and thank you for inviting us into your home. that's it for the special report, fair or balanced and as they get ready to move. fox news prime time posted by maria bartiromo starts right now. hello maria. >> maria: it's thank you so much. and welcome to "fox news primetime." my maria bartiromo and as you see we are waiting house democrat delivery of the article of impeachment tonight against former president donald trump to the senate. this will trigger the official start of the trial process, the house charging trump with incitement of insurrection. the child will not begin until the week of february 8th and senate leaders are beginning to pause the process to get both sides time to prepare their cases. we will bring back the anchor of "special report" bret baier and there are a few differences this time around from history and historic impeachment per threat.

>> bret: exactly, this is the second time in 53 weeks that this is happening and it's historic in that way but it's also different in the process. the house is supposed to be this grand jury and the grand jury is supposed to meet in like we saw in the first impeachment. now that is short-circuited end of this impeachment article will go to a senate trial which will look different than the first one. >> maria: it's john roberts will not be presiding over this, he is not a sitting president any longer. >> bret: right. and the supreme court chief justice will not be sitting in the senate. it will be senator patrick lahey. the democrat from vermont and his role. it's going to be interesting to see how the case is moving forward and a lot of what we are hearing is there will be

constitutional questions about impeaching a president who has already left office and that may be a lot of the focus of the legal team as they make that case. >> maria: the other questions about this is ensuring an effort that donald trump cannot run again. thank you so much bret baier. joining me now is house minority leader kevin mccarthy to react. we want to get the g.o.p.'s response to this. your reaction? >> purely political. if the house is supposed to be the grand jury, there was no hearing, no investigation. it was just rushed through and there was no bigger example of how political this is by seeing who one of the manager is is, eric swalwell. eric swalwell who is associated with the chinese spy. i was briefed by the fbi. if any democrat had the same briefing that i was, they wouldn't have eric swalwell,

one, on the intel committee and let alone a manager. that just shows what a farce this impeachment is on they are just plain politics. the saddest part about all of this, what the american people want to have happen, they want to start focusing on putting people back to work and getting kids back in school and making sure anyone who wants the vaccine gets it. but now we have president biden who has gone back on every promise he made, just even a week ago about unity. there is no unity coming out of that, he's killing union jobs and empowering our adversaries. china is -- it's now no longer a policy of america first, it's china first. russia is winning because he's fighting the institution of america about energy and independence. tomorrow i will send him a letter because he just went back and lied to us one more time. he's killing energy independence in america making russia and the middle east stronger. >> maria: i want to talk about the biden agenda and how the

article one. incitement of insurrection. the constitution provides that the house of representatives shall have the sole power of impeachment and the president shall be removed from office on impeachment for and conviction of treason, bribery or other high crimes and misdemeanors. further, section three of the 14th amendment to the constitution prohibits any person who has "engaged insurrection or rebellion" and in his conduct while president of the united states and in violation of his congressional oath faithfully to execute the office of the president of the united states and the best of his ability preserve, protect and defend the constitution of the united states and in violation of his constitutional duty to take care that the laws be faithfully executed, donald john trump engaged in high crimes and misdemeanors by inciting

violence against the government of the united states. in that on january 62021, pursuant to the 12th amendment of the constitution of the united states, divisive president of the united states, house of representatives and the senate met at the united states capital for joint session of congress to count the votes of the electoral college. in the months preceding the joint session president trump repeatedly issued false statements asserting that the president-elect and results with the product of widespread fraud and should not be accepted by the american people are certified by state or federal officials. shortly before the joint session commenced, president trump a addressed a crowd in washington, d.c., on there he reiterated false claims that we won the election and we won by a landslide. he also willfully made statements that in context encouraged and foreseeably resulted in lawless action at the capital, such as, if you don't fight like you are not

going to have a country anymore. thus incited by president trump, members of the crowd, he had addressed in an attempt to interfere with the joint sessions -- 2020 presidential election unlawfully breached and vandalized the capital come injured and killed law enforcement personnel. menaced members of congress, the vice president and congressional personnel and engaged in other violent and deadly, destructive and seditious acts. resident trumps conduct on january 6th, 2021, followed his prior efforts to subvert and obstruct the certification of the results of the 2020 presidential election. those prior efforts included a phone call on january 22nd, 2021, during which president trump urges the secretary of state of georgia brad raffensperger to "find enough votes to overturn the

georgia presidential election results and threaten the secretary if he failed to do so. in all this, president trump greatly endangered the security of the united states and its institutions of government. he would threaten the integrity of the democratic system, interfered with the peaceful transition of power and imperiled a coequal branch of government. he thereby betrayed his trust as president to the manifest injury to the people of the united states. wherefore donald john trump by such conduct has demonstrated he will remain a threat to national security, democracy and the constitution if allowed to remain in office and has acted in a manner grossly incompatible donald john trump thus warrants impeachment and trial and removal from office and disqualification to hold and enjoy any office of honor, trust

or profit under the united states. nancy pelosi, speaker of the house of representatives. mr. president, that completes the exhibition of the articles of impeachment against donald john trump, president of the united states and the manager's request facility order for the trial and the managers now request leave to withdraw. >> maria: the senate has received the impeachment article. we are talking with minority leader kevin mccarthy and we are reacting to this. congressman, the key word there was removing from office. he was already out of office and what happens now, as it means he can no longer run for any office again? >> first they would impeach him but then they have to come back and vote. they could do that with a simple majority, deny him the ability to run again. think for a moment of what time they are wasting.

