spite of campaign. there are no red states, blue states, just the united states states, where have i heard that before? i heard that. a lot of people hear this message of unity, well maybe you can save it. we'll have to play this out with the election and then we're going to have to see if it were to be a president-elect biden, we're going to have to see what kind of agenda he pursues. matt schlapp was on before our show. it is not republicans who turned around used the force of government against our political opponents. that was done to donald trump. it is a little rich to think unity will be received genuinely from 70 million people who voted for donald trump. jedediah: yeah, you know, i thought there were two very good speeches. as always with any speech you say actions speak louder than words. yet you have to wait and see. you have to wait and see if the actual message of unity portrayed last night will

translate into action. joe biden will have a lot of pressure from members of the media, people in the hard left, who don't necessarily want to see the compromise. he talked about a man it today, when he spoke about it, he said this is a mandate to cooperate. i think that is largely true. there is lot of frustration from the american people when it came to stimulus, relief packages, with respect to industries that suffered because of covid-19. there are a lot of frustration that republicans and democrats couldn't come together on that. if nothing else joe biden doesn't has a very long career that involves a lot of reaching across the aisles. i think a lot of people viewed him, the fact he had the long career as a do no harm candidate. he had been embedded in washington for a long time. he wasn't very transformational. that possibility may have aided him in the end. people saw him relatively harmless. someone that would sit back and not be offensive and what not.

regardless i think the message of unity is an important one. some people have doubts about whether or not that will translate into action. katie pavlich of our own network talked about that yesterday. she said unity has been joe biden's mantra. millions of americans don't feel unified right now. listen to what she had to say on that. >> this is whole mantra, his whole ideology reaching across the aisle, unifying the country but tonight it may look and feel that is something he can get done and in the moment, of course he is celebrating this with his, with senator harris but the truth is right now the trump campaign has a number of lawsuits pending. they plan to file more monday morning. there are a number of americans all around the country who are rallying on the opposite side of this and they do not feel they are unified. they don't dough not feel they have had their questions answered about the election, the end of the election.

♪. will: with joe biden winning the white house, democrats retaining control of the house the focus is shifting to undecided senate races. it is safe to say both parties have georgia on their mind as two peach state races head off to a runoff that will determine the senate balance of power. where things stand, tom bevan, "real clear politics." let's focus on georgia. it seems to be where the balance of power hangs in the senate. talk to me about these two run i don't haves, how close will they be in the process and turn out of the general election we saw a

few days ago? will we get the same turnout or go through the same process? >> we'll have to see. both sides are already mobilizing their forces down there for everybody around the country who is exhausted by the election process and happy that, you know, it has been relief it is over, be glad you don't live in georgia, you have six more weeks of this. it will be hand-to-hand combat for the two senate races. david perdue is ahead by two percentage points over jon ossoff. he did not get 50%. he fell one percentage point. the other race is hard to care because you had a bunch of republicans including kelly loeffler and doug collins split the republican vote. i think republicans have, precisely the region, the energy level, turn out on behalf of joe biden, democrats will be hard-pressed to replicate that in a january 5th election. it will probably be lower than, certainly lower than the general

election. special elections always are, particularly at that time and place. and so, look i think republicans probably have an advantage heading. both sides will fight tooth and nail for it t could, both these races could very well be close. will: i asked about the process, turnout and mail-in balloting had so much to do who won or will win the presidential race. will that play over, spill over into the runoff what i'm curious about. i have want to ask you about kamala harris, potential filling of senate seat she holds right now n georgia, one more time what is at stake? joe biden's total agenda, tax rates, everything is at stake here in georgia? >> everything is at stake. republicans lost one senate seat f they lose both of these, 50-50 senate. kamala harris would break the tie. this is huge. this is as big as it gets in terms of you know the balance of power, how things will go for the next four years. both parties understand that completely.

plans to challenge biden's keystone state win vowing to file suit tomorrow. will: bryan llenas live in harrisburg, pennsylvania with more on the potential legal battle. reporter: will, jed, pete, good morning. look, there were spontaneous celebrations in major cities across the country for president-elect joe biden but the reality is nearly half the country was not jubilant, nearly 70 million voters. here in harrisburg, the state capital, a few thousand trump supporters gathered. they believe there was voter fraud in this election in the keystone state. they point to the fact that there were perceived anti-trump biases of state officials running the election. >> changes to the state election laws they view as unconstitutional. honestly in their eyes, they cannot believe trump could have lost any other way. >> trump had a following like the beatles. biden had eight people in a room. >> no way he could have won the popular vote in your mind seeing that? >> absolutely not.

seen the evidence yet. we'll follow the lawsuits and where the evidence takes us throughout the process. guys. will: thanks, bryan. jedediah: we appreciate it. with the trump team pursuing legal challenges in number of states where do things go from here? what happens next? let's ask fox news contributor, former assistant u.s. attorney andrew mccarthy. thanks for being on the show. i watched you all week and you have been giving fantastic insight on all of this. obviously a couple of lawsuits in georgia, michigan, have been thrown out. many others remain. give us insight what you think happens next. if you can do so in the context of election fraud and voter fraud and what would need to happen to actually affect the outcome of the election. >> a lot, jed. he would probably, the president would probably have to flip pennsylvania and at least two other states which is a tall order. there is one bright line legal issue and that is the one in pennsylvania. the other ones are situations

