this election, tens of thousands of votes were illegally received after 8:00 pm on tuesday, election day, easily changing the results in pennsylvania, and certain razor thin states. hundreds of thousands of votes were illegally not allowed to be observed. a judge in pennsylvania found republican observers in the philadelphia convention center were too far from the mail-in ballot count at 25 feet so he ordered them to be closer at 6 feet but on the issue of whether they were allowed access fox news found these claims unfounded. there were republican observers that were allowed in the convention center. we spoke to them on the ground. on the issue of tens of thousands of votes illegally received after 8:00 pm tuesday right now under pennsylvania law late mail-in ballots, the

pennsylvania supreme court made the decision they believe mail-in ballots that arrive three days after election day should count. the president and republicans believe they should not count, they are unconstitutional and that could go to the supreme court but as a practical matter those late mail in ballots are part of the count. we spoke to the secretary of state's office, the supreme court ordered those late mail in ballots should be segregated and statement, the counties are counting the ballots, count of these are included in the overall totals publicly display. the bottom line is do we think -- we don't know how many ballots have been segregated and separated. could they make the difference in pennsylvania? maybe. the secretary of state says she does not believe there will be

enough of those late mail-in ballots to be segregated to make a difference but we know those late mail in ballots are part of the count on your screen and right now as a practical matter biden is leading by 28,000 points over donald trump in pennsylvania. >> contrast pennsylvania with florida which knows how to conduct elections and dealt with a lot of ballots being mailed in and reported overwhelmingly in the president's direction by millions of votes on election night. it can be done if handled properly. that the contrast with pennsylvania. poll watchers were allowed to talk to pull purchase, they had to fight to get close enough to see aunt in philadelphia, no good-faith reason to block poll watchers from being able to watch. as far as ballots after the election it remains to be seen if those will be considered legal ballots. the insanity of the president

tweeting out this morning, as you look, you can't read it without a content warning acknowledging this may be something you shouldn't see, it leads to suspicion about the fact that there are irregularities and all going in one direction. that is the argument the trump campaign is making, you can't move the deadline without the legislature doing it. if you segregate these ballots and alito said they need to you are setting up the possibility for supreme court challenge which could change the balance of pennsylvania which is why news networks shouldn't call this election, should wait to see what voters say and that is what the president is saying. count all legal ballots that are submitted. >> and 2020 we have technological marvel to communicate with anybody on it,

we have an archaic voting system, insane at this point. a healthy discussion whether or not the potential fraud is systemically enough to swing the election? i would say this. if an infection shows up in your leg and hand that seems small but showing up in different parts of your body it might be worth a check up. the democratic party responses you are fine but after years, after years of life upon live upon lie, flip your channel changer in your hand and hear about russia collusion, postal service conspiracy, whatever law you want to pick from there has been some skepticism, some learning of the benefit of the doubt. it seems to be quite responsible, very reasonable to say i don't have trust in the institution and i want to verify, make sure that all of this is on the up and up. no matter what political party

you are from a reasonable request. >> i think allegations of widespread fraud need to be backed up. allegations of poll watchers not being allowed in need to be backed up. i'm not seeing that. that is not -- you just heard poll watchers were allowed in from the start. the problem with this is that when you say this it makes people feel they can't trust our democratic process, they can't trust the electoral process. if that is the case in there is widespread massive fraud that could affect the outcome of this election we need to know about it but if that is not happening, these can be dangerous in terms of how voters view the process. we have to trust the process. the legislature - the legislature in pennsylvania decided they didn't want to tally a lot of mail-in ballots early which is why you are seeing a lot of buildup. a lot of people in pennsylvania

voted in good faith that they were polls. if you agree the supreme court should have made the decision or not but the state court made the decision and people voted based on that. that will tell us if those votes are legal. people's if you give motor information and you vote by this day, but if somebody told you if you go to the polls, sign off by this day your vote counts and you vote based on that information you were misled and how does your vote not count? >> no doubt allegations of fraud earlier -- regular reasoning to be best about restoration of faith in the system depends on acting people, the most irregular election in our history. the way restore faith is putting evidence and research into assuring that is the case. this process of -- >> you have to look in order to

>> we have a staff person who worked for us in her apartment in washington dc, got her ballot mailed to her in four other ballots to her apartment. four ballots out there. in pennsylvania no signature requirement mandated by the secretary of state so people can send those ballots in and they would be counted. you don't have any safeguards in place, throwing ballots out there like happened in this election, all kinds of columns take place and we outlined this in a report two months ago, we said this was going to happen in sure enough it is. the postmaster general, you guys know what is going to happen, donald trump is going to be ahead and you will be looking for, finding and counting votes after the election, first time in american history we had a major

>> if it is just that, counting the ballots that came in via mail why put out cardboard and not but people observe as they are permitted to do by federal law? why kick people out of philadelphia where they are counting the ballots? and why is it always just problems take place in big cities run by democrats in swing states? why is that the case? in 23 ballots come in, 23,000 ballots came in, that is statistically impossible. that is one thing but why do we see other factors in play? >> if you don't mind just quickly, one of the challenges people are having, they are getting mixed information, your hearing from one source that poll watchers are allowed in, one of those boards, some are saying people koreans of the polling sector and trying to fill those. there's a lot of mixed information.
