battles across the country. first in michigan the trump campaign filed a lawsuit against secretary of state alleging credential election challengers were blocked from having sufficient view of the vote counting process and in eligible ballots were tallied. the attorney representing ballot workers in michigan had this to say. >> mister larson in his affidavit says he saw the majority of the votes, the ballots he was observing were not being processed properly and being assigned to different names so these are very serious allegations that not just one or 2 ballots, thousands of ballots. >> in pennsylvania the trump campaign filed five appeals, the decision to count different categories of mail in absentee

heavy rain and powerful winds up to 50 miles per hour with threatening storm surge. one man died after being electrocuted in standing water. dennis steen is tracking the storm and joins us live. >> janice: the threat isn't over in terms of heavy rainfall and gusty winds but the storm is going to start to we can and move quickly northeast over the next few hours. we had a landfall an hour ago just south of cedar key, florida. the fourth landfall. it may couple and falls across central america. there is the satellite radar imagery, potential for heavy rain, tropical storm force winds, no tornado warnings right now, flood advisories in effect, flooding video all over the tampa bay area. that will be concerning as it moves northeast. it will be out of here fairly quickly after weeks of watching this storm.

need that one seat to keep hold of the senate so general question do you think they can do that? >> yes i do. it is easy to look at this and think this is a real challenge for republicans, things are sliding away in the senate but before election day there was supposed to be a blue wave in the senate and now we have at best a situation where democrats can capture, divide the senate and divide control. for at least one of these races, the other is difficult to tell, both are difficult, almost throwing the dice but one of these races gravity tends to float republican. >> the runoff candidates, these are the candidates. rafael moreknock, these are the results. did end up on top with this one

but the latest polling, people are not trusting polls but this one is out there, from november 8th through ninth, this is pretty index at this point. >> a couple ways to look at the race. the interesting thing about polls in the general election they were pretty much accurate, they weren't off. we shouldn't look at them with such a jaundiced eye. the natural thing is look at how the general election turned out for the two candidates, what appears to be -- that election had 20 different candidates including two republicans who are at each other's throats the entire time. now one republican endorsed the other. the most recent polling shows the race is too close to call. as the republican leffler starts to focus on the democratic candidate warknock, will he

sustained negative hits which emerged largely unscathed in a general? >> the other is david purdue and john oss oh's after, will this be close? >> there is no way it can't be. specials favor republicans, they are more reliable voters, that is not something we can rely on because there's so much attention in georgia, so much many spent with messaging and turn out but perdue has a slight two point advantage walking out of the general, that was a 3-way race with a libertarian, get more votes for republicans than democratic voters, the latest polling, one pole we have to stick with, a four point lead on behalf of perdue, that is outside the margin a are. it is too close to call. i am rolling the dice the

service. walk us through what happened. you were in afghanistan for four months, came home and you works with the sheriff's department and pull over your wife, was that tough to pull off? >> it was tough to pull off given arrival dates and times change so much when you are traveling. the hardest part was i had just gotten off the plane, barely enough time to drive straight home, spend a few minutes planning and she had to pick him up. it was kind of a rush. >> your wife was in on it? >> she was in on it, she talked to my captain, they are the ones who figured out. >> he didn't think she was getting a ticket or anything. what was running through your head when you saw your dad?

>> we are back with extreme weather. tropical storm eta making a second landfall in northwest florida near cedar key. kelly cowan from tampa joins us as the storm brings life-threatening storm surge. was the latest? >> reporter: the waters rose very quickly in this neighborhood just behind me, things have improved significantly in the last few hours but the issue is not only a fool day of tropical storm rains dumping on this area but right around midnight you had high tide come in and that sent a surge of floodwater rushing through this neighborhood

causing many to be evacuated overnight and flooded people's homes virginia by apartment building just ended up with a lot of water inside. those residents still bailing out their homes after water rushed up over barriers they set up at their doors to keep the water at bay. once high tide came in it completely flooded them out and it has been a sleepless might for dozens of people in this area. many tell us they came home from dinner or work and found the roads were too dangerous to navigate so they spend the night just outside their neighborhood on higher ground camping out in their cars waiting for the water to go down because as you can see behind me the water doesn't look that deep but this is the highest point of the neighborhood. as you go further back the water rises because the elevation is dropping. a lot of people don't want to risk their vehicles, killing

this? >> the logan act prohibits private parties from engaging in diplomatic or foreign relations with other nations in an effort to undermine or undercut the us government's position. what's going on here is people who believe they won the election and talking to foreign leaders, congratulatory phone calls and discussing foreign affairs of the united states, this happened in the trump administration in 2016 after the president had been elected, before he took office, that led to issues but there is a long history of this happening. the question is why is the logan act be in of today and why was it "back then also? shannon: great question we are wondering and we have some media headlines because coverage of this has been a little different, back of the neck accusations were swirling around michael, washington post, did michael flynn admit to violating
