1:16 am
>> entirely correct. because brandenburg is a 1969 case which sets the standard for what it means to incite violence. where is the line drawn between what is constitutionally protected and what can be punished by government. brandenburg says that line is if the speech is to be directed towards causing immediate lawless action, not just that but has to be likely to incite or produce that action. what donald trump did by speaking to a group of supporters and advancing his legal theory that state action during the election in several states was unconstitutional, unconstitutional because the rules of the state legislatures, not new york, that's where i am but in these other states were abdicated in favor of is made by the courts and executive officials, that is actually a theory that at least four

supreme court judges in the pennsylvania case set is likely to stay a true constitutional violation and should have been heard by the supreme court so for advancing constitutional legal argument the democrats are saying donald trump incited an insurrection, that is the most novel outlandish claim ever. >> let's look at a quote from the article for impeachment, this is donald john trump by such conduct has demonstrated that he will remain a threat to national security, democracy and the constitution if allowed to remain in office, this warrants impeachment but a lot of people saying you look at the time, we are down to less than two hands, how many days he has left in office and with the senate not set to return until january 19th it makes you question the argument of what they are saying, not being able to be in
1:18 am
office anymore. by the time the senate gets back he's not going to be. >> mitch mcconnell circulated a memo saying the earliest the seneca point particles of impeachment wouldn't be until an hour after joe biden has been inaugurated as the president so donald trump would no longer be the president. article 2 section 4 of the constitution requires it be a sitting president, not a former president being impeached and it says the president shall be removed from office on impeachment which the text of the constitution requires it be a sitting president. the constitution doesn't make any allowance for impeaching a private citizen and if we go beyond the text of the constitution to the intent of the framers of the constitution, that is supported and at the time the constitution was drafted many states had
1:19 am
provisions in state constitutions that allowed the former president and officials to be impeached but framers and drafters of the constitution to liberally chose not to adopt that formulation. and commentary on the constitution james madison said in federalist 39 easement should only occur during the continuance of the president in office. >> it is crucial to remember what you said, it will be a textual interpretation and if it ever reaches the supreme court, very textual supreme court especially the latest justices so that would deftly go against impeaching the president post january 20th. we appreciate your time. still ahead, wild video is a plane falls from the sky and crash lands, that story coming up. >> a struggling restaurant warns it is last call as bar service remains band in minneapolis, the owner joins us live next.

jillian: it might be last call for some struggling minneapolis bars as they comprise expenses ban on bar service despite the rest of the state using dynein restrictions, the owner of tony jarrett in northeast minneapolis suspend his retirement fund just to keep his bar afloat and he joins me now. thanks for joining us, appreciate it. tell me what the last few months have been like for you and at what point you realize you've gone through the rainy day fund and don't know how much longer you have left. >> we have been closed since august 1st is when the mayor put restrictions on seating at the bar. i have as bar space so i have to close.
1:24 am
the governor lifted the restrictions and we are supposed to open on monday, but he continued restrictions on bar seedings so i have to stay closed. two miles away they are open two miles away from me and i have to be closed. jillian: we are seeing pictures of your restaurant, let's pull up the dynein restrictions that started in minnesota that include bar seating that allowed two her party, 50% capacity, reservations required and the curfew that starts at 10:00 at e in the nighttime and during the day but a curfew when you are able to open, how does that affect you and you think you can open safely?
1:25 am
>> we will be able to open safely. that 50% you are not going to make a lot of money but at least you will be paying bills, there will be money coming in. right now we have nothing coming in. we just went to work. we want to be open and work. jillian: what are your employees saying? >> they are upset. they are my friends. i told him we are going to open up on monday and i had beer coming in, payroll starting on monday and on saturday from a third person i hear we can't open up and i have to call them and say i am sorry, we can't open up because of the mayor. and it is like telling your friend you can't work. it is sad. jillian: what is your message to your mayor? >> use common sense.
1:26 am
people that aren't coming to my bar are going to 2 miles away and drinking. they are still drinking but not drinking in minneapolis, they are drinking a mile away from minneapolis. just open up. it is common sense. use common sense. jillian: how much longer can you go if you have to remain closed? >> i can go a while but i'm worried about other bars that can't. they have rent to pay. i don't have to pay rent, don't have a mortgage but there are 100 bars that have to pay rent. i am worried about them, they won't be able to make it. jillian: thank you for joining us and sharing your story, appreciate it. todd: still ahead many on the left celebrate as conservatives are blocked on social media, jason ran sworn censorship could be coming for the left as well. a pilot puts pro trump flyers on

