[♪] judge jeanine: hello and welcome to "justice." i'm judge jeanine pirro. we have a packed show ahead but first my open. for four years we listened to unsupported allegations of a conspiracy by a foreign government to interfere with our presidential elections. that russia stole the election of 016, implanting that their russian asset donald trump as president of the united states. for four year we were told trump was a russian asset, a putin puppet. and we must get rid of him to

save main today. almost on a daily basis the minstrels in congress put on their minstrel show as adam schiff pontificated about real evidence that he has seen with his own eyes. evidence that requires that donald trump be gone because america and democracy weren't safe. never ever, not once did we see a scintilla of evidence. never. were we supposed to take it all on faith? they put the president and the country through hell as the work of congress was halted and the media every day reminded us we were getting closer and closer to the big russian reveal of russian collusion that fizzles like bob mueller did when he showed up and testified. then they took another showdown to the sub basement of the capitol where they regaled each

other in their star chamber. in fact they never stopped. now just over two weeks, the president's lawyers come forward alleging an organized criminal enterprise, a conspiracy by democrats especially in cities controlled and corrupted by democrats. the president's lawyers alleging a company called dominion they say started in venezuela with cuban money and the assistance of smartr smartmatic software, a back door is capable of flipping votes. and the votes are actually counted in a foreign country. these are serious allegations. but the media has no interest in any of this. but you and i do. and as we should. because 73 million americans voted for donald trump.

republican seats in the house they said would be won by democrats in the blue wave. but it never came. they said the risk of our giving false hope should be enough to stop us two weeks later. i say the risk of not looking at what is staring us in the face is too great to not stop us. the president's lawyers offered evidence by way of affidavits which i told you last saturday as a judge from a legal perspective are sworn statements of individuals signed under penalty of perjury. meaning they know they face the penalty of prosecution and five years if they lie. these sworn statements are factual allegations and part of virtually he lawsuit. it's how you start the case. the president's lawyers

indicated they have 250 such affidavits. under oath, people ready to testify. people ready to face the hate that the left inflicted on all of us from day one. and you know what i'm talking about. let's not kid ourselves. there is not a lot of violence going on right out there now because they believe they got their way. forgive me but i believe the only important thing is that lady justice gets her way. consequences be damned. rudy giuliani made clear democracies were targeted by crooked democrats who stole votes. these are cities where they are comfortable with political corruption in pittsburgh, philadelphia, and detroit. he describes election night numbers going from the favor of donald trump, but by the next

morning a third increase in biden votes. curious the mail-in balance lots for biden with no down ticket vote. in atlanta, a sworn affidavit under penalty of perjury. perjury. the affiant said many of the boxes of ballots voted for 100% biden, zero trump. the ballots seemed to be perfectly pulled the out like they were preprinted with the presidential candidate selected. georgia uses dominion voting systems that has a history of voting systems. on november 4, biden received a batch of 134,886 votes at 6:30

in the morning. in wisconsin the day after the election. biden received a dump of 143,000 votes at 3:42 a.m. the upshot in the graph is stunning. it suggests there was a pause, then a filling in the needed votes to win. how do we know this? he knew it through affidavits, sworn statements where you can actually go to jail if you don't tell the truth. interesting, though, isn't it? adam schiff and the democrats can lie to us literally for years with no consequence to them. but american citizens who put themselves on the line and face the insane hatred and threats of others essentially get prosecuted and witnesses are putting themselves in the line of fire simply because they heard or saw something that was

incredibly dangerous to speak of but about which they chose to speak. two individuals and one dominion employee signed affidavits. but there is a hue and cry by the media to see the affidavits. many are already on file until lawsuits across the country. but many of these witnesses are seeking protection for their safety until the time it's necessary for them to testify. does anyone believe they were exaggerating when they say they are in fear? does anyone think the group that brought us hysteria, division and chaos for four years while donald trump was president and now is unusually calm, wouldn't react to a narrative difference than the one they are comfortable with now. i ask you, what is the problem seeking to confirm this election had no irregularities? why have we found thousands of ballots after the election was

called? why were observers not allowed to watch which was their legal right. and additionally to make sure everything was done correctly. as an aside on november 5, i tweeted there were complaints of voter fraud. where is the fbi and the doj? the tweet was removed. because some or all of the content was disputed and might be misleading. i then asked my girlfriend jackie to tweet the exact same thing. she did, and her tweet has not been removed. leading me to believe that it's got nothing to do with algorithms and the censorship going none this country is a censorship about individuals. censorship of people is in full play now. why was there an overnight

stopping of a vote tabulation that cannot be explained. are there enough trend lines to overturn an election an individual state? can a court throw out thousands of votes because of instances of fraud or overvoting? how can w we assess whether a provisional ballot can be counted if they show up to vote and is told he or she voted by mail. how do we handle that. the secretary of state in georgia who unilaterally changed the election law without appropriate legislative authority. clearly only the legislature can change the election rules. how is it that biden under performed hillary in every city except the four that.

