legal team is continuing to fight and in an exclusive interview with our own maria bartiromo. >> well, i'm going to use 125% of my energy. i've got the best supreme court advocates, lawyers, that want to argue the case if it gets there. but they said it's very hard to get a case up there. we have tremendous proof. we have hundreds and hundreds of affidavits. carley: meanwhile, the former director of the cyber security and infrastructure security agency, chris kreb, sounding off on how this was a fair election. >> the proof is in the ballots. the recounts are consistent with the initial count. to me, that's further evidence, that's confirmation that the systems used in the 2020 election performed as expected and the american people should have 100% confidence in their

vote. carley: president trump weighing in on twitter, saying that 60 minutes, quote, never asked us for comment about their ridiculous, one-sided story on election security which is an international joke, adding the 2020 election was, quote, probably our least secure ever. griff: today, president trump's legal team is set to hold a meeting in phoenix with legislator as they continue to fight 2020 election lawsuits. in maricopa county no election of fraud was put forward. this comes as the secretary of state could certify president-elect joe biden winning arizona as soon as this morning. meanwhile, a partial recount paid for by the president's legal team confirms biden as the winner in wisconsin. the state is set to certify their results tomorrow. carley: fox news contributor sarah carter says president trump should continue the fight because at the end of the day, he'll do the right thing.

approval. that first batch of vaccines landed in chicago on a united flight from germany over the weekend. meanwhile, the nation's largest school district is reopening. new york city mayor bill de blasio changing course, just weeks after shutting schools down. listen to this. >> a lot of parents, we've heard your voices loud and clear. you wanted schools back open. we're going to ask everyone to be a part of that, everyone to participate, to make it work. >> reporter: so preschool and elementary schools will be the first to reopen, followed by district 75 schools. students and parents must sign testing consent forms and 20% of students and staff will be randomly tested each week. and guys, despite positive test results, dr. fauci says it will be months before school age kids get the green light for vaccinations. the cdc is set to discuss regulations and distribution on tuesday. carley: a major reversal on the school front in new york city, ashley. thank you so much. griff: thanks, ashley. fox news contributor dr.

killed. the sun times reports a 14-year-old boy is among the injured. he is set to be in -- said to be in fair condition. police data shows 53% increase in shootings and killings compared to this time last year. griff: today, the iowa state canvassing board is expected to certify republican house victory, beating rita hart by six votes after a recount, dealing another blow to the democrat led house. the party flipped eight house seats this year. this morning, she will join "fox & friends" to discuss what's next. that interview, you don't want to miss it, 8:15 east coast time. the march for trump bus tour kicking off in florida. ♪ griff: the two week tour is set

>> i am going to make a commitment on the first 100 days, i will send an immigration bill to the united states senate with a pathway to citizenship for over 11 million undocumented people in america. griff: president-elect joe biden previewin previewing justs massive immigration overhauls, promising to reverse president trump's immigration policies as soon as he's in office. carley: retired i.c.e. director tom homan joins us with more on what buy done's border reset could -- biden's border reset could look like. good morning. >> good morning. carley: joe biden wants to basically undo just about everything that president trump has done when it comes to immigration and through executive orders he wants to undo the president's travel ban, bolster daca, pause deportations for the first 100 days and stop border wall construction. you have advice for biden. you say he should speak to a

border agent before going through with his immigration plan, right? >> absolutely. do what president trump did. what president trump did works. if you look at the data right now, illegal immigration is down about 80%. that's unprecedented by any president. so you think joe biden will come into office, okay, look, the border's more secure now than it's ever been, illegal immigration is down a tremendous am. what did he do and why did he do it? you mentioned the travel ban. ask, why was the travel ban put in place. it wasn't because of race, religion, ethnicity. it was put in place because u.s. intelligence showed the countries weren't doing proper vetting for people they gave passports to. they weren't sharing information with us on criminals and terrorism. the united states said until you get your act together, we're not going to allow you to issue you the visas and come to the united states. he needs to look at the data. he wants to stop the border wall. every place they built the border wall resulted in decreased illegal immigration,

decreased drug flow, it saves lives and helps the border patrol. he voted for the secure fence act in 2006. talk to the experts. look at why the decisions were made and build upon them and you can be the president with a secure border. griff: tom, he's not talking to the experts, he's bringing in the obama team, alejandro mayorkas will head the dhs, he was the number two guy there, instrumental in daca. he's going to bolster daca. i want to talk about stopping the border construction and also the pause, 100 day pause in deportations. the fact agents tell me that while it's not at the record levels it was in the recent past, the apprehensions are up so. what do these four things we've just pointed out, what does this mean for the progress made? how quickly do things go back to the way they were? >> we lose all the progress. when he talked about the things he's promised, stopping

construction on the border wall, put a mor moratorium on deportations, limit i.c.e. detention, give free healthcare. it's going to cause a surge at the border you've never seen before. when you make these type of promises, you won't be detained, you won't be deported, you can work, and on top of all that, we'll give you free healthcare. what does he think will happen to the border? when he was the vice president back in '14 and '15 we had a family surge and what did the obama/biden administration do? they gave i.c.e. -- a lot of money to build thousands of more detention beds. they built family detention centers. they built children facilities that they called the cages and it worked. what he did back then worked for those two years. he can't forget what they've done. he can't keep folding to the progressive left. we will lose the border if he keeps promises he made during