where you have to come in and prove factual fraud or impropriety. the big ticket item in pennsylvania is that the state supreme court changed the rules of the election prior to the election that had been set by pennsylvania state law, by the legislature. they gave three extra days for receiving ballots. under the constitution the state legislatures, not the courts, not a bureaucracy, are charged with setting the rules for elections. so they have a very significant legal issue that so far the supreme court has been i think too timid about and hasn't jumped in. i think they should have ruled on this two or three weeks before the election. but the straight question is, should those votes count from the fourth, 5th and 6th of november? you don't have to prove any fraud with that that is a straight up legal issue. the rest of it i think is, you

know, we could all see there was a lot of potential for fraud because we have this unprecedented, massive use of mail-in voting, which just innately is not as safe in terms of election integrity as coming into the polls physically and voting. so you have to kind of compare what the potential is which we can all see, what they're able to prove as a matter of hard fact. and then it is not just can you prove instances of fraud but can you prove so much that it would actually make a difference in the outcome of the election? pete: as you reference the with the mail-in, mail-out balloting you remove safeguards like signature requirementing. you can understand why people would be concerned. the gore contest took 37 days. we're only five days in. some people are alleging, oh, i haven't seen the evidence yet. have you talked to any of the litigators and how could we have

all the evidence if it hasn't play out in court yet? doesn't this have to play out? >> i heard from a couple of them and you know, they're, they're gathering information. they say they're getting affidavits from relevant people and the like. i'm not one of these people who worries too much about this there is no crisis of the regime here. we have a process whereby the beginning of december statutorily it is december 8th. as a practical matter it is december 14th. that is when the states have to not only have certified their results but sent them to congress. so you have from now until december 14th to play a lot of this stuff out. and it is going to get, as far as the courts are concerned, it will get expedited treatment. we've already seen some cases come in and get dismissed pretty quickly just because there wasn't enough quantum of fraud evidence it would have made a difference, even if you allow

for the fact that there were irregularities which there are in every election. i don't think this is a crisis. we have a presumptive result. it looks at the moment like what happened to president trump is kind of what happened for him in 2016, in the sense that you have a handful of states that are really razor thin. they can pursue recounts. it is appropriate to do that. the likelihood that it would change 10 of thousands of votes is not high but we have a lot of places where it's really tight. so they should pursue their remedies and we got plenty of time to do it. will: andy, we don't have much time. nice to see you again. it has been quite some time. >> hey, will. will: let me see if i understand completely where we are when we began this interview. the context of this election is highly irregular. it is high potential for abuse. skepticism would be well earned. there are instances of irregularities, or fraud that evidence needs to be brought

dig in on that. >> jed, you have to take a bit of a step back. if it is a gop led senate, anything legislative will have to be incredibly bipartisan. i think the chances of tax reform based on the original biden plan is highly unlikely. i think you may tweak around the edges on tax reform to reduce some deficits but i think that what we're going to see bipartisan. i know it has been an ugly name but it will rear its head and do something i think extraordinary. i think we'll see a large infrastructure plan, possibly around two trillion. my guess that is one of the few things that the gop will approve using deficit spending. partly because infrastructure is the fastest multiplier of gdp and it is also the best jobs promoter. the wages are much higher than minimum wage. with respect to tax reform it is -- go ahead, sorry. jedediah: yeah. yeah, no, i want to hear from

you on tax reform, go ahead. >> with respect to tax reform, listen, it is clear we have to pay for some of the things we need to do and joe biden's tax plan would raise about $3 trillion in revenues. it won't touch anyone who actually makes under 400,000. if you make from 400 to 800,000, actually, your taxes go from 25 to 25 1/2%. the ones who are getting -- jedediah: see that is what he says. not to interrupt but i don't want to run out of time. i want to dig in on this that is what he said during the campaign but that is not what was found by, for example, i you know, said non-partisan tax found takes, there are others, wharton study, there is a lot of studies that came out that said because you're raising the corporate tax rate, 28% is pretty high. that would affect individuals that make less than $400,000 a year. one study showed it would affect up to 85% of people. you're saying that his policy, you anticipate will not affect the middle class in terms of tax

hikes? >> correct. correct. actually, if you look at moody's analytics, i saw the wharton research, being a wharton guy, found quite interesting, it said the opposite, the biden plan would gain 7 million more jobs than trump plan. it would gain wages, reduce debt. when put side to side it was deemed a much better plan. why business leaders were supportive of the biden plan. with respect to corporate tax rates, listen, most people never thought it would go to 35 to 21 to begin with. going back to 28 is interesting compromise. that being said, it will be incredibly difficult to get structural tax reform done. today you have to assume that 50-50 chance or higher that it is gop-led senate. once again, infrastructure is the mosby partisan thing you can get done. deficit spending will get a bit

expecting them to respond as though there was not a rooting interest. i would return if we might, this idea of unity. i'm an optimist i think. i'm certainly hopeful that joe biden means the words he said in that speech last night which were very laudable words, that the country will come together as one. but i do think largely i'm being a realist, it is happy talk. i'm looking at evidence before and after as a result of that. not just joe biden, but most on the left pushed back on their ideas responded with ad homonym attacks about people's character. are you racist, homophobe, what is wrong with you at that you might disagree with me. that realism makes me wonder what our future is. will it be one of unity? jedediah, you said president or presidents elect should not be held responsible for msnbc contributors. we saw what they had to say earlier. when it comes to that divisiveness is bottoms-up movement.

