will: more comfortable than what we are wearing in studio. rachel: i know. will: we are glad to have you with us, rachel. we have a lot of news to get to. what a day for this country. pete: some days you wake up and say what are we going to talk about today is one of those days. a lot of great guests as well. we start this morning with a fox news alert. the fda approves pfizer's covid-19 vaccine for emergency use in the u.s. officially. paving the way for widespread distribution. lucas tomlinson is live outside the fda in maryland as the first dose is set to be administered in less than 24 hours. lucas, good morning. >> good morning, guys. normally it takes years to make a vaccine let alone get it approved. this one done in record time. president trump touted the achievement last night from the oval office. >> our nation has achieved a medical miracle. we have delivered a safe and effective vaccine in just nine months. this is one of the greatest

scientific accomplishments in history. it will save millions of lives and soon end the pandemic once and for all. >> some 6 million doses of the pfizer vaccine will be districted across the country this he could would. u.p.s. is leading operations in the east. fedex in the west. the first shots could be given in just days. doctors and nurses as well as the elderly are expected to get the first shots. operation warp speed officials want to get all americans vaccinated by june which will require a healthcare lien effort are provided a guide who should get the vaccine first state governments will make those decisions. the head of pfizer said getting emergency use approval from the fda was a team effort. >> together, with other manufacturers, collaboration is expected to deliver hundreds of millions of doses to americans by the end of next year. >> there is a press conference here at the fda in three hours. we will keep you updated, guys.

will: all right, lucas, thank you so much. you know, pete, rachel, in a year where bad news has become the norm. negativity we wake up to almost on a daily basis. i don't think this can be highlighted and emphasized enough. what we are looking at is not really not just a will will scientific but political miracle as well. a vaccine being distributed across this country is scientifically something you could not have imagined. yet, each at that rachel, politically, it is a miracle as well. this with the fda dragging it feet a little bit more than it should have on this to get a bureaucracy to move with this kind of speed along with science is simply amazing. i want to give you quickly this. this is a timeline for vaccine distribution coming up over the coming months. december healthcare personnel, long-term care facility residents. they will begin to get the vaccine. in january and then through march it will look like this, essential workers. that's non-healthcare workers and beyond march high risk adults. that's the plan the next couple

of months. rachel? rachel: well, listen, i love what president trump just said. the pandemic, this virus started in china. it's going to end right here in america. that's the kind of optimism that we love to hear. we have the most amazing scientists and they are amazing. they can get things done. usually it's the government slowing everything down. operation warp speed is so perfect for donald trump. you know, whether this election moves forward or not, you know, or biden gets in or not, this is a hallmark of donald trump the way he does things. he is a businessman. he knows that government and regulations can get in the way. and he got rid of all the red tape and the road block and here we are where our most vulnerable citizens are going to be able to get vaccines in walmart, in cvs, and the most convenient fashion and free. it's really -- sometimes government works. and this is one of those times. pete: government can work when as you mention you put a businessman in charge who says

we are not going to pray by the rules of the past especially on something like this. it truly is historic. i remember when this all first started march, april, we talked about how we get out of this and a lot of people kept saying it's the vaccine. two years for a vaccine, three years. you didn't see your way through the tunnel. president said we are going to do this as fast as possible and truly they delivered in historic fashion. not soon enough, because the cover of the "new york post" this morning says you are a mean one, mr. grinch, cuomo because indoor dining shut again here in new york city starting on monday. all of these things are topics that our own brian kilmeade will be talking to, well, the man himself president donald trump today. he's talking to him today at the army-navy game which we will also be talking about all morning long. certainly the topic of the vaccine will be part of it. we will air that interview tomorrow morning on "fox & friends." look at brian kilmeade doing weekend work for us. he never stops anyway we know that we will have it on during the game and it tomorrow as well. another topic the president will

certainly be asked about the ongoing legal challenges still moving forward. one of which the case that texas brought basically arguing that in the states of pennsylvania, wisconsin, georgia, and michigan, because the rules were changed in extra constitutional ways, those outcomes should be challenged. well, the supreme court ultimately, yesterday, rejected hearing that challenge from texas. disappointing a lot of people who feel like just at least an airing of it is worthwhile of the highest court. matt gates talked about how he was one of those house members, over 130, i believe, signed on to that lawsuit in addition to those states in yellow who joined with texas to say we would like the supreme court to chime in to make sure that legal votes are counted and the election can be trusted. representative matt gaetz chimed in on that on the story last night, listen. >> remember, this is not will occasion the trump campaign failing to produce evidence. it's a failure of any court to exercise jurisdiction sufficiently to allow us to

