shannon: this is the first lawsuit of its kind in california and possibly the entire country. in chicago there is no official deal to get kids in classrooms but there is a movement, the teachers union struck a tentative deal to vaccinate 1500 union members a week, students are still virtually learning. mitch mcconnell made an impassioned plea on the senate floor to get kids back in school. >> kids, parents and a lot of teachers have given online learning there all. we will be deluding ourselves if we continue to accept this pale shadow of proper schooling, states and districts have got to follow the science and get american education back on track. >> one state senate is trying to make that happen, the virginia senate passing a bill requiring every local school to make in person and remote learning an option to students and coming up later at 5 am, talking to

unfortunately the teachers union in our district is still very much at odds with the board, and unsuccessful negotiation for the last weeks, no resolution yet and legal action being pursued. >> here's what the union says in response, quote, the superintendent fails to take into consideration the organizational needs of students, staff and parents which we have been sucker punched by district that cries wolf when there are mounds of proof of the district have negligence in preparing buildings for students. what are these mounds of proof the union mentions? >> i think the union's argument and across the country becomes more disingenuous by the day. our district has an acted

significant amounts of short-term remediation to buildings, purchased safety women, air purifiers, all of the required elements to meet the same guidelines to safely reopen, that information is public information communicated by the board, to the community including the teachers union, they continue to refute that or indicate it doesn't meet their satisfaction which is unfortunate because it meets the state requirements. there is in order to reopen and the teachers won't comply with that so it becomes breach of contract issue and the indication that it is a tool to be used to take the next step. >> what i don't understand not just in your situation but across the country is the random inconsistency among districts. twice montclair different from the town i grew up in, verona,