the claims of racism comes from movements, not politicians. politicians responded to the movements that is why i'm concerned. i will be optimistic. i can't help but be realistic the way this goes on. joe concha was on earlier and talked about the media and their role in all of this. >> in the first 100 days of the trump administration the president received 92% negative coverage. that is supposed to be the honeymoon time. it only got worse from there. by the way 71 million people voted for president trump. when the race was called for joe biden yesterday, why did i see any of the looting and rioting we hear the right-wing doing? if donald trump won re-election, all right, would these activists posing as journalists be calling for unity or continue to lead resistance? that is the thing. completely different tone. as you said, not surprising at all. jedediah: yeah. i mean i don't think the media reaction was surprising. of course we've seen two

speeches so far. that is all we've seen. potentially obviously there is a lot of policy to come. the speeches were good speeches. there wasn't a lot of negativity. even if you wanted to criticize. they were well-delivered and the content was good and calls for unity are great. what will really be great, if those are applied. that reaching across the aisle we have seen to his credit and joe biden's political career thus far if that continues so if you see a hard push from the left as we talked about. we know kamala harris had a very strong liberal record in the senate. the likes of aoc and bernie sanders want to hear their voices in an upcoming potential biden administration. so we'll see if he delivers on those promises and i think you can be hopeful that will happen when it comes to joe biden. i don't know how hopeful you can be in terms of media response. because you have to look at history and it often tends to repeat itself. i will give them the benefit of the doubt because you have to, right? we're in a place i feel like you have to be optimistic.

i think people wanted compromise. i think they want us to reach across the aisle. i think they want solutions. i will take a step back, give everyone a clean slate. we'll see how it goes. the criticism will certainly follow if need be. pete: oh, that wonderful clean slate that was given to donald trump when they boycotted his inauguration, when they spied on his campaign, when they launched an entire special counsel, when they deemed him illegitimate and call all his supporters racist. i'm not a realist about this this is laughable, the idea of unity. these are words, they're not deeds. their deeds show us who they are as the left. fool me once, shame on you, feel me twice shame on me. this will not be a unifying moment an there is no reason to believe it especially since the president is still conducting a recount right now with legal challenges. that is ongoing. and so the idea of unity strikes a lot of people as very rich at this moment but we will continue to watch as it unfolds.

one thing we didn't see, guys, yesterday was those riots. apparently they were put on hold. they're satisfied now. celebrations seen in cities across the country, including this one in atlanta. the presidential race has not been called in georgia. ballots are still being counted in the state. jonathan serrie live in atlanta with more as the count is underway. reporter: good morning to you. this section of atlanta that i'm standing in is fulton county. it is georgia's most populous county. while they were reviewing provisional ballots that they had reported on friday, they discovered that not all of them were counted. so overnight, fulton county election workers started over and they rescanned all provisional, military, overseas ballots from friday. observers from the state and both parties were called in to monitor the recount. the tight race in georgia sending two u.s. senate races to

♪. will: joe biden now declared the president-elect of the united states but votes are still being tallied across the country. as the president legal team vows action in key states, including a new lawsuit in pennsylvania tomorrow. our next guest says america should welcome review for close counts. here to discuss is fox news contributor, george washington university law professor jonathan turley. thanks so much for being here with us. if we might, let's start with sort of setting the stage. i know this isn't a legal concept. it is not even circumstantial evidence but dealing with an unprecedented level of mail-in balloting, questions in some cities that have had problems with corruption in the past i think would it not be appropriate for everyone to look at this at least with a skeptical eye to start? >> well at a minimum i think there should be agreement that we should look at the votes we're just completing the tabulation stage.

we have not entered the canvasing stage. much of the evidence of voter fraud would not be readily available during tabulation. indeed much of the information is being held by election officials. you would think both parties would agree we should look at these allegations. we're seeing a number of affidavits coming out with sworn statements that they witnessed voter fraud. now that may not be enough. many of those are epsodic. we're looking for something more systemic. something that could alter the outcome of a given state. we still have not seen the evidence. there is no basis right now to suggest that joe biden is not the president-elect and that he secured this position through voter fraud but the point is unknowables. we have a history in this country of election problems. 1960 president kennedy is widely viewed by some historians, i should say by some historians not to have been elected there

were allegations that he secured that narrow victory through voter fraud by the daley machine in chicago and texas. in 2000, there was the allegation in florida. later studies suggested that al gore may have won florida. there is a lot of examples where we were a bit premature. we have to get it right. will: that only adds to the scene setting i'm talking about. highly irregular election. never had mail-in balloting like this. problems in cities that had problems in the past. you point to the 2000 election and the 60 election as problems in the past. get specific about this election. when it comes to pennsylvania, the president plans to file suit tomorrow, in michigan, 6,000 votes tabulated in the wrong direction. which if any of these potential suits hold the most merit on finding a systemics as you point out fraud that could change significant outcomes in this

election? >> you know what is funny is, the three states i mentioned before the election remains the ones i'm most interested in, nevada, michigan, and pennsylvania. in pennsylvania you had an order by a supreme court justice to compel them to separate ballots that were received after the legislative deadline. notably the election officials were not giving a clear answer as to whether they were doing that, and it required the intervention of justice alito. that is a large group of ballots. but the main thing i'm looking at is, when you talk about systemic problems is the, is how these ballots were authenticated. because if there is a problem in the system as to authenticating ballots, that would affect the entire election. what concerns me is that we had over 100 million mail-in ballots, yet cities like philadelphia and detroit with long histories as you have noted

what do you think we'll actually see? >> well, just prior to his call for unity he also said that his election was getting the soul of the nation back. in other words those of us who support president trump or president trump's administration had destroyed the soul of america. so it is very difficult to then in the next breath say, oh, kumbayah, let's all get together. but the problem for mr. biden is, is that he needs alexandria ocasio-cortez more than she needs him. that there was a lot of compromises made here. you're looking at a dynamic when it comes to the red wave that happened, other than the presidency, you got a dynamic of americans saying you know, we don't want to defund the police. we like what is happening with the economy. we like what happened with the supreme court. we want more of that. you have got major republicans moving into the house. you have got house legislatures in certain states switching to republican. that was a statement. there is no mandate when you

