some questions that many americans want to know the answers to. >> harris: the schools are going to be a big one. promise of getting them reopened in the first 100 days already being questioned. harold and kim, great to see you. we've got breaking news. we're going to get right to "outnumbered" now. we begin with a fox news alert. two fbi agents killed, three wounded in a shooting in south florida today. two of them in a nearby hospital reportedly in stable condition. as you can see, as we saw it live last hour, a flag draped body being taken into -- taken from an ambulance. the agents were serving a search warrant for child pornography at a home in sunrise when the incident happened. this is the first time fbi agents have been killed in the line of duty since 2008. our phil keating has made it to sunrise and can bring us the

latest. phil? >> reporter: harris, this is an extreme rarity that fbi get shot, b, get killed. that's what happened around 6 a.m. in sunrise florida. this is broward county just west of ft. lauderdale. further down the street, which you cannot see, a massive amount of police, sheriff deputies as well as federal agents. this is an enormous scene. right around 6 a.m., fbi agents accompanied by local sunrise police delivered a search warrant to a subject who lives in a gated apartment complex. instead of that subject being woken up, surprised and opening the door. instead, a bloody gun battle. two fbi agents were killed. three others were wounded.

two of them are being treated at a local hospital. just a devastating scene. the man was being served a search warrant for violent crimes against children. instead of a peaceful arrest, he was apparently armed, obviously, and shot the fbi agents. the subject is dead. it is still unclear whether fbi agents returning fire killed him or whether the subject shot himself and killed himself. take a look at the aerials that we have soft two fbi agents, their bodies being taken from the hospital on their route back to the broward county medical examiner's office. draped in an american flag. really resembles a funeral procession. it's very, very serious any time a federal agent gets shot and killed. it is something that doesn't happen very often. it is something that is sad. >> harris: i'm going to ask my

team -- phil, excuse me. i'm going to ask them take the banner down off the screen. you can see dozens of police officers, law enforcement there, maybe even some of them are fbi agents. we don't know. we can't tell everybody. look at the salute. as you noted, we didn't notice this before. it was happening live. this is a funeral possession. when you see the reaction of those saluting that body draped in the american flag, you know the enormity of the moment there for all law enforcement, the fbi, the community, those who have to work the scene. i mean, it is, this, this is heart breaking. >> reporter: any time a law enforcement officer dies in the line of duty, it is a big deal. people are very disheartened. it is tragic. when it is a federal fbi agent, things escalate even higher. the crime scene behind me -- so

the apartment complex is over there. can't see it because there's a row of office buildings. it has two entrances to it. both are blocked off by police officer cruisers. the fbi is not providing much more in detail. they have no scheduled press conference planned. media stays here, we're hoping it will materialize this afternoon. but just devastating scene. a very brutal early morning shooting with multiple fbi agents shot, two of them killed and, of course, the subject also shot, served a search war ran for violent crimes against children. whether that was just child pornography or even worse, we don't know yet. details are still scarce. harris? >> harris: there is no such thing as just child pornography, from what i understand on the wire copy. they were looking at violent crimes against children. it could be a host of things. phil keating, thank you very

much. we do know immediately after this happened, that that neighborhood was put on lockdown. people told not to come out of their houses. i talked with a former detective who said that that is precautionary, in terms of likely, in terms of the crime scene that was created there. it's not an indication that anybody might still be on the loose. we'll continue to follow this, as you know, during the hour. we'll go back to phil keating if we learn more. president biden doubled down now on his push to unravel former president trump's border policies. as he prepares to sign additional executive orders focused on immigration just hours from now. after already halting border wall construction and reversing former president trump's travel ban. this as some 100 house democrats are demanding a path for citizenship for millions on ope

