the bishop of brooklyn praised the ruling saying, i'm gratified be the decision by the united states supreme court who have recognized the clear first amendment violation and urgent need for relief. i'm proud to be leading the diocese of brooklyn and fighting for our sacred and constitutional right to worship. >> let's go to the justice department. david is live with more. >> happy thanksgiving. this ruling came down before midnight and the implications will last for decades long after covid-19's in the history books. it's a win for religious freedom and amy barrett, a month already feeling her fate on a career that could span for decades. she was the key swing vote here, a 5-vote in favor of the conservatives. john roberts known to be a devout catholic sided with the liberal wing of the court on this decision.

the majority, the conservatives decided that this was something that needed to be done so this is how they ruled. andrew cuomo announced various restrictions on gatherings as a way to hold the pandemic or stop the further spread. he insists in the name of health and safety is why he did this and he reacted to the high court ruling this morning by telephone. >> it's the relevance from any practical impact because the zone that they were talking about has already been moved. it expired last week. i think this was really an opportunity for the court to express its philosophy. >> they contended that it violated freedom of religion. he talked about zones and changing, changing for religious institutions, different color

zones to change the amount of people allowed to gather. >> the governor is dealing with a situation and he said look, given the facts am going to make this change, the color scheme, but what the supreme court said is, not so fast. just because you move the categories today doesn't mean you won't change it up again tomorrow. >> civil liberties union releasing a statement, the freedom to worship is one of our most cherished fundamental rights, but it does not include a license to harm others or endanger public health. this is a complete 180 from supreme court decisions from just about five months ago when justice ruth bader ginsburg, she passed away in september. at that point they ruled that governors in nevada and california are the ones that can make the decisions on those restrictions, but now just as barrett is o on the supreme cou, already a change.

attention, small business saturday is just as important for many americans. he coronavirus pandemic has devastated main streets across america. let's bring in gene marks, always loaded with lots of advice. i want to start with small business saturdays. do you have any advice, especially the ones, they don't have a team, how can they spread the word about their business beyond their customer base? >> good to see you. if you're running a small business now, you've got to be innovative this year to continue to take advantage of small business saturday. you have to do more online. online sales this year are more than 35% and a a lot of that is because small businesses have pivoted from selling from their story. they're all offering discounts to their customers as well,

extending their store hours, allowing people to order from the website and pick it up. they are doing everything possible to make sure they're providing a safe and healthy alternative so customers can feel comfortable. one final thing, you can extend the discount, all those things from the holiday season. that is a smart thing business owners do. >> the best thing we can do to help our businesses during these challenging times of course is to purchase their goods and services, but should we order early? be patient. we can't expect them to have big time operations. if you want to order five gifts from this one small business online, how else can we help them? >> i also want to say, if you have the opportunity to order

out more, take advantage. i am talking to you from philadelphia and our restaurants are shut down. no more indoor dining. we need the help. another thing to consider with people you frequent. a lot of them offer gift cards. even if they're not buying something right now, they get the cash up front. of course you get the gift card, use it another time. those are, just two things you can do to support your small businesses. very important thing to do. >> really great advice and also if you're going to order from your local restaurant, make sure you tip. those people are working really hard to be there for you. >> i forgot to mention that. the biggest people that are hurt is not just the business owners during this pandemic, it's the workers and you know that. a lot of the workers, they're struggling through all of us.

your 100% right. when you're going to buy something, add on native. it might not be a big deal to you, but it such a big difference to someone who is making $10 an hour. try to do that. >> millions of americans are still unemployed. you have people trying to find ways to make money. what is your advice where people who are looking to start a business? a new revenue stream? >> that's interesting. the u.s. census bureau released data, 1.6 million new start-ups this last quarter and 86% increase over the same time last year. the start of this year, up almost 30%. a lot of people are thinking about starting businesses. they're doing it because they have to. people are working from home more and they have a few extra minutes where they can focus on