even know what to expect. when we look what president trump has accomplished, again, i'm of a mind this is not over until every vote is counted. i encourage the president to do what he is doing. one thing to declare a winner, another thing to have all of us agree on the dynamic. those celebrating joe biden's election, you're looking at, you're happy a man got kicked out of office, who managed the first middle east peace deal in the last quarter after century, first president who has not brought us into a war, shrunk the racial wage gap, shrunk unemployment gap numbers for every sector in this country. best economy the world has ever known. i think they're are going to be in for some surprises when it comes to what the democrats want to do. we saw the destruction economically through the obama-biden years. we saw what was going on with the international scene. iran, russia, and china. and i think that there are going to be waking up when and if this

in three states -- georgia, north carolina, and alaska. meanwhile, trump supporters turned out across the country in protests, many in states where the president is contesting the results. currently the trump campaign has active lawsuits in pennsylvania, arizona, and nevada. the suits in georgia and michigan have been dismissed. now, president trump did not speak yesterday, but he tweeted a couple of times. here's one of them saying, "the observers were not allowed into the counting rooms. i won the election, got 71 million legal votes. bad things happened which our observers were not allowed to see. never happened before. millions of mail-in ballots were sent to people who never asked for them." now, that tweet was flagged by twitter almost immediately. we'll see where the legal challenges go. meanwhile, john roberts, our correspondent at the white house says that talking to sources there, the president's legal team says the president will fully commit to a peaceful transfer should those legal challenges not show a clear path to victory. finally, as for the president-elect, biden, nothings on his schedule today as far as

each other again. and to make progress, we have to start treating our opponents as our enemies. they are not our enemies. they are americans. they're americans. jedediah: your thoughts on that message, newt. >> well, it's a nice sentiment. first you go out and the democrats steal five or six states, and that's what republicans believe we're watching. we think we have evidence of a lot of it. then you turn around and you say let's forget four years of nancy pelosi, let's forgot four years ago of impeachment, harassment, opposition, hostility, hatred, and now that i've won, why don't we make nice together? i think he would have to do a lot to convince republicans that this is anything except a left-wing power grab financed by people like george soros, deeply laid in at the local level. and, frankly, i think that it is a corrupt, stolen election. it's very hard for me to understand how we're going to

work together without some very, very big steps by biden. and i have -- i have doubts if the left-wing of his party would tolerate him genuinely trying to work with republicans. will: and that hope i do think requires us to ignore that every time the democratic party and most of it's surrogates have been pushed on the issues they've resorted to character attacks on anyone that dared to disagree, newt. so i want to ask you this. do you think they even try? that is happy talk, yes, it's true; that is optimistic talk coming from joe biden. it is a serious question, newt because we're already hearing from people like alexandria ocasio-cortez who's talking about compiling a list, campaign staffers for pete buttigieg. who drives it? that's the question. who drives this call for unity? who drives this message? who who drives the democratic party in the coming years? >> well, look and who turns it into reality? i mean the fact is we believe in philadelphia, in detroit, in milwaukee, in arizona, i suspect

they're going to try to steal north carolina next and fulton county, georgia, we believe these people are thieves, we believe the big city machines are corrupt. interesting patrick basham who's the most accurate pollster -- he's british -- wrote in a british newspaper this morning that this clearly was a stolen election, that it is impossible to imagine that biden outran obama in some of these states. and he said if you look at places like cleveland or chicago or new york, none of this happened. but where it mattered they stole what they had to steal. and i think that they have a big mountain to climb if they think they're going to get -- some republicans will, frankly, run up and accommodate 'em and be nice and hope that the media likes them. but the base of the republican party is going to really want us to remember nancy pelosi and to offer them the same level of cooperation that pelosi for four years offered the president.

pete: exactly. it's laughable to believe that there will be some clean slate of unity at this point after what was done to president trump trump. but speak to those trump supporters. not the republicans like you said that want to live in the warm glow of the establishment media, but supporters who do feel like this election was stolen and they feel like the count needs to continue. what's the approach going forward for those people? >> well, i think the first approach is to say anyone you run across as i have -- for example, we just had our ambassador to denmark tweeted out that her husband's been dead for five years. she just got a ballot from los angeles for him to vote. she voted in pennsylvania and her vote when she checked last night still hasn't been counted. so i would say, first of all, in the immediate future find every example you can of some kind of polling discrepancy, some kind of inaccuracy, somebody who was turned away. we just learned that in maricopa

county, arizona, they were taking the trump voters who had to fix their ballot, telling them to press a ingredient button so that it would be counted, but the green button in fact discounted it. so they're now arguing over recounting a whole wave of things where the poll workers deliberately were destroying republican ballots. and i think you find this in county after county. we found out that -- go ahead. jedediah: yeah, newt. no, i just want to ask you for clarity, because the accusation of incidents of voter fraud, which do happen in every election unfortunately, is very different from the accusation of a stolen election. that's very serious. the implication there is that there's enough widespread voter fraud going on that would have changed the outcome of the election. i haven't seen evidence of that to this moment. is that what you're suggesting has happened here? >> what i'm suggesting is you don't see the evidence because the local officials who are democrats hide the evidence and

then turn to you and say since you have no evidence. so they say, "oh, we let the poll watchers in the building." that's right. but they kept them far enough away they couldn't see anything. and i think i can show you case after case it happened magically at almost exactly the same moment on election night that a series of key states quit counting, almost as though they were coordinating what they were doing. and it happened a few hours later, about 4 in the morning, that they had huge data dumps of biden votes. now, i don't know how -- how do you prove that without really having to get the f.b.i. directly involved? and given the f.b.i. for the last four years, why would you trust them? the entire deep state has tried to destroy trump for four years. we know it now as a fact. we know that -- how hard they worked to undermine him. and i think if you're a typical trump supporter, you regard this as an effort by people on the left to do everything they can at every level, including the news media.

