from people that saw tens of thousands of ballots. here's the point. they're winning these things on little tec technicalities, likea thing called standing. they're saying the president of the united states does not have standing. todd: federal courts have ruled on the merits of the case and found the president and his legal team lacked the evidence to back the claims. in georgia, the state's two senate seats have gone to a runoff election. if democrats sweep, they'll win control of the u.s. senate, drawing nationwide attention and money. >> this race now has become a national race and so this is everybody in the country, democrats and republicans, trying to weigh in here to get the majority in the senate. >> we have the level of investment and engagement that it takes to win a runoff. we know from the numbers that we're in a good place. >> reporter: runoff election in georgia is january 5th. as for brian's interview with president trump, we'll have the

full version up next hour. back to you. todd: rich, thanks. carley: now to a fox news alert. today, pfizer's coronavirus vaccine will arrive at hospitals nationwide. todd: ashley strohmier live at saint barnabas hospital in the bronx. >> reporter: the vaccinations could begin here at saint barnabas hospital in the bronx soon. they're expected to receive the first batch of those doses before long. now, the first pfizer biontech vaccines left several locations in michigan sunday. people could be seen cheering on the trucks leaving some people even holding trump signs too. the first batches arrived at lax over night. the airport shared a photo on twitter. one challenge for the distribution, pfizer's vaccine needs to be stored at extremely low temperatures. gps enabled sensors will track the shipments and ensure they

stay cold. >> we've got a portable cold storage capability that the vaccines are sent out to other locations around the country. we'll be able to get some of those small ultra low vaccine temperature vaccine freezers out as well. >> reporter: the first round of shipments will be staggered arriving at 145 distribution centers today, 425 sites will get it tuesday and then the remaining 66 on wednesday. and then more promising news, the moderna vaccine could be approved this week. >> our plan from day one has been to have a portfolio of products. pfizer is one of them. moderna, which likely will be approved by friday, probably this coming week, is able to produce 100 million doses in the first quarter. >> reporter: frontline nurses anworkersand nursing home reside expected to be the first

vaccinated. senior officials across the three branches will get them in accordance with government protocols. president trump, however, is pushing back. he tweeted people working in the white house should receive the vaccine somewhat later in the program unless specifically necessary. he added that he looks forward to taking the vaccine, quote, at the appropriate time. now, still ahead, family and emergency medicine dr. jeanette nesheiwat is joining us to talk about the shipment of these doses and the vaccine as well as when you could potentially get your first dose. todd: looking forward to speaking with the good doc about that. a lot of information we want answers for. carley: the second indoor dining ban starts today in new york city. new york govern for andrew cuomo announcing the two week ban after a rise in covid-19 hospitalizations. thousands of new yorkers were seen enjoying their last sonar inside restaurants last night -- last supper inside restaurants last night. later, we will talk to new york

business owners. todd: a source tells the ap they are asking for information on burisma. it comes as fox news obtained and. mail from 2017 revealing that hunter requested keys be made for his new office mates, quote, unquote, which included his father, joe biden, jill biden and uncle jim widen. those keys were allegedly for a space he was to share with an emissary from a chinese company. as the new information comes to light, peter s switzer sounds o. >> what you have is a situation today where the bidens have repeatedly lied to the media and the media doesn't care. they don't want to catch them in lies, they don't want to pursue the lies. look at hunter biden. hunter biden goes on national television, on abc news, and

said i have not received a single penny from the chinese. well, we now know of course that he got close to $5 million from cefc, a chinese government connected energy company. he was flat-out lying to the national media. what's been the media's response? nothing. they've taken it. they've accepted it. todd: former hunter biden business partner, tony bobulinski made the claims about hunter receiving $5 million from a chinese energy company. this all comes as joe biden prepares to choose his attorney general. new york governor andrew cuomo reportedly on the short list. carley: a gunman is shot dead by police after opening fire at a new york city cathedral. about 75 or 80% of the u.s. population before her immunity -- herd immunity can really be established. we hope to reach that point between the month of may and month of june. jillian: operation warp speed of icials are turning their attention to reaching herd immunity. todd: the question we are wondering, how long before all americans have the necessary access. fox news medical contributor dr. jeanette nesheiwat joins us now. doc, let's go through the projected timeline of vaccine distribution starting with this month, december. healthcare personnel, long-term care facility residents, white house staff. there's some question as to whether or not the white house staff will actually get it. the president putting out a tweet that said other people should get it first. january through march, essential workers in the non-healthcare sector and beyond march, high risk adults. based upon your sources, what are we hearing in terms of when the general public will get an opportunity to get the vaccine?