>> the playbook for distribution, is on cdc.gov. they can gene print it off. i guess they want to us mail them a copy. about it there's to be seen. the cdc also hosts a web page with a summary of each of these jurisdictions plans as well. they worked closely with the trump administration on those plans. to make sure we can reach every zip code in america. we want to make sure every any noarmt community as access. cvs and walgreens, are participating in this program so every american who wants to get a vaccine will be able to get a vaccine. we'll start with our most vulnerable americans so we can reduce the risk associated with this virus. judge jeanine: when you say the most vulnerable population, will that be all over the country?

take the vaccine, i suspect. at some point is there a requirement or is it like the flu vaccine. if you want to take it you do, if you don't, you don't. >> the trump administration is no freedom. we want to equip people with as much information as possible. we are encouraging people to take it. we are sending our public health officials out to message. this process has not cut a single corner. the clinical trials have been some of the largest in history. there are niewsm ruls layers of independent scientific review that will certify any vaccine give to the public is safe and effective. so we are looking at probably 20 million americans in december. on a rolling basis, tens of millions of doses every single month. and we think every american will have a vaccine available next year in the march and april time

in georgia. and that lawsuit was for what? >> i filed a lawsuit on behalf of myself but it's actually i feel on behalf of the voters in the state of georgia who voted in person. in march of 2020 in a back room deal of which hardly anyone knew about, not even state legislators knew. the secretary of state of georgia signed a consent agreement with the democratic party represented by perkins coie where they changed the rules with respect to the absentee ballots. under federal law with respect to a federal election. that only change that can be made is by the state legislature. they did not have the legislature approve it. some legislators didn't ebb know

it existed until the last few days. so they violated the law and poisons the entire general election of november 3 in the state of georgia. it's unconstitutional and unlawful and they will have to figure out a way to have a new down ballot vote and the legislators will have to select the president of the united states. which i believe will be donald trump. e won this election by a record landslide. judge jeanine: a federal judge in atlanta rejected this lawsuit that this lawsuit is associated with. district judge a trump appointee said he did not find evidence of irregularities that affected more than a nominal number of votes. >> what the court initially ruled is he die mid the motion

we filed for temporary injunction to stop the certification of the vote for georgia officials today. turns out that while he spoke about the case in general, the lawsuit has not been dismissed. he took the position that with respect to the recount, i did not have legal standing. so we believe we are still in court. i just found that out. we filed the motion for emergency hearing because they are destroying ballots, we caught them in a truck going to thank red them. we asked for the evidence on preserved. we sent out letters to never the county demanding they preserve all evidence. they tried to steal this election judge now they are trying to destroy the evidence. judge jeanine: when you say they were trying to destroy the ballots. do you have evidence of that? >> i have video evidence i

posted on my twitter account. i have photographic evidence i posted on my twitter account. there is no question theyer at dekalb county elections office with a shredding truck. we have video evidence they were shredding documents and putting them in bins and trying to drive off. judge jeanine: it seems, lin, your argument is similar to the argument made in pennsylvania, but apparently with no positive ru9, and that is article one section 4 of the constitution doesn't allow anyone but the legislators to amended anything as it relates to election law. is that the issue you are taking up on appeal? >> if the judge follows through on his comments and dismisses that count of my complaint.

we'll file an emergency appeal in the 11th circuit. the law gives me standing as a voter to file the lawsuit. you are right, the supreme court authority that only the legislator can change the rules regarding a federal election. the secretary of state acted unlawfully. he has been caught. we just have to get this in front of the right court to uphold the law. whether this local judge does it is irrelevant. it will have to find its way to the circuit court and may very well have to be decided by the supreme court of the united states. judge jeanine: thank you very much for joining us this evening. ric grenell still ahead. but next, congressman doug collins is here with reaction to the outcome and what's next.

does it feel like you have been campaigning forever. >> it does, judge. it really does. i go from one campaign to working to help to get this president the vote he deserves. judge jeanine: i admire your stamina. but let's talk about -- i'm not going to talk about the recount. let's talk about the election in january. i believe it will be january 4. both loeffler and perdue had more votes and the democrats did. if one of those senators hang on then the republicans keep the senate, is that correct? >> that's correct. we do. judge jeanine: if americans are disappointed, at least in georgia, if they believe that the president did win as many people do, 73 million votes, a lot of votes, ballots coming in

without be down ballots checked and no blue wave as they said there was going to be, do you think that the republicans are going to say, you know what, it doesn't matter any more, they may not come out to vote. or are they incentivized now? >> i think they should be incentivized. if they believe in what donald trump is doing. they need to get back out. they don't want chuck schumer in the senate to dismantle what this president whose done to revive our economy and make our military stronger and have world leaders know america means what it says and puts america first. they have to get out and vote for david perdue and kelly loeffler. donald trump is a leader and he will do everything he can. we have to hold the line in the