get it under control. jedediah: joe biden vowing to build back america's economy. so what does his agenda mean for your wallet? don peebles served on president obama's national financial committee, and he joins us now to break it all down. i want to take a look with you about some components of that economic agenda and we have that for the audience to look at, repeal and replace the 2017 g.o.p. tax cuts, raise corporate tax cuts to the tills, raise the minimum wage to $15 an hour, a $700 billion "buy american" plan plan. the first thing that strikes me as concern is the corporate tax rate and the implication that that will have on citizens as it trickles down and just these promises that were made that tax hikes would not hit anyone making less than $400,000 a year that nonpartisan says have said simply is not true. can you weigh in on that with me please? >> i think, first of all, without control of the senate, those reforms are impossible to get through. i don't think a republican senate will allow that to go

through; so this depends on the two candidates, two democratic candidates in georgia winning their runoff, which is unlikely. however, the tax policies and the tax reform bill that was passed under president trump actually increased the top bracket income because they eliminated significant deductions of state and local income taxes. and so i think any kind of tax policy that would increase corporate taxes, especially coming out of this financial hardship of the, you know, pandemic that we've experienced would be very retroactive in terms of reducing businesses' output and putting a regressive economic tax policy on businesses at a time when we need to put more capital into businesses to create new jobs. so i don't think that is a good idea, and i think under these circumstances hopefully president-elect biden would re rethink some of these policies. jedediah: and just quickly on that, because joe biden has been

presented as someone who has throughout his career reached across the aisle, my suspicion is that he will face extreme pressure on economic issues from the likes of bernie sanders, for example, who was front and center during the campaign talking about the economy. do you expect him to cave to that wing of the party on the economy, if given the chance, if he's given the chance to run with it, let's take the senate out of it for a second, where would his head be at? >> no, i think president-elect biden, if you look at the entire campaign and election that took place where sanders was the last man standing other than biden, biden made it clear that he was going to operate and govern from the center. but i would think that it is more likely that a president biden would negotiate with republicans in the senate to compromise, to get them something that we want. i do take him seriously when he says he wants to bring america together. and we've got to remember that half the country, nearly half the country has voted for this president, the current president and his policies.

keystone state win, bowing so file suit tomorrow. pete: brian guinness is live in harrisburg, pennsylvania, with more on the legal battle. brian, good morning. >> good morning. well, look. pennsylvania is at the center of president trump's legal disputes and the results of this election election. tomorrow rudy giuliani, the president's personal lawyer, will file a lawsuit specifically about the republican poll watchers and observers and their inability to actually see the mail-in ballots being counted and as well being processed. those are his claims. take a listen. >> the people standing -- the people standing behind me are called witnesses. they will eventually -- soon, hopefully -- appear in court and give this testimony because we're going to file a federal lawsuit that will cover here and pittsburgh. >> we'll see what kind of new evidence he presents because trump campaign lawyers in court actually admitted that they had

poll watchers inside of the philadelphia convention center since 7 a.m. on election day. then there's this signed, sworn affidavit which is now in the hands of senator lindsey graham and the senate judiciary committee. the affidavit is signed by an erie, pennsylvania, u.s. postal service worker named richard hopkins who alleges under oath that he witnessed the postmaster say that, quote, "he was back dating the postmarks on the ballots to make it appear as though the ballots had been collected on november 3rd, 2020, despite them in fact being collected on november 4th and possibly later." this speaks to the most significant legal argument republicans have in pennsylvania pennsylvania. the issue of late mail-in ballots under act 77, all ballots need to be returned in pennsylvania by november 3rd at 8 p.m. on election night in order to count, but that was before the pennsylvania supreme court ruled that ballots can legally be accepted up to three days later as long as there is no evidence that or proof that it was sent after 8 p.m. on elections night.

now, the u.s. supreme court has ordered that all 67 counties need to have tracked and segregated and counted all of these late mail-in ballots in anticipation that this may go to the u.s. supreme court. the big question right now, though, is how many late- late-arriving mail-in ballots are there? we still do not know. the counting is still continuing of mail-in ballots. there's about 60,000 left. we do know that the secretary of state in pennsylvania guys has said that she doesn't believe there are enough late mail-in ballots to change or alter the result of the election, which has the president-elect now biden ahead of president trump in pennsylvania by some 41,000 votes. so we shall see. guys? pete: brian innis, thank you very much. evidence comes in. how many places did that happen? were there other postmasters? how many? tens of thousands? hundreds of thousands? we don't know. that's why we've got to ask these questions and get the evidence. let's bring in house minority

whip steve scalise to help us with that. steve, we had governor mike huckabee on earlier, and he pointed out which is simply a fact, that, you know, media organizations don't validate presidencies. ultimately it's voters and reelects that do. so there's a legal challenge coming from the president right now. where do you believe we are on this and as far as pertains to evidence and challenges? >> good morning. good to be with you. and -- pete: good morning. >> -- we're really at the beginning of the legal side of this. of course you had election night tuesday night. then you had some states still counting, some very questionable things happen, especially when you look at many states that have the laws that allow a poll watcher to watch the counting. it's part of the transparency process that's a law in most states. that was not being followed. they were not allowing trump's poll watchers to watch what was going on. and, you know, what are you doing behind closed doors where you're afraid to let other people watch you when the law says you have to? clearly the pennsylvania law which is clear after 8 p.m. on tuesday night, ballots can't be counted yet they were counting