produce evidence. oftentimes these motions to dismiss have been granted on the sufficiency of the pleadings not on the sufficiency of the evidence. and the people's house may be the last forum available for us to make those arguments. will: the supreme court last night, rachel, pete, suggested that texas did not have standing to file suit against other states and their election procedures. we will be talking to jonathan turley fox news legal analyst later in the show. we will both talk about what happened last night at the supreme court and where the trump legal defense team goes from here. for now, rachel, at least the piggest lawsuit of the week has been rejected by the supreme court. rachel: yeah, it's real travesty we have a fox news poll that actually says, you know, 36% of all voters believe the election was stolen. but, look at these numbers. trump voters 77%. 68% of republicans. essentially 50 million americans who don't feel comfortable with the election results because

they believe it was rigged or it was -- yeah, it's rigid. that there was cheating involved. and i think that, you know it's one thing if the supreme court had heard the evidence and then came out and said look, there is nothing here. i think you get the unity that the democrats and joe biden say they want. but, are if you don't allow this to air out, when you have that many americans uncomfortable with the results and with how all the shenanigans that they saw happening in this election, i think it's very troubling and i think it undermines, you know, moving forward, not just the biden administration if he gets, you know, sworn in, but i think there is just a mistrust or a distrust of our institutions in general. pete: when you dismiss things or as youtube is now doing saying you are not allowed to put a video up that would question the results, you only solidify people even more in their belief. again, that poll from fox was not was it rigged or a little bit off. it's was it stolen?

rachel: you are right. pete: people that you know or talk to that resonates with the people trump supporters and republicans have that feeling that this election was not fair, illegal votes were counted and that ultimately that's going to -- we are going to live with that sentiment. should it be joe biden on inauguration day and a lot of trump supporters watch what continues to go on in the will suppression and then what happened beforehand with hunter biden the way stories were suppress suppressed. none of it felt above board. when it comes to the actual legal challenges, we will have rudy giuliani, former new york city mayor and president trump's personal attorney, he's going to be on the program later on. we will ask him where is it? is there a recourse. electors start voting to certify results starting this week. what is the plan of the trump legal team. certainly they look at these numbers in a poll like this, will, they feel like the public portion of it they have convinced people that there was fraud there. the question is can you do it in a court of law.

will: rachel brought this up a minute ago saying people have lost faith and trust in institutions. youtube suppressing any videos of election fraud. let me give you one of the stories that undermines any trust in any institution much less the media of this past election cycle that is as you pointed out the suppression of the hunter biden story. this week we learned that, in fact, the doj and fbi had, in fact, been vetting hunter biden. this, of course, after months from the mainstream media telling you that not wa only wat fake news but russian disinformation. pald faced lies to the american public. now that we know hunter biden was being investigated. joe biden got pressed on this by one reporter out there, fox news' peter doocy. this is what that sounded like. >> did hunter biden commit a crime? have you spoken to your son, mr? >> i'm proud of my son.

will: that's the one, rachel. rachel: yeah, sorry about that. will this is not a victimless crime. first of all, this investigation will tell us, you know, where that money came from and if that money came, you know, what foreign country it came from and if that money actually ended up some of it, at least with joe biden himself. so this is a very important investigation. it's not just some minor, you know, thing. it has huge consequences. and it's also not a victimless crime. it's not just some it tax thing. it will future potential president of the united states joe biden. sell out our country and will children and future to line their pockets. this is a huge story. and i would say that the media looks just awful through all of this. i don't know how they ever recover from it. pete: they won't. they can't. peter doocy was not an approved reporter to be called upon. hence, he was dismissed quickly.

