i think it's going to snow next week maybe too. >> and the woman cheers because she has no driveway to shovel. ainsley: you cheer because your wife does it all. >> she's good. she's very good at it. >> i cheer because i've got a big bottle of the alleve that brian says really works. >> thank you very much for joining us on this very busy wednesday. we're going to start with the historic second impeachment of former president donald trump. opening arguments are set to begin just hours from now after the senate voted to proceed with the charge of inciting an insurrection. ainsley: griff jenkins is live in washington, d.c. as we learn how trump, president trump is reacting to the hearing. hey, griff. >> reporter: that was fascinating. good morning. and steve, you're right, those opening arguments begin at noon. the house managers will go first, they'll have up to 16 hours to make their case. that will be followed by equal time for the defense. after that, senators get up to four hours to ask questions and

finally four hours for closing arguments. that won't all happen today. all this comes after yesterday's day one making history. the senate voting 56-44 saying the trial is constitutional. in that vote, six gop senators joined democrats crossing the aisle, collins, cassidy, murkowski, romney, sasse and toomey. the vote was expected. cassidy was a bit of a surprise. the trial opened with a graphic 13 minute recap of the attack on the capitol as the lead house manager, jamie raskin, delivered a very emotional argument. listen. >> senators, this cannot be our future. we cannot have presidents inciting and mobilizing mob violence against our government. >> reporter: the big question, ainsley, people are asking this morning is what was lead defense attorney bruce caster doing when he made statements yesterday like this.

watch. >> i'll be quite frank with you. we changed what we were going to do on account that we thought that the house manager's presentation was well-done. >> reporter: the two sources tell fox news the former president trump was, quote, furious and beyond angry at caster's rambling performance. trump's other lawyer, david shoen, said the accused is not the president and therefore under the constitution you can't try him and ultimately all this comes down to that vote on whether to convict or not. that likely won't happen until next week at the earliest and based on that first vote we saw yesterday, it would take 17 republicans to cross the aisle to convict. steve: on the former president's reaction, i texted

with dan earlier this morning, the reports of him being enraged are over-reported. i was with him most of the day. someone somewhere along the way felt the need to say he was screaming. comma, was not true. no doubt about it, i would be screaming if that defense attorney was defending me many he forgot to, i don't know, i put it here somewhere, prepare to he defend the president. maybe only had two weeks, maybe the problem was the other team got fired a couple weeks ago and they had time to prepare and the house seems to have prepared with all the resources. ted cruz weighed in. ted cruz would have done a better job. just about anybody would have done a better job for the president. listen. >> today shows us what we will see this week, which reminds me of shake spear, full of sound and fury, signifying nothing. we'll see democrats pounding the table, we'll see a lot of moralizing and a lot of really

venting their hatred for donald trump. in case you haven't been paying attention the last four years, the democrats really, really, really hate donald trump. this is political theater because rather than address the real problems, the real challenges we have in this country, rather than focus on getting kids back in school and getting tens of millions of americans back to work, the democrats want a week of just political theater raging at donald trump. >> well, i think he's probably right. and that's one of the reasons why there will be no witnesses for the most part. it's going to be on the fast track. the best evidence the democrats had was that 13 minute video. that was impossible not to watch. it was shocking. and it was terrible. they feel that that shows exactly what happened but the question isn't what happened on january 6th because it was bad, and we all know that it was bad, but instead the question is whether or not the president incited it. and so that is -- and brian, to

your point about mr. caster, at one point he compared manslaughter to murder, which both involve culpableity which given the fact they're trying to figure out whether or not the president incited it, it was a bad way to go. to griff's earlier point, the acquittedal is a foregone conclusion. he will not be convicted so why is it taking so long to get to that point? ainsley: good point. they need the 17 votes and they don't have it. a few republicans broke with party lines. the majority did not. the majority of the republicans say it's unconstitutional, you can't impeach a president after he's out of office. the democrats say they're doing this because they want to punish him, they don't want him to be able to run again. let's talk about jobs. this is on everyone's mind, when you see the shutdown of the keystone pipeline, you hear these individuals, carley shimkus, we're going to talk to her a little later, she went to this area where so many of them have lost their jobs, a lady is holding her baby saying this is