those ballots. the supreme court said you have to keep 'em separate. there were questions of whether or not they separated all of those ballots, and the secretary of state has yet to set how many there are. she'll a, "well, we don't think it's enough to be outside the margin." well, then how many is it? why aren't they transport about these things? these are laws on states' books that aren't being followed. dead people have clearly been identified as having cast ballots. these are all things that raise very serious concerns, and it's part of the legal process. you go back to bush v. gore, it wasn't 'til the second week of december that that got resolved by the courts. so, you know, you can see there's still a lot of these cases that have to be made and let the courts resolve these disputes. jedediah: congressman, i want to ask you about some of the results and what we've seen in the house. house republicans have really chipped away at that democrat majority. they flipped at least eight house seats, many of them won by female g.o.p. candidates. we have a bit of a montage from

two congresswomen elects. we want to play that for you and we'll talk about it. >> i'm an everyday iowan and that's what it came down to. i listened to the concerns of the people in my district and i think it was a very clear message that they said they're tired of the left leaning rhetoric about medicare for all, the green new deal, and nancy pelosi stalling of much needed aid for iowa families. >> it all comes down to that "america first" agenda, making it so that americans can make the best decisions for themselves and their families. i don't believe that a big, bureaucrat government is best suited for that. and my constituents don't either either. so having that message really empowering people and making it so that there's equal opportunity out there rather than equal outco.es jedediah: your response to these election wins in the house. >> yeah, we've got some great, great new members coming in in this freshman class. i know you ran ashley hinson there in iowa. i was there a week and a half ago campaigning in iowa and boy, the energy level on the ground

in iowa and all of these candidates that won was off the charts, they really organized well, and they went against, you know, stream of the media projection that nancy pelosi was going to gain another ten seats. instead the opposite happened. we're probably up by about ten on our side. and there are a few races on the west coast that still haven't been called that are leaning our way so i'm real excited about this freshman class. it's a much more diverse class than we've ever seen before, more women, more african-americans, more hispanics, cuban-americans. it's going to be a great group of members to come in and help us fight against the socialist wave that you're seeing on the left. and, frankly, internally they're having some very big fights because nancy pelosi drove 'em so far to the left that a lot of those members got beat in those swing districts and many of them came close and we're going to win the house back in two years because of how far left they went. will: congressman steve scalise, thank you so much for your time this morning. let's check in with jillian mele with headlines this morning.

national commission of -- bipartisan commission of scholars. i will ask them to over 180 days come back to me with recommendations as to how to reform the court system. there's some literature among constitutional scholars about the possibility of going from one court to another court, not just always staying the whole time in the supreme court. will: there's joe biden in october saying he'd be open to reforming the supreme court after dodging questions of whether or not he'd pack the court. here to discuss president of the judicial crisis network, kerry severino. if joe biden survives whatever recounts and legal challenges are to come and becomes president of the united states, what do you think about his promises off and on throughout the campaign to look at packing the court? will it happen? >> yeah. well, i think in order to do that, he'd have to win both the presidency and then have control of the house, which they now have much narrower control on,

and the senate. so the question i think comes down to are they going to be able to do that? if they had the opportunity to do that, would they do it? i think absolutely. the left is dying to get control of the court and use it as a super legislature to achieve their policy goals. but whether they'll be able to really comes down to the senate. that of course comes down to georgia. i'm optimistic that there we're going to see just like across the country in these down-ballot races this year that the american people are going to reject that radical agenda. we saw it in state races for house seats. we saw it for governors raises. i think, you know, even if joe biden does narrowly win the presidency, the american people are soundly rejecting this radical leftist agenda, and that includes court packing. will: you point out george, carrie, becomes the battleground essentially for this issue. democrats still control the house if not by a smaller margin margin. if joe biden becomes the president you have the executive and that leaves the senate and that lives those two the senate races in georgia. but either way that goes, okay,

he made promises. i just want to be clear with you here. do you think either way that goes there will be an attempt or was that just a moment in time for joe biden? was that just a moment in time for the democrats, that was some way to respond to amy coney barrett's nomination? whether or not they see packing the court or rotating justices, will they go for it? >> well, look. that wasn't just a response to justice barrett's confirmation. that's something they've been calling for for years. and i think whether they do it only depends if they have the opportunity. if they think they have a chance to do it or have the ability to advance it, as you said, maybe they'll just try it in the house knowing they can't get it through the senate if georgia goes gops and we keep the senate in republican hands. but will they try it? i think if they think they have a chance at advancing the ball in it, they absolutely will. they want to have every possibility to turn judges into unfortunately more of a political football than they already are.

abandoned and not listened to, they will go back to the streets to riot. and so, you know, he better be prepared because, again, they're going to be collecting on that debt. pete: so, lawrence, they fully expect that he is the trojan horse that many have called him, that he will get inside and then unleash the troops. and if the left-wing socialist troops around allowed to advance that agenda, then they go from inside the city to outside and rioting. so you're saying he either lets 'em run things other they're going to threaten violence in the streets. is that your thought? >> well, they have an agenda and if he's not going to be the progress that he said he was going to be, they said he was going to be the most progressive president. and if that's true then he'll be fine. but if he plans on to be that moderate, to bring the country together, to talk with those working class folks, those trump supporters that feel like they were forgotten, i don't see how you're able to please both camps camps. and so i think joe biden in his first hundred days is going to

have to define what his presidency is going to be. and i think he's bound to tick one of the groups off. pete: what do you think that will be, lawrence? who is he? >> i don't know. i'm not sure. i mean, he says one thing. he gave a unifying speech yesterday. but i will -- i have to admit that there's some caution for me when i hear that elizabeth warren and bernie sanders and even kamala harris may have their progressive roots within that administration. so, again, i don't know where he stands on -- i would have like the to have asked a lot of these questions during the campaign trail, but apparently this is over now, he is the president-elect and i'm going to do my job to support the country as i always have, every president, but there are still real questions about how he's going to define his presidency, and i think that will be in the first hundred days. pete: yep. calling for unity after what you've done to a president for four years and calling his supporters racist for four years pretty rich. but we'll see what happens. lawrence jones, thank you for your time. >> thank you.