>> yes, most likely the end of next month and february. because remember, we want to target those who are at high risk. those who have high risk of complication, those who have high risk of being hospitalized, being put in the icu and ventilator. if you're 19, 20 years old, young and healthy, it's reasonable for you to be at the end of the line even though you can still transmit the virus which is why we say please everyone still wear your masks, practice social distancing, keep your hands washed and clean. for everyone, even if you've been vaccinated. this is a timeline we have to use. we want to protect those who are most vulnerable. this year it will be healthcare workers, frontline workers, nursing home residents. they were hit the hardest. we saw a large number of deaths in nursing homes. followed by essential workers, those with underlying medical disease and then everyone else in the community. carley: this is such a historic day. ups says the vaccine will be delivered to all locations by

10:30 this morning. so for somebody who has been battling this disease on the frontlines since march, describe the significance of this moment to you. >> i became teary eyed. i became emotional yesterday when i saw the fed ex jet taking off. i knew it was a sign of hope. it truly is the beginning of the end of this pandemic or at least gives us an ability to control the pan demuck. the vaccine alone is not going to end the pandemic. we need everyone to take their part, helping to mitigate the spread of the virus. it's going to take time to immuneize the entire nation. it was almost i would say tears of joy yesterday. but december, january, february, we see, carley, that the numbers are rising. we had nearly 300,000 deaths and over 100,000 people who are hospitalized, 20,000 of them are in the icu. so right now we are struggling. it's critical now more than ever that everyone play their part,

wearing their mask and be careful with the social gatherings. 74% of the outbreaks we have right now are social gatherings, dinners, parties, people getting together, not social distancing, not wearing masks. we're almost there. we still have to do our part and be vigilant the next few months. todd: a follow-up on a time line, that only the most vulnerable should ge get it offe past. president trump said i am not scheduled to take the vaccine but look forward to doing so at an appropriate time. my final question for you. you want to go to the negative to be sure. what could slow up the process? >> well, if there's any issues with manufacturing of the vaccine, we have hundreds of millions of doses coming in from pfizer, from moderna. we saw there's issues with the trials and some of the other pharmaceutical companies. we have data that's going of to come out with astrazeneca and

soon. it could be a -- and johnson & johnson. it could be a manufacturing issue, it could be an unknown side effect which could appear. usually, side effects happen within the first two months. we haven't seen anything that would be serious, life-threatening complications. we haven't found anything that would slow us down. the biggest issue is encouraging and educating everyone to eventually get that vaccine and understand it's going to be safe, it's going to save your life, it's fda approved and doctors, nurses, healthcare providers, we wouldn't take it for ourselves or loved ones if we didn't believe in it. todd: dr. jeanette nesheiwat joining us live on a monday morning following an exciting weekend as our nation looks forward. carley: still ahead, her painting on santa and baby jesus deemed too violent by facebook? todd: i mean, really. that's on your screen right there. does that look violent to you? the christian artist behind it

carley: listen to this, a painting of santa claus kneeling next to baby jesus censored by facebook not once, but twice. a flag said the image may include graphic content. after several complaints, facebook unblocked the art work. the artist, gaye francis willard joins me now with her reaction. this is unbelievable. >> it is, isn't it. carley: i want to read facebook's guidelines for sensitive content. they say a photo or video containing graphic content may appear with a warning to let people know that the content may be inappropriate or hard to watch for some people. do you think your painting of santa claus and the baby jesus

fits that description? >> i certainly hope that it isn't hard to watch and i can't imagine what could be deemed violent or unfit for anybody to see. carley: it is a beautiful painting. you are obviously an extremely talented artist and your painting was originally blocked in 2018 and then they unblocked the photo once folks started to complain. but then this happened again this year. so has facebook responded as to why they keep on blocking this beautiful image? >> their response has been a generic response, really. they have attributed it to the algorithms, which basically leaves them not responsible for whatever they've done, it's just a technical thing that happened and nobody's really responsible for it. carley: we just showed a little spotlight on a portion of your photo that showed the cross and you say that was actually an

