n. tyrus, i wish you. >> you are an american, jack. we say pecan over here. tell jasper hi. pecan it is. >> dana: thank you for joining us, i'm dana perino. bill hemmer do you say pecan or pecan. >> pecan the snooty kid from cincinnati. see you at 5:00, thank you, dana. >> bill: big hour begins now i'm bill hemmer, waiting to hear from the coronavirus task force and waiting to hear from the president-elect as president trump's legal team keeps up the election fight. much more on that in a minute. the task force set to brief americans on the same day the cdc issued a major travel recommendation for thanksgiving. some governors moving to shut things back down as cases spike. joe biden meeting virtually with a group. expected he will speak after that concludes. all of this as president trump's legal team says he won by a landslide and they will prove it. reporting analysis begins now.

jonathan turley on the president's legal push. garrett tenney on breaking developments out of michigan, but we begin at the white house with kristin fisher. good afternoon, kristin. >> good afternoon, bill. well, a lot of the claims that we heard during that news conference we have heard before. and, in fact, many of them have already been thrown out in court. but there were two that were new. and they are out there. i really don't know any other way to say it. rudy giuliani claimed that there was a centralized plot involving widespread voter fraud in big cities that are controlled by democrats. and then another member of the trump campaign's legal team sidney powell, she says that that plot came -- is communist in origin and came from venezuela. now, to be very clear, the trump campaign has not come anywhere close to proving those final last two claims in court and listen to what karl rove thought about it just moments ago. >> these are serious, i think, somewhat strange accusations but

serious and now both mr. giuliani and ms. powell have an obligation to go to court and prove them. because we're -- these are questioning the fundamental fairness of the -- of our presidential election. has an obligation to go to court and prove these or the american people will have every reason to question their credibility. >> now, the campaign is describing that 90-minus conference as simply an opening argument. they are asking the in court. with approaching. >> describe where we have been and where we are at. what you have heard, i'm sure, in the fake news papers tomorrow will be one of two things. either there was not sufficient evidence that we have presented or we spoke too long. okay? so what you have heard now is basically an opening statement

this is what you can expect to see when we get to court to actually have a full trial. >> an opening statement according to the trump campaign. now, as for president trump, as of now, no plans to see him today on camera. this is, i believe, the 12th day since the election that he has had no public events on his calendar. vice president mike pence has been today held a task force briefing in the situation room and now bill we have a fairly rare briefing, another briefing of the white house coronavirus task force in the briefing room set for 4:00 p.m. bill? >> bill: waiting and watching on that. thank you, kristin. nice to see you on the north lawn. to say michigan we roll now. two republicans in that state claim they were bullied into certifying results in the election and now trying to change their votes. garrett tenney reports on that. the latest in michigan today in lansing, garrett? >> bill, now these two canvassers say they want to take back their votes, certifying the election results in michigan's

largest county. this comes just days after william hartmann and monica palmer are their names. they voted against certification, citing concerns about discrepancies in the numbers of ballots recorded as cast and the number of ballots counted. then during the public comment phase of a meeting of the wayne county board of canvassers tuesday night. the pair says they were repeatedly threatened and accused of being racist for their decision. take a listen. >> shame on you. shame on you for leading to this level of corruption. >> the law isn't on your side. history won't be on your side. your conscience will not be on your side. >> after more than two hours of that, the pair agreed that they would vote to certify the results if a complete independent audit of the city's elections would occur. however, after they voted to certify the results, michigan secretary of state said she was under no obligation to do that. so now the two republicans want to change their votes back.

in a sworn affidavit, monica palmer said i fully believe the wayne county vote should not be certified. the wayne county election had serious process flaws, which deserve investigation. that reversal also comes after president trump reportedly reached out to the pair tuesday night to thank them for their support. though, ms. palmer said that had no impact on their decision to try and reverse their vote. even now it is not clear if this attempt to try to change their votes will have any effect on this outcome given that wayne county has already submitted its certified results to the state. also important to note, the concerns that ms. palmer raises potentially amounts to a few hundred votes in a county joe biden won by more than 300,000. >> bill: garrett tinney, thank you from michigan. i want to bring in jonathan turley: i watched your twitter feed light up during that 90-minute press conference. that was something else. that's why we brought you on today. first of all, here is rudy giuliani one of the points that

