the senate. edward lawrence on capitol hill for us. thank you. >> thanks, dana. >> dana: thanks for joining us. i'm dana perino. i'll see you on "the five." as i promised, 12 minutes ago, here i'll bill hemmer. >> bill: we'll see you at 5:00. good afternoon. back in new york, i'm bill hemmer. the assault on the u.s. capitol bringing questions about what we do next as a nation. the riots were the most significant breach of a government institution since the british burned the capitol during the war of 1812. this time the aggressors were american citizens. numerous questions about security. the instigators were all over the internet warning washington that they were coming weeks ago. no problem. capitol police say four people died. they arrested 68 so far and more

than a dozen for unlawful entry. more than 50 officers were hurt. some seriously. today crews are putting fencing around the capitol complex. an officer on scene telling fox news, this is the new norm that we'll see daily. all of this raising questions. what are the next steps for the president. the republican party, the u.s. congress and the country. ahead this hour, we'll get reaction from lawmakers from both parties and a variety of voices to fill the next 60 minutes. we begin with bret baier and former whitewater independent counsel. good afternoon. >> good afternoon, bill. obviously the big news this afternoon from the cabinet that elaine chao, the transportation secretary resigning saying she could no longer sit by after what happened yesterday. calling it tragic and avoidable.

i think you may stop seeing those key resignations because i talked to a couple of senior officials saying that the consensus now in the cabinet is that they want to stay and be in the positions to steer the next 12 1/2 days if possible. there is the sense of uncertainty about those 12 1/2 days. but talk of the 25th amendment being used or launched with the vice president, that would take a majority of the cabinet and the vice president. it is not in the card, i'm being told, neither is impeachment as an option for disaffected people on capitol hill saying the president should be out of office immediately. >> bill: you cover politician for a living. i'm looking at this populous movement.

happen inside, but also foreign policy. what country is looking at america see. if they see vulnerability to attack in the next 12 1/2 days. >> bill: thank you, bret. want to bring there ken starr. there's breaking news open the hill. nancy pelosi is saying she asked for the resignation of capitol police. now she says she received that. he will be submitting his resignation. what do you think of all the calls for the 25th amendment, the impeachment movement, what do you make of that so far? >> i think everybody needs to return to abraham lincoln and the first inaugural and put a stop to this. and to appeal to the higher angels of our being as mr. lincoln said. everyone that articulates the 25th amendment knows full well that it cannot happen as a practical matter. so it's political rhetoric that is just adding further heat.

country. you know, she was voicing her opinion and she got killed for it. >> at least three others tied for what police say were medical emergencies. this from the d.c. mayor. >> obviously it was a failure or you wouldn't have had police lines breached and people enter the capitol building but breaking windows and terrorizing the people, the members of congress. clearlythere was a failure there. >> bill: that's the mayor of washington d.c. calling for congress to create a nonpartisan commission to figure out what went wrong with capitol security. the army says 850 national guard members are there today. dozens of more across the city. in the past year, we've seen the national guard deployed to cities around the country from portland to kenosha to new york. we're going to bring in retired general jack keane. general, can you understand that? >> in what terms?

>> bill: why they weren't ready. >> well, yes and no. first of all, it was an open secret that this was going to be a very large demonstration, hundreds of thousands of people coming to washington d.c. it was misguided by the president and his supporters to have such a rally because the reason for the rally, bill, was that the constitutional duty of the joint members of congress were executing it to ratify the electoral college vote. it was also well understood that agitators and demonstrators would be likely protest and try to enter the capitol. given that the intelligence was out there and well understood by many people, it's mystifying to me why the leadership of the capitol police department conduct a massive interagency effort and be prepared properly with barriers, fences going up

now and also cordons of additional interagency police and federal troops to protect the building. to do that, you have to set the cordon outside the perimeter of the capitol itself. nobody should have been permitted to enter the capitol grounds much less enter the building. so i think what we're going to find out is that yes, there's a failure there in the planning of this. i think i the intelligence was pretty obvious that this -- there was huge potential for what we saw taking place. >> bill: general, they were throwing up flares online for weeks as we mentioned a moment ago. nancy pelosi says the chief of capitol police will resign. continue, general. >> well, that's probably appropriate. but you know, the other irony, bill, washington d.c. with the metropolitan police force

