i'm trace gallagher. rudy giuliani presented surveillance video that he and others claim show workers illegally counting ballots without supervisors present. as the legal battle rages on president trump says the evidence shows there was widespread voter fraud. >> whether you go to wisconsin where we just filed a case, or michigan, or if you look at what's happening in georgia as an example or pennsylvania, if you look at nevada, which is moving along very rapidly, or arizona. you saw those numbers come out yesterday. we found massive fraud and in other states also. this is probably the most fraudulent election that anyone has ever seen. >> trace: let's get to griff jenkins live in atlanta. good morning to you. this video is causing quite a stir. >> it sure is, trace. good morning. the president's legal team bringing their fight to the state capitol in atlanta asking the legislature to overturn the

election results producing witnesses alleging widespread voter fraud and this video which they allege is new evidence of surveillance cameras capturing election workers illegally counting ballots with no supervisors present affecting 24,000 ballots. a senior source in georgia's secretary of state office tells fox news they have investigated the video and these claims, found no wrongdoing and had a designated observer in there the entire time. which has been the case since this past june. the state's election chief tweeted this saying the 90 second video of election workers in state farm arena purchase porting to show fraud was watched by secretary of state investigators and shows normal ballot processing. president trump criticized brian kemp calling him hapless tweeted this. people in georgia got caught

cold bringing in massive numbers of ballots and putting them in voting machines. great job, governor kemp. the governor had this to say. >> the president, as i said many times, is a fighter. you know, we've had a few battles but nobody worked harder for donald trump before november 3 and i've continued to support his efforts in the campaigns any way i legally could post the election and i will continue to do that. one of those was supporting the legal process to play out. >> it is not just here. out west in nevada the trump campaign filing a new lawsuit yesterday before judge alleging that they have evidence of dead people voting and thousands of double votes. the judge in that case says he will attempt to reach a decision and ruling at some point today. but here where i am it will be very busy in the peach state with vice president pence coming down in a matter of hours to rally for senators perdue and loeffler and visit cdc and on saturday you have

i find it very interesting what they unearthed in georgia. they produced a video and it looks like the officials have looked into it and there is an explanation. i think we should proceed. let them make their claims. this is the proper way to make a claim. let them be investigated and let's come to a resolution. >> sandra: bill, i want to play the sound of a georgia voter last night recounting this fake absentee ballot story. listen to this. >> so i went to vote in person on october 23 for early voting. i was told that there was an absentee ballot already out for me. but this was, of course, not true. i never requested an absentee ballot. i always vote in person. they found out that someone requested and submitted in the same day an absentee ballot in my name. and this was also really strange because you can't do that.

>> sandra: she never even requested one, she says. that was her story. she shared her account. now we're left wondering what the impact of all of this could be on these georgia runoff elections, bill. >> yeah, the runoff is the big case now. as far as that woman is concerned, i totally believe what she is saying. in my house i have two daughters, one -- i live in new jersey, my older daughter lives in virginia, the other one in texas. we got absentee ballots for them here. there would have been nothing to stop me or my wife from filling out the ballots, sending it in even though they voted in the other states. as the "wall street journal" pointed out many times the mail-in ballots create a lot of opportunities for mischief and acrimony. we're on to the senate races and we have an editorial this morning confirming that no one has a bigger interest than donald trump in seeing the two

republicans, kelly loeffler and david perdue, win their seats because the first thing the democrats want to do is undo everything donald trump did. so his legacy is at stake. right now the democrats have the house and they have the white house. for their legislative agenda and these broad big spending things there is nothing to stop them except for republican senate. so that's why people are rightly saying this race is like a second presidential election because it is going to determine the scope of the biden administration. how free they are to just run the table. >> sandra: really laying out what is at stake there. dig in deeper to this story as that women shared her account on hannity last night. here is sean talking about that surveillance video that would show some of those observers were asked to walk away from the vote counting. here is sean last night. >> what you are looking at, the

video showing observers being asked to leave the vote counting location. that shouldn't happen as a matter of law. look at the right-hand corner of this video. it shows certain poll workers just hanging out staying behind. now look at the spot shadow on that video. look at it right there. the same workers who stayed behind are now wheeling out suitcases that were under that rectangular table there. so the obvious question is well, why were the suitcases hidden under the table. if there were ballots why did they kick people out of the room? >> sandra: what did you take away from that? >> well look, i think sean is right in the sense that it raises real concerns. even brian kemp, the governor, said it raises concerns and should be investigated. now i believe the georgia officials say they have investigated and they didn't find anything untoward. let's hear their explanation for it.

