vaccines. this seems to be great news. what i'm stunned about, according to gallup only 63% of the country is going to take it. 37% say i don't think so. what also bothers me 49% of nurses in miami when surveyed. miami-dade county said they won't take it. and about 50% in new jersey over the summer of nurses said they won't take it. so, to me, in a country that accepts polio and measles and mumps, why is this the line in the stand for way too many people? steve: good question. keep in mind. as this rolls out, this is just the first link in the chain. the "wall street journal" has this great item today that talks about what all is involved in getting it from that factory in michigan to you. they say the effort realize reas on chemists, truck drivers, data scientists, farmers and healthcare workers. sings it takes these ultra cold freezers because these doses have got to be kept at 94 degrees below zero.

of those biden ballots under the table with the black dress and they took them and started shoving them into machines. what happened to this country is we were like a third world country. and i do worry about the fact, you know, you asked the question illegitimate president. that's what i worry about. brian: so part 2 of the interview a little bit later on in the hour. talked about 13 minutes. the president dolls, rudy giuliani, over the weekend came on and said no, we are not done yet. he has individual states from arizona and pennsylvania. is he going to challenge again. today at noon, guys, steve as you know. they are going to certify the electoral college. ainsley: many republicans agree with the president. if you look at the fox news poll 77% of trump supporters believe that this election was stolen. 68% of republicans believe that and 10% of democrats told fox news that they agree that it was stolen. the president says he is not done. you know, he is a fighter. i was shocked that the supreme court voted the way that they
3:40 am
did because i thought the best argument the president had was the constitutional and he has put so many constitutionalists on the supreme court. but they said texas doesn't have the right to, what walls their wording. doesn't have standing in other states. and the president thinks that they are just too chicken to take this on? steve: brian, i'm shocked that a sports guy would leave out the headline from the army-navy game the score army 15-navy 0. brian: my bad. 100 percent. ainsley: pete is happy this morning. steve: a week before they leave for christmas break all eyes on capitol hill this morning where senators are set to unveil a bipartisan covid-19 relief bill, finally. >> it hasn't fallen apart. we have been meeting day and night for the last month. we were on that call all day yesterday. we get on the call again this afternoon to finish things up. we will have a bill produced for the american people tomorrow. $908 billion. this is only until april 1. we are trying to get through the toughest first quarter of our country that we have ever faced.
3:41 am
steve: all right. here with reaction. new york republican congresswoman elise stefanik. congresswoman, good morning to you. >> good to be with you, "fox & friends." steve: it's good to have you as well. listen, it's great that they are finally getting around to something. it's not as much as the democrats in your chamber wanted. explain, if you you would, why it sounds like they are going to split this thing in half because they think that that's a better way to get things done? >> well, unfortunately speaker pelosi has walked away from the negotiating table for months. and i trust leader mcconnell and his judgment to how he can deliver needed relief to the american people. it's important that we provide additional support for small businesses through the paycheck protection program as well as support for hospitals, the vaccination distribution effort for operation warp speed needs additional funds. what they are having to split off is the democratic proposal for state and local aid but also importantly the republican proposal for liability protection, which i strongly support. we need to make sure that small
3:42 am
businesses manufactured, any place of work is protected from those endless liability lawsuits. because our small businesses are working so hard to keep their employees safe but also safely get people back to work. but i'm optimistic that we will get it done next week. steve: you are talking about getting employees back to work. couple employees after christmas 12 million americans unemployment going to run out. bernie sanders have come to the same point of view that there needs to be another round of individual checks sent out to americans. where do you come down on that, congresswoman? >> i think it is worthy of discussion. i think there are clearly still millions of americans who are suffering, of no fault of their own. and even look no further than new york state. the worst governor in america. governor cuomo has ordered a shutdown of restaurants. so a lot of people are going to be out of work as we are heading into the holiday season. i think we need to have targeted support. targeted aid directly to individuals.
