without any lawmaker, any legislative approval, and only a state legislature has the constitutional right to do that. look at the state of georgia, with the horrendous consent decree entered into after democratic party lawsuit earlier this year with georgia secretary of state. well, secretary of state had no right to do that because that secretary of state wasat also acting without legislative -- legislative approval, flagrantly unconstitutional. the suit's second argument surrounds, well, the unequal application of the law, and when poll workers and partisan observers encounter different roles in different counties, well, equal protection clause, yeah, has obviously been violated. as kris kobach accurately has pointed out, if texas referred veils, there are multiple remedies for examples, state legislatures in georgia, wisconsin, michigan, and pennsylvania,ns they could exclude ballots that were counted in violation of state law.aw

another bite at that apple. but pennsylvania and your state of wisconsin, i look at the law. there is no mail and balloting, very limited male in balloting in wisconsin. explain what went on there. >> thanks, sean, and what lara said about the texas case is true because the state of clerks, didn't follow the law. wisconsin is a little different because it's not about whether someone called and 50,000, you know, ballots in a u-haul trailer. what wisconsin is about is whether the clerks and the people responsible for conducting the election conducted it in an illegal manner. i have been fighting the situation here in wisconsin for 20 years, but it culminated this time with three things. i'llim give you three examples. number one, the clerks decided that they were going to have in

person absentee ballot voting to create a system in wisconsin which doesn't exist, which is early vote. accept, in wisconsin law, it's very clear and it's unequivocal, that absentee ballot is not a right, it's a privilege, which means you have to follow the rules. and they didn't follow the rules, didn't have absentee ballot applications. they created this entire system of people showing up, voting early, but not following absentee ballot rules. that's number one. number two, the clerks decided, instructed by the wisconsin election commission, to fill out parts of the absentee ballot envelopes for the particular voters. with the state law says is unequivocal, it says that if that happens, that ballot should not be counted. number three, the clerk sent set up ans in person ballot system n dane county, they went to parks and set up picnic tables everywhere andyw the

dane county clerk decided because of covid that if you wanted to declare yourself indefinitely confined, which is usuallywh, you know, for unfortunately elderly people that cannot get out of nursing homes, you can declare yourself indefinitely confined, without a photo i.d., and show up and vote. and so, and by the way, these are things that have been getting worse and worse and worse over time in wisconsin. the milwaukee police departmentl many years ago, issued a report, and you can find it in 70-something pages long, it talks about all kinds of problems, not these specific ones because these are a lot worse, but the kinds of things people not enforcing the law, felons voting, felons being hired to be election inspectors, it goes on and on. the point is, sean, it is true that in the case of wisconsin, this is about the state itself and its people and force with

conducting the election not following the law. >> sean: it's amazing -- >> and the democrats don't have a response. >> sean: the amazing thing also is the wisconsin supreme court, you explained on this show, has previously weighed in on what would be the president's arguments, correct? >> well, it's funny, because in the footnote, the wisconsin election commission issues some guidance to its clerks on how to conduct the election, and in that guidance it said, you know, do a, b, and c, and a footnote said contra, which means, you know, contrary to what we are saying -- by the way, see this case over here, this appellate case, and this case over here is a case that shows that when a clerk the box. it overturned an election in that case and the result was the

other person running for office actually won. it's the exact same pattern that the trump campaign is arguing. the only difference is that instead of it being like ten or 12 ballots, it's 100,000 ballots. that's the issue for the court. the democrats arguing substantially on the legal part of this case, they are arguing, well, he should have brought the casey sooner. >> sean: it's meaningless. >> that's not a strong argument ont' the case. it is not a strong argument on the merits ofof this case. >> sean: the supreme court, when they did say you have to go to the lower court first, clear three of the seven to say, we are not doing this because we are saying this lacks merit, don't think that. that's interesting. all right, reince, thank you. speak with the chief judge -- oh, okay. >> sean: know, the chief what? >> okay, the chief judge set exactly, when the court decided to send it to the circuit court first, the intention was it was going to call back to the supreme court, probably this