and how do you say you are going to ban fracking and energy in this country but then you go work with a chinese energy firm. the reason it matter is because of you who joe biden is compromised. not just on principle but on whether or not, i mean, whether or not he is tied in ways that it would compromising to him to the chinese government or chinese companies over there. there is a new email unearthed today that shows when hunter biden was setting up offices he wanted to make sure that this chinese executive was an office mate with joe biden. does that matter? certainly does if you are going to stai stare down the chinese d choose pete buttigieg. it doesn't stoke any fear. will will gregg jarrett talked about the lack of media coverage when you wremps referenced, rachel. here he was yesterday talking about. >> it this wasn't media incompetence. this was willful, martha. this was deliberate. this was the worst cover-up by the media in my lifetime. it wasn't just the censorship by

twitter and facebook. no. the "new york times," "the washington post," cnn, msnbc they all refused to cover the story. they kept assuring the american public there's nothing to report here. there's nothing to investigate. will: i think what gregg jarrett said there is incredibly important. rachel and pete you talked about on joe biden potentially being come pro-mighted his relationship with the chinese government is one very important angle to this story. the other is as gregg jarrett pointed out we are not simply looking at incompetence from mainstream media and bias. we're looking at deliberate misinformation, cover-up. we are looking at a conspiracy since the american people do not know about a story before they go into a election. you cannot emphasize this enough this was the american media lying to the american people in order to affect an election outcome. that is beyond reproach. pete: true, what he said. rachel: sounds like meddling in the election something we talked a lot about.

texas did not have understanding to bring the suit. tell us what that means. >> you know, for a while a number of us have been trying to really tell people that they shouldn't put too much stake in this case because it was very unlikely to prevail. the court has never allowed other states to force compliance of the state laws of the states like wisconsin and georgia. this is something that has to come within your state. so it was carrying a lot of bag gamg going into the supreme court. it was extremely up likely to succeed. and that's what made me a bit uncomfort being with the president highlighting this case. like someone buying a lottery ticket and planning to buy a house with it. it was the longest of long shots. and it basically fell out oas we thought there were two justices that thought the case should

have been accepted only because they felt you had to accept it. they didn't necessarily support it on the merits. seven of the justices clearly didn't even think that was necessary. and so, this didn't get any further than the pennsylvania case that the court rejected about a week ago. and that case they rejected it within 40 minutes of the final briefing filed. so these cases are still having trouble legally creating a foundation for relief. and we see many of these patterns across the country. a lot of these cases have been dismissed on standing. this threshold issue of who is allowed to bring a case. but, other cases have been rejected on other grounds, including what's called laches. a lot of these judges have said you waited too long. that is these changes were made months ago you should have come to us before the election. you can't wait and then after everyone vote and shortly before the electoral college meets, say i want to just throw out all of

these results. another problem which has been coming up in these states is the relief factor. some of these judges have said, look, you have made valid claims. in the pennsylvania case said, look, these voters have made a valid claim that their votes should have been counted. but the judge said that doesn't mean that i'm not going to count millions of other votes. so your relief is the problem. those are all recurring problems. will. will: not that these issues aren't obviously very important. these are procedural issues. you are obviously a law professor for what it's worth. i am an attorney. i understand the importance of standing and relief but for many in the american public they're looking at saying these are all being thrown out on technicality. i understand these are morton technicalities. the point is the court is not hearing these days based upon their merit. whether or not there was enough election fraud and clearly many americans believe there was election fraud. what do you say to them about why that's not being heard in the legal system?

>> no. i'm sympathetic to that because people feel like they are not being given a full review. we have a case in wisconsin today around noon where the wisconsin supreme court is going to be reviewing that case. once again, that's probably that's clearly not enough to overturn the results of the election. will: that was my last question for you really quickly where do we go from here in terms of legal cases is wisconsin next the last fight for the legal team. >> yeah, there is a few cases like wisconsin that are still out there. there are torpedoes in the water. they are not big enough to sink the ship. i think that that was the big play that failed last night in the supreme court. will. will: all right, jonathan, we appreciate your time this morning shining light on this for what it's worth as well. later, we will be talking to former new york city mayor and trump's personal attorney rudy giuliani. he will let us know where they plan to go from here. that's a little bit later. 9:30 eastern time on "fox & friends." still ahead, new york and pennsylvania are enacting new

are. rachel: back with quick headlines starting with a fox news alert. a minnesota police officer is shot in the line of duty overnight. the officer was responding to a call about a man wanted for violating a court order. the police say the man opened fire before running away. he was arrested about 30 minutes later. thankfully the officer is in stable condition. six people are hurt after a car plows through a crowd of protesters in new york city. warning here, this video may be a little bit hard to watch.