he's trying to drive home. watch here. >> these cities are cities controlled by democrats which means they can get away with anything they want to do. it means they have certain degree of control over certainly control of the election board, completely. and they control law enforcement and, unfortunately, they have some friendly judges that will issue ridiculously irrational opinions just to come out in their favor. >> bill: so, on that point, he was suggesting that the pattern is same throughout these cities and states. how did you hear it? >> yeah, he was going beyond that. he was most of us thought he would be talking about athis one occasion machines for signatures. instead we got a global communist conspiracy that even featured the dead hugo chavez. it was quite a thing. only thing missing was a sinister figure petting a white cat. it was very heavy stuff. and the only good news is that this will have to end up in court because if think are not

going to present this nevada court as part of an election challenge, they will probably be forced to do so in defense of a defamation claim. because this company and its officers could well sue them if they can't prove these allegations. i mean, it was one. most amazing press conferences that i had seen. >> bill: what jenna ellis said is that this amounts to an opening statement and we have heard from you and ken starr and andy mccarthy and others saying it takes time to gather the evidence ised that the state of their case as of today. >> no, i'm very sympathetic that it does take time to get affidavits in evidence. on that part they were perfectly valid in saying that they are now moving towards court. but this is really not the time for opening statements. this is the time for hard evidence. and this press conference was long on heated rhetoric and short on hard evidence. i mean, i think they are going

to have to present this evidence quickly. these allegations are sweeping. they are disturbing. either way. if they are true or untrue they are disturbing. i am going to make the presumption that these attorneys can support these arguments because, if they cannot. they honestly could be subject to and the trump campaign could be subject to illegal action by the company. >> bill: how do you move a court at this point? >> well, you know, they raised some, you know, issues that we have read about before. these questions about overvoting. repeated submission of balloting. they have a lot of affidavits. people are making statements under the penalty of perjury. and their point is that most of the cases have been dismissed are not their cases and that they are now ready to roll. all right. but we are running out of runway. i mean, certifications will begin next week. and so i think that they have to realize time is of the essence.

and so if that was their opening statement, they better move to their closing statement pretty fast. >> bill: is the certification that becomes paramount now or is did when the electors are appointed on the 14th of december? because, if that's the case, this is going to run for a little bit here because it's three and a half weeks from now. >> it can run. but, i got to tell you that's my worst nightmare is to see a challenge occurring past the certification stage. it's one of the reasons i have been telling people that they shouldn't be fighting these challenges. that president-elect biden should have told his campaign to stand down. let these things be heard. let people hear the evidence. the worse scenario is that this bleeds past the certification and then you will have arguments that states like michigan or pennsylvania should not certify their votes. that would lead to a blood letting on the floor of congress. and we don't need that as a country.

i mean, this country is a powder keg. and we need to find ways to reduce that temperature. there is a couple of ways to do that. i mean, president trump should have called for the ascertainment of the election. i said two weeks ago it should have been ascertained so that president-elect biden can start in his transition. it doesn't bind anyone. it's not a certification. but he can do that and say i'm still going to challenge these results. and president-elect biden should -- >> bill: he was saying repeatedly in 2000, 20 years ago, you had 37 days between gore and bush. is that not valid. >> it is valid. when it comes to ascertaining the election, that's a responsible thing to do also responsible thing for president-elect biden to come forward and say look, these attacks on trump and republican lawyers are outrageous and i support looking at these allegations. i don't believe that they are true. but i understand that over 72 million people voted against

confusion over this decision by new york city to put an end to all in classroom instruction. as we mentioned new york is the largest school system in the entire country. hundreds of thousands of students take part in a combination of in person and online classes. as of now only remote learning. outside of city hall this morning parents delivered a petition with 12,000 signatures demanding that schools reopen. many are angry that the restaurants and bars have have not been forced to close also consider arbitrary the city's 3% infection rate used to complicates matters. the city and the state use different metrics prompting this exchange yesterday between the governor and a reporter who wanted some clarification about the shutdown policy. >> so confused. >> well then you are confused. >> i'm confused and parents are still confused as well. the schools. >> they are not confused. you are confused. >> no i think parents are very confused as well. >> read the law and you won't be confused.