3:43 am
so i'm open to that discussion. steve: okay. you, of course, that's going to all be happening in the senate later today. you are in the house of representatives. big story broke at the end of last week and that is eric swalwell, who sits on the house intel committee, turns out about five years ago he had a relationship with somebody believed to be a chinese spy nancy pelosi has got no problem with it she is not concerned. but then again she knew he had that relationship. and, yet, she placed him on the house intel committee. >> he needs to step down immediately from the house permanent select committee on intelligence. it's not just that he had a relationship with a communist chinese spy. it's that she fund raised for him. she placed an intern in his office who is affiliated with the chinese communist party. that's infiltrating an official office. and speaker pelosi was made aware of this, but she did not brief her colleagues in the gang of 8, which is the leadership
3:44 am
that gets highly classified intelligence briefing. not only does he need to step down from the committee but he needs to appear before the ethics committee and speaker pelosi needs to come clean with the american people as to when she knew, why it was okay for her to keep eric swalwell. never should have kept that seat on the committee. this is disturbing. he owes his constituents answers. steve: well, you know, that's point of view because you are a republican. right now the house is run by democrats and you know nancy pelosi is not going to call him before the house ethics committee. >> well, it's not because i'm a republican, steve. it's because i'm an american. and i understand that one of our greatest adversaries is the chinese communalist party. steve: yeah. >> whose size and scope of their influence operation sls very, very concerning and one of our top threats. to say have a member of congress on the house intelligence committee who is privy to the most classified briefing, he needs to appear before the ethics committee and republicans
3:45 am
really every member of congress should continue to ask these questions of speaker pelosi until we get answers. steve: well, we have a lot of questions and he has not provided hardly any answers. elise stefanik, thank you for joining us today. >> thank you. steve: all right. it is a quarter before the top of the hour. and janice dean it's going to be a sloppy afternoon here in new york city. i see that blob heading for new york. janice: yes. what's behind the blob could be our big blockbuster storm before christmas. let's take a look at it real quick. here is our first round of mainly rain along the coast. we will get some interior section snow. but this is not the main event. the main event is coming wednesday and thursday. what this storm will do is set the table for cold air to be in place and bring, perhaps, a really big snow maker, a blizzard, perhaps event for parts of the northeast. so let's take a look at it. there is the forecast radar as we get into wednesday and thursday. i will remind you that two of
3:46 am
our reliable forecast models are in a bit of a disagreement as to how weak the storm is going to be and how close to the coast it's going to be. so the euro model is one that's going to bring us, perhaps, really big snow totals. the gfs model, the american model, is a little weaker and brings the storm more offshore. which could bring more snow totals to the i-95 corridor, so the bottom line here, steve, is we have to fine tune the forecast, but someone will get at least a foot of snow and it looks like the interior sections, but the i-95 corridor including all the big cities, boston, new york, need to pay close attention. i will bring you the very latest. back to you. ainsley: restaurants in new york are closed down for indoor dining. they rely on outdoor dining and with this blizzard they are not going. steve: i have heard if there is over a foot of snow they have to take down the structures completely if it's a tent or whatever they have to take it out of the street. brian: 1% of the cases are from
3:47 am
indoor dining. 1%. ainsley: carley has more headlines for us. carley: gunman shot dead by police after opening fire at a new york city cathedral. [gunshots] carley: police returning fire on the suspect after he fired several shots on the cathedral's steps just moments after an outdoor christmas concert ended. no one was hurt in the shooting. police say the suspect brought two guns. a full can of gasoline, multiple knives and a bible to the cathedral. homeland security ordering federal agency tolls scour their networks for compromises after the treasury and commerce departments are hit in a cyber attack. according to rioters the hackers are believed to have gotten in by tampering with software used across executive military and intelligence agencies. they also broke into one
3:48 am
agency's office software monitoring staff emails for months. russia is reportedly considered the main suspect. its foreign ministry denies any involvement. those are your headlines, guys. brian: thanks is much, carley. appreciate it. coming up straight ahead spend months defunding police why are they complaining about lack of police protection? try to find out after the break. everyday you're eating acidic foods; you're constantly weakening that enamel structure. pronamel repair allows more minerals to penetrate deep into the enamel layer and it repairs it. it is pretty phenomenal.