imperative we have this money coming in for our of family. joe manchin, a democrat from west virginia, he's been a big proponent of coal, defender of the industry, and he sent a letter to president biden and he said please reconsider your decision to close the pipeline. please. he said i encourage you to reconsider your decision to revoke the cross border permit for the keystone xl pipeline and take into account the potential impacts of any further action, the safety, jobs and energy security. it is of the utmost importance that the united states maintain that energy security through strategic relationship was our allies, rather than increasing reliance on opec nations and russia. this includes the development of infrastructure like the keystone xl. a lot of people are against the pipeline. but it is very safe way to transport gas and oil. brian: it's so agonizing and carley talked to people directly affected as in you lost your job the next day after he signed

that paper, 14 state attorney generals tell president biden that they are reviewing available legal options to suing the federal government for stopping it. they're all republican, obviously. john tester, another democrat from montana, he also voted against stopping the xl pipeline. remember, the votorama the other day, debating whether to go forward on the reconciliation option on passing the $1.9 trillion rescue bill. they voted on the xl pipeline and i think it was 52-48 they voted to put it back online and they -- so chuck schumer pulled it out. so joe manchin said something there. joe manchin should say listen, unless something happens on the xl pipeline i'm not voting for your $1.9 trillion bill. he is the most powerful man in washington. you're there to represent west virginia. west virginia needs the xl pipeline. make the stand, joe. >> here's the thing. joe manchin is now the new chairman of the senate energy committee so he really has more

power than he did before. so that's why there's so much heft to that letter that he wrote. then you've got john kerry who said we want these people to get these green energy jobs. so they should go and work where they make solar panels which really would mean you would have to move to china because that's where most solar panels are made and that's one of the points that was made that what the executive orders have done, not helping people who need jobs. >> so i guess pipelines are really fine, particularly if they help terrorists. but it's not surprising because nuking the pipeline was never about the environment and you know this, mark. it's all been about appeasing the coastal elites, the people who fortify his victory and appeasing them. that's what his entire administration has been about so far. if you look at the actions he had taken, they've been about virtue signaling to the coast and nothing to do -- nothing to

benefit the americans in the middle. >> you've got all these people saying hey, i hope you reconsider. when you think about the people who voted for joe biden, you've got the environmentalists who love the fact that he signed these executive orders. you've got the team at biden inc., the administration trying to figure out what to do about climate change. but then you've got his union labor base and they're looking at all these thousands, 11,000 union jobs just poof. you've got to figure, ainsley, they're thinking is that the kind of president he's going to be? ainsley: you're right. more than 50 executive orders in action so far from joe biden. so i was watching the super bowl. one of my favorite things about it was the national anthem. the whole thing was great. it was great during covid just to watch that, the whole experience. if you go to a dallas mavericks game now, you will not hear or be able to stand for the national anthem because they're not playing it anymore, not singing it any more. 13 preseason and regular season

games and it's not been played and the athletics they just realized this, no one else has noticed it or said anything. >> there's no fans. ainsley: the athletic, they write, this is a quote from that publication. the dallas mavericks ceased playing the national anthem before home games this season and do not plan to play it moving forward. a decision made by the owner, mark cuban, the mavericks did not publicize the anthem removal. mark cuban declined to comment further on it. brian: i texted him this morning. i cut and pasted somebody -- another nba owner of, cut and pasted it and said there was no comment. also this from dan patrick, the lieutenant governor of texas. the decision to cancel our national anthem off of the dallas mavericks is a slap in the face to every american, an embarrassment to texas, sell the franchise and some texas patriot will buy it. we are the land of the free and home of the brave. so he's obviously outraged and

this shows a different mark cuban. he had a different statement about this in the past, while always being socially conscious. listen. >> this is america. i'm proud to be able to speak out civilly. that's who we are as a country. if they were taking a knee, being respectful, i would be proud of them. i think we evolved as a country. this is a unique point in time where we can grow as a society, grow as a country and become far more inclusive. >> i think we all have the same objective. everyone wants to make the country better. i always thought we could start on the foundation that we're all on the same page, that we're happy to be in the country. i think by pulling the national anthem, you cut the legs out of the foundation of the patriotism. patriots want to make the country better by criticizing it

number of stories starting with this. one person is dead and four others are hurt in a mass shooting at a minnesota health clinic. police say the suspect, gregory ulrich targeted the facility because he was upset with the treatment he received. investigators found a suspicious package inside the building and several suspicious devices at a motel where he was staying. three of the victims are in critical condition. a fox news alert now, democrats one step closer to unilaterally passing a covid relief plan. a house committee passed parts of the package including a minimum wage hike to $15 an hour. representative ilhan omar tweeting if it passes the committee on education and labor after more than 13 hours of debate. republicans warn the hike will destroy businesses. white house press secretary jen psaki said schools that have had in-person classes once a week are considered reopened. >> his goal that he set is to have the majority of schools,