accident that happened in the picture. explain this image and what this picture, this beautiful painting means to you. >> well, i have always loved being -- loved the image, santa claus kneeling at the manger because i just love christmas and that's one of the things i really like. but there was no art work to put on the wall and since i'm a portrait artist, i decided that i would paint one for myself. so i really wanted the cross to be central but i wanted it to in the shape of a star and so i had done that deliberately and then i had come back to my easel and there was another cross, perfectly positioned, at the feet of jesus as if it was a shadow of the star cross that i didn't intend to be there. carley: that's so beautiful. you know, you are a successful artist. you have people that could speak up on your behalf and say that

images shouldn't be blocked by facebook, that have been so because of the facebook algorithm. are you concerned about other folks that may not have as big of a platform as you and what facebook might be doing in terms of their posts? >> i don't think it's that i really have such a big platform. i think that a lot of people have been personally affected by this because they feel that it is kind of an attack on their faith and what they believe and how they live their life. it's not really so much even about my painting as it is about what it represents. and so i think that's a broader question to ask about facebook. carley: we reached out to facebook too. we're still waiting to hear back. if we do hear back from them with more explanation we will certainly let you know. your christmas collection is called every knee shall bow.

documents from hunter biden is asking for information spanning over of two dozen entities. carley: fox news obtained an e-mail showing hunter requested office keys for his family members. brooke, what's going on? >> good morning, todd and carley. the federal investigation into hunter biden's quote tax affairs as prosecutors reportedly seeking documents related to more than two dozen entities, including burisma holdings where hunter sat on the board. this comes as fox news obtained a new e-mail hunter biden sent in 2017 where he requested keys be made for his new, quote, office mates. his father, joe biden, jill and james biden, for space he planned to share with an emissary to the chairman of a chinese energy firm. in the e-mail hunter requested that the signs of the office be updated to reflect, quote, the biden foundation and hudson

west, cefc u.s. senator ron johnson says this is just the tip of the iceberg. >> we are finding more and more of how involved not only hunter biden was but also james as well as joe biden and he has not been truthful with the american public. >> a well-placed government source told fox news that hunter is a target of the federal probe. but said that president-elect joe biden is not a subject or target of any grand jury investigation at this time. joe biden has repeatedly denied being involved in his son's business dealings. meanwhile, this comes as the biden transition team has yet to announce the president-elect's choice for attorney general. some lawmakers raising concerns about the future of the investigation and some even suggesting the appointment of a special counsel to ensure it continues. >> so many of us have gotten used to in the era of trump that being a normal question.

joe biden will not run the white house as a family business as president trump has and will not interfere in decisions made by senior leadership in the department of justice. he won't view the attorney general as his personal attorney. >> fox news in october first reported that the fbi subpoenaed a laptop and hard drive linked to hunter biden in connection with a money laundering probe. now, sources tell fox news that laptop is being looked at as part of the federal investigation into hunter biden. carley, todd. todd: thank you very much. joining us now with his take on the hunter biden investigation, former assistant fbi director, chris swekert. let's start with the ukraine piece. you say this is another sign that this investigation is way bigger than just tax fraud. why? >> yes, certainly heating up. the fbi agent that took custody of the computer from the computer repair company slipped up a little bit. he left a file number on a receipt that he gave the shop which is standard procedure.

it indicates there's a 272 case open of which is a money of laundering case out of baltimore. so i think there's something more serious, far more serious than just a tax case here. it could very well be a money laundering case and when have you money laundering cases like that, this is a generic money laundering designation, that means you have illicit funds or at least reasonable indications that a allow you to open of up a full investigation. each money laundering count carries 20 years. it's a powerful statute. carley: wow. and this also goes deeper than just hunter biden. we heard in brooke's report that hunter biden requested keys for his new office mates, which included his father and his chinese business associate. so the real question is why would joe biden lie about not having any knowledge of hunter biden's foreign business dealings when clearly he did.