karl, thanks for being here. as someone front and center with the 2000 recount you can understand the impulse to want to get it right to make sure the legal votes are counted that everything is above dashboard, so what's your thinking right now, five days into this post- election as the trump team continues to bring legal challenges because they think the outcome was fraudulent, what does that say about where we are , where are we and how far should they go in your opinion, karl? >> well look first of all remember this is different than 2000 and in 2000 the secretary of state of florida issued an un official count pending the canvas that showed george bush in the lead and that's when al gore attempted to do something that is illegal under florida law, and that is to conduct a recount in only three heavily-democratic counties, florida law requires a recount to be conducted statewide, they conspired with local officials and three democratic counties to recount the vote they aren't recounted they are recounted twice already, remember you have

the famous people holding up a ballot trying to see the intent of the voters so it's entirely different than this. in this , the accusation is if there was fraudulent activity and the vote count itself and so the president has every right and he will have to, however because the states are now issuing unofficial counts, about to issue unofficial counts, and they're going to move to a point where they begin to canvas these and formally declare the results of the state, so monday is going to be an important day for the president's legal team to get these actions out there and frankly i have to say, jim baker was in florida for the recount the day after the election and i'm not even certain who of the trump team so they got to move quickly, and they have every right to do so. i think trey gowdy the other side said it terrifically one of the great majesties of america

is that not anyone from the lowest to the highest has fair and equal access to the courts and that includes the president of the united states and he has a right to do that, absolutely. jedediah: karl, the new york post editorial board came out and argued that trump' legacy is secure and by that they mean policy but he should stop with the rhetoric like stolen election and things of that nature. it said president trump, your legacy is secure, stop the election here is the quote actually. even as non-stop poison from most of the media carried the election, the rest of the gop did well likely keeping senate majority despite having to defend far more seats than the dems and gaining enough house seats to cripple the power of nancy pelosi or her replacement to lock in his legacy trump must rally republicans to move forward by behaving with dignity in the face of likely defeat. your reaction to that take? >> well, i'd add one more thing to the political accomplishments and that is that the republicans in the face of in a unprecedented effort led by

president obama kept their strength in fact increased their strength in state legislatures which matters with regard to re districting next year. the republicans were expected to lose a large number of chambers and instead they gained three, so, the president does have a lot of political accomplishments in this election let alone the policy accomplishments over the last four years, but i think it sound advice. he has to be careful about his language. he has every right to pursue these instances he thinks where he thinks he's been wrong, but you got to be careful about the language because if it's not proved out, if there are not, if it is not a stolen election, if he lost pennsylvania and michigan and wisconsin by the margins that today are on the books, then, you know, and it'll color his record. it will color people' perspective of him so pursue all of these things, absolutely but let the facts and the evidence and let the lawyers do the

talking and i'd tweet less and put them more in the spotlight. will: karl, let me return to the comparisons of 2000 you have a direct experience that might give us some insight. i think the american people would like some sense of expectation. what was it 37 days in florida that it took these -- >> 36. will: for that challenge to survive. what would you expect, how long will this take? how long will these legal challenges which i'm sure will be fast-tracked, how long will it take for them to reach some sense of resolution for the coming suits president trump plans to launch? >> well i don't have a good answer for you, because word ton thing, look, we were in florida and we were focused on a couple of simple questions. what the gore campaign and these three democratic counties were doing was that in conformity with state law and the answer was clearly "no" and if it was not in conformity with state law should they be stopped and the answer we thought should be yes, and twice i'll remind you the supreme court of the

united states of america held the gore campaign was violating the constitution in two places including the equal protection clause of the 14th amendment. these three counties were going to be treated differently than the people in the rest of the state because these counties were being recounted and everybody else wasn't, as state law require, and why was that? because later we learned in the autobiography of david boyce , michael hooley said if we have a statewide recount bush's lead will grow the only way that we can win is to focus on these three large heavily- democratic counties and "harvest votes" using the so-called undervote issue and defying the attention of the voter and gain enough votes to overcome bush but it didn't work out but twice the supreme court and again david suiter and steven bryer joined the other five more conservative justices in holding that and the final decision was not on whether or

not they are violating the law 5-4. that decision was on should we remand it to the florida supreme court one more time and tell them to get it right or shall we end this farce and it was so close to the date of the meeting of the electoral college that five justices said enough is enough we have twice told you 7- 2 you got it wrong, and so we're going to end it so that's why it took 36 days. i'm not certain we'll have upset as a court as the florida supreme court was back then ignoring the explicit u.s. supreme court that this was unconstitutional and they are the ultimate arbitors of who violates the constitution but my guess is we're going to have quick resolution on some of these issues like we have last week. the president won the issue on the observers in pennsylvania. they were allowed to be within six feet. they weren't being there. they had to be allowed to be within six feet and some others that were revolved quickly and