lasting we have right now is email and i that you can 24 hours it will be shut off too. this is not our civil liberties, they can shutdown a billion-dollar company. this is where we are getting evaluations at overnight. >> parlor, big tech power and democrats cheer on the crackdown. >> jason ran says the left has to worry about the move from silicon valley and he joins us now. let's scroll the list of internet platforms were donald trump has been banned or
1:31 am
restricted. it is lengthy. can we somehow fit them on that screen, there is still a lot but you say the left should be the most worried about this conservative purge. what you say that? >> when i was younger i had a mentor who gave me a quote that simply said imagine the power to censor in the hands of your worst enemy and right now progressive activists are celebrating this because they have the power but they are not always going to have the power. there will be a shift at some point in the power dynamics of washington and at some point republicans are going to have control and is going to be this desire to be vindictive and to pay back and when that happens is going to be this desire for people to step up and help them out and have some compassion for what they are going to rent my fear is this is dangerous going down this road of censorship. my fear is people are not going to want to step up and help them out.
1:32 am
you've also given in to the worst instincts of what purge effective -- activists want to do which is cancel people based on the content of their ideas, the content of their speech. right now they are coming out to conservatives but you think people in the french part of the democratic base are not going to turn on the democratic party which they have already done in the past they are going to be surprised in the coming months if not sooner. >> let's look at this twitter statement on conservatives reporting losing followers, changes and follower accounts can because by a wide range of factors that may be due to on following or because accounts were to be in violation of twitter rules. we have seen a lot in the last few days. we talk about how when people feel your silencing them they are going to want to speak out and be louder and you wonder what that leads to an you wonder if a lot of these decisions are being made too quickly. >> absolutely and it is not just about wanting to be louder, you're pushing some of these ideas further underground which
1:33 am
is what you don't want to when talking about some of the more scary positions and let's be clear there are some folks on twitter or on parlor or any of these sites who have some very odious positions but the idea is to shine a spotlight on them, not push them further into the dark web or wherever they will end up going because there you have a harder time spotlighting it and, meaning fighting back against it using better ideas but also you have them creating their own sense of community which is not what i think any of us want to have happen. >> look at this. i saw this yesterday and this really shed light on a lot of this for me when i pulled this up, the big tech campaign support shows the bias. look at these numbers on your screen, take a look, google, very first one going to the biden campaign, over $4 million
1:34 am
compared to 106,000 to 106,002 trump and the list goes on, microsoft, amazon, apple, facebook letters no comparison. what do those numbers say? >> the numbers say that when we are told there is no left-wing bias, pro-progressive bias from silicon valley they were always lying. they told us there is no anti-conservative bias, we are doing the best we can and when they said that they were giving money towards progressive campaigns, silencing news stories that could have heard joe biden and now the conservative big tech purge is underway, they told us why don't you go ahead and create your own website, they take it down from amazon web services go ahead and create your own apps, they take it down from apple and google and at some point the fear is they are not going to sell you the servers to do-it-yourself. we have lists being compiled of people who used to work for the trump administration.
1:35 am
there's problems here. >> big tech is walking into a section 230 trap especially with a conservative majority on the supreme court of one of these cases makes it up there they are playing with fire and silicon valley and that could bite them. we appreciate your insight as always. tourists at the washington monument suspended, national memorial superintendent says the suspension will last through the 20 fourth through threats from groups involved in the violence of the capital. of the closures are possible throughout the national mall. >> bill belichick is turning down the presidential medal of freedom. in a statement that immigrant patriots head coach selling capital rights as the reason noting the team's actions and addressing social justice last year saying, quote, continuing those efforts while remaining true to the people, team and country i love our way the

benefits of any individual award, donald trump is expected to present them with the nation's highest civilian honor this week. >> shocking video captures the moment a small plane crashes in new york. look at this. you can see it right there. look at that, 20 and cessna going down near a landfill was the 57-year-old pilot reported engine trouble but it is unclear if he called an emergency. he suffered serious injuries but will be okay. the crash under investigation. >> emotional tribute to alex are back from ken jennings in his first appearance is jeopardy's guest host. >> sharing the stage without extra back was one of the greatest honors of my life, not many things in life are perfect but alex did his job pretty much perfectly for more than 36 years. like all jeopardy fans i miss alex very much. no one will ever replace the great alex back but we can honor him by playing the game he loved. >> trebek died in november from pancreatic cancer at 80 years old. you can hear the emotion in his voice. >> governor cuomo reversing course nearly one year into the pandemic.
1:37 am
>> we simply cannot stay closed until the vaccine hits critical mass. the cost is too high. >> social media reaction to the democrat's 7 shift on lockdowns. >> the oldest bar west of the mississippi saved by barstool founder on the emotional reaction as he helped small businesses all across america. you remember rick, her neighbor? sure, he's the 76-year-old guy who still runs marathons, right? sadly, not anymore. -what? you mean-- -mm-hm. just like that. wow. so sudden. um...we're not about to have the "we need life insurance" conversation again, are we? 1:51 am
1:52 am
giano caldwell joins me now. great to see you. the biden team on its inaugural theme, quote, at a time of unprecedented crisis and deep divisions america united reflects the beginning of a new national journey that restores the soul of america, brings the country together and creates a path to a brighter future. that sounds great. are you confident biden is going to do that starting on wednesday 12:0 one? >> uniting progressives and liberals against conservatives and any ideas that joe biden and his team or democrats in general wants to unite americans is a farce. we are seeing already, not that there's a lot of conservatives that feel they are under attack by big tech or the democratic party or the shutdowns across the country they feel they don't have a voice and no standing in his country.
1:53 am
we never been this polarized and we are getting a taste just days before the inauguration of what a joe biden presidency may be like for the rest of us on the conservative side for the next four years and it doesn't look good at all. >> i should be clear when i said when salmon next wednesday it's just that this week feels really long already. the anti-trump measures pushed by democrats. i will focus on the top 3, article of impeachment, 20 fifth amendment resolution and to me for removing lawmakers who supported what happened last week. isn't it in biden's self-interest to get his party to not really try those measures but to really focus on his agenda? i was told the reason we put joe biden into offices to focus on his agenda for america, no? >> we didn't put him into office, somebody did but it
1:54 am