brian: black lives matter activists slamming d.c. police for not protecting them during a pro-trump rally. complaints come despite their calls to defund the police. todd piro is live in the newsroom are more. todd? todd: good morning to you. the dc branch of blm not holding back during a sunday press conference, listen. >> allowed white supremacists to come into this space they said no right to be here. they came to black lives matter to attack [inaudible] npd did not stop that. >> npd cannot will not keep us safe. >> activists criticized the mayor and doubled down on calls to defund the police that they
3:53 am
otherwise complained of. four people stabbed. 33 arrested during clashes in the capital. at least 8 officers were injured. historically black church was vandalized with proud boys burning banner. comparing the act to the cross burns by the ku klux klan it is being investigated as a hate crime. mayor bowser condemning the act saying in a statement we saw forces of hate seeking to use destruction and intimidation to tear us apart. we will not let that happen. she has not responded to blm's criticism or their renewed calls to defund the mpd. violence has risen homicides raising 20%, 18 year high. brian: most predictable outcome ever. anxiously? ainsley: democrats far left agenda not sitting well with law enforcement members like our next guest who switched to the republican party claiming his values don't align now with the democratic party. here to explain is fayette county pennsylvania sheriff james custer. sheriff, thanks for being with us.
3:54 am
>> hey, thanks, ainsley, and good morning. ainsley: good morning to you. thank you for what you do protecting that community. why did you decide to become a republican? >> it's like you mentioned briefly, it's the shift in ideals of the current democrat party at the national level. the socialist agenda and this is something that that i have been considering for several months. it started back when the pandemic started. and the mandates coming down by the democratic governors and of which we have one here in pennsylvania that i feel are unconstitutional. and as the sheriff, it is my duty as a constitutional sheriff to protect and serve uphold and defend the constitution of the united states and these unconstitutional mandates being brought down on our citizens and being able to protect their
3:55 am
rights and freedoms under the constitution. ainsley: that's right. i know a lot of people agree with you on that one. did this factor in the defund police agenda. i know law enforcement they obviously don't like that idea. was that a factor when you changed your party? >> yeah. that was a definite factor being that over 30 years in law enforcement starting back from the george floyd incident. and all the civil unrest and the calls for accomplish the police, defund the police that was part of factoring in to my decision that, hey, this is not the what i signed up for. and there is plenty of people out there that are backing us, and that's why i was one of 40 individual sheriffs here in the state of pennsylvania to endorse president trump as our law and order president.
3:56 am
that was a big part of it at the time. ainsley: i think a lot of people in your county agree with you. used to be blue, now it's red. 40,000 republican and 20,000 democrat. more than double the area now. ainsley: what's the reaction from your community you switching parties. >> i would just like to correct that real quick. that's not really the registration numbers. that was the margin of victory for president trump here in fayette county. ainsley: got it, okay. >> republicans are actually probably about 5,000 less but president trump four years ago took fayette county. ainsley: sheriff we have to leave it there. >> 64% of the time. ainsley: we're out of time. god bless you for your service. senator david perdue is going to join us at the top of the hour. if you have postmenopausal osteoporosis

brian: today pfizer's controversies vaccine will arrive in hospitals across america. >> 145 centers getting it across the country. this is absolutely unprecedent. we are extremely excited. >> this is dangerous stuff. we are playing with fire right now. >> speaker pelosi needs to come clean with the american people as to when she knew. why it was okay for her to keep eric swalwell. steve: early voting begins in georgia today. >> last line of deference against this radical agenda. >> no court including the supreme court of the united states has had the courage to allow it to be heard.