usually in the lead handles large demonstrations. they're one of the best in the world in doing it. the best in the united states in doing it. like the inauguration is coming up. it will be an interagency effort led by the secret service, the metropolitan police will play a huge effort in doing that. this should have been an enter agency effort. a command and control center should have set up. we'll get to it. there's a huge leadership failure that took place. the good news is, the capitol police protected their members. that's a good thing. they should be honored for that. >> bill: no doubt. >> the other thing that happened here that is very good, the intent of this american mob was not just to enter the capitol, but it was to disrupt the constitutional process that was taking place there. they did not succeed in that. they delayed it. thankfully vice president pence

and the democratic republican leadership in both houses, even though they knew their members were shaken by what took place and let's say that that is very understandable, they brought their members back, to the desecrated building and fulfilled their constitutional duties and they should be commanded for that. >> bill: general, i have about 30 second left. i know you pay attention to events. "washington post" reads this. china is having a field day with the u.k. capitol chaos. i don't know if you saw it, but there's a lot of talk out of china how messed up the u.s. is as a result. >> listen, americans are friends and allies are horrified by what took place. china, iran, russia, venezuela, they're all talking out of both sides of their mouth now and rejoicing and thriving on this. they're hitting us where our sweet spot is, as a core, as a people. here hitting us over democracy.

>> bill: new questions about what was going on inside the west wing after a stunning 24 hours. inside the white house, john roberts reporting that several officials have resigned. others say they will stay until the bitter end to make sure there's a smooth transition in the next administration. john roberts joins me from the north lawn. good afternoon. what are you seeing today and what are you hearing? >> bill, good afternoon. the transportation secretary who happens to be mitch mcconnell's wife, elaine chao, the highest ranking official to say that they're stepping down there the wake of what happened yesterday. in a statement, she said "questioned our country earns intoed a traumatic and entirely avoidable event as supporters of the president stormed the capitol building following a rally he addressed. it's deeply troubled me in a way that i cannot set aside." chao joins a growing list of officials that are stepping down, including mick mulvaney,

stephanie grisham, the first lady's chief of staff, mat pott, sarah matthews and ricky nase a nasetta, john costello. no word from the president since this morning in a statement that was released. the president did have an event today. he presented the medal of freedom to gary player and anika sorenstam. cameras were not allowed in. certainly hearing a lot from people that were close to the administration and the president. he's former attorney general, bill barr, tearing a strip off of the president today in a statement saying "orchestrating a mob to pressure congress is inexcusable. the president's conduct was a

the full secretary of homeland security had been withdrawn. i'm told that that was just coincidental. the deputy press secretary, judd dear, there a statement to fox news saying the withdrawal occurred yesterday. it was not related to wednesday's events or the acting secretary's comments, acting secretary wolf remains the acting secretary and continuing to perform his duties. the president was supposed to address the rnc tonight. i'm told that won't happen. the sources on the ground in florida says the president still does have a large measure of support from the committee. >> bill: a quick question. you know these people well, actually. do any of these resignations surprise you or is there one that does? >> you know, i think the one that surprised me the most is sarah matthews. pottinger wanted to leave after the election but i was convinced by the national security adviser to stay. sarah matthews, you know, i got

results. he was nowhere near the militant that he became. i think the attorney general is exactly right, bill. donald trump incited that grotesque attack on the capitol building yesterday. he bears responsibility. as his friend, i'm deeply ashamed for him and for all of us. i think what happened was appalling. ultimately the four people that died, that blood is on the hands of the president and don jr. and rudy guliani and all of those that helped inspire and excite that mob and sent them to the capitol building as if it was a scene from le miz. it's something i will never forget. this is a deep scar. the president now owes it to history and to the american people to try to calm things down. the attorney general barr is exactly right. this is the time now, the president must man up. he lost this election. it's over. now he has to help calm this

