william. >> harris, the challenge that president biden has is how does he undo the trump policies he doesn't like without undoing the success trump had in reducing illegal immigration? the chief thing among us right now is something known as title 42. that's the emergency order that allows the when someone is enco crossing the border in the field they're fingerprinted there and taken directly to the nearest point of entry and sefpt back. no detention, no shelter. since the pandemic began that's 300,000 migrants from around the world. >> title 42 is the essence of right now keeping people back. and by taking away the remain in mexico policy and the take away of article 42 you will see a tremendous surge. >> bill: it's already happening.

president trump and visiting fellow at the heritage foundation. great to see you, ken. let's start with that line. the people south of us think they are getting into line to get into the country illegal. how can the line start in a different country? >> yeah, this is the biden effect, right? what the white house said is they wanted fair, safe and orderly. that's what their policies are intended so they say to achieve. and each one of them achieves the opposite. it is not fair to people who have been going through our legal system to essentially throw open the gates to illegals. it is not safe in the border communities or frankly in any of our cities or towns because these folks go all over the country. and it is certainly not orderly. we are already understaffed in the immigration space. immigration judges and officers, and the idea that

they would end the remain in mexico program, one of the most successful programs -- forget in the trump administration, but in american immigration history is utter foolishness and shows they are willing to throw out the things that work simply because they were conceived of and implemented effectively by the trump administration. it is very sad for america and i feel bad for the agents who have to contend with this situation. and of course the border communities that will be most affected. >> harris: it puts pressure on our relationships with nations that are far south of us like guatemala. we've already seen them in one caravan, thousands of people having to use force in some instances to keep them from going north. it does strain those relationships. look, you know, if anybody thinks this is a party thing, a political party thing, they need to listen to

representative from texas. look at this. just yesterday i got a video of about 150 people walking on the mexican side all in a row going to the rio grande so they can cross. they are starting to come up and why i've cautioned the biden administration. i'm waiting for the new secretary to come in and say guys, let's be very cautious. the wall take it down or don't do it but we have to have technology, personnel and certain policies in place. otherwise the bad guys are staging to get people across. who is he talking about specifically there, ken? >> so what he is talking about specifically is that the mexican drug cartels, the most evil force in the western hemisphere, deestablishizing mexico. these evil organizations control much of the country.

they run these pipelines of people. the other things they run in these pipelines are drugs and other illicit products which poison our communities and kill 70,000 americans a year. 70,000. that's who we're facing off with and who runs this operation south of the border. it isn't the mexican government. it isn't the guatemala government. your point, harris, was a very good one. we watched the pictures of guatemala literally holding back an invasion of illegal immigrants at their border and the biden effect encourages more of that. if you are guatemala and you are resource strained and you want to have sovereignty and you want to protect your own country especially in an age of covid and the new variants, what this administration is doing is treating your country like road kill for illegal immigrants and the pipelines the illegal human smugglers set up.

>> harris: they are running right through it. this is something that popped and i'm sure you might have anticipated this would come up. there are now multiple reports, ken, that you signed a last-minute agreement with ice union that gives the union veto power to hamstring the incoming immigration policy from biden's changes. what do you say about those accusations about those reports? >> well, first of all, there were an enormous number of issues with the union for the removal officers that had hung out there through multiple administrations. the last time joe biden was in a presidential administration they could have resolved these and they didn't. we worked through these as best we could and i didn't resolve all of them but i resolved a lot of them for the long term four, five, eight years, things are settled now and look, these are law enforcement officers in a very difficult position.

they can't tie the hands of the administration per se but they get a say. they get an understanding and an opportunity to be heard about how policies will be implemented so they can keep their officers safe and achieve the mission for which they are there, and that is to keep america safe. >> harris: i have one final border question for you. as we look at what has gone on january 6th, the insurrection at the capitol, and then national troops still there. what does it look like down at the border right now? should we be sending -- we are capable of sending in reinforcements. look what they did at the u.s. capitol and it has been weeks. should we, could we be doing something similar at the border? how dire is the impending situation? >> so can we absolutely. and unfortunately the biden effect is creating its own humanitarian crisis with an already overwhelmed immigration system.