4:01 am
if you look at the evidence, thousands of pages of evidence. they say we lost an election. we didn't lose. >> story punch heads across the country. kicked off a plane because their 2-year-old wouldn't wear a mask. >> very humiliating, too. >> first, we begin with a fox news alert. today, pfizer's coronavirus vaccine will arrive at hospitals here in the united states. brian: deliveries are expected in all 50 states. 600 locations. steve: ashley strohmier is live in the bronx in new york city where the doctors are waiting for the fedex guy to pull up. ashley. >> yeah, they are, steve. good morning. those vac sin nations could begin as soon as this morning here at saint barnabas hospital in the bronx. as they are expected to get their first dose, batches of those doses here any time. the first pfizer vaccination seens left several locations in michigan sunday. people were seen cheering the
4:02 am
trucks on as they left. some people even holding trump signs. the first batches arrived at lax overnight. the airport did share a photo on that on twitter. shipments will be staggered arriving at 145 distribution centers today. 425 sites will get it tuesday and the remaining 66 on wednesday. dr. monday self-absolutely claiming concerns about a shortage in doses saying could be approved soon. listen able to introduce 100 million close doses in the first quarter. >> hhs secretaries alex czar says the u.s. is on track to give 100 million doses by march. >> we could have every nursing home patient vaccinated by
4:03 am
christmas. remarkable. 100 million shots in the arms by february is very much in scope. >> president trump says white house officials will not be given priority despite claims from the nfc the tweeting people working in the white house should receive the vaccine somewhat later in the program unless specifically necessary. it is important to note that frontline workers will be receiving the vaccines today along with the nursing home residents. back to you guys. ainsley: this is wonderful news. that's incredible when you hear that every person in a nursing home will get that vaccine by the end of the year. the president also tweeted out in addition to the one ashley just read, vaccines are shipped and on their way five years ahead of schedule, get well, u.s.a. get well, world, we love you all he says is he going to take it at the appropriate time. you mentioned the last few days how the president how bush and clinton and president trump and obama all say they want to get it at the appropriate time.
4:04 am
steve: on tv. ainsley: i think that will send a great message that we need this herd immunity. a lot of people i know are worried about it. i think that's going to die down as more and more people get it. brian: if you are in nursing home and want to see your family, i think that would be the best ticket to make it happen 30's, since polio, measles and what have you. i'm finding this astounding this is their line in the stand and not even shooting the vice knew dr. marc siegel weighed in. >> we want to give it first to those working on the covid wards those working i treat covid patients but i will get it in the next wave of people we have to do it in an organized way. gus perna calls this a d-day
4:05 am
against the virus. we feel that way. nothing compared to d-day to saving the world. we are on auto very similar path here. steve: and then he stopped talking. brian: that's true. i didn't realize. moderna is next and could get the go ahead this weekend. that's two shots. this is two shots. three weeks later you need the other because you have to do it exactly like the study showed it and fda green lighted that way. one will get you 70% immunity, two will get you up to 95 and another one next year. by the time they get to johnson and johnson, steve, there should be one shot. steve: that would be great. because people would appreciate that. i think a lot of people don't want to get the shot because, you know, it became politicized months ago there were people who said, you know, i just don't trust donald trump and his health department. you know, they are trying to get it through before the election. as it turns out it, did not come out before the election. and it was not politicized we heard from all of the experts. what you are seeing on your
4:06 am
television, you know, it is one of the largest mobilizations in american history. this is something here in the united states. it's not just the guys at pfizer who are doing that it's the people who are working the loading dock there. it's the people at fedex and u.p.s. and all of the shipping companies. ainsley: god bless them. brian: the military. steve: it's all of these chemists and pharmacists and pilots. and then when all those people are work, what do they have to do? they also have to make sure that not only do all the places have that super freezer where it's 9. they have also got the needles and the swabs and the masks and the ppe. it's got to all be there exactly the time that the vaccine defrosts. you have got to give the shot to the people as soon as it defrosts otherwise, it goes bad. so what we are looking at something we should be proud of. it the it's not just one
4:07 am
company. it's a lot of americans particularly people in the nursing homes are vaccinated before christmas. ainsley: i look at the vaccines loaded on the truck. all those lives being saved. without this vaccine more deaths more empty chairs around the christmas table as we keep hearing. i'm just so proud of the people involved in this. 95% effective. what if it were 30% effective it would be a different story. amazing. steve: important thing to remember is nearly 300,000 americans have died to coronavirus that we know of so far. they are coming to the rescue. if you have a chance, please consider it because it does appear it does a very good job. brian: we are taking it. steve: as soon as possible let's talk politics and the senate run off in georgia. jonathan serrie joins us from atlanta. you are standing there but early voting starts in that state? >> that's right.