telex. carley: yeah. you know, joe biden has said he wants to sell a bill to the senate for a pathway to citizenship for 11 million undocumented immigrants in america. now, if the senate stays in republican control there's no way that that's going to pass but that also sort of proves where joe biden stands on this issue as well. >> look, this country is proving if you stay here long enough, illegally, we're going to give you something. the worst thing he could have said on top of everything else he said is talking about amnesty. in 1986 when there was amnesty, it brought a surge to the border, people want todd be part of the amnesty and in '12 when they talked about daca, what happened the next two years. hundreds of thousands of mothers brought their children across the border, they wanted to be part of the daca. now he's talking about amnesty. on top of everything else he promised, we're going to lose the border many that's going to bring unprecedented amounts of people across the border to be a part of that give-away program,

york and new jersey did not escape the economic beatdown. griff: cheryl casone from our sister network, fox business, joins us live to break down the numbers, cheryl, good morning to you. cheryl: good morning, guys. not great numbers here. as of november 16th, nearly one-third of small businesses have shut down for good. according to track the recovery, dot org, 27.8% of small businesses in new york have closed their doors permanently. 31.2% of businesses are gone permanently in new jersey. this as governor phil murphy says another statewide shutdown is still on the table. >> i'm not sure i'd say possible, but it has to stay on the table. i don't anticipate it and i sure as heck don't want to go that route. god willing, we won't have to. cheryl: well an official from the national retail federation of independent businesses telling fox business that without federal dollars coming to newer gentleme jersey in pars

won't make it through winter. carley: there is one bar in staten island that is fighting back, they declared an autonomous zone, saying they're not going to comply with their coronavirus restrictions, right? cheryl: it's the staten island pub, again, autonomous zone. the owners of mack's public house kept the doors open despite the orders to shut down. they joined us last hour. >> we just can't -- we can't close again. there's no other option. >> and why is everybody allowed to cram themselves into a target or best buy but my establishment all of a sudden seems to be the only place that somebody is able to contact coronavirus? cheryl: the pub this an orange zone which prohibits indoor dining in bars and restaurants. we'll see if the sheriff comes after them. that's happened in other cases in new york. griff: cheryl, we've got to round it off on this and that is, is there anything the rock cacan't do or sell? the hollywood superstar, we expect him to be in children's

ride here. griff: the supreme court says new jersey officials must respond this week to a lawsuit over restrictions on religious gatherings after governor phil murphy cracked down even harder with his most recent pandemic orders. joining me now to react, fox news contributor jonathan morris. good morning, jonathan. thanks for getting up on an early monday morning. we saw the last supreme court battle with respect to religious gatherings in new york, now this one in new jersey. what are your thoughts? >> yeah, i think at some point the governors are going to have to stop wasting people's money, our money, and bringing these i think really outrageous and irrational and unscientific restrictions to church gatherings. absolutely governors have the right to keep us from imminent danger, right, when there's a new pandemic of this sort. but we know more about the virus

now than we did eight months ago, much more. and to say that 10 people can come into a huge church like the one we're seeing on the screen right now is just unscientific. we can go into liquor stores, no problem. we can go into grocery stores and rubble bows with people, no -- rub elbows with people, no problem. because they say it's necessary. to say only 10 people can come into a church is really saying close down your church. imagine that, 1,000 person congregation, coming into this church and the pastors there saying you 10 people can come in. it's impractical and unscientific. griff: you mentioned the bars versus the houses of worship and we saw in the new york case, justice gorsuch saying this isn't fair. it's a double standard to apply it and in the case of saint patrick's cathedral and the churches you're seeing there, they hold 2, 3,000 people and you're going to limit it to 10. doesn't seem fair. do you see this being a trend that's going to go in the favor

of religious freedom? >> oh, yeah. the trend has already begun, griff, no doubt. and it's because they're just looking at the facts. the supreme court is saying show me scientific evidence that says more than 10 people in a church that can seat 500 or 1,000 is somehow going to put people into very serious danger. and the states are just not able to prove it. now, people know so much more about this virus. we can make decisions ourselves. and the church has been so good, even putting more restrictions on the congregation than the state required before. but to go from 50% down to 10 of people is just a very bad decision by the governor. and the churches here are not asking for special accommodation. they're just saying let us be treated like any other group of people. 10 people in a massive space, that's not social distancing. that's closing the church down.