"new york post" front page, do as they say, not as they do. dr. bill been it et is the former secretary of education. i learn a lot every time i listen to you. i want to put up this covid hypocrisy democratic hall of fame if i can. newsom, pelosi's haircut. my hall of fame goes to steve adler, the mayor of austin who went to cabo and recorded his stay at home video in his time share in cabo. what do you make of these politicians? what do you think? >> two things.

one the obvious thing commented on already, trace. the degree of hypocrisy is astonishing. i would add a couple other things to that. one it's a loss of credibility. it hurts credibility of leadership. say what you want about donald trump, tough, rough, brutal but tends to tell the truth. he tells it like he sees it. the second thing is, i think kind of a subtlety, when these people are seen at the french laundry or cabo or go to the hairdresser or out to dinner like the l.a. supervisor was, another thing is clear. it's clear they don't believe their own message. they don't believe it. they don't think they are in danger. so we're supposed to change our lives, shut down our businesses, keep our kids out of school, and they are behaving in such a way that makes it plain they don't think they'll get sick at the french laundry sitting shoulder to shoulder. that's the other point that has been missed. this raises the whole question

of credibility and who people can believe. one other point to this. earlier segment showing the videos there of georgia. well, some georgia officials since we have looked into it everything is fine. it brings to mind an old line of groucho marx, who will you believe? me or your own eyes? i go with my eyes. >> trace: the "new york post" wrote this and i want to get your take on the other side. the hypocrisy was bad enough cracking down on religious gatherings even giving a pass to black lives matter and getting together with family on thanksgiving but not marching with hundreds of strangers to smash windows and set dumpsters on fire. all the hypocrites are democrat and proud progressives. everybody gets the whole hypocrisy when you go to a $1,000 dinner at the french laundry. harder to get the nuance

hypocrisy protests and religious gatherings. why we have had so much pushback. fair assessment? >> sure it is a fair assessment. again, this is why people become cynical about politics, cynical about leadership and why i'm sorry to say some people in georgia are discouraged about voting again, although this is a very critical and important election. because it becomes plain in the enforcement situation in new york. it is not motivated by the truth or science, it is motivated by politics. but the american people, a lot of them, are very resolute. they know what they know and they know what they see. in the early 17th century, trace, galileo said the earth goes around the sun. the church, my church said no it doesn't, no, it doesn't. earth doesn't move and pounded him and pounded him and pounded him. when it was all over he said

yet, it moves, referring to the earth. he knows what he sees. the american people know what they see and they don't like it. this discontent will be with us for a long time. there are a lot of questions remaining unanswered, officials saying don't worry about it, nothing here, no problem. it's not going to do it. people won't be satisfied with that. i'm not. >> trace: people know you are the former secretary of education. i want to get your take on this horrifying story out of california. 11-year-old buy was on the zoom class meeting. took a gun and took his own life. we don't know really the back story but we do know that mental health has been brought up, right, in the case of this homeschool learning and learning remotely. and one psychologist said quoting here, all they need talking about kids, is one meaningful adult to talk to that needs to be maybe a teacher or coach and if children don't have that person now, and it really brings up an important point here. again not pointing fingers at

the background on this child who took his own life but there is a deep seated problem going on in this country with education at home. >> and it's connected to what we're talking about. look, the evidence is clear that kids can be in school and should be in school. the quote is good. i remember a quote from a psychiatrist at yale who said all that's needed for a child's success, the fundamental thing is for one more adult in his life to be crazy about that child. and that is a necessary condition. other conditions have to be satisfied as well. look, this kid no doubt had problems. i don't want to be accused of hypocrisy here. i help found lined indication company but it is not for everybody and certainly shouldn't be for everybody for all courses. it doesn't work as successfully. again, there is no good scientific reason that kids should not be in school. this child no doubt had other serious problems. it wasn't online education that