starting something else. if you have an idea to start up, go to amazon or at sea, ebay. not as difficult to do as you think, it takes effort but if you think you can do it, i think you should. people have some extra savings from not spending a lot of mon money. if you have savings, now's a good time to invest. it doesn't have to replace your day job. it could be a side gig or something else you could do. people are doing it. you should take that as consideration. and not the only one starting up a new business. it's a good time. >> we heard you. it's always a pleasure. happy thanksgiving. >> happy thanksgiving. >> of course this holiday is about giving thanks to those around us and those who can't be close because they're serving to

keep us safe. let's pause and appreciate to recognize the men and women serving our country across the globe. president trump is trying to bring hundreds of thousands of them home, but many remain overseas this thanksgiving. jennifer griffin is live from the pentagon with more on that. >> on any given day you can find 300,000 u.s. troops deployed overseas. acting defense secretary chris miller, a former green beret blue overseas and had thanksgiving dinner, home to the u.s. navy fleet. the u.s. is reducing its presence in afghanistan by half, but 2500 will remain after january 15th. done from a high since 9/11 of 100,000 u.s. troops. the u.s. has 800 military bases and more than 70 countries, britain, france and russia by contrast have 30 combined. a growing sense of drone bases

in places like djibouti and the horn of africa, and in ram stein germany. 60,000 american troops served at bases in the middle east. 1,000 at nato headquarters, thousand troops in cuba to guard 40 prisoners at one home and obey. 40,000 currently serve in germany, down from a high from the cold war. more than 50,000 troops are based in japan along with 28,500 and south korea. the outgoing top republican on the house armed service committee explains what would happen if the u.s. close those bases and returned home. >> it's been the best 70 years, pretty much, you could argue in human existence. it's partly because the united states of america has been engaged in the world. if we step back others fill the void. they will not share our values. the world will suffer.

churches, synagogues filed the motions, emergency motions with the supreme court to try and overturn those bands as well. there's going to be more on the subject in the next few days. >> quickly, does this mean they can pack them in now to churches and synagogues? >> i don't think necessarily. they need to be careful. in the case of where you have, new york, he said, you can only have ten people in the synagogue or church, that didn't seem to make sense to me. they need to make common sense, just like he said for example, he issued a blistering opinion, just really giving it back to him saying. >> we have to leave it there. >> you can't go to church. >> we appreciate your insight.

13 million cases and so far more than 262,000 americans have been killed by covid-19. health experts fear thanksgiving gatherings may cause a surge, but despite the warnings they report it screened more than 1 million people just yesterday. most flyers in one day since march. new york city physician and fox news contributor. do you have any concerns about gatherings today or travel this weekend? >> happy thanksgiving to you and everyone watching. even though it is thanksgiving, we are in the midst of a pandemic, so were never short on news. there is more people traveling then any time during the pandemic, but we have to remember it's less than half then normal years, so i think the majority are staying home, there are limiting their gatherings, but families have

been able to make decisions that's best for them. it's watchful waiting, there is a lag, so in 2-3 weeks we will know how say people were over thanksgiving and i only can hope they have limited the amount of indoor congregating with different households because i would hate to see a further increase before thanksgiving. over 90,000 americans hospitalized. that is far more than we had in the early spring where we didn't even reach 60,000. there are certain regions that are struggling right now with the pandemic. it's important for us to stay as close to home as possible and try to limit that travel. >> absolutely. and you know very well the cdc is expected to shorten the quarantine time from the current 14 days, possibly 27. do you think this is a good idea?

>> they alluded to this earlier this week and i think they should have been doing this earlier. the 14 day recommendation where someone had a positive contact, that i came back at the time we are testing was not readily available. unfortunately a lot of people cannot take 14 days off. if you want people to be open, honest and transparent, we need to do what we can to make sure they're not having to do quarantine if they're not infected. the big problem is 47% of people who are infected and contagious will be asymptomatic. we need to discern between the a nomadic people and people who aren't infected at all and who are having to quarantine and stay home when they didn't need to. lessening it to 7-10 days is a good idea, but it has to be paired with a negative test. for me to feel comfortable any people out again

