meanwhile, twitter's ceo defending his company's decision to banned president trump and said it could set a dangerous precedent. snap chat the latest to block the president claiming it's in the interest of public safety. so is big tech keeping the public safe or violenting first amendment rights coast to coast? dan springer reports on the hearing today. mike emanuel on the president's final days. in a moment, robert ray will join me on impeachment. hello, dan. >> hey, bill. this hearing lasted 30 minutes. now we wait for the ruling. basically the judge has to decide whether or not to issue a temporary restraining order that would force amazon to put parler back on its servers. amazon took parler down a few days ago after the riot at the capitol last week. in court, documents said the company had been giving parler warnings for months that it was allowing content on the platform

that promoted violence, rape, murder and torture and that in violation of their contract. in today's hearing, amazon's attorney argued that the events of january 6 changed the way we think about the world. took what was merely hypothetical and made it chillingly real. amazon had every right after that happened with the surge in content, violent content on parler to take that into content. parler has grown rapidly in recent months. now has 15 million users, many coming over from twitter after president trump's account was blocked. the company's lawyer argued today there's no evidence that parler had anything to do with the criminal behavior at the capitol. david grossbeck said today millions of law-abiding americans have had amazon silenced by their web services. the ceo says they're caving to political pressure from the left.

to get to the number that you'd need to remove him from office, you'd have to have a massive shift in terms of the number of senators that would vote for this. to the point that senator graham just made, he's out of office. i don't think republicans would go along with that. seemed like the point is moot. >> bill: so here's james comey on the possibility of a joe biden pardon of donald trump. >> donald trump, he's not a genius but he might figure out if he accepts a pardon, it's an admission of guilt, the united states supreme court has said. i don't if he would accept a pardon. as part of healing the country and getting us to a place to focus on things that are going to matter the next four years, i think joe biden has to at least think about that. >> bill: tom, what do you think of that? >> it's an interesting argument. joe biden would be better off to come out and say, tell the senate, when democrats take control of the senate, look, we

don't move forward with removal of the president. do not move forward with the trial, the impeachment trial. we need to lower the temperature, conduct business, new business, my administration, my agenda and get things moving and put the past behind us. that would be the smarter move politically i think. in terms of getting -- offering trump a pardon, you know, that might be a tough sell with members of his political base and rank and file democrats. >> bill: if you believe this goes nowhere in the senate, what does chuck schumer do? what is the off rampfor him? >> the off ramp is for him to let it do. i don't know the senate has to do anything with the articles of impeachment as they're put forward. they don't have to conduct the senate trial. again, joe biden's already asking and trying to figure out, can we do something to get my nominees confirmed, right? so i can start governing and also democrats are itching to get the first 100 days underway.

right now it seems on a course based upon, you know, the only person that really matters i think wants -- if the house sends the impeachment article over will be chuck schumer. he's commented come hell or high water, there will be a trial and a judgment. i would hope, as i said and i said yesterday, i don't think that is in the country's best interest, but you know, it's difficult to see how -- now that they backed themselves into this corner anyway to come out of it. the calculation changes once the new president takes office. you know, you don't know what you don't know and you don't know what the new president will do going forward, whether he will send any signals to the senate or whether he exercises his own pardon power over the former president. you know, i don't know. >> bill: okay. you said you believe this is about preventing donald trump for running for political office again in the future. that could be the case if you get a conviction.

however, you need 17 republican senators to get there, robert. >> right. so it would require bipartisan support. i think it would require mitch mcconnell to be on board with that course. i don't think that is in the country's best interest. i think 75 million americans supported donald trump and his efforts toward re-election. i don't think it's the job of the senate to preempt that decision. i think it's up to american voters to decide first, donald trump is the nominee and whether or not he's elected to office for a second presidential term. i don't think that is the job of the united states senate. i understand how people may feel differently about that and i think that would be a dangerous precedent to set. >> you were one of the prosecutors so to speak in the -- you were one of those presented the case a year ago this month, in fact. the fact that there's no

evidence, there's no witnesses, there was nothing that was presented in the house side, i have to think that makes the job in the senate more difficult. is that true or not, do you believe? >> i don't think much about what happens in the house, once they commit to a course of returning an article of impeachment makes a difference. i understand republicans say the president was denied due process. that may be true in a political sense. ultimately the process the president is afforded is a full and fair trial in the united states senate. look at how this is going to up fold. you'll have a full and fair trial maybe but you'll have it during the first 100 days or so of a new administration. i don't think that that is really what the president-elect would like to see happen. if he was candid about what he would prefer in terms of beginning a new administration. i think -- put it this way. every president deserves a clean