griff: and jonathan, the new jersey officials have until thursday afternoon, evening to respond. but really if you could just weigh in, what is the mental aspect of this? i mean, you could make the case that this mental strain to have a bar, restaurant close but this is a house of worship we're talking about. >> that's exactly right. we think of -- we just saw the news over the weekend that more people died of suicide in japan than from covid-19. okay. we're in a different situation of course here in the united states. major numbers of deaths because of coul covid. but to say to people you cannot come and worship god, even though you can socially distance, you cannot come to worship god, even though you're wearing a mask. why is it you're taking something like religion and saying you are special, you are dangerous, you are dangerous to the people, people are saying, governors, you do not have absolute control just because there's an emergency and

carley: good monday morning. today, president-elect joe biden is set to receive his first intelligence briefing as his campaign announces he will have an all female senior communications team. picks include kate bettingfield as communications director, jen socky as press secretary, senior advisor simone sanders as chief spokeswoman to vice president-elect kamala harris and senior campaign advisor jean jean pierre as press secretary. many picks have been analysts in the media. dr. tim growthclose says president trump worked so hard to expose the media's left-leaning bias, he made it a

mainstream sticking point. >> trump helped exes pos ex e. it used to be the mainstream media would say we're balanced. after trump they would say of course we're not balanced, we have to oppose trump. that's what we should do, that's the proper and moral thing to do. at least now they admit it. carley: in the months leading up to the election, the media research center found evening newscasts' coverage of president trump to be more than 92% negative compared to biden's 34%. griff: vice president-elect kamala harris is getting slammed for a tweet urging people to help small businesses. harris posting, quote, small businesses especially black and minority owned businesses urgently need relief to survive the effects of coronavirus this winter. joe biden and i are committed to helping these businesses during this pandemic and get them the support they need to thrive in years to come.

let's talk about what are your plans when you get here to the nation's capital? >> plans are simple, it's never really changed, it's about supporting the constitution. it's about making sure that we actually have bills, policies, laws that make sense for all of americans. it's about making sure our businesses have freedom to operate, that our families have the freedom to choose what they're going to do in their lives around that people in this capital aren't smart enough to make those decisions for them. carley: tell us about the freedom force that you and other newly elected members of congress have formed and your plans to take on the progressive squad. >> well, listen, it's a great plan. what we've seen is that the left has people who are out there every single day, pushing this narrative that america is some worse off country that we need heavy hand from government that you have to have these ultra progressive left wing policies. if you look at the elections in 2020, what's clear is that americans want to be left alone, they want smart policies, want to follow the constitution, they want individual liberty, they

want freedom. so whether it's myself, virginia, nicole, stephanie, whoever, we're here to say we're going to stand against that, we're going to support the constitution, we're going to support free markets, we're going to support individual liberty and we're going to take that message to all voters across america. griff: let me ask you, because you saw so many americans flip seats. we just had another one in iowa, just by six votes. do you believe this is a rejection of the policies of the progressive left? >> absolutely. without question. listen, i'm a political convert. i got into poll of ticks 12 years ago -- politics 12 years a ago because i saw the bailouts in 2008 and i wanted no part of them. what you're seeing, americans, whether white, black, hispanic, red states or blue states, they're rejecting those policies. the green new deal is a disaster. parents want school of choice and parental empowerment for their children. americans want to have opportunities to succeed. they don't want people in

his legal team is turning forward in terms of the courts with evidence they say they have hundreds of affidavits of people who have sworn testimony that they have seen the way the dominion systems work, that they can switch votes. [lost audio] the next couple of weeks will be critical to see what kind of evidence the legal team brings forth. the president was yesterday and dug n terms of what he saw. [fading audio] carley: the president wants his case to go to the supreme court but he did talk to about how that may be difficult and might not happen. you follow the legal workings of you who all of this works. do you foresee any of this making its way to the supreme court? >> i do. in fact, right now, you have a case that is going to the supreme court, having to do with pennsylvania. remember, supreme court justice alito made a ruling that one of

the counties in pennsylvania have to separate the ballots that came in after 8:00 p.m. on election night. at that point the county organizers blew that off, did not separate them. that's already in front of the supreme court. so the pennsylvania situation is going to be dealt with. i suspect we're going to hear some kind of a ruling this week because i know that the legal team of president trump is going to be appealing an appeals judge ruling on friday about those ballots. so you are going to hear more about this in front of the supreme court this week the trump legal team seems to believe they are going to have a victory once the supreme court rules just on the law in terms of the ballots and whether or not they are valid if they came in after 8:00 p.m. on election night. that's one case. the other cases, you are right. it's a short timeline. we will see if anything else gets to the supreme court. the president talked about that yesterday. griff: maria, just quickly before we run out of time you

also talked to the president about what's at stake in georgia. >> absolutely. because right now, we are hearing from stacey abrams who says she has got up to 900,000 ballots already -- mail-in ballots. people are saying how did you get some ballots and the race is not until january 5th. he is worried that weekend see fraud in georgia. a lot of things happening in georgia. you had one judge basically say stop touching the machines. a ruling. and then he retracted that last night. we're going to hear a lot about georgia coming up. this is all very fluid. the president's legal team is fighting on every point. and we are going to see news happen in the next two weeks. it's critical that they do put forth evidence of this fraud in the coming two weeks just for the public to understand what they are fighting for. so i think these next two weeks are going to bring a lot of information in that regard. carley: congratulations on the interview. >> thank you. carley: we have to let did you go because your show starts in two minutes. thanks for hopping on.