4:08 am
8:30 state farm arena is opening up to voters fulton county selected this site because they can space people far aenhancing social distancing so the people can vote safely during this pandemic. democrats are expressing optimism about the chances of jon ossoff and raphael warnock going into the run off against kelly perdue and kelly loeffler. 1.2 million absentee requested so far just shy of the 1. 1.3 or the duration of the general election. republicans are trying to reassure voters who are skeptical about the outcome of the presidential race in georgia that the party is keeping a close eye on the elections process going into these two senate runoffs. >> we want people to have the confidence to get out and vote. whether they do or not, they still have to vote, maria. we beat them by 2 points in november even with all this potential -- if we get the vote out we will be able to hold the

line in georgia. >> this election will determine the balance of power in the united states senate. purdue criticize out of state interest trying to influence races spending on both runoffs could reach as much as $500 million. back to you guys. ainsley: that is very important these two races. thank you, jonathan. let's bring in g.o.p. senator david perdue good morning to you. >> good morning, guys. ainsley: stacey abrams was on another network over the weekend and talking about a number of people that are voting. she believes it's a sign because there are 85,000 applications from voters who did not vote in the general election. it's a big number. listen to what she said 2 million absentee ballots have been requested thus far and put them into context 1.3 million were requested for all of the general election. of that 1.2 million, 85,000 of
4:10 am
those applications are from voters who did not vote in the general elections and disproportionately between the ages of 18 and 29 and people of color. that signals enthusiasm for jon ossoff and raphael warnock and signals that we understand that we may need to make a plan to vote and deliver this election. ainsley: senator, what's your reaction? >> they are behind where they were in the general election, ainsley. we beat them by 2 points. 52.5% of georgians rejected ossoff in my race and warnock. today is the first day of early voting we are encouraging everybody on our side to get out early. don't wait until january 5th. get out before christmas. brian: senator, right now we understand according to trafalgar has you trailing.
4:11 am
you had 80,000 vote win but you didn't get 50%. do you believe that ossoff has gotten to the point where he is now beating you by a point? >> i'm a outsider to this particular process. back in 14 these same had he down 8 to 10 point. won by 8 then. they had us down by 5 and we won by 2 we just came up a you few thousand votes short of this 50% rule we have in georgia. i don't pay allot of attention. the best poll we have had is the election. again, i go back to that. they didn't get they couldn't get to 48% on the democratic side. we get our vote out in georgia. we will be just fine. we have to remind everybody, we are doing everything we can to plug the holes that we saw emerge in the november election and let me remind the voters. most republicans are voting in person. there is a reason why the democrats are trying to go for more absentee ballots. if you vote in person you have to have a photo id. in absentee ballots you don't. we know some of the things that were done in november and trying to make sure they don't happen
4:12 am
in january. steve: right. we have heard from the president over the last couple of weeks. he says obviously he thinks that even though the numbers right now say that joe biden won georgia the president says he won georgia given disparities and information he has talked a lot about. he says the election was rigged them. i talked to some people down in georgia and they said well the president says the november election was rigged why should i vote in this new election if it's rigged too? >> >> that's a great question that's why we are doing everything we can with the state election board. the state's office and attorney general's office and the courts to make sure that. [lost audio] ainsley: may be frozen. steve: i was reading in the atlanta journal. patrick bell who is the forsythe
4:13 am
he worries about the harvesting absentee ballots and people moving out of the state retained their. and people moving to vote in georgia specifically. senator, are you worried as patrick bell is in forsythe county that people have moved to georgia just to vote. >> of course we are. i mean this is what yang and freidman said. some of these leading democrats come on down to georgia and take advantage of this law. we are trying in the court to make sure resegregated all the people who registered after the november election amend have gotten an absentee ballot provisional ballot to make sure. i come back to say this to the viewers. in georgia, if you are really concerned about the outcome. we are the last line of defense against this radical leftist agenda. we don't have to listen to us. you just have to read what the democrats have put in their national platform. and i believe georgians are
4:14 am