>> it's a big one and i think it is going to be worth watching. maybe better than the sunday night football game. these two are really going to go at it with each other. they certainly have in the campaign. loeffler attacking warnock as a far left radical anti-police, anti-military, harkening back to a speech he gave, a sermon he gave in 2011 where he said you cannot serve god and the military at the same time. warnock going at loeffler for some stock trades she made in january of this year after getting a briefing on covid. although she was cleared by an investigation in the senate. to give you a flavor probably the wrong word for what i'm about to say of these two, at one point last month warnock did an ad where he was holding a bag of dog poop and said he is getting smear campaigns and he throws it in the trash.

that gives you a flavor again wrong word, i can't keep saying this for what you'll see on sunday night between warnock and loeffler. >> sandra: chris, how would you lay out what is at stake with these georgia runoffs? >> it's enormous. by all accounts we think we'll have president biden in the white house, we'll have a slim -- much slimmer than she expected nancy pelosi but a slim democratic majority in the house. is it going to be all democrat washington or a republican senate to be a check and balance. the republicans have 50 seats. if the democrats were to pick up both it would be 50/50 and you would have vice president harris, kamala harris who could break the tie. so if the republicans can win one of those seats then mitch mcconnell remains the senate

majority leader and is a check and balance as i say on biden and pelosi. if the democrats pick up both seats then they have got senate majority leader chuck schumer. i don't think you need to say more than that to give you a sense of what the stakes are. >> sandra: as we now know the president will be heading down there himself. the republican party sees the importance of his presence there. chris, he will arrive there in the middle of this election battle where he is challenging the results of the 2020 election. so what can president trump and vice president mike pence say and do down in georgia to make sure that they have their party and have republicans show up? >> well it's an interesting issue as you were saying it i was thinking for president trump because he is continuing to say that he won the election. and that he is going to end up in the white house. and that blunts the republican argument you've got to elect

these two to block joe biden as the president. so it will be interesting to see how he finesses that. in the steve harrigan's piece you have some republicans in georgia like the famous lawyer lynn wood saying don't vote in this primary because the election was stolen in the last he -- the victory was stolen from donald trump on november 3. that is getting republicans in georgia to pull their hair out because they are saying look, we don't want to depress the turnout. we want every republican to vote so we can hold onto these two seats and hold onto the senate. it will be interesting to see how the president raises this issue about these senate races being all important to hold onto the senate. i suppose he will say i need partners in the senate to help me with supreme court picks and things like that. i suspect he won't concede but he is going to still say it's very important for republicans to have a majority in the senate. >> sandra: that makes this sunday's show a big one for you, chris. you have the president heading down to georgia, the big debate

lockdown restrictions in much. the governor announcing a regional stay at home order. one l.a. county sheriff says he won't enforce it. meantime l.a. mayor eric garcetti issued an emergency order saying it's time to cancel everything. with us now to tell us how one of california's biggest cities plans on dealing with all this, san diego mayor kevin falconer. what happens for those who don't know will kick in once hospital's icu capacity gets below 15%. it could affect the city of san diego, county of san diego. are you in favor of this policy, mayor? and how do you handle it? >> not at all. i think what you've seen is the continued growing frustration out here in california. we get new executive orders with no science behind it. and so when you see this new order that says, for example, we'll shut down outdoor dining, which has been working very

successfully. when it says we'll shut down playgrounds for families and kids. no science behind it. why you see the growing anger and frustration. i think rightfully so in california. particularly here in san diego folks are doing the right thing. following all of the protocols and once again to get this new order with no science behind it really has people at their witt's end. >> trace: the baffling part. you talk about no science behind it. when the l.a. counter supervisors voted to actually shut down outdoor dining they acknowledged at the meeting they don't have the science to back this up, which is why you have cities like beverly hills saying they'll start their own health department to make their own rules and pasadena saying we won't abide by this at all. l.a. county sheriff said the following quoting here. i want to stay away from businesses that are trying to comply. they bent over backwards to modify their operations to