what did you think about that? >> no, that's right, bill. we had commitments on a number of states. once there was the breach of the capitol and the violence and the evacuations took place, when we finally reconvened and there was discussion going on, there was contact made, some of them felt that they didn't want to go on any further. >> bill: what do you make of that? did that give you additional pause? you went forward. >> yeah, no, the -- i didn't really understand the argument. didn't change the constitutional question that we were trying to press. the process, by the way, that has happened three times previous to yesterday, every time by democrats in this century alone. so didn't really change the constitutionality or the questions we wanted addressed

that dealt with electoral integrity. i respect their position. that's what they decided on. >> bill: your positions is the courts went around the legislators and changed the rules. you made the case that tens of thousands more votes came in in arizona than other wise. if that's true, that could have changed the way the stay turned out. that's a heavy claim. can you back that up? >> what my claim was and what is backed up by documentary proof but the additional time to register votes, we have in maricopa county alone more than 32,000 voters registered. around the state we don't have the full tally yet, but believe me, those tens of thousands of people registering to vote in those last extended times, they were unlawful voters. we just received, believe it or not -- >> bill: so you're saying those are illegal votes to this day?

>> oh, absolutely they are. >> bill: maricopa county is phoenix, the largest county in your state. that's where your win and lose elections in arizona. >> that's right. two aspects of it. we have not received all of the voter records to see who voted to compare with those documents until just a few days ago. so we asked for more time and we were never given more time. >> bill: i know what your position is. joe biden will be the president in 13 days. there's this call for unity. do you believe that americans will be satisfied at some point that the election system in the u.s. will be built out of confidence? or do you believe in a democratic system, this is just the way it is every four years? >> well, with i don't want it to be this way every four years. but until we actually can have more transparency in elections, until we say look, let's audit

yesterday. how to sort it out, dr. marc siegel with some knowledge. here's the issue. the state level, the vaccinations have been sticky. cdc says we're up to about seven million. that is well under the number we were told by the end of december. what is the issue? >> well, first of all, there are not enough vaccine centers. that is starting to change and more and more portable vaccine centers are being held, more money from the federal level. too much variance from state to stay. governor cuomo says firefighters, cops, not yet. jersey, governor murphy saying firefighters and cops now. let me tell you what the problem is. if you set the line at healthcare workers and say i'm going to vaccinate healthcare workers right now, you wind up with healthcare workers that don't show up or noncompliant or giving to it too many administrators. if you widen the net and say let's get it to nursing homes, let's get it to everybody over

the age of 65 the way governor desantis is florida is doing. cops and firefighters are on the front line. get them vaccinated. the more you broaden it, the more vaccines in people's arms. six million have been given so far. that's not near enough. the supply will open up. we're giving about half a million doses a day. we have to get to a million doses a day especially with the spread like this. >> bill: you speak to members of operation warp speed all the time. could the feds help give better guidance to states? if they could, what would they tell them? how could you make this better? >> yes, i do speak to them all the time, by the way. i interviewed dr. hahn, head of fda this week. i interviewed dr. adams, surgeon general who has his heart in the right place. the states don't always follow their guidance. cdc has a careful map of what gets what went.

i have a problem with that map. i like what florida and texas are saying, which is give it to everyone over the age of 65 first and healthcare workers. bill, you know why? over 80% of the deaths from covid-19 are those over the age of 65. it doesn't stop at 75 or stop at the nursing home door. we have to give all of our elderly and then we have to give our workers on the front lines. that includes cops, firefighters, healthcare workers and emergency medical personnel. >> bill: do you still sense resistance to getting the vaccination from some? >> much more than i want to see. bill, think of it this way. glass half full. we've given this vaccine to six million people. the media would be all over this like insects at a picnic if there were a ton of side effects. this is a safe vaccine, both the pfizer and the moderna. a huge success story in terms of safety and effectiveness. everybody needs to take it as