one of the things they don't know in your intro there was talk about redoing the asylum system. career immigration officers have been deciding their immigration cases. these are not decided by political people. and a very percentage, single digit percentages actually qualify for asylum. central america, of the 21st century is not central america of the 1980s. their governments are supportive and they are trying hard to work for their people and doing a much better job year in and year out. they do a much better job when we partner with them instead of treating them like road kill like this administration is doing to guatemala right now and that's the path that we took in the last administration. and we generated the best partnership, the most effective partnership on curbing illegal immigration for all of our

countries ever before achieved. and that was done with some very tough, hard nosed negotiating but with operational support from cbp, from ice, from the state department. it was an all of government effort to help our allies do the same job we're trying to do for ourselves, that's enforce their own laws with respect to immigration and that helps us because it slows down the flow and makes it -- skews it to the legal instead of the illegal. >> harris: ken cuccinelli thank you very much for responding to all of my questions and all the perspective and information you've given us. a political showdown is facing up ahead of former president trump's impeachment trial that starts one week from today. house democrat impeachment managers are filing pre-trial briefs with the senate today. trump's attorneys are also set to deliver a formal response

agents have been killed in florida and at least three others were injured. this is the scene in sunrise, florida. they were serving a warrant in a child pornography case. the suspect is deceased. two of the wounded agents are reported to be in stable condition. it happened this morning in sunrise, florida. names of the victims haven't been released. the f.b.i. is investigating and our own phil keating is heading there. we'll bring you updates as we get them. two f.b.i. agents dead in florida. the biden administration has paused a controversial plan to vaccinate guantanamo bay detainees before most americans. remember, we got you on the story yesterday. but that's not stopping two republican lawmakers from taking further action. what they are demanding now. and this.

huckabee, fox news contributor. thanks for being with me on this big story. your reaction. >> cuomo is not going to resign. i don't think that's realistic. the two things that should happen. one an apology. he should i poll guys to the families of the people in the nursing homes that died. janice dean lost both her in-laws. the arrogance of cuomo is stunning. i can't think of a political figure lacking in self-awareness and tone deaf in the manner in which he said hey, people died, who cares? that kind of thing is just amazing to me that he believes that he is so removed from the sentiments of the people that he could say something like that. the second thing whatever political ambitions he might have had for the future, i think he has wiped them out with his policy but more importantly with his outrageous arrogance.

i just don't understand the attitude that he comes with. i think it is so off putting even to people who are maybe democrats and leftists and people who might have supported him for governor i can't believe they find his attitude and temperament and sense of arrogance, anything other than just absolutely disgusting. so i don't know where he is getting this. here is the big issue i think, bigger than all of it. the government officials making these policies have had really no big impact on their lives. they still go places, they visit with people. they are not the ones who have lost their paychecks and lost their businesses. i have said and will continue to say that when government officials shut down businesses, they should themselves not take a paycheck until they can open those businesses back because the one group of people who throughout the entire pandemic have not lost one paycheck tha

taxpayers are funding. those taxpayers who don't even get to pay taxes because they don't have a job right now. >> harris: it's such a critical point. such an interesting perspective to point out. two house republicans i want to get to this introducing legislation to block guantanamo bay prisoners from priority access to covid vaccines. all americans should get the vaccine first and suspected terrorists should be last in line after some intense backlash which we had here on "the faulkner focus" yesterday the biden administration paused the plan to vaccinate guantanamo bay detainees ahead many americans. the key word is pause, not necessarily gone. do you think the republicans are on the right track trying to make it more solidified or is it not necessary? >> i think it's necessary because of what you just said. the biden administration didn't hit the rewind button, the pause button. they'll pick up when they get a shot. this is outrageous that you will put detainees in gitmo

correct. i think the other point here to think about is january 6th what it meant, a day in which one of the most important things congress does, a peaceful transfer of power and you had a mob come into the united states capitol and i think it was even senate majority leader mcconnell who used those words and said that mob was incited. i think he directly invoked that president trump had a role to play with that. what we ought to be thinking about now is what happened yesterday in the white house with president biden having 10 republicans trying to find some compromise and move us forward as we deal with covid and covid relief package. i hope whatever happens between the congresswoman and senator that they're able to find some common ground and let us all move on from it. from whatever their disagreement was. >> harris: i "new york post" op-ed titled obsessing over aoc only boosts her profile and terrible ideas. what do you think of when you hear that, kim?