going to stand up to that we are not going to let the road to socialism run through the state of georgia. and if we win georgia. we absolutely save america. ainsley: do you trust what's going to happen in january? i know that the fox news poll shows that a lot of republicans they don't -- they do think that the president, the election was stolen. 77% of his supporters told fox news they believe he was robbed. 68% of republicans felt the same way and even 10% of the democrats. what are you doing in the state of georgia to ensure the people who are going out to vote for you that their voices will be heard and nothing nefarious will happen? >> we are asking to change several things. one is how the signatures are verified. there were a lot of changes going into the 20 -- the november 2020 election. from past practices in georgia when we didn't have this sort of problem. and so we want to go back to the way we used to do it on signature verification is very important. the second are these as you mentioned votes coming from out
4:15 am
of state and make sure the ballots themselves before before they were separate from the envelopes. ainsley: you have less than a month to make these changes and christmas is around the corner. people are going to be spending time with their family. how are you going to change this before the runoff. >> working the courts right now. negotiating with the election board. but the main thing we are doing right now. early voting starts today look all these intransis is occurred in november and we still won we shut them down then. we will not have the degree of intransis is n january that we did in november. brian: won by 88,000 but wasn't enough because of georgia's rules. one buzz term i heard that resonates by georgians outraged by it is defund the police. clearly in a zoom call that number and that stats and bar graphs got back to joe biden. listen to this. >> i don't think we should make
4:16 am
that a big issue going into january 5th when the election takes place down in, in, um, in georgia. i also don't think we should get too far ahead of ourselves in dealing with police form and that they have already labeled us as being defund the police. give me advice, whether we should do that before january 5th. because that's how they beat the living hell out of us across the country, saying that we are talking about defund the police. how much do we push between now and january 5th. we need those two seats. about police reform? brian: he is saying keep the powder dry until january 5th i don't want the truth to get out. >> that's exactly what they are doing. james carville theory lie lie lie up until the election and do what you want. look, this shows the hypocrisy of the democrats and their
4:17 am
platform. they want to defund the police. they want illegal immigrants to vote. they want higher attacks and they want to stack the courts. but obviously they don't want to talk about any of that so mainly what they are spending their money on there down here is attacking kelly loeffler and me. what we are doing, basically right now, is reminding the people of georgia what's at stake here. we won't get a second bite at this apple. this is the very last line of defense against this agenda because schumer changes that filibuster rule we won't get that back. brian: running against a documentarian who is for the green deal whose main client is china. >> i'm running against the guy that worked directly for the chinese communist party in china and, you know, tried to hide it from voters in georgia. he did hide it from voters in georgia. he got caught and lied about it. he has got a bigger connection to communist china than hunter biden or swalwell. i mean, this is a trophy that we really need to get at rubber

stamp like raphael warnock the two most liberal democrats the put up in my lifetime. they are going to be a rubber stamp for chuck schumer in this agenda that they want to perpetrate. ainsley: senator, we wish you all the best. thanks for coming on our show. merry christmas. >> god bless you guys. ainsley: god bless you too. a family booted off of a plane because their 2-year-old daughter wouldn't wear a mask. the parents tried and she wouldn't. twitter is deeming the viral video, quote. sensitive content? this morning those parents speaking out on "fox & friends" next.

4:24 am
exactly. elise, i will start with you. >> so, we have flown united many times. actually flown with her two months ago and we never had a problem. we had been treated very nicely. nobody has ever told us to put a mask on her because she is 2. every public place we go to it's never been a problem. going into that flight, too. we just assumed it would be like it's been for the past couple of months and the first moment that we stepped on the plane right off the bat. we got treated very badly like no how are you guys? good morning, just how old is she? so my husband told them she is 2. and they proceeded to tell us we will have to put a mask on her. and we said well, we didn't bring a mask because she has not worn a mask. they said well, she is going to have to wear it. we asked for them to give us a mask. they gave us one. we went to our seats. sat down, tried to put it on her and between that interaction and us having to supervisor come and telling us we have to get off the plane. there was no interaction between
4:25 am

at aspendental.com steve: we're back with a fox news alert. big box stores with pharmacies are getting ready for the vaccine rollout, that means getting a shot could be as easy as going to your nearest walmart or walgreens, sometimes soon, grady trimbel joins us from a chicago walmart with more. so grady, the question is, everybody has got a walmart in their neighborhood. how soon will it have a vaccine inside? reporter: steve it'll likely be several months but as you said getting the covid-19 vaccine could soon enough be as easy as going to your local walmart. this vaccine is en route to walgreens, walmart, and cvs as we speak.