we are in the middle of the pandemic and he said he would be prepared for this pandemic. he tells us there would be 100 million vaccinations and 100 days. that's exactly what we are already doing. they say they want to remove him from office but if they had done any research, he was already removed from office but if we had a hearing, what we're finding out after the fact is the fbi already knew, before the president had any speech of what they wanted to impeach him with, people were planning to come into the capital. they had worn from these reports, the capitol police. i think it would be a big investigation, to know why didn't we have national guard to national guard here already? when they found that ieds earlier in the day, why did they call the fbi and why didn't they call the national guard? instead they played the

political game. when americans are out of work, we are in the middle of the pandemic and we can't even get our kids back wall. you look back at the hypocrisy, now gavin newsom says he's got to open the state up. why? because election is over. >> maria: right. let me ask you about that because you mention the national guard troops. nancy pelosi has said she wants those troops securing the capital until mid-march. how much did that cost and do you believe that you need national guard troops of the capital now until mid-march? >> you should see the capital, they have barbed wire around it now. it looks like a war zone. remember what nancy pelosi said back in june of 2020 when there were riots happening in washington, d.c., when they were burning a church and others? she said it was scary to see the national guard at the lincoln memorial, they shouldn't be there. what about when they were burning in july and seattle which they are still doing? she called it homeland security.

she made fun of them, and this is what nancy pelosi thinks of the national guard. after the inaugural, she was kicking them out into the winter. >> maria: congressman, as we wrap up here, what are you going to do about it? they are impeaching a former president and you will do what? >> the one thing i first did was vote no. it's a political move and goes against everything we know about the impeachment process. the grand jury gets to call witnesses and the grand jury gets to have a hearing and we didn't get any of that. i hope the senate plays the role and what they should do and votes this down. but we are confronting exactly what joe biden is doing making russia and china stronger. getting back to the american first policy and not china

that happened before the president even completed his speech? how do you charge the president with inciting violence of the capital when he told people at the rally to peacefully and patriotically make their voices heard of? this is really as kevin just said an obsession with the democrats. they tried to remove president trump from office before he got there and they are trying to relive him now that he's already left. it's really ridiculous. 19 minutes after president trump took the oath of office. "the washington post" headline read, trying to campaign president trump, and the american people see it for what it is. it's pure politics and it's wrong. >> maria: pure politics but it's also accompanied by big tax which is canceling drop associates and canceling trump supporter's. you see it and look at social media and it looks like

communist china. >> it's gary what's going on. there are some things he said in his speech that i thought were appropriate, but frankly it's hard to unify when you are impeaching a president that has already left office. it's hard to unify when the leftist trying to cancel 75 million people from speaking their mind and engaging in their first amendment liberties and having a debate. we will have to look at the section 2:30 that has to be changed at a minimum and we have to look at the antitrust issue and breaking news companies up. all these things need to be on the table because, what is going on with the attack on the first amendment? i said this in the committee. do you have a first amendment when only one side is allowed to talk? we all know that it isn't and it is not supposed to be that way in this country so hopefully they will come to their senses. if they don't we will have to engage in those things that we talked about, section 2:30 and the antitrust legislation that

we may need. >> maria: but congressman, is it going to go anywhere? they are the majority in the house and senate in the white house so do you really have the influence that you need to push 2:30 forward and ensure that the is companies are liable for what they are doing? you can get sued by saying something on tv or newspapers and yet anything can go on in social media and they have protections because of section 2:30. >> we can keep highlighting, like you are doing, but we can also look at what's been happening the last couple of weeks, since they suspended president trump these big media social media platforms have lost like $60 billion. at some point these customers will say what's going on here? it sends a right message to these folks who are making it tough for people to communicate and who are trying to cancel

some conservative voices throughout the country. hopefully we will win in 2022 and we can push even harder to get the changes done. i hope we can do it this year and i hope there's democrats that will work with us and we can get the things done i will make a difference for free speech and for the first amendment. >> maria: and president biden has been trying to move fast with his agenda and yet now this. how much time does this take and cut into what he's trying to do? before you go, assess the biden agenda and tell me where you feel there are mistakes or what you feel is most unfortunate to the american people right now. >> we are losing energy jobs which is a decision on the pipeline, which will private, could probably drive up the cost of fuel. he's decided he's going to release 14,000 illegals. how is that good for the country? we have a wall around the capital to protect the politicians but we can't keep