good morning to you. >> good morning. >> so these guidelines that are circulating, it makes it sound like for the average crime that somebody who is in this country illegally commits, they're not going to get deported. so it's harder to arrest them which means it's harder to he deport them. >> exactly. that's what they're doing, they're circumventing the judge's order. thank god for the ag be in texas who is taking the time and thanks to chip roy, chip row has led a group of senators to send a letter to ask about this. i filed an affidavit with the texas ag explaining the consequences of such a policy. because look, you and i have talked the last couple years, every time that someone's released from a sanctuary jail, they commit a murder or rape, we talk about it for a couple days and it goes away. be clear what's happening here. president biden declared the entire country a sanctuary jurisdiction which means more tragedy is going to come. mark my words. people will die.

people will be raped. people will be victimized by criminals that shouldn't be here. this is -- it's coming. and we've been talking about this for two years. it's already started. i want to mention one more thing. there's a national sex offender operation planned next week. they were targeting the arrest of sexual -- convicted sexual offenders including child molesters. they canceled the operation on the heels of this memorandum. so it's already starting. we have sexual predators who are here illegally walking the streets in our communities because of the actions of this administration. >> you look at numbers, surge in numbers, the daily average flow last month was 2,000. last month it was 2,000. now it is 3500. there were portions of the arizona border that law enforcement had seen gigantic increases in and those had completely gone dead during the trusm add medicine -- trump administration. when you look at last calendar

year, 103,000 total arrests, 90% of those were arrested had criminal convictions or pending criminal charges. now, because given the fact that the law enforcement is so ham strung in who they can arrest and who they can deport, what's going to happen to all those people? >> you know, there is no reason to reprioritize what i.c.e. does. if they would have clearly looked at the data, 91% of everybody i.c.e. arrests, either convicted criminal or of pending criminal charges. what they did, they took 95% -- that's not an exaggerate. 95% of the criminals i.c.e. have arrested are now off the table. they're free in the community. what kind of message does that send the rest of the world? come to the country illegally, if you can get past border patrol, don't commit an aggravated felony, you're here to stay. it's no longer illegal to be here illegally.

i started as a border patrol agent, climbed the ladder to be the i.c.e. director, when i read this policy it's the most anti-law enforcement, pro-criminal policy that i could ever imagine in my worst nightmare. i cannot believe they put this in writing. this is sending a message to the rest of the world, the border is surging. in the memo it said we have to redeploy resources to deal with the asylum cases. they fail to mention the surge at the border is of their own making because of their promises and enticements, that's why there's a surge at the border. they want this. this is designed to be this way. they're bringing millions of people into this country who will now be counted on the census, since joe biden overturned that, which leads to seats in the house, electoral college, and elections. this is power over public safety, the quest for power over protecting american citizens. >> nobody knows more about the topic than you do. tom homan, thank you very much for joining us live. >> thanks for having me. >> all right.

kids play. that coach, steve corey joins us now. coach, how hard has it been, waiting five, six months to have an opportunity to play, you find out fall sports will have a chance but not football. >> brian, it doesn't make any sense. i mean, we're sitting there wondering each week, and the governor's had announcement as we've gone through this thing, waiting for some kind of direction and each week the kids' hopes way up there, waiting for this decision to be made and now they've got some of the sports that are going on and football -- she sometimes doesn't mention sports in her weekly or bi-weekly decision making on all that's going on. it's so frustrating. the kids are frustrated, the parents, the coaches. what is she basing it on? that's the question we all have. why? >> eight states canceled sports, 35 states modified sports, some of them are going to start fall sports march 1st including football. they've got the same thing as

you. they say we're going to give it a shot. we saw college do it. we saw pros do it. why not let the kids do it. this would be an opportunity for the kids to show additional discipline. would you welcome that opportunity? >> absolutely would. you know, we follow guidelines to get for workouts, with distancing with so many numbers on the field, masks on, all the things they've asked and required to do and the kids have done all of that and there's been no -- we practiced outside for weeks now with no trace, transmission, nothing going on. and it just doesn't make any sense. and again, the data, the science, all the things they talk about following, she's not following. because just look at it. there's 30 years of states that have played football. they've already played. why aren't we looking at what they did, what happened, and how they did it, so forth and so on and open this thing up for the kids. that's the fraught traiting -- frustrating part. >> and they're playing football around you, aren't they.