border county in new mexico and then the elected district attorney on that border county and then governor of a border state. so immigration has been part of my life and my career. and so i know it very well. i will tell you, the policies by president biden are extremely dangerous. i support the security of our borders. without a border, we don't have a nation. and we don't have -- right now with the pandemic going on, this is the worst time ever to think we can open borders to people who want a better life. i understand they want a better life. i get that. right now with a pandemic and the insecurity that's taking place and the lack of vaccine, etc, americans have to take care of americans first. that doesn't mean we cannot make reforms or do reforms in congress later on. but right now, this is bad timing for us to do this. >> harris: i want to double down with a follow-up, if the panel

will be patient with me right now. because of your experience, to hear you call it extremely dangerous, why do you think biden is doing this now? >> it's all politics. it is all politics. there's not any thinking, i don't believe, by any member of his team, of bringing in thousands and thousands and thousands of people who have been abandoned from their own country, and bring them across, border after border until they get to the u.s. border. taken money from them. they are abused brutally, physically, sexually. the women, they're being paid, these coyotes. we don't know who's crossing. we don't know who they are. we don't know where they come from. they don't just come from south america or mexico. they come from all over the world. they're coming through the path of least resistance. when we open the door and allow

people, potentially those who want to cause us harm, and we open it without having any background or understanding of their purposes here, i understand many of them want good jobs. i get that. but we have to be able to verify people who come to this country, to be able to live here and work here. we can't just open the doors and say, come on in. >> harris: steve? well, that's exactly right. i'd say also that immigration has been a huge part of my life. i'm an immigrant here now. my parents were eup immigrants to the u.k. from hungary. most immigrations are pro immigration if it's properly controlled. for decades, at least in the 1986 immigration reform, it was out of control in america. that's why people were so concerned. president trump, the first president, the first administration to get control of immigration, both at the border and all sorts of other ways. you saw the benefits of that.

not just with less chaos, but economically, where you saw job opportunities increase for the lowest paid, whether they were immigrants or not. you saw earnings rise after decades of stagnation. all of those benefits. part of the reason because of the tighter control of immigration. president biden wants to throw that all away. it is also true to say as was written about in a book on immigration, the greatest victim of uncontrolled immigration are families who have been immigrants. they are the ones who suffer from less job opportunities. the governor is exactly right, this is about politics. it hurts the very people who democrats claim to speak for the most. that's why it is so disgusting to see this happen. >> harris: you know, emily.

i was reading today about the unaccompanied minors that are coming across in all of this. we can see that because we saw in guatemala as they were trying to keep people from crossing into their country to get here, there were a number of children among them and they would make their way through, possibly getting to the u.s. border and those children have to be vetted the way governor martinez said. maybe you discover they're not really with the people they're with in a familial way. this is messy and dangerous. >> it is indeed. i thought ken cucanelli, who was on with you earlier, did an outstanding job of articulating specifically why in certain contrast to the biden team, this is not safe nor is it fair nor is it ordinarily for especially those migrants, especially those unaccompanied minors trying to cross the border. it is up across the back drop for human smuggling that

provides funding for the transnational narco cartel. this reform trying to be inserted into the lockdown relief bill would provide the largest legalization, the largest amnesty in u.s. history providing for about half of the unauthorized population in this country. but what other options are there? i'm sure the governor knows well. she articulated the fact. we have this totally unorganized set of laws. of course it's confusing. it provides a very limited path way for legal immigration to this country. essentially, you can't pull proof of credible persecution or threat, if you don't have an immediate u.s. family member here, or have an attorney willing to embark on that process for a green card, your options are limited and difficult. the answer is our lawmakers come together. the answer is legislation. it is not a unilateral executive

order or sweeping immigration bill that will obviously not pass the house. it requires actual collaboration, actual earning of the salaries we pay under the leadership of a president that indeed could unite. quick final point. you often talk greatly so about the voices at the table. the voices at the decision making table. i think that 11th hour deal with the unions of the customs and border protection agents is crucial for those law enforcement officers that serve in a largely thankless incredibly dangerous job tpoeur for their voices to be there is right on. >> as joe biden as tried to act like this, his 100 day pause o texas judge. they're still pressing ahead trying to return to catch and release. again, getting rid of policies and protections that did work in securing our border and trying to reduce illegal immigration into this country, the stay in

