>> a win today in pennsylvania for the campaign that supports our continued assertion the secretary of state extended the deadline without authority and this lawsuit is a step to securing our rights to that recount in pennsylvania. >> reporter: the trump campaign celebrating a win in pennsylvania ruling the state may not count ballots where the voters need to provide proof of identification and failed to do so by november 9th. a member of donald trump's legal team, harmeet dhillon joins us to break down what this means for the president's chances in the keystone state. the trump team got a win in pennsylvania. can you explain this particular case and how significant it is? >> this is an important case about a constitutional issue that is broader than pennsylvania namely where you

have a republican legislature or democrat legislature and they passed a law regarding deadlines for voting. and other officials like the secretary of state or the supreme court unilaterally change it if they don't like what you did? always the legislature may set the time, place and manner of elections. the secretary of state of pennsylvania decided to extend the deadline. people voting for the first time after provide some form of identification and they extended that out and there are some ballots that will be segregated or not counted. jillian: how many may not count as a result and is it enough to change anything? >> reporter: we don't know accurate tallies of these ballots but a different category of ballots is over 8000.

another category, ballots that arise after the election day, segregated by the supreme court, you are talking tens of thousands of ballots but with difference between the parties of 50,000 with some ballots, waiting to be counted, the president could change that. you would have to change the outcome of other states to change the outcome of the election. shannon: donald trump commuted the prison sentences, spent a lot of time on prison reform. gavin newsom interviewed 22,000 commutations including 10 immigrants facing deportation.

>> these are different circumstances, the governor before them. the reason for those commutations including minor drug offenses and murder and no one the murder, to avoid them being deported. if you are a criminal serving time at the end of the sentence, you would be handed over to ice to be deported but if your sentence has been commuter a vacated it could be a different setting. what the governor is looking at is even if we have president biden who is probably going to be soft on these folks there will be laws and regulations for the department of homeland security, people wouldn't find out, different motivations of the president's commutations, ironically, joe biden is

shutdown nonessential businesses including restaurants. the texas restaurant association warning half of eateries would close after a second lockdown. this has been a difficult year for you. simply put how difficult, how hard is it to be a restaurant owner in texas right now? >> it has been incredibly hard, 50,000 before the crisis it, we lost 15%, restaurants are trying to grapple with the health and safety protocol, changing business models overnight. we are grateful to be in texas where we have a governor who was in this crisis but as the numbers increase we are racing for an impact that could lead to 40% of restaurants or 30,000. shannon: that is a terrifying number and el paso shutdown all

nonessential businesses. have you spoken to the governor? any indication how he feels about it? >> we worked closely with the governor's team, we had good news last night, they did stay the order in el paso until it could be heard, that was good news overnight. we were fortunate we are going to step through this together with a regional approach in texas so we have peaks in areas we can address of them. we have to think about eight month of this crisis, we received eight weeks of federal support. talking about a catastrophic impact to the nation's second largest employer in a $70 billion industry. >> you mentioned the stimulus which stalled on capitol hill. what are restaurant owners saying? how badly do they need a second round of stimulus? >> that is the most frustrating

part. it is clear under have handicaps and shutdowns restaurants are desperate. these are small businesses. none of the ten are 50 or less employees, these are small businesses and we are stuck in partisan politics. we have been really singing everything we can at the capital asking for a second round that will help restaurants get through winter but we don't see it in sight and we will not stop until it crosses the line but it is extraordinary to think it is so critical. shannon: small business owners are struggling and it is tough to see. thank you for being such a good messenger.

and expecting a biden/harris when and hoping this administration will not be as tough on them as trump has been. it is almost like they couldn't believe it was too good to be true because they would like to see the us quietly go back to the world health organization, come back to paris and let china continue its effort to spread their values and give america a bad name around the world and hoping they might go back on the taiwan arms deal. they like this. jillian: iran has been very busy building a stockpile of enriched uranium, 12 times what the iran nuclear deal would have all out. donald trump pulled us out of the old saying it was ridiculous, they are a state sponsor of terrorism, no checks on ballistic missiles, joe biden

vaccine rollout has become political. >> if the doctors tell us we should take i will be first in line to take it absolutely but if donald trump tells us to take it i am not taking it. >> the bad news is it is two months before joe biden takes over. the trump administration rolling out the vaccination plan and i believe it is flawed. shannon: with your response to that rhetoric? >> andrew cuomo, the grandma killer, should be quiet and let them handle the situation. he is incapable of managing the global pandemic. he worries about trump, worry about the cdc and all the people in the clinical trials and pharmaceutical companies, presumably they are not all in on it was trump. let's trust the real experts and let the politicians get out-of-the-way. shannon: can i just ask your opinion of what it feels like to be part of something that is so much bigger than you? this is something that will help

morning? >> it is sad. another example of the men and women of law enforcement who answered the call every day, they run towards danger when everybody else runs away. an example once again of people out there who want nothing to do other than to kill police officers and it is sad. i'm wondering when the protests and marches on city hall's will start to protest the officers death. shannon: it is awful. we will continue to follow the story, manhunt underway. we will keep everyone updated. there is a new report that shows a 72% increase in nypd retirements. you are one of them and you had a goal of being with the department for 30 years that you

did not reach. >> that is right. my dream was to do 30 years if not more but i reached a point i just couldn't absorb any more. myself, like a lot of cops before me and a lot of cops after me are tired of being colonized, trying to do -- the fear that no matter how great a job they do there will always be someone to manipulate the narrative to cause civil unrest and chaos in communities for the sole purpose of disparaging the police's good name. on top of that, that has not only happened from civilians but is coming from political officials, city hall, from police department headquarters. why would you stay more than you have to? jillian: i'm sure it was

internal struggle to come to this ultimate decision that you see what is going on with the department. a lot of you have been struggling, and cities across the country. it has been hard. you had a goal. what is it like to come to that decision? what goes on within? >> it is not easy. it is not just a job you do for any amount of time in your life and walk away from. it is more than a job. it may sound cliché, you don't just pick up the mantle to find something you do with your life, you do it for a reason. the cause is greater then your self and people don't realize police officers do this day in and day out running towards danger for the sole purpose of

helping the communities they live in and the communities they serve and helping everybody else but themselves, supporting families with their jobs, so much bigger than that. jillian: let's talk about your partner who was gunned down in the line of duty, this is something that should never happen to anyone but this was in the bronx, you were a in an unmarked nypd car. there was a man just praying at the memorial there. tell me what this photo means to you, the significance of a moment like this. >> brings a comfort to see there are still people who understand the sacrifices made by the police. for someone to take a moment to stop and give their respect and thanks is comforting and encouraging to see somebody like

that. she just wasn't a cop, she was a mother, a daughter, a sister, a friend, a coworker. it is much greater than just being a cop. it makes me angry when i see one of these. i hope it's not taken out of context but when i see memorials with names like lou holder, donald moore, the list goes on, these memorials represent, thanks and remembrance. it is also a reminder to police every word that there are people out there who choose to be evil in the world. they you just because you are in uniform. they hate that you represent law