senate. judge jeanine: i just had lin wood on the show. obviously he's one of the brittest legal minds in the -- the brightest legal mind in the country. his argument is the secretary of state didn't have the right to the have this deal where they changed the election law without getting the legislature involved. the runoff in january, those same rules will be in effect. is that correct? >> that is correct, judge. that is the concern i have. a secretary of state who has known for a while -- this has been too much. saying egg was fine in georgia. we found 10,000 ballots. 3,000 went to president trump that were never counted on election day. is it right we have different

standards and the secretary of state's office never gave clear guidance. then you get back to the con isn't decree and how we have handled these signatures. he claims one thing. and we know the truth in other ways. down from 3% two years ago to .03% this year. judge jeanine: have the elect results for the president been certified in georgia? >> they have. but there is a problem. the secretary of state seems to heard about the election in the original form. this is something we are looking at. this is -- there will and statutory recount two days after the certification. but this is the problem we are dealing with down here. it's inconsistency.

administration is over or whether president trump has a second administration, don't you think it's time that we completely declassify all of that information that was classified in the run-up to the 2016 election so the american people can finally knower respective of whether anyone is prosecuting anyone, what went on in the run-up by the bind and obama administration? >> thanks for having me, judge. i would say not only is it important that we have that transparency for how this russian collusion investigation happened throughout the trump administration. but i think we fundamentally have done something didn't for washington. the people want to see transparency. this is a foreign concept to many people in washington, d.c. the politicians, the bureaucrats, even the reporters

are not really accustomed to having people just share the information when they have the power to share the information. and i actually believe that what's happened over the last year with declassify kaig and transparency is something you won't be able to put back into the bought. people will demand it going forward, no matter who is president. he single time we have politicians trying to spoon feed information to the american public saying i can't tell you about all this information but you have got to trust me. that trust has he voted. people will demand to see the evidence and facts. judge jeanine: let's see it. it's 2020. there may or may not be a new president in 2021. why isn't everything declassified now? >> when i was there i demanded

we declassify everything that wasn't a source or method. we have a problem in the intelligence community where they overclassify. the reality is that they are overclassifying information. judge jeanine: who can are override their overclassification? >> the director of national intelligence and the president can do that. judge jeanine: that's radcliffe. >> i think the people will demand it. they saw the information come forward and it was nothing like what the politicians were saying. this will impact decisions in the future. we need to demand the director of national intelligence for all of the future, the future dni, and future presidents of either party will be about transparency. transparency is not political.

judge jeanine: let's transition from unmasking to a real unmasking in california with mr. gavin newsom the governor of california who thinks he's above the law and the law doesn't apply to him. we have got hundreds of thousands of people in california, millions i suspect who are being told you can't travel, you can't have more than 10 people at your house for thanksgiving. yet he's violating that. nancy pelosi in california. maskless in a salon that isn't supposed to be open. yet salon workers who try to go to work with a mask on are arrested. >> we have a problem in california with politicians to do one thing and say another. it's nothing new but it just came to light to the rest of the country. gavin newsom is the biggest

federalist editor, holly hemingway. you penned a piece in the federalist about the democrats reaping the fruits of their four year anti-trump conspiracy theories. >> it's been so interesting the last few weeks to hear people saying going to a court of law and litigating election results undermines democracy. this is absurd in multiple ways. it's important that people have confidence in the result of an election. but we have just lived through four years of undermining the legitimacy of the 2016 election. this is something that has been broad, it's been done throughout the media and the democratic party. and we have been told that he's not the legitimate president and

he excluded with russia. but going to courts of law to litigate election results is horrific. it's offensive to the people who were harmed by the four years of russia conspiracy theories. judge jeanine: the numbers that have come in. the president was i think elected with 9 million more votes or 10 million more votes than last time. and he had the highest number of non-white voters in decades. which is kind of interesting. and it kind of suggests that maybe what the president's lawyers are talking about might be the case. but the silence on the part of even some of the republican party to maybe let's just move along. everybody is quite on the street. let's just let this go. what do you think of that?

the mob is at peace and we'll have peace at last. what do you think of that? >> there is a divide in the republican party about whether you should accept being treated like second class citizens or not. president trump has a massive amount of support. 70 million voters. 10 million more than the last timee ran. he has this idea that conservatives should not be treated like second class citizens. election fraud is something that happens in this country. republicans tend to let it go. you have the example of richard nixon. there were credible allegations regarding the missouri governor's race. there were questions about al frankin and whether he won his senate seat. but after a while, republicans

say maybe this shouldn't be allowed to continue particularly in a year where you change from traditional style of voting to massive mail-in ballots where you lower the scrutiny of those mail-in ballots. you had many changes nationwide in terms of opening up massive avenues for mail-in ballots at the same time scrutiny was decreased. you would think everyone would tear about having confidence in this election. when people say they have seen problems under penalty of perjury, you would think we would take that to its natural conclusion so no matter who is deemed president, in the electoral college, they can feel confident in the decision. >> they think we should be