mexico to people's applying for asylum in mexico rather than, again, coming into the united states and being released into the population. the biden administration wants to get rid of that. the democrats claim they want to help people that they're turning their backs on. that is disingenuous. it is the very definition of it. if you look at the leisure and hospitality industries, again, legal immigrants in this country, many of them work in that industry, in that business. half a million jobs were lost in that very industry just in the month of december. there are almost 18.5 million americans, most here legally, who are collecting unemployment in this country. who are you governing for? it is americans who are here legally who our hospital systems are overrun, our healthcare system is at the breaking point. they're focused on one of the

issues that they pander to the left with on the campaign trail. think about americans who are here legally. >> harris: i do have one big question. obama had a majority. biden has a majority. why not run this on capitol hill? my guess is there really isn't as much intestinal fortitude to handle immigration reform among democrats as you might think. i don't think there's a lot of agreement there. all right. the case being made that joe biden may be the most liberal president ever, as he signed a record number of executive orders and actions now and is proposing a climate plan that could kill thousands oven additional jobs. already killed 11,000 or so by canceling the keystone pipeline. as new york's governor faces more and more pressure over the under counting of nursing home

>> harris: president biden is about to sign another executive order on major u.s. policy as some observers are calling him the most liberal president ever. rich lowery, in fact, writes in "the new york post" the fact is that biden is governing as he promised, further to the left of his own record, further to the left of his ex-boss, former president barack obama, and further left of any democrat who made his career prior to the

cultural left. this as biden is pushing for possible amnesty for more than 10 million additional illegal immigrants. and proposing a new $2 billion relief bill that includes a $15 an hour minimum wage and signed an executive order on climate and green jobs which critics say is hostile to fossil fuels and could kill thousands of jobs. energy rich new mexico could be the hardest hit state. of course, former governor martinez of energy rich new mexico is with us today. so i have to go to you first to ask. what does this mean? is this really happening? is there a way to stop it? >> it is highly destructive especially when 80% of americans rely on fossil fuels for the energy of our country. and so in new mexico, 38% of our budget relies on our funds, whether they be taxes paid, by

the oil and gas industry. so when we eliminate 38% of our budget, that actually goes to education. k-12 or pre-k through 12. you eliminate that? we're in serious trouble. we cannot flip a switch on and say we're all going to do solar and wind energy and flip the switch off the next day on our fossil fuels. it's impossible for us to do that. it's going to affect our schools. it's going to affect health care cost. 38% of budget. i left at $6.3 billion was my budget. the current governor has raised it to $7.3 billion. now 38% of that budget is reliant on the oil and gas industry and they want to get rid of it? they don't have a plan for us to slowly move into that. i believe in all of the above. my policies as governor were all of the above. not eliminating a single one. we have less carbon if we're not

relying on venezuela or russia. relying on people who are not our allies for the oil and gas that comes into the united states. right now we have energy independence. that means we have strength through security. why would we ever, as americans, give that up? >> harris: that's a great question, dagen. why would we? >> pandering to the left, the biden administration is. he's governing for paris and greta sunberg. every president since richard nixon promised energy independence. president trump actually achieved it, and now we are bending down to nations that hate us. why are we doing this? we're killing the keystone pipeline alone has destroyed jobs. why are we putting the burden on states that will have much less revenue to fund their school

systems? why is the question? because john kerry said himself, 90% of all the planet's global emissions come from outside u.s. borders. we could go to zero tomorrow and the problem isn't solved. because of fracing, natural gas, our emissions are at the lowest level since 1950. but the biden administration is going to implement policies that cripple us financially and put us in a dangerous position when it comes to nations not just venezuela, but say iran. it gives power to nations that hate us and want to wipe us off the map. none of it makes sense other than they're worried about what the rest of the world thinks. >> harris: this makes me want to zoom into the white house press briefing. seriously, steve. i know there have been some thoughtful questions recently. not everybody is about covid right now. this is about our future.