[screams] the driver speeding through an intersection hitting several people who were protesting against ice. they were taken to the hospital with non life-threatening injuries. the driver was arrested and charged with reckless endangerment. pete? pete: thank you, rachel. all right. new york and pennsylvania announcing new indoor dining baned aing to a growing list of states cracking down on restaurants. so can they survive these growing lists of restrictions. here to discuss owne joe, ownerr in virginia and phil, owner of restaurant in hershey, pennsylvania. thank you for being here this morning. reuben, in new york city we wake up this morning hearing that indoor dining closed yet again. did you expect this? what do you do?

>> first and most we all wanted this situation under control and health is always the top priority. with that said, restaurants truly are an ecosystem. it takes a small village to operate these restaurants from employees to the distributers to the farmers from the beginning of covid we really haven't had much direction, much help, much really guidance on how to proceed with this covid situation. i think government is asking us to be responsible but i think they must do the same thing back to us. right now it really is nearly impossible to survive under these situations. pete: if you can't be open, winter is coming. government won't provide assistance after government tells you to shut down you are in an impossible spot. joe deal in virginia not completely shut but faced the same kind of restrictions. you point out that businesses just across the street from you don't have to apply by the same standards. explain that as a restaurant owner. >> well, yes, sir, if you look

across my soldier shoulder busin tennessee. the business i'm in is virginia. a state line separates our streets. monday we start on a curfew so any restaurant after 12:00 most of our customers will walk across the street. there is no curfew on the tennessee side. we all are under some really tough restrictions right now in restaurants. ours is a little different because we are split. our city is split why state lines. our virginia regulations are much tougher than the regulations in tennessee. right now we just -- on monday we have groups no more than 10. the tennessee side has zero restrictions on groups. so it does make it hard on a restaurant. especially this time of year not to hold groups. this is christmas party time. it's really tough right now. pete: have you considered staying open saying don't go over to tennessee stay here but you have no choice but to abide by it at this point?

>> i'm a rule follower and most of my friends are part of the police department. and i have the utmost respect for these guys. i don't want to put them in an awkward position. so, you know, i would like to kick back but i don't think that it's time for me to do that yet. we are still afloat. i don't have a problem at all with other restaurants who are. i will support them 110%. i'm just not to that point yet. pete: phil, you are in west virginia where the governor just announced three weeks shutdown on very short notice. how can you plan for shutdowns? >> well, it's tough to plan for a shutdown, especially when you have perishable products and more importantly when you have staffs that are living paycheck to paycheck. and we're at the holiday season. my problem this time was the governor on wednesday stated that he had no intentions of closing our businesses. so, on thursday, all of our businesses bought food products and staffed up for the weekend. and then yesterday he said we

have 24 hours' notice to close. i don't understand from a business perspective how you can close a billion dollars industry with 24 hours' notice. and we are not doing it. pete: so you are going to stay open? >> we are absolutely staying open. i'm going to stay open to serve my food products that i have in house. i think it's unfair to ask us all to close after 24 hours. we have a very large coalition of restaurants that are going to stay open. and then i will reevaluating it based upon what the state decides to do and based upon when my food inventories are depleted next week. pete: phil, that's an important point if groups of businesses come together and stay open together it changes the entire dynamic. reuben, joe, and phil, thank you for what you do. and let's hope that the government doesn't bait and switch you yet again. god bless you. thanks for the update. appreciate it? >> thank you. pete: coming up, a second

and then i offered to help. and i did help. i was thanked by the fbi for my help and that person is no longer in the country. and i was a little surprised to read about my cooperation in that story because the story says that, you know, there was no -- there was never a suspicion of wrongdoing on my part. people who did had share classified information were the people who leaked this story. and, to do that against the critic of the president they may think they are going to silence me. they are not going to silence me. will: the important point that the american people need to understand is not that a chinese spy snuggled up to eric swalwell but that someone told many on him. let's bring in michael waltz a member of the task force. thank you for joining us. want to get your reaction to this story congressman swalwell as well. >> incredibly rich coming from congressman swalwell who sat at shift's right hand during the

entire impeachment investigation. the leaker in chief that was coming out just flying out of the intelligence committee as they were going after the president. the point that i want everybody to understand today is that the country is flooded with chinese communist money. this is a much bigger and pervasive problem. it's in hollywood. it's in think tanks. it's in journalism. it's in "wall street journal." and it's going after progressive politicians. like swalwell. they went after senator dianne feinstein and put an operative in her campaign and these aren't -- now we are getting reports of jon ossoff in georgia that was taking anti-democracy money from a linked entity in china. these aren't members, progressive members on, you know, the shoe shine committee. they're on intelligence, they are on senate intelligence. they are on house armed services. and i think we need to take a hard look at how they are voting, how they are voting