the state department calling the intimidation tactic concerning endless moves come as president xi jinping threatens a new cold war against any nation that would stand up to communist china. and issuing sanctions on those who have pushed back. joining me now is john ratcliffe, former director of national intelligence who has seen all of the intelligence, in fact the most intelligence then anyone except the sitting president. john ratcliffe, it's wonderful to see you tonight. before we get into china i really want to get your take on what we just saw and one of the elements of this impeachment would mean removing any security that president trump has. is that right? >> it would. i will tell you the whole exercise though is silly. president trump has now been subjected to two impeachments and neither one of them he did he have due process.

in the first impeachment he was deprived of lawyers for the first 71 of 76 days, a fundamental premise of his system is due process, and he was deprived of it. it was even worse this time, it was a two day proceeding with no hearings. you have that issue and secondly, it's a farce. there is no constitutional basis to move forward with a trial against as your prior guests, it's certainly not helpful and disrespectful to the office of the presidency. i wish it wasn't happening. >> maria: director, i want to get into china and whether or not you believe that the biden administration will be softer on china. the trump administration obviously was with prosecutions and tariffs. do you believe joe biden would

pull back? >> you talked about some of the things china did but what i will say is both publicly, what china is saying and privately what the intelligence showed us postelection is china is happy that joe biden is president of the united states. a sense of weakness and i don't mean that as an insult to president biden. but china saw weakness from the obama/biden administration and as you pointed out it wasn't until someone stood up to a rising china with different policies and sanctions to hold them accountable in the world marketplace. china wants to see if it's going to go back to business as usual as it was under the obama and biden administration. what you are seeing is they are testing to see whether or not the biden administration will

stand up to china and what's important is your point about the intelligence, no one has seen more intelligence in the last year than i have. so the question is will they. i watched a real haynes rhetoric which was tough on china but that has to translate into action. that hasn't been the history with joe biden and let's hope that that changes because maria, this is not a political issue. this is about national security and we all fail and suffer as a result of that and not taking china seriously. >> maria: we know that china has stated its goals clearly,

overtaking the united states in that regard, not just economically but militarily. the trump administration has pushed back on investors who helped to fund china's expansion by banning investment into chinese companies that are tied to the military. i want you to listen to jennifer psaki, the press person for president biden and what she said about what they are doing right now in terms of the listed chinese companies on the new york exchanges as well as the potential for investment into these companies. listen to this. >> there are a number of complex interagency reviews that are going to take a range of interagency actions in a range of relationships with companies as it relates to chinese investments and other issues as well. those complex reviews are just starting. we are starting from an approach of patients as it relates to our relationship with china.

>> maria: so they are going to review it, john. what do you think? >> i can tell you it's entirely inconsistent with what the intelligence shows. it says we should act with respect to china and i increased our spending on china from intelligence collection standpoint in the intelligence community budget and that ought to increase even more going forward. what i'm hearing are signs that maybe we will back off and we want better relations with china and you know, the path of appeasement is the road to nowhere when it comes to china. give them an inch and they will take a mile. that's how they became our number one adversary and that's how they will supplant us as a world superpower. >> maria: what do you think corporate america needs to understand about the subject because right now as we speak

there are several companies that are gearing up to own and operate their own business in china. jpmorgan has gotten a license to do so, goldman sachs has gotten a license to do so. wait for the first time in several months saw jack ma, the founder and builder of alibaba in the end group saying he made a critical comment about xi jinping's regulatory environment and it like that, is anther group ipo was pulled and he disappeared. that was an important message for corporate who are about to go to china. i would say it's probably unheard of that you actually build a business and make it very big and expect to keep it. jack ma learned that lesson. >> what we seen as china sets up the laws to help china and i get that that's a global

marketplace, but what we've seen is some of our investment banks basically betting on china and placing financial success on china over our own national security. china knows that, they know they can use american businesses as a means to gain intelligence against the american people in the national security posture. so again, it's something i think we need to be more aggressive and learn from the lessons of the past about how china will change the law to their benefit, punish those that speak out against the government there, and china is not our friend in business or in any other enterprise. >> maria: a word on the cabinet, and whether or not there are china appeasers there. susan rice has been named the head of the domestic policy.