5:35 am
they will be among the first to receive it. they will administer it first to health care workers and the elderly, they've actually partnered with tens of thousands of long term nursing homes and those nursing homes could start seeing vaccine inoculating their residents by december 21. that's a week from today. eventually, anyone who wants a vaccine though, will be able to get one at any of these pharmacy locations. the timeline for that though, that could be a ways away, some point in 2021. cvs and walgreens in fact are hiring tens of thousands of employees to help with this roll out. in terms of who gets the vaccine , the pharmacy chains won't be deciding that. walmart making it clear, it will not have any say in who can receive the vaccine, but we are ready to support states once they do, that is also the case for cvs and walgreens but all of these pharmacy chains chosen because of their proximity to thousands, millions and millions of people across the country,
5:36 am
steve, it could be very simple once this vaccine is available. steve: okay, we love simple. grady thank you very much for the live shot from the parking lot of the walmart. ainsley: thank you, steve. well, the supreme court striking down a critical challenge to the election, but the president insists the fight will go on. brian: the supreme court would not hear the texas case, it did not have standing according to them and judging by your tweets you're very disappointed in that is it over? president trump: no it's not over. we keep going and we're going to continue to go forward. we have numerous local cases and we're in some of the states that got rigged and robbed from us. we unevery one of them. brian: so what is the exact next step, trump campaign senior advisor steven miller joins us now. steven at noon they are supposed to certify the election and january 6 they are supposed to transmit it with the vice president with the gavel, vice president pence. what would stop that? >> great to be on this morning, thank you for having me.
5:37 am
the only date in the constitution is january 20, so we have more than enough time to right the wrong of this fraudulent election result, and certify donald trump as the winner of the election. as we speak, today, and ultimate slate of electors in the contested states is going to vote and we're going to send those results up to congress. this will ensure that all of our legal remedies remain open. that means that if we win these cases in the courts, that we can direct that the ultimate state of electors be certified. the state legislatures in georgia, wisconsin, pennsylvania , can do the same, and likewise, congress has that opportunity as well, to do the right thing. if you just cured three simple constitutional defects, donald trump is the winner of this election. whether it's the signature matching in georgia that was illegally changed as a result of a consent decree without the legislature's approval or whether it's the hundreds of thousands of improperly-cast ballots in wisconsin, absentee
5:38 am
voters who never actually submitted the request for an absentee ballot or whether you're talking in pennsylvania the clear equal protection violation when democrat ballots were cured in advance of election day and republican ballots were, these are just three of hundreds of violations that we've documented and those three violations alone make donald trump the winner of the 2020 election. steve: right and we know that your legal team has litigated that. you've not had any success with it so far, but steven, explain if you will, what these trump electors are going to do today, because you know if a state went for joe biden, everybody votes for joe biden. you're saying the trump electors are going to come in and say hold on. we're not going to go along with it and cast our votes for donald trump. >> that's right. you have an ultimate slate of electors in a state like say wisconsin or in a state like georgia and we'll make sure that those results are sent up side by side, to congress, so that we have the opportunity, every day between now and january 20, to
5:39 am
say that slate of electors and the contested states is the slate that should be certified to uphold a fair and free election and an honest result. as you know, as you've covered we've all talked about, there were millions of ballots that were cast in violation of plain state law, federal law, the u.s. constitution. you have underage voters you have voters with felony criminal records just qualified from voting in their states, you have non-resident, non-citizens, voters who are deceased, you have voters who haven't lived in the state for years, and you add all of these together and you have donald trump winning the state of georgia, winning the state of arizona, winning the state of wisconsin, winning the state of pennsylvania and i could go on, so that's what these ultimate electors are going to do to preserve our rights to ensure an accurate and honest result to this election. ainsley: so stephen, a fox news poll 77% of trump supporters believed he was robbed, 68% of republicans believe the election
5:40 am
was stolen and 10% of democrats said that they agreed too but what's your next step? the supreme court already reject ed this. how do you plan on, what's the next quiver, what did nancy pelosi say arrow in your quiver? >> well we have open election challenges and all the contested states. take wisconsin for example. that is still working its way through the system and if you look at what happened in wisconsin, wisconsin has a state law that says in order to vote, by mail, you have to apply, but in democrat precincts, instead, they solicited hundreds of thousands of votes from people who never applied to be absentee voters. we have no idea who these people are. we have no idea if they are even eligible to vote in their state or how many fraudulent ballots were included but we do know that those votes were cast in clear violation of federal law and it is also a clear violation of the equal protection clause as well, because republican voters were not solicited to issue those same ballots.