covid is part of all of this. if you want to put kids back in school, how can you take away energy funds, as the governor just described, in her state? this would be going to schools. how can you take a chunk of the budget because you're going to miss the fossil fuel energy because you're not doing a segue into that. you're just turning off a switch. >> exactly. there are many more creative, pro growth, pro business ways for keeping the climate goals that the democrats have, but they're not interested in that. i want to take a step back and go to the point about how this administration is shaping up. that quote from rich lowery that you put on screen, i saw that earlier today. i thought there was a typo in it. he said biden is governing exactly as he promised. no. he's governing in a way that is the direct opposite of what he promised in two specific ways. first of all in terms of moving to the left. doesn't anyone remember back in

the primary stage when everyone was worried that bernie sanders was going to move the party to the left. they said, no, we can't have that. we've got to have a moderate in there. we have to stop the rush to the left. that's why they went to biden. now he is turning into someone advocating and bringing in the same far left agenda that they said they were going to be against. the second way biden is governing in the exact way of what he promised is the use of all the executive orders. weeks before the election, biden said you can run things through executive orders. those are the actions of a dictator. we were living in a democracy. we need consensus. he said that weeks before the election. now he's doing the exact opposite. it makes me think he's not in control of it at all. he's being wheeled out a few minutes a day to sign these executive orders. the show is being run by the

activists who have taken over the democratic party. >> harris: that's an excellent question to follow up on. i know you're not asking it as a question, but i will. if it is not him, who is running things? that's what i want to know. do t of the mittens. emily? >> i am as well. exactly. we're going to learn more about that moving forward. i have to say, what i find most disturbing and odd that people are accepting this on the left is the fact that when you peel back the ramifications of every one of these orders, they have the exact opposite of the stated intent of the american people. right? raising the federal minimum wage, loss of 2 million jobs. that's a fact. that's the epi. that's not a partisan fact. we have the keystone pipeline that goes from net carbon emission to zero to diverting it to rails and trucks, killing jobs. as my colleague stated, diverting energy power to foreign nations.

part of the problem has been the shortages of vaccines. could this help the situation? we'll stay on it. emily? >> thanks, harris. all right. new york state democrats blocking an attempt by republicans to subpoena records from the state health department on coronavirus related nursing home deaths. this after the new york attorney general scathing report that the state may have under counted those deaths by as much as 50%. as attorneys continue to pile up on governor cuomo, the new york times reports nine of the top health officials quit in recent months over concerns about cuomo's pandemic response. according to times the governor threw out a vaccine distribution plan crafted by experts and went with his own rollout. steve, i'd like to start with you on this. i found it notable that according to "the times" both current and former health officials declined to say their identities because they didn't want retaliation against them.

they are still beholden, it appears, to governor cuomo. your thoughts? >> it's just incredible to me how he's still there. i don't know what provisions there are in new york. i'm in california and there's an effort going on to recall governor newsom. i don't know how he can get out with a straight face. look at the disasters he's caused throughout last year. the way he is just out there shamelessly puffing his own performance even though it was a disaster that led to so many deaths directly, far more than even we first suspected. now in his own health department, they're saying they can't speak out because he's going to victimize them. this guy is a monster and he's still there in the governor's office in new york running things even though he's so incompetent. it's obvious he is not fit to run anything. i don't understand how there is not a massive outcry and hasn't

>> the white house in response pointing to this statement saying the goal is to make briefings as useful and informative as possible and, quote, regularly engaging with the reporter who will be in the briefing room to understand how the white house can be most helpful. critics say such a move would have been met with universal outrage had it been the previous administration. governor, your thoughts on this being a hypocritical response? >> absolutely, that miss psaki cannot answer a question without saying i'll circle back with you. i'll circle back with you.