>> bill: up to 20,000 national guard troops expected in washington d.c. troops are getting the same type of prep before deploying to baghdad or kabul. looks like an invasion. what is happen, jennifer? >> good afternoon, bill. the scene behind me, you can see the thousands of u.s. national guard troops arriving as we speak on capitol hill. we've seen them pouring in to the capitol with m-4 rifles, battle gear. a different scenes that a week ago when you had 340 national guard that were approved for the capitol, unarmed, to serve as traffic cops. that is because mayor bowser, the mayor of d.c. and the capitol hill police did not request the national guard. now capitol hill police are unnerved after the riots and the

breach of the capitol. so the build-up till now, you'll see u.s. national guard armed across the capitol. this feels very much like what you would find in the green zone of baghdad. there's layers of security, very few civilians walking on capitol hill right now. there's fences everywhere. we've been told national security officials overseeing the inauguration prep have spoken with state governors about the threats that they face as the capitol becomes a hard-target for groups that want to disrupt the inauguration. we learned the entire d.c. mall will be closed to the public during the inauguration. security officials tell me they're closing basement parking lots in d.c. near the capitol for vehicle-borne ieds and truck bombs. capitol hill police are so on

the edge after last week's attack that they have requested up to 20,000 troops. more than twice that was mobilized for the obama administration. one website that the feds are monitoring has 1.7 million followers and it's calling for upwards of 100,000 armed protesters to disrupt the inauguration. there's been requested by the capitol hill police for 50 caliber machine guns. that's not been signed off by the pentagon. security officials are weighing whether to ban trucks coming into the capitol. one senior officials said i don't underestimate any of these groups now. many have members who have had military training, there were law enforcement and retired military that did breach the capitol. the pentagon is concerned about how many veterans were seen inside the capitol. the mayor is urging visitors to

with that confederate flag last week. authorities have been searching for him for a week. according to the source, his son hunter facing very similar charges. as i speak to you, bill, social media accounts are going dark. twitter purging them following the riot in and out side the capitol. twitter suspending accounts that violate the terms. many of them deal with people at the riot or associated with that riot. with sites like twitter and facebook cleaning up the space, parler with an uncertain future, the banning of the posts according to law enforcement experts, criminals can go underground. we can't track them as much. >> it's a catch 22. the word is communication, open communication. these groups feel relaxed with each other. to be able to open up or to each

other. in doing so, law enforcement can develop certain tools that give them a great deal of intelligent information. >> yesterday clete keller was charged with entering the capitol. he's 6'6" wearing a u.s.a. jacket. today in court, a man named cleveland meredith who has threatened to kill nancy pelosi on live television, he never made it to the capitol but still charged for some of the threats. also a retired firefighter was picked up near philadelphia. authorities say he threw a fire distinguisher into the crowd hitting several police officers. we're told this is not the fire extinguisher that hit brian sicknick. he died from his injury. authorities looking for his killer or killers. if you have any information, cap the fbi.

we're suddenly scared by it but it's in the news. it's a variant. three variants, three mutations on the virus in ohio. here's the good news. absolutely covered by the vaccine. absolutely. also, these strains are looking for a survival advantage. meaning there may be more transmissable. more contagious. they don't make you sicker though. none of that. >> bill: three mutations not seen before. that doesn't concern you? >> no, because you know what the vaccine does, bill? it looks at multiple targets on the spike protein. many targets. it's so far, it's all of these strains covered by the vaccine. we're looking at the one out of south africa. the united kingdom strain has 23 mutations on it was studied by pfizer and the vaccine covers it beautifully. this is what viruses do. they keep changing like the combination to the vault to

they have. the virus is nailing california and arizona. both ramping up vaccines. arizona has the highest per capita infection rate in the country. one in three in l.a. county have been infected by the virus and many don't know it. like most other states, these two are giving the vaccine to anyone over 65 that wants it. at super sites like petco park in san diego. confusion among consumers. states and counties differ on age. do you need aapointment or i.d.? is it free or does the administration cover it? what about the medical allowances? it's a public education nightmare. some states are doing better than others. vaccines being delivered in west virginia at 69% followed by north dakota, connecticut.