>> because it's highly embarrassing. and i think, i hate so say it, i don't think joe remembers what he said yesterday a lot of times. what happened two or three years ago probably pushed out of his mind. but i think that this investigation is heating up. i don't know that it's going to lay a glove on joe biden, but it does look like hunter biden is in some serious hot water here. todd: there's also the part of this, why are we just finding out about this now? here's peter switzer on what he calls media disservice. take a listen. >> a grand jury was impaneled in 2018 to look into hunter biden and his foreign dealings. nobody in the national media took it upon themselves to actually pursue that story. it's a massive disservice to the american public. we have a national media that wants to protect certain powerful figures and wants to go after other public figures. todd: why was there seemingly

no intellectual court or potentially more sinister motives about this up until now? >> i think everybody knows that the mainstream media is very political in that sense and you see them covering -- basically covering for both bidens, quite the opposite in the case of trump and the russia inquiry and all the things attendant to that. so i will say this. chris wray, as the fbi director, has done a good job of not leaking information about this investigation. that's appropriate. what jim comey did was not. carley: you know, we are running of out of time. but i want to ask you one quick question. it's a very important question. if joe biden did receive some form of payment from this chinese company linked to the chinese communist party,s if he did, do you think that that affects his ability to be our commander in chief? >> without a doubt. when i hear him say that china is not a threat and china is not

competitive, he's either clueless or he's sticking his head in the sand. they they are the greatest threat to our national security and have been for quite a while. they've been stealing us blind. carley: criminally, this has so much to do with hunter biden but there's so many more implication toss the story that involve the current president-elect. chris, thank you so much. we appreciate you joining us. >> thank you. carley: meantime, a former aid to new york govern for andrew cuomo is accusing him of sexual harassment. lindsey boilen making the claim in a series of tweets saying in part, governor cuomo sexually harassed me for years, many you saw it and watched. she said she was harassed about her looks and grilled about her work. she did not cite specific examples. he shocuomo denying the allegat, his press secretary telling the associated press there's simply no truth to these claims. todd: president trump slamming the cleveland indians for reportedly planning to change the team's name.

carley: welcome back. homeland security ordering federal agencies to check their networks after a suspected russian cyber attack. todd: trey yingst live for us with more on the hack. trey, good morning. >> reporter: good morning. russian based hackers are believed to have launched a major cyber campaign over the past several months against key u.s. government agencies. these hackers reportedly targeted the u.s. department of commerce as well as the u.s. treasury. one government of usual telling reuters, quote, this is a much bigger story than one single agency. this is a huge cyber espionage campaign targeting the u.s. government and its interests. the department of homeland security is asking all fisslan s to look at areas where they may have been compromised.

the wall street journal reports that hundreds of thousands of u.s. networks were exposed to potential risk. russian's foreign ministry responded, calling it an unfounded attempt by the u.s. media to blame russia. we know that russia has you routinely targeted the united states with cyber attacks. it's being described by u.s. officials as espionage. carley: trey yingst, live for us in jerusalem, thank you. todd: as homicides soar in seattle, the city's considering easing punishments for some crimes under a so-called poverty defense. here to react, seattle correspondent, ari hoffman. here's what you can get away with by claiming the poverty defense if it goes through, the crimes include theft, trespassing and assault. you have to claim you're poor, addicted or have a mental issue.

is that the answer to solving the rise in homicides. >> of course it's not. right now in seattle they have spiked, the scrims hav crimes hd up to 300%. homicides have more than doubled. seattle politician's solutions is to just decriminalize crime. hundreds of misdemeanors will no longer be considered crimes if you can display you have a mental disorder or a drug abuse or it's a crime of poverty and you display that you have a need. well, i feel the need to go to nordstroms and get some new suits. we can't always get what we want. unfortunately, that's what these people are doing. that's why so many businesses, so many residents are fleeing downtown seattle because the laws right now are not being enforced. todd: there are somehow proponents of this idea, one of them the king county director of public defense, this individual writes this is not that we don't care about the business community or of about people who have experienced harm. it is that we know this process,

this processing of human beings through system is harmful to our of clients and racially disproportionate and also not getting business owners what they need either. how is basically allowing crime in any way, quote, getting business owners what they need? there's a disconnect there in my mind. maybe you can help explain that. >> no, i can't and i wish i knew what the end game was. pete hemes holmes, the city att, says this is the policy he's been enacting in his office for years which explains why there are massive spikes in crime because they're not prosecuting anybody. when they do arrest them, they turn them loose the next day to go backed an back and reoffend. the residents and businesses are leaving in drove. todd: you gave me a great segue, the nypd says 88% of nyc gun suspects have been freed this year as shootings soar.