>> yes, they are. right across the river. you can drive from my house, 20 minutes, and they're practicing. >> what do you say to people who are watching, what's the big deal, it's just a game. only 2% of the kids get scholarships anyways, what's your answer to that? >> is not about scholarships. i have to look at the kids, look them in the eye, look them in the face. i'm telling you, these kids are lost. they need some seasons normalcy. we're not even -- sense of normalcy. we're not only back in school. each day they have a workout, it's a different attitude for this kids. we have kids who decided not to play, they're lost. some are going to finish school early. the kids need the normalcy, the socialization. they need each other and she is denying that for these guys. >> a nonathlete who has no clue how much damage she's doing. here's what her office said. governor brown knows how important school sports are for the mental health of student add

energy jobs, as you heard on the fox news channel the laid off workers tell a different story. in order to get the full picture i went to south arkansas, a town comprised largely of pipeline workers, and they say this executive order will crush their community. watch. >> you're looking at an unemployment office this morning. everybody here is affected and out of work of. carley: a few weeks ago you were in nebraska, working on a pump station. and that executive order comes down with the signature on a piece of paper, you become one of the first people to lose their jobs. >> it's hard to make plans when you've got an administration that's trying to crush your future. carley: this was going to be your family home for you and your three boys. >> yes, the land's been in my family for years and now i'm without a job. carley: now you don't have a

can get jobs working in renewable energy, what do you say? >> my husband has spent many, many hours practicing to become a welder, to be able to turn around and go into a different job trade completely, we would be starting over. >> these small towns, the industries are not there. nor is he providing the jobs that he said he would. they're simply not there. >> it's not just that easy to get rid of everything you worked so hard on and go do something else. >> this pipeline was going to bring about 800,000 barrels of oil into the united states from alberta, canada a day. now that the pipeline's not happening, what's going to happen to that oil? >> this pipeline wasn't going to be a new source, it's a different mode of transportation, a safer, cleaner mode. we can't run the country off green energy alone. we are supposed to be a super power. >> it's something that's going to take many years to change over things and right now it's not the time. >> it's completely political. coming in regardless and the pipeline allows a safe way,

for the environment. ainsley: when you're a parent, everything you do is for your child, carley, and that mom, the one in the jean jacket right there who said how am i going to pay for my daughter's college, she wants -- we want to give our kids a better life than we had and college and education is such a gateway into so many wonderful things for the future. what did the little girl tell her mom, these a junior in high school. carley: that woman's daughter, she asked her parents should i even go to college. i know we don't have the money. there was a another woman who just had a baby who worked on the pipeline with her husband and she is saying how am i going to take care of my child. i don't even have health insurance anymore. the fact that this is pointless, that it doesn't have a point regarding the economy or the environment, it's like i said, it's all just a political decision for joe biden to get a win with environmental groups, makes this crushing. >> but at the same time, all those union members, union

members are core democrats for the most part, historically. and thousands of them now out of work. and your earlier point, carley, talking about i wonder if joe biden has heard those voices, unless he is watching this channel, he's not going to hear them. because no other channel is following this story. they're just pretending it doesn't even exist because when you see tens of thousands of jobs, at least 11,000, plus the collateral damage from it, when all those jobs go away, it's like that's a big thing in the country. carley: exactly. you're absolutely right. it affects other businesses too. and now there's a concern, are people going to leave and go to other communities and it could just become a dead town which is the thing that you want to happen the least because these are good people. i mean, they don't have a lot right now but they even said to me, they -- even fed me, they gave me lunch. they're kind people. i fell in love with them. it's so sad to see how under-represented this story is.