thrown out so some of them will be but we don't know exactly what kind of evidence the president's lawyers have and what kind of case they're going to present so it's hard to determine. my gut tells me because of the outcome of the election it's going to be done relatively quickly so these will be heard on an expedited basis and probably resolved quickly, so the ones that don't get tossed out will probably come to resolution, i hope, maybe next week, but remember, he's got to win, biden is at 290 right now, so the president is going to, the president is going to have to have successful lawsuits in at least probably three states. you know, pennsylvania is 20 electoral votes, wisconsin is 10 electoral vote, nevada is six electoral votes so he'll probably have to have success in two of those states. again we don't know what his claim is going to be and what the evidence is going to be but i would expect i don't think it

china. there's growing consensus in the united states, bipartisan support in the congress and a growing consensus around the world of china's behavior, and the need to hold them accountable, that they have truly become an aggressive nation, and as such, while i don't think they'll ever give trump credit for that to be frank about it, pete, i think they'll largely move in that direction, but here is a couple things that we will see change. one, there'll be more of a tone towards president xi, and certainly, the rhetoric has increased dramatically as a result of the pandemic and his spreading the localized epidemic to the world at large and i think president trump rightfully held them accountable for that. that tone will change. secondly, i don't believe they have as strong a view of the trade imbalance and the lever to use to correct it tariffs as much as the trump adminitration has done so they

are going to talk more about working with allies but when they get out there and they start working with the allies, they're going to find to their surprise if they don't know already that the trump team has worked considerably with our allies in the region to sure them up and to make certain that they understand that we've got their back. pete: it's a very interesting point almost single hand edly president trump shifted a foreign policy bipartisan consensus that china had a peaceful rise and instead took them on and now that's become the consensus that the they are an adversary that needs to be dealt with but i got your take as well on iran, general. there's a tweet that i believe we have it we'll put it up, ioto la tweeted this that the situation in the u.s. and what they themselves say about their election is a specatacle and an example of the ugly faith of the liberal democracy of the u.s. regardless of the outcome one thing is absolutely clear the definite political, civil and moral decline of the u.s. regime our

opponents often point to the messiness of our republic as a sign of weakness. what would our future with iran look like? >> well first of all that's a bit rich, isn't it, pete? these are the guys when they had , when their people accused them of fraudulent election several years ago they went into the streets and shot and killed them and imprisoned thousands and this last year they've killed 1,200 demonstrators demonstrating peacefully and imprisoned 12,000 and they are being not only imprisoned but tortured, and the iranians, as we know, the commander of cyber command, announced last week that iran had made an attack on the united states election process and cyber command conducted an operation against them successfully to defeat that, so it's a bit rich what he's saying and what is he looking at? he's looking at a process that's within our democracy. if there are election irregularities go to the court and address the and resolve it. that is the process we're in. that is a working democracy and

i liked using the example i've been in the state lawmaker for three years now and in the middle of covid i passed a prison reform bill and i can't remember the last time i saw a republican push a reform like that, but when that bill is voted on, every single democrat and every single republican voted for that measure and it was signed into law. we've got to really work and this election what we're seeing in 2020 it's the mandate now is that we have to reach across the aisle to get something done. there was a red wave across many states in the general assemblies and state legislatures, massive turn out on both sides of the aisle. people want someone whose going to get something donald we've got to be able to work together and i've dot that as a state lawmaker and i look forward to doing that in congress. it used to be that way but now we've allowed our disagreements to cause so much division and people are really tired of it and we've got to rebuild our country, states and communities and i'm raising my hand, stepping into the arena and i'm ready to do it. jedediah: i think there's a lot of truth to what you just said

pennsylvania, on michigan, on arizona, and he's going to join me first to discuss what evidence he has and he'll tell us how many lawsuits will drop this upcoming week that the president is going to be suing pennsylvania and others so that's number one. number two is at this point, markets are focused on the senate. that is where we are. we've talked a lot about the policies coming out of the biden camp and that includes $4.3 trillion of new tax increases. it includes major big government spending programs like the green new deal at $100 trillion. the only way he can get through those programs is if they have the majority in the senate, so we've got two run-off races in georgia in january. these races could not be more important. this is the difference between socialism and capitalism. so you're going to need to see kelly leoffler and david purdue win their races otherwise you're talking about a narrow

majority but a majority in the senate, by the democrats, and if chuck schumer is in fact the senate majority leader he will likely push all of this through and you will have a stock market that sells off, so it's really hard to say right now the markets have been rally ing this past week had a huge rally at 7% on the dow and s&p 500 and the nasdac was up 9% last week and it all had to do with the expectations around the senate. this is all going to happen between thanksgiving and christmas, because the run off races are in january 5, so this going to be a very busy end -of-year at this point i can tell you the market believes the republicans will stay in the majority and i would expect a pretty good market performance continuation of the rallies that we've seen, but you can't tell whether or not he's going to get these programs through. it's all about policy, guys, and of course, we're watching the litigation. you know, the media does not decide who the president is. remember that. pete: correct. maria: it's state officials that decide so we've been talking a

seattle but interested to see how buffalo bounces back especially the play of josh allen started off the year mvp caliber we sat down for an interview and talked about this incredible pace he was playing at and has really fallen off. i think he bounces back today against the seattle defense in the secondary, they are good against the run though and that's an area that buffalo has been good at and relied a lot on their run game the last few weeks and had success in doing so, so it should be a good match up, don't be thrown off by seattle going east. seattle does very well in the eastern time zone and does very well on the road as well, i expect russel wilson to play at the high level that he's been playing at all season long so it should be a very good game and closer than some might think. will: that cross-country trip is rough on some teams i think the chargers notoriously have a tough time traveling back east. speaking of the chargers by the way the fox has chargers and raiders later today. >> they do in another game actually that's also a good game but a game we're really excited about because usually the chiefs play over on that other network