they are blaming bail reform. to that earlier point of sort of forgiving crime immediately, how does an idea like bail reform become reality when those who enforce the law, i.e., the nypd think it's a horrible idea? >> it is a horrible idea. it was pretty much taken from seattle. we're coming up on the one year anniversary of bail reform. last year, over hanukkah, which we're in the middle of right now, the jewish holiday, there were a ton of attacks against jewish targets and those people for the most part, the perpetrators, were released back onto the streets right after committing these horrible crimes. it was just the beginning. in new york it's almost impossible to have a firearm to protect yourself, yet the criminals have them. todd: it's a fascinating time. i don't know if there's an end in sight. we keep on doing more and more of these segments where crime is no longer crime. ari hoffman, we appreciate your time this morning. thank you very much. >> always a pleasure. carley: starting today indoor dining in new york city once again banned.

carley: indoor dining in new york city, banned yet again. more than 8,300 restaurants have already closed in the empire state and more expected to under the strict new orders, taking effect today. with me now, two new york city restauranteurs and new york city councilman, joe barelli. sean, i'll start with you. the governor shutting down indoor dining once again in the middle of december, when it's starting to get really cold outside. what is this going to do to your

business? >> effectively now we'll have to close because with the weather forecast this week and there's a nor'easter promised, it's just not sustainable to expect people to sit outside. we just have no option but the to close again. carley: that is so sad again. tyler, before the governor shut down indoor dining, restaurants were only allowed to serve inside at 25% capacity. describe what that looked like in your restaurant. that doesn't sound like an environment where people would be climbing all over each other, which would lead to an increase in spread. >> no, let's be clear. inside dining at 25% capacity was well-spaced, adequate tables, responsible adults wearing masks, washing hands and being respectful of each other's space. what we have created here is a safe environment now with personal heated private dining cabanas outside on the sidewalk. it's incredible the atmosphere right now. and a i just hope we can survive.

carley: i sure hope that for you guys too. joe, you have been one of the only elected leaders in new york city to be talking about data and how important the science is to back up these closures. we have some of that data right now. it shows that the top five sources for covid-19 spread in new york city, household and social gatherings at 73%. you see restaurants all the way down at number five. 1.43%. so how can the governor rationalize shutting down indoor dining when you see statistics like this? >> look, carley, i don't know. i rack my brain to try to go through history and come up with one example of a politician announcing a policy that's so harmful for his own of constituents while simultaneously announcing the statistics that show the policy will be completely ineffective. the truth is, you have almost no chance of getting covid by the

governor's own statistics if you're eating in a restaurant in manhattan and many other places around new york city. it's not even being done fairly. that's why it's so much of a problem for so many new yorkers. manhattan actually has half the positivity rate of the state-wide average so there are places in upstate new york and else wear, long island, that have so much higher averages but they're allowed to stay open. i don't want them to shut at all. but it goes to show you that fairness is not part of this governor's playbook. carley: sean, it seems like restaurant owners are being treated as scapegoats for elected leaders who want to feel like they're doing something so they're shutting down businesses even though the science isn't there to back it up. >> yes, it makes no sense. as joe just mentioned there, the most us fro frustrating thing -- obviously we want every restaurant to stay open. the rest of the state is 50% since june 3rd. where is the da data to say youe

safer in westchester than you are in new york estimate we follow all the protocols that was introduced, spent a lot of money and there's no data to say that you're safer in westchester or long island or montauk than you are in new york estimate that's the most frustrating part for me, apart from having to lay off the staff again, is just where is the divide. carley: just a few weeks before christmas which is so unfortunate. tyler, there was a survey out in november, it says that restaurant operators who say it's unlikely they'll still be in business six months from now if no additional relief packages are brought forward. and in new york state, that number is at 53%, nationwide, 37%. what say you? do you think you'll be able to survive this? >> i'm a person of positivity and i'm going to tell you right now, we aren't going anywhere. cuomo is not stopping us. de blasio is not stopping us.

these individuals are doing nothing short than stealing personal liberties. look, the virus affects people. no doubt. if you're sick, if you're old of, you need to stay home and let everyone else get back to life as normal. we have an incredible program here and by far we are the best cocktail bar, restaurant on the upper east side and i want you to come visit us. carley: okay. joe, what will new york city look like in a few months if these shutdowns stay in place? >> well, look, i mean, you're already starting to see the trickle down effect of restaurant closureses, not to mention their suppliers are starting to go out of business, small mom and pop landlords are running out of income to sustain their buildings. the truth is that if we don't recover our small businesses in this state we're going to have a very long and serious financial winter in new york state. the way to cut that off is to be very aggressive in reopening right now and giving some sort of aid to these small