vis-a-vis or defense bill, our intelligence bill, and as we go, you know, really truly take on what i think is the greatest threat this country has ever faced in the chinese communist party how they are viewing it and what they are saying. rachel: congressman, you bring up such a great point you actually sit on that china task force and it's a task force that nancy pelosi refused to put any democrats on. what does that tell you about the democrat party and whether or not they truly are beholding to china and can't be really fair when it comes to issues that involve china? >> well, the sad thing is she had initially agreed with speaker mccarthy. this should be a bipartisan issue. the chinese communist party is in a cold war with the united states just look at president xi's speeches where he talks about replacing the american dream of freedom and democracy with the china dream around the world of prepressure and kowtowing to the communist party. that's the issue here.

we just had vice president biden this year say the rise of china is no big deal. it should happen peacefully. we can all get along with this notion that we are just nice to them they will be nice to us back. that's not what their leadership is saying. navy is larger than ours. launching more into the space than the rest of the world combined. flooding the zone in the united states with money in a way the soviet union was never able to do to influence all of american society and around the world. to eventually, again, kowtow to beijing and how they see the future not us. and i'm not going to have my grandchildren grow up in a world led by chinese communist or, for that matter the united states led by democratic socialists. and that link there is something that should scare every american. pete: that is a link. it's a very fair point. you know, we talked earlier about how the hunter biden story was suppressed before the election. we are now learning there is a hunter biden investigation in

army today. pete: you have a second on that one here. i mentioned it's going to be different because of covid-19. the national guard has been heavily involved in the covid-19 response. can you explain to our viewers what that has been and also will that include distribution of the vaccine? >> yeah, absolutely. and so, you know, tomorrow obviously is the 384th birthday of the national guard. and it really goes back to our first formation with the massachusetts bay colony in 1636. and since then our national guardsmen this year is no exception. when you look what our soldiers and airmen have done really since march, we have got even today 20,000 guard men helping out with will covid-19 across the country. reached a peak of about 47,000 june of this year. as we look forward we are continuing to do those missions that the governors have asked us to do up to this point. we are in close concert with

the navy academy so i was starting that game. couldn't play varsity football back then so i was -- so i was in the stands watching the army-navy game and i was nervous wreck. and then the next year i'm starting and president kennedy was going to be at the game and so the 62 army-navy game i was more nervous before that game than any game i ever played in other than -- i was nervous before the super bowl but the army-navy game was really special and so 1 1962 we had a really good game. we won 35-14. and i had a -- i was really -- i have always been proud of that game. our team really played well. so that was a long time ago. but i still get pumped up whenever the army navy game comes every year. so, it's fun watching the game and i really enjoyed playing in three games.

talking about there. >> i certainly did, yeah. pete: he asked that gentleman what's next we'll ask the same question of you in the legal challenge, what's next? >> well, what's next now is to take each one of those complaints that were against different states, to break them down into individual complaints and over the next two days bring them in those states where we would have standing, namely in michigan, georgia, pennsylvania, nevada, arizona, wisconsin we already have an ongoing case, so we may or may not supplement it's going to be heard today, so basically, we'll take the advice of the supreme court. the supreme court says, i think incorrectly, that the state of texas doesn't have standing, but certainly, the president of the united states has standing. certainly the electors like that gentleman that spoke to you has standing, so we will be bringing those cases in their names in the states in which we were cheated. georgia is probably the most dramatic example of cheating because it was done live, pete.

evidence are the 1,000 affidavit s from all different witnesses in six different states that all basically say the same thing. they go anywhere from active voter fraud to 50,000 acts of voter fraud and then you have the statistical analysis of the machines that are done by experts that say they couldn't possibly have produced that number of ballots in that period of time. you have the 700,000 ballots in pennsylvania of mail-in ballots that was sents in but never sent out and in other words, they were made up. you have 60,000 dead people voting in one state. you have 40,000 dead people voting in another state. you have people who aren't citizens voting in arizona. more than enough citizens that goes way beyond the margin of victory, and just think about that alone. biden supposedly wins arizona by