and exposing an susan rice is back in business at the white house. >> untroubled by a lot of folks that are being considered and some have already been placed into the biden administration because as you correctly point out, some of those individuals were involved in taking intelligence that we had that show that there was no russian collusion and turning them into a fake russian collusion narrative for political purposes. weaponizing the intelligence that we had and the intelligence community for political purposes and to see the folks that did that now return to the fold in the biden administration which leads me to believe that it's going to happen again and it's all about accumulating and keeping power and making them

america's national security's subservient to that. we suffered as a result of those actions before and we will again. >> maria: john, before you go, your last act as the director of national intelligence was to add the u.s. space for us to the intel community assessment. why did you do that? very interesting. >> time will tell, that will probably be the greatest contribution to the intelligence community and our national security group posture going forward. you always want to have the high ground against your adversaries and there's no higher ground than space. right now china and russia can't compete with us in space and we have intelligence collection streams that we can get that other countries don't have and so it's very important. i was very grateful that president trump and vice president pence were supportive and empowered me to get that done. america will be better and safer

xi jinping's speech in the doubles meeting today but first, your reaction to what you saw today in washington with joe biden now pushing buy america. i must've heard you say that a hundred times of the last couple years. >> you go back to the 2016 campaign and i am grateful that the president was able to sign close to a dozen buy american order is on my watch. we did a lot of good, we doubled the amount of seal and one of the most important things i think for the biden administration is to follow through, maria, on this beautiful essential medicines order that we did in the last few months of the administration to bring in our masks and gloves and ppe and things like that. i would say the order today itself, there were no action

items and it's kind of like go study this. the one thing that caught my eye, and i think this would be a more comfortable in a biden administration, i will be candid with you. i had to fight people like mulvaney and kudlow and they always tried to kill the jones act and that's essential towards rebuilding our american shipbuilding capabilities. i wish the president lock in terms of all a lot more that can be done, i assure you that donald j. trump did more than any other president up to that date. >> maria: he is saying the opposite, but explain the jones act. i want you to react to what biden said today but explain the jones act for those that don't understand.

>> so for example there's a ship that goes from jacksonville to puerto rico and back carrying supplies. those are two points within the u.s., in the territory and the state. they have to have an american hole and it has to be crude and owned by americans. we had a tremendous hit on the jones act but if we can have that we can regenerate and christened the ship down there on the president's watch and it's very important. if the biden administration protects that, good for them. >> maria: peter, do you expect the biden administration will be -- we talked about hunter biden's ties to chinese companies and partnerships with beijing.

do you think that's going to get in the way of being tough on china? >> i think it's not about an expectation anymore, if you look at the way they started out with jen psaki today, this whole going back to the future of the first obama-bite and it administration with strategic patience, that didn't work in the middle ages and it won't work with china. as radcliffe said before me, they intelligence report says that the time for action was yesterday and we really have to be very aggressive. my fear, maria, is they are putting in place kind of the globalist old guard and they think that they can somehow negotiate with the chinese beast. as far as i'm concerned at this point after four years, china and these people are pathological liars and sociopaths who have killed over 300,000 americans with the virus

is running things and in terms of what policies are most important? >> i've said it before but i think it's worth repeating. susan rice is there inside the white house and she's been given a portfolio as to domestic policy. we all know that's a joke. she's run the national security portfolio and certainly has run the u.n. portfolio. she knows the state department and certainly wants to be the secretary of state. we got a vice president who wants to spend most of her time in the senate because of the 50/50 type. susan rice is extremely excited that vice president harris is preoccupied in the senate and this shadow presidency of susan rice is front and center. >> what about policy, rick? president biden wants to get the

u.s. back into the paris climate accord and obviously it has done that on day one. and wants to ensure that we have a partnership with the world health organization also on day one. we are considering -- he is considering the iran deal again. he heard john pataki earlier in the show saying they were considering -- the band put in place. what's your take? >> first of all let's talk about the importance of alliances. the trump administration made the nato alliance a top priority after multiple administrations including the obama-biden administration ignoring the lack of funding for nato after countries in the nato membership promising to deliver and fair share but not delivering it. president trump delivered on that and so he made the nato alliance longer than ever

before. let's look at the paris climate accord. we have continued the united states under president trump continued to lower our co2 emissions. our political will is rock solid towards environmental policies. the reason that we got out of the paris accord is that other countries are not politically astute enough to realize that they have to make progress personally on lowering co2. other countries are not lowering the co2 and they talk a big game but they want us to pay for it. president trump said, no. if you don't have the political will to lower co2 emissions in your own country then why do you think that the americans paying you to lower co2 is going to make a difference? what we have done is put our money where our mouth is during the trump administration, our

record, our environmental record is very clear and very proud of it. >> maria: speaking of the biden administration has banned fracking on federal land. is that all nodded to russia by the way and is it a job killing experiment? also, your thoughts on china and the role that china played in the coronavirus? should there be an investigation here? they were doing military experiments in the wuhan lab we learned later and there were mistakes. >> let's take that second part first on china. u.s. intelligence community issued a very rare statement, a unified statement early on and made it clear that this virus started in china. because of the secret communist china ways that we all found