>> i want to move on because everyone is very on edge about this. astrazeneca announced its vaccine a couple of days ago touting 95% of effectiveness, however when half of their volunteers were given half doses of the vaccine, that went down to 62%. they say the half dose regiment was the result of a manufacturing error. does this concern you? should this cause concern for americans? >> i'm going to change those numbers. first of all, astrazeneca came out with their numbers saying that there were two arms in this trial and it was an error. people were supposed to get two injections, but 2,000 people only received half a dose of the vaccine and then a full dose

later on. interestingly, this error, those 2,000 people were the ones who showed a 90% efficacy against covid-19. the people who receive the full dose, that was much lower, 62%. scientists and researchers were scratching their head, the half dose provided a higher efficacy? they had to really go back, they have to look at this and now they're saying, i think were going to have to start a new trial to figure out if it wasn't a fluke, it's the half dose followed by the full dose that provides better efficacy. astrazeneca is working on their data. all eyes are on madrona and pfizer because they're likely going to have that approval by the end of 2020 and 20 millin americans will be vaccinated with the technology. there is a light at the end of the tunnel.

as i say and not as i do. including gavin newsom here in california who had dinner, a now infamous meal. others getting their hair done. what message is that something? >> it sounds all the wrong messages. the elites get away with it and everyone else has to hunker down and do nothing. the sad part of it is it undermines confidence and trust in the system. when we do have to make hard asks of our citizens, there is no trust in the government. if there is no trust in our leaders, it will hurt us more. some of those same elites have really tried to neighbor against neighbor. taking pictures if you see your neighbors having too many people or thanksgiving dinner. what we really need is the country, we need neighbors helping neighbors. that is what gives us strength. that is the way we will beat the virus and move forward in a positive way.

>> do you sense a shift in obedience and the willingness of people of americans to keep going along with the rules? >> i do think people are weary. the country is tired and exhausted and that comes from the extremes on the far left and the far right that have tried to turn everything into a political issue. someone rather have a wedge issue. i have confidence in the american people. i may be pessimistic about what you described, but i've never been more bullish on the country because they know how to rally together. we have a mayor here in salt lake city who said, we can do social distance, but let's not lose social grace. that is what we need. we can help each other. we can congregate in ways that are responsible. we can make sure we take care of the most vulnerable, but we will

never get there by pounding the wedges in deeper. we have to build bridges. >> "the wall street journal" had a fascinating editorial today about the subject of hypocrisy. here's a quote. people in blue states, as well as the states that made donald trump a one-term president have been standing in line or three or four hours before traveling. these people are perfectly aware that infection rates are rising and to the prevention cautions against celebrating the holiday with people outside your household. the decisions to buck public health warnings, trust their common sense and spend thanksgiving with loved ones is a welcomed indication that people may be tiring of this condescension. >> that's a very accurate description for a lot of people that i know. the interesting thing is, people have the right intentions and we

can to get there. we can be responsible and we can have that grace and we can make sure we are doing the things that will help us get through. the one thing we know about this virus is that it is novel, it has not played out the way anything else has. we will have to make adjustments. it is why leaders have to lead. so many of these leaders are happy when things are going well and they have good press and no one's challenging their decision. the real test, what do you do when it's tough? we elect people to lead when times are hard, not when things are going well. that is what we have to expect out of every leader, at every level regardless of persuasion. we have to expect more out of our lever leaders. the more weary the nation

according to the nfl network, a strength and conditioning coach did not report symptoms and didn't wear a mask or a tracking device. as for the steelers, this is the second time their schedule has been impacted, and outbreak in the tennessee titans organization forced them to reschedule their game against the steelers. some of them took to twitter with their frustration. wide receiver juju smith-schuster said "first they take away our week because another team can get their situation together and now they take away our thanksgiving prime time game for the same reason." wide receiver tweeted, "what a joke." even though this game has been rescheduled to sunday, the nfl is still doing more testing and contact tracing, so another ravens player could possibly test positive for covid-19 and that could impact the schedule, hopefully that doesn't happen, but we will have to wait and s