the schools are open by state law. >> will they be open tomorrow? that's the question i think jimmy is correct in asking that question. i don't think it's obnoxious at all. >> well, i don't really care what you think. >> meanwhile, an increasing number of states are now imposing new restrictions statewide in kentucky starting on monday schools will halt all in person instruction. the earliest next month others include no more indoor dining. and in maryland starting tomorrow all bars and restaurants will close at 10:00 p.m. most hospital visits are suspended. and in kansas starting the day before thanksgiving, a mask mandate will be in place for all counties that do not have their own requirements in place. across the country as you mentioned the virus continues to rage, more than a quarter of a million americans have now died from the virus according to some of the experts now approximately 3% -- excuse me, 3 million americans are now currently infected with the virus. that would be about 1% of the

population. and lastly now, bill, new guidance from the cdc that say if you are planning to travel for thanksgiving, don't. bill? >> bill: david lee, thank you for that one. bring in dr. marc siegel to discuss all of this. doc, good afternoon to you. >> hi, bill. >> bill: 3% positivity rate in the public schools they close down. that 3% seems exceedingly low. i know they reached a deal a few months ago but what do you make of that. >> first of all, bill, 3% is low when you look at it this way. everyone who thinks they have covid out there if 100 get tested, 97 out of 100 are negative. that's still quite low. second there is no correlation between the number the percentage that test positive in the community and in schools. in fact, many major studies have shown, including one recently at brown university that, in fact, children students in schools do not spread this nearly as much as adults in the community do. so the real issue with schools is keeping schools safe, getting

enough testing. having enough protocols in place, masking and distancing. and that the teachers feel safe. but you know what, bill? the tremendous cost of keeping the schools closed has to be considered here. a lot of poorer students don't have the ability to do remote learning. they don't have the laptop. they don't have the ipad. and the socialization in schools is so important. and mental health screenings are important. and nutrition is important. and eye and dental care are important. across the board, when you close the schools like this, it is a tremendous public health cost. >> bill: i agree with you. another topic thanksgiving travel recommended by the cdc not to do it. i mean, there are millions of people who jump on the road for turkey day. what do you make of that? >> well, bill, i think that they know the cdc knows that they are not going to get across the board compliance here. 50 million americans are supposed to be traveling in the next few days. i think they are trying to send a message that traveling is a risky proposition if you are not tested before because, after all, if you were tested and you were negative and you got on a

plane, your chances are way, way less that you would spread covid-19. and planes themselves have been tested recently and have been found to be a lot safer than we thought they were. the other thing that cdc is saying, bill, is that all gatherings should occur with people in your immediate family. so you are not exposing yourself to someone, especially of a high risk group is involved an elderly person is involved. you are not exposing yourself to someone where you don't know who they were edges bodie exposed t. keeping yourself small makes a lot of sense. >> bill: vaccine follows on johnson and johnson if these two companies go forward you could have four major players on the scene perhaps in a month on the vaccine front; is that right? >> you are right, bill. as you know i'm very excited about the messenger rna vaccines we have been talking about already. 5% effectiveness. let me tell you what astrazeneca oxford vaccine brings to the table and johnson and johnson as well. they bring to the table a

>> bill: from michigan the governor there holding a news conference after three republican lawmakers introduced articles of impeachment against her. all this over covid they say the state's restrictions violate the constitution. we will monitor that to see if thee responds to it. meanwhile, let's go to mike tobin who is live in chicago on this and more. hey, mike. >> hey, bill. the initial response from michigan governor gretchen whit her to this resolution calling for her impeachment. impeachment and removal from office was dismissive. a spokesperson saying of the republicans who introduced this resolution governor whitmer doesn't have any time for partisan politics or people who don't wear masks, don't believe in science and don't have a plan to fight this virus. one of the authors of the resolution says governor whitmer is dismissing the separation of powers using executive orders during the pandemic to bypass the legislature. >> the problem is the governor hasn't had time for the michigan house of representatives, the senators or the 10 million people that are trying to live through this virus.

>> now whitmer has come under fire for the harsh and critics say arbitrary of the lockdowns in michigan. the resolution calling for impeachment says in addition to bypassing the legislature the banned the free exercise of religion. offered no big contracts to political allies and overall failed to manage the crisis. part of the resolution reads she has exceeded her constitutional authority. violated the constitutional rights of the people of michigan. issued orders that are not in the best interest of the people of the state and used the pandemic as an opportunity to reward political allies. it should be noted that the republican leadership in michigan is not backing the resolution. lee chatfield, speaker of the house our fox affiliate told the resolution is a distraction what needs to be done in the state. the republican senate majority leader mike shirky has not signed onto the resolution. bill? >> bill: thank you, mike tobin in chicago on that. after california's democratic governor was caught as a dinner party while telling his constituents to stay home.
