it seems the rules are applied unequally and we have lived under incredible tension on top of that for the last year. as predictable as day after night, big tech followed up on what they gave us a taste of pre-election. last night when twitter said it would permanently ban president trump from its platform of 88 million followers. the slide down the slippery slope began. censorship in the united states is the biggest threat to our freedom right now. social media is the broadcast medium our generation. it's how we communicate. it's how we get news, it's how we share our thoughts, persuade, dissuade, argue, how we laugh, emote. there is a reason freedom of speech is in the first amendment. it's the essence of our american

way. suddenly silicon valley, jack dorsey and company, they get to decide what speech is acceptable, anointing themselves as arbiters of whether what the right says is allowed to be heard. the amazing part is the united states supreme court repeatedly held that even hate speech is protected speech and cannot be regulated because it's part of our fundamental right of free speech under the first amendment. i don't like it when kamala harris goes on twitter to raise money for criminals so they can commit crimes again. but i would fight for her right to fight for it under the constitution. even the aclu has criticized the move by twitter. an apple has removed parler from its platform.

when you are removed from these platforms were the subject of derision and dismissal from your job. if you are on the left you are rewarded with a job and head of your department at the university. censorship is destructive to our free and open society. how can anyone possibly believe this is good. forget fair. the idea that people get to decide whose speech is suppressed and whose isn't is outside our american framework. as big tech continues to suppress conservative speech, the inability of americans to get the facts will be even more dire, drawing a politically influenced distinction between the truth and a lie which will create even more chaos. fiction often drives people over

punish that. the company said they started their companies so people could connect with each other and have dialogue. now they are doing everything they can to try to stop it. that's a problem for us. judge jeanine: you are in the united states senate. there are issues regarding anti-trust, monopoly, the communications decency act, unity. what do you expect congress to do, what can you do, and what can you do if the democrats have the house, the oval and the senate? >> the democrats do have the house and the oval. so we'll find out what exactly that looks like in the days ahead. we said in the senate we want hearings. there have been hearings in judiciary. we are working through the process to determine the best way to address that. we'll see if the democrats kill

wednesday you were in the senate chamber when all this happened. i suspect -- why don't you tell us what your emotions were when you first realize there was a breach. >> it was a difficult day. we knew there were a lot of people with strong opinions. we bring it out in the senate and the house and we talk about it. that's what we do as americans. there was a push to say we can't talk about this, we can't discuss it. we know things get out when you start talking about it. i was part of group that said let's talk this out. we herd one of the house office buildings had been breached and the outside area. we are getting noise as people are tracking it online. we were in the middle of the debate. we didn't know what was happening. i was speaking in the senate at the time the notification came we have protesters inside the building and they are actively coming to the senate chamber.

i was actually debating and i looked up and saw the vice president being pulled out by his security team. they said there are protesters in the building, we have to shot this down. it was a disappointing day for us as americans. as americans we are better than this. but we know there was a group of people who were so angry they let their anger get out of control and they should be pros cuted for it. judge jeanine: one of the things going around on the internet, it was antifa and wasn't really maga. one of the i am ands was an b one of the images they had. they said look at the police. the police are bringing antifa. and then they showed the buses. behind the buses were more police cars. can you explain what that was about? i can. i am stunned that i am hearing

we knew they didn't like people on the right and didn't like the president. but apple is take down parler which is pretty much a right conservative communication social network. how far can this go and as a congressman what can you do? >> judge, a lot of alarming things about last week. but the censoring from big tech has been going on for a long time. the washington posted article that's been proven correct about hunter biden was banned by twitter. we need conservative alternatives. it's really just free speech alternatives. it's what started fox news. all the mainstream media prior to fox news being created would only tell the left's story. there was no fair and balanced reporting and it created a vacuum. there is a need for more parlers and public squares, places where

people can go to talk about ideas. conservatives are being silenced by big tech and it's a serious problem. judge jeanine: what can you do? can you take away their immunity? the doj is suing them for anti-trust violations. when is the government going to regulate these people? >> if you look at the laws already, they don't qualify for the protections of the law because those protections section 230 or others are there for people who are true public squares, town halls. that's not what they are anymore. they are censors and publishers. the ayatollah can post there. once they say they will allow certain speech, but not all speech, they don't deserve the liability protections.

so all of that needs to be addressed. >> i know that. but this is the next hill for people on the right. we can't share our ideas, our thoughts. we can't learn about what people are saying who are conservatives or republicans. this is major stuff. but i want to segue back to election integrity. there are millions of americans who are not happy with the election and don't trust what happened. i know it's up to the states. but can be done by the states to insure that there is signature verification or voter i.d., or the mail-in doesn't change the election laws a minute before the election. what do you recommend so americans people comfortable with a free and fair election?

>> what we have got to get back is to what our founding fathers laid out in the constitution. legislatures are the party that's supposed to determine what election looks like in each state. i don't want the federal government run can the elections. you look at some of the changes made in the last minute. it wasn't through legislative bodies. they went to a court where they shot they could get a favorable opinion and got rid of things like voter i.d. and added same-day registration. things that make it rife for voter fraud. in my state we confronted voter fraud that had been going on for decades. everybody ought to play by the same set of rules. that's something we need to address. we need to find out the rules on election night. when a large state like florida and texas can get their returns

around people. the president suggested he will find another platform. do you know what he's thinking or what his options are to communicate with the public? >> i don't know specifically. i wouldn't want to get out in front of him. but the president has been very successful first as a candidate, and then as a president bypassing the mainstream media. he never had to call a press conference. and the notion they can ban twitter and fn * and others can want leader of the free world, the president of the united states, think of what that does to every day americans who want to disagree on one of those social platforms. if they can do it to donald trump, the president of the united states, they can do it to anybody. that should scare everybody. judge jeanine: with this impeachment effort they say they can get it through the house next week, and they may try the president once joe biden takes

let's talk about big tech, section 30. for some reason they get protected. what can we do about their protection? >> the law should be reformed because the courts are misinterpreting it to allow them to participate in discriminatory censorship. they locked me out of twitter yesterday after i posted a tweet that they previously found to be not in violation of their rules. they tell me i can't go back on for seven days. it's not just about censoring people for saying the wrong things. they don't want us to be on the internet anywhere. going over to parler may work for some time. but i predict unfortunately that parler won't be around in a few weeks the way things are going. judge jeanine: it isn't. they suspended it today.