is now seeing an impeachment trial and a partisan covid-19 relief measure and so i really think you're seeing washington once again completely at odds with the rhetoric that's coming out of its leadership. ainsley: i know that you are chairing this new super pac called national victory action fund and why are you doing that and what are the plans? i know your focus is on midterms, right, in 2022? >> that's right. we have to get the majority back in 2022 in the senate n the house. this focus, the national victory action fund, is about giving candidates, getting them small dollar donations, grass roots donations across the country, directly to the candidates themselves. not to a committee, not to somebody who is saying they're raising money on behalf of them, this is helping them raise money into their committee. this is a super pac, it is an opportunity for us to help people around the country contribute those low dollar

donations to candidates. in fact, in georgia we saw this effort raise over $11 million and create 100,000 new donors into the loeffler and senator perdue campaign, over 500,000 contributions, it was the largest sort of conduit compared to the next two or three in georgia during the special election. so this is about getting candidates time, control and money. so they can win elections in 2022 and we can retake the majority. ainsley: you said you saw -- you planned -- you're watching georgia, what happened in georgia, you want to do what stacy abrams did, get out there and start pushing years in advancing right? >> that's right. we've been out-raised in 2018 and 2020. you saw stacy abrams raise $24 million. campaigns need money early. when they have the time, they don't have the money. when they have the money, they

time for the defense. after that, senators get up to four hours to ask questions. finally there, will be four hours equally divided for closing arguments. that's a little confusing to those who watched yesterday. what we saw yesterday was the pretrial constitutionality fight over whether a former president, now a private citizen, can be tried for impeachment. well, the senate said yes. voting 56-44 that it is constitutional. six gop senators joining democrats, they are here, collins, cassidy, murkowski, romney, sasse and toomey. the only one who was a surprise was senator cassidy and he had this to say afterwards. >> house managers made a compelling, cogent case and the president's team did not. i'm going to vote for the side that did the good job. >> reporter: house managers began yesterday with a graphic 13 minute recap of the attack on the capital as the lead manager delivered an emotional argument pointing to that video, telling

senators that this is what high crimes and misdemeanors is all about. >> senators, this cannot be our future. we cannot have presidents inciting and mobilizing mob violence against our government. >> reporter: then when it was team trump's turn, the lead defense attorney stunned viewers, rambling at times and complimenting house managers. sources tell fox news former president donald trump was, quote, furious and beyond angry at caster's defense. trump's other defense lawyer fared better making the arguments. >> the accused is not the president. the texas united states constitution therefore does not vest the senate with the power of try him and remove him. >> reporter: ultimately, this will come down, guys, to whether enough republicans in the end are willing to convict donald trump. 17 would be needed. but we won't find out whether or not that happens until likely

well, i called the city health services and they said it was okay. and i couldn't find anything on the website but keep in mind, she's in charge of making sure that people don't break the rules and, ainsley, when you look at what the neighbors told the papers, she was breaking the rules. ainsley: well, do we have a sound bite or is this a quote? they went door-to-door in her neighborhood, asking neighbors what they thought about this. and one of the neighbors said this. i just saw 20 to 30 cars is a lot of people, no surprise here. the poor suckers are locked down and people who have power get to do what they want. what rules pertain to me? but then to defend her, everyone had their temperatures taken, they wore masks. they were socially distanced. she said at the time in the state and county, you could have outdoor religious cultural events. she's saying i did nothing wrong. another neighbor said they loved the music that was playing because in the middle of the pandemic when they weren't

leaving their house they sat in the backyard, roasted marshmallows and listened to the wedding music. you're not allowed to have a reception or of you weren't at the time. >> she said it wasn't a reception. she had food. she had wine. she and her husband danced but that was not a reception. ainsley: the problem -- the double standard that we're seeing by a lot of these lawmakers around the country is they are breaking the rules. according to her, when you read how they did it safely, i don't think she was breaking the rules. maybe i'm wrong. she said she didn't feel like she was. she said that was not her intent. but listen, you know why they're doing this to her? because they're considering her for district attorney. these reporters are going door-to-door in the neighborhood, probably saying what do you know on her. oh, she had a wedding. how big was this wedding? i don't think she did anything wrong. >> let me put it this way. you shut down restaurants. you shut down all businesses. but it's okay to go have a

backyard wedding when they tell us to stop the spread. they had 25 to 30 people. she said one person danced. you have to suspend disbelief to believe that. why did it have to be discovered. ainsley: if she didn't break any rules, what's the problem. >> the problem is, i think if you're a business owner and you're told to not have easter, you can't have your family get together, you should just stay with your nuclear family, the people you're sheltering with, it's okay to have a wedding in this place that is shut down the entire state, shut down every school but i'm an official and i can have 25 to 30 people, close friends in attendance and we believe she's the only one who danced. >> she and her husband. it comes down to semantics. you could not -- you could have a wedding at that point but you could not have a wedding reception and so she said that what happened after the wedding was not a reception. it was just a meal with wine and