association is calling the black lives matter at school week of action. my next guest write it looks like a case of political indoctrination. a deeper dive into the curriculum that seales schools will teach is forward a leftist political agenda and good and police as evil. so they present blm as good and police as evil. jason rantz join me as a radio talk show host. what went wrong with the intentions of this? >> i don't think anything went wrong. it was the intention. this is curriculum that doesn't just impact seattle. it is happening across the country this week in schools. it teaches students explicitly how to become progressive social justice activists, it forwards a number of anti-police narratives including that police purposefully target

african-americans with the intent to kill. that they choose not to de-escalate. that they are quick to use force because of their training. this is curriculum that says any jail or immigration law is state violence. it doesn't just stop on policing and issues of diversity. it specifically says it is going after the family structure and teaches kid as young as kindergarten that they should be choosing their own gender. my favorite line from some of the curriculum that was put out there was treating everyone the same might be unintentionally oppressive. this is the kind of stuff that right now is being taught to children all across the country. of course, especially here in s*elt. -- seattle. >> harris: is there anything about we're in it together and all americans? i'm curious. >> no, of course not. >> harris: since may 25th imcurious if that language was there.

>> bill: -- >> what's worst. by design in seattle public school district they aren't presenting alternative opinions to the black lives matter sent to me by a spokesperson saying the predominant viewpoint has been the alternative view and led to institutionalized racism and it is not being presented and teachers are allowed to give out their opinions in the classroom. all they have to do is make sure they label it as such. what i've been telling people to do make sure as wur kids are there and monitor as a parent. remote learning so you are able to monitor and have deeper conversations with your students about what is going on. >> harris: oregon measure is decriminalizing possession of hard drugs like cocaine and heroin that went into effect yesterday. i want to ask you about this. the executive director of the

drug policy alliance celebrated that saying the first domino of our cruel and inhumane war on drugs has fallen. the law is meant to protect people against persecution, harassment, criminalization at the hands of the state for using drugs and instead given access to the support that they need. quickly, how is that going over? >> it's not going to go over well. we've seen in the pacific northwest for the most part legalizing hard drugs. you aren't getting popped for possession and not charged. drug dealers take advantage of this. when they know you aren't going to get arrested or charged for low level crime, they simply carry less product and they just resupply throughout the day. we've seen -- talk to any police officer in the area and they'll tell you that. they continue to flood the market with these drugs including fentanyl-laced drugs which in oregon last year april to may a 70% increase in drug

dead. no emerging details yet. one of the f.b.i. agents who was killed now we saw this moments ago, we're showing you the flag-draped body of that agent. this is a tough day for the nation, obviously for those in sunrise, florida. they went to serve a warrant. two of the wounded agents reported to be in stable condition. and for some insights into what may have happened and how the investigation is unfolding right now i want to bring in pat brosnan a retired new york city police detective joining me by phone. pat, these scenes are horrible to watch. they were doing their jobs. what is the first thing that will be looked at at this point? >> first of all, good morning and it is absolutely heartbreaking. those images are terrible, terrible. but the fact is as you mentioned there is no such thing as a routine search warrant whether for computer evidence related to child

exploitation. every single warrant is the same as going after a confirmed cop killer. this just reinforces and is a brutal reminder of the extreme dangers. this is the guy who would be served with a criminal complaint possibly relative child pornography. he opened fired. wounded three and murdered two f.b.i. agents. unbelievable but a reminder this is really dangerous work. >> harris: we are being told that the neighborhood here, the water terrace neighborhood i believe is what it is called in sunrise, was immediately put on lockdown telling people to stay in their homes. we know the suspect is deceased at this point. don't have details about that. i would think, pat, that is because this is an enormous crime scene or what is the protocol? >> it's an enormous crime scene, harris. there is no indication based on known facts that there are any other actors involved.

>> harris: the white house is responding to reports that the press is complaining the biden administration is trying to see their questions ahead of white house press briefings. one reporter told the daily beat the press cannot really do its job if the white house is, quote unquote, picking and choosing the questions and that, quote, that's not a free press at all. end quote. the white house says it's part of making the briefings useful is engaging with reporters.