5:41 am
that's still being worked through as we speak and in georgia, any day, the state legislature could stand up and require signature verification in that state. that one act, that one act, would give donald trump the state of georgia. there was a rejection rate of mail-in ballots of over 6% in 2016. after the illegal consent decree , that was done without a legislature approval, it went down to a third of 1% at the same time as the number of mail-in ballots increased exponentially. guys, that's not possible unless there is massive fraud. brian: stephen so if there were underage people voting and criminals voting, if there was illegal ballots cast, your legal team, in almost every state, 50 times lost, so do you have the worst legal team who just don't seem to be presenting good case or you just too late in this case should have been brought before the election? >> we did bring this case before the election, but what you have to appreciate and
5:42 am
realize is that the pressure from the corrupt corporate media to make everybody cave and bend is overwhelming. it is overwhelming and so yes, judges are caving. yes, politicians are caving. we need heros to step up and do the right thing. ask yourself this question. if democrats really believe, if democrat officials really believe that these results are lawful and honest, why are they opposing an audit of the vote? why are they opposing that we take the ballots, we take the envelopes and we actually match them up to real human beings? do you realize that in not one state that's been contested, they've actually done a forensic analysis of the vote to see how many illegal aliens and dead people voted. democrats have opposed that at every single step of the way. meanwhile, we've tweeted out the names and the pictures of the dead people that voted in this election. that's just what we've been able to find. imagine if you did a forensic analysis of the vote. think about it.
5:43 am
using the pretext of covid, state democrats unilaterally changed their election laws for one sole purpose, to facilitate fraud, and weaken every single anti-fraud measure and they did it illegally and now they are trying to cover up the results by opposing audits to the vote. you only do that -- brian: well in georgia they were republican secretary of state and republican governor. steve: that's right. >> and it's a shameful episode and we need signature matching in that state, and if we did, if we did, brian, donald trump is the winner of georgia. we're going to win the senate races too, and if we similarly correct the defects that i just identified in other swing states , it's all over. donald trump has 270. brian: all right thanks so much we'll see what's next. >> thank you. thanks so much. steve: all right, let's bring in jonathan turley, fox news contributor george washington university law professor. so, professor you just heard stephen miller and apparently, the plan is, in these contested
5:44 am
states, the trump electors are going to show up. it was just supposed to be the biden electors but the trump electors are going to show up too and throw a monkey wrench into things. >> yeah, this is what i wrote about a few weeks ago and i called the death star strategy that seemed to be unfolding and that is to force a fight on the floor of congress that has happened around 1870 we had the type of challenge that occurred with the haste-hilden election and it's very hard to do and it's very unlikely to succeed but they can force a question to the presiding officer who be vice president pence, but i still don't see the votes that be available to make that type of shot successful. ainsley: how does that work? what do you mean? they would vote, everyone would cast one vote for who they wanted to be president? >> well to challenge this type of issue you need a member of
5:45 am
both houses. one senator, one house member. the democrats did this , by the way, without all of the criticism we're seeing today , but they actually did it in 2016 to try to block the votes in ohio. this be a more comprehensive challenge. that did not work in 2016, to their credit some democrats condemned that effort. i think they'd have a hard time bringing some of the republicans in on that effort if they try it and it does seem like they're laying the ground work for it. brian: so jonathan i talked to you before the president's interview just to get a sense of william barr did the right thing and the president is very disappointed, to say the least, with the attorney general. not talking about hunter's investigation, listen to this exchange. >> jonathan turley said that he had no choice, he would have been like it would have been like james comey again. president trump: all he had to do is say an investigation is going on. when you affect an election,
5:46 am