conform to these orders and then they have the rug yanked out from underneath them. that's a disservice. i don't want to make them more miserable. so you've got this policy in place and even the sheriff doesn't want to enforce it. what do you make of all that pushback? >> i make what i said before, that growing frustration is because people are losing confidence. if you do not actually conflate doing the right thing based on science and you roll out new regulations, new color codes and in the case of what happened yesterday in california i don't know if you were aware they carved up the states into new regions. from santa barbara to san diego. that's the exact opposite of what we've been arguing for in terms of our own ability, local control to do what's based on the facts here on the ground in san diego not what is happening in los angeles or santa barbara as an example. people want to do the right thing. they are working hard to keep everyone safe. that's our goal. yet when you have orders like this that come out not based on

taxpayer abuse, the sacramento bee and other publications in california have been writing about this. legislators in the california assembly have been debating about this and the california comp troller refused to pay the $34 1/2 million bill that knickerbocker sent to secretary of state padilla. i'm asking for not only answers but a return of that $35 million in taxpayer funds back to the treasury because somebody has to get it back to the taxpayers. that's what the house oversight republicans are trying to do. we've clearly caught the secretary of state violating the taxpayer trust. it's a partisan firm, you showed that. those taxpayer dollars should not be sent to the joe biden partisan firm. they should be sent back to washington >> sandra: many democrats are saying it's not a partisan firm. we can tell you what they have on their website and what they claim to be. this is part of your letter. i'll put this on the screen.

facing possible prison time in the fisa controversy, kevin clinesmith, f.b.i. lawyer who pled guilty to altering an email to bolster the case for fisa warrants on a trump campaign advisor. the investigation by john durham is set to continue into the administration. we'll get to john durham in a moment. first to kevin clinesmith and what might be happening with him, trey. >> well sandra, let's focus on what he did. this is an f.b.i. lawyer. we give them these amazing powers. these powers that you and i don't have. they are investigating an american citizen to decide whether or not he is an agent of russia. he learns he is not an agent of russia, he is an agent of the c.i.a. and you manufacture, you alter, you in essence destroy evidence because that's how much you hate president trump.

let's don't forget kevin clinesmith with a an anti-trumper. i was a prosecutor for a long time. i want a justice system we respect. when i see cities burning because people want police reform, if you want police reform don't let f.b.i. lawyers alter evidence. then to have bob mueller, one of his prosecutors, one of the special counsel prosecutors write a letter asking for leniency for this f.b.i. lawyer who altered evidence? you are going to ask for leniency even though you put other people in prison for doing less than that? look, if you like police reform, then you ought to be really upset about what this f.b.i. lawyer did. >> sandra: easy to see you are fired up about this, trey. i'll put up the prosecutors' statement on what they saw happening here. it is plausible, f.b.i. lawyer, that his strong political views or personal dislike of the current president made him more willing to engage in the

fraudulent and unethical conduct which he has pled guilty. the defendant plainly has shown denot discharge his important responsibilities at the f.b.i. with the professionalism, integrity and objectivity required of such a sensitive job position. the defense has responded, trey, only fair to put that up on the screen as well. this is how the former f.b.i. lawyer is defending himself. when kevin altered that email in june 2017 he was spread thin and exhausted at work in his personal life. that is no excuse but it does help explain how kevin came to do something so out of character. trey, what did you think when you saw and heard that? >> just how outrageous it is. spread thin, are you kidding me? i'm married to a first grade school teacher. if anybody is spread thin it is folks in that line of work not some government lawyer. the easy thing to do, sandra, if you are really spread thin is how about you accurately

relay the content of that email? it takes a lot more effort to change it than it does just to let it go through. and the notion that you have a pregnant wife, okay, so did one of the people that andrew weissmann put in prison and ruined his career. he had a pregnant wife, too. where was the sympathy for these special counsel prosecutors when it was someone not working for the f.b.i. facing the exact same music? >> sandra: trey, what do you say to some on the left who say this is a non-story especially now we know bill barr has appointed john durham to continue investigating the origins of all this under a biden administration. final thoughts. >> a non-story? we watch cities burn because of police misconduct. you want to ignore an f.b.i. lawyer manufacturing and altering evidence? do not lecture me about police reform in our criminal justice
