distancing requirements during the pandemic. white house press secretary jen -- >> kamala harris said it was a human rights abused committed by the united states government and joe biden said under trump there have been horrifying scenes at the border of kids being kept in cages. now it's not under trump, it is under biden. >> this is not kids being kept in cages. >> harris: even democratic congresswoman ocasio-cortez tweeted this. this is not okay. never has been okay. never will be okay. no matter the administration or party. kristin fisher is live for us at the white house on this top story. >> this is the first migrant child facility to be opened under the biden administration but even that name is being criticized because this same facility was open for one month

during the trump administration but back then it was called a tent city where kids were kept in cages. harris, you mentioned the criticism from alexandria ocasio-cortez, but this is an issue where there is truly bipartisan criticism. take a look at this. you have democratic congressman bowman who says regardless who is in the white house the words migrant facility for children shouldn't be in our government's vocabulary and jim jordan who tweeted they aren't kids in cages anymore, they are kids in migrant facility. what changed? the white house says what has changed over the last few weeks there has been a tremendous surge in unaccompanied minors arriving at the border. nearly 6,000 were apprehended in january alone. you take that and combine it with coronavirus-related restrictions and the biden white house said they had no choice but to reopen it. the white house press secretary jen psaki insists this time

it's different because they aren't separating families at the border. >> it is not a replication, certainly not. that was never our intention of replicating the immigration policies of the past administration. we're in a circumstance where we are not going to expel unaccompanied minors at the board. that would be inhumane. >> so the white house is saying that the reopening of this facility in texas is only temporary but the more longer-term housing options run by the office of refugee resettlement are approaching capacity and harris, there are no signs that this surge of unaccompanied minors at the border is letting up any time soon. harris. >> harris: kristin, thank you very much. coming up we'll dig deeper into the media's double standard on this issue when it comes to president biden versus president trump. and we'll get to this now. breaking news. protests gathering outside new york city hall. they are rallying right now for governor andrew cuomo to face

accountability for his handling of the coronavirus pandemic. specifically the nursing home deaths cover-up. democrat state assemblyman ron kim, who has called for the governor to be impeached, is one of the members leading the charge. however, critics say democrats are all talk and no action. >> democrats are talking a big game at home in front of their local news but when they get to albany they sit on their hands and nothing is getting done. there has been no movement in albany to even end his emergency powers that he has been given during the pandemic. not even to end those, let alone start an investigation. issue subpoenas, call for officials to testify under oath that we've been calling for now for months. >> harris: from lawmakers to citizens. you are hearing from people and what they want. bryan llenas is live at the

protest in new york city. >> good morning. the hold cuomo accountable rally about to start in a couple of minutes. this is being led by democratic assemblyman ron kim and victims' families of covid-19 in the state's nursing homes. one of the things we hear about is why governor andrew cuomo put in immunity provisions into the state budget that shielded nursing home operators from being sued by families or any legal liability. that's a big part of today. ron kim, i will ask him questions. thank you for being here. what are your demands today? >> we are asking governor to immediately return all of the hospital and nursing home lobbyist money over $2 million that he took for the last few years. immediately rescind and repeal the toxic corporate immunity that led to more deaths. turnover all the communication with the lobbyists to the press

and journalists and the public so we know exactly what you did. we're dropping a letter to congressman jerry nadler to open up a congressional hearing on this matter. >> you allege the greater new york hospital association which donated to democrats 1.15 million that went to the governor election in 2018 you think cuomo drafted those provisions with them top of mind. >> they drafted the bill and bragged that they wrote the bill, put it in the budget last minute. mind you, he didn't have to do that. he had emergency powers to do this on his own. he did it at the last minute to implicate the senate and assembly in a toxic bill he knows was bad. that's why we need to hold it accountable. many of our colleagues voted against it. it is time to go back and give justice for these families whose rights as patients and residents were taken away from

them by cuomo. >> democrats in albany big talk stripping the governor of his emergency pandemic powers. so far all talk. 15 times republicans have tried to do this and democrats haven't come along with it. what are you telling your colleagues? do you believe they will at least do that? >> i'm confident my leadership and my speaker will get this right. he is right now working overtime building consensus to hold the governor accountable. we have over 100 democrats. it is a process but i know we'll get there and i'm confident we will be a co-equal branch of government when this is over. >> impeachment commission. you are pushing for that. do you believe he should be. is it warranted. >> it is all interlinked. saving the sanctity of the senate and assembly not cuomo. we should at least take away the emergency powers. >> dana: zbloo* thank you for your time. a big part of what they're

saying with the liability immunity provisions. not the first time we heard this. the a.g. last month released a report found that nursing homes that did not have proper safety infection protocols and low staff ratings had higher fatality rates in their nursing homes. the immunity provisions weren't good. in order to insure no one can he vaid potential accountability the attorney general recommends eliminating these immunity provisions. calls from all over about this. again, this is why they want a full investigation. harris. >> harris: all right. bryan, thank you very much. republican new york congressman lee zeldin joins me now on this very issue. first of all you are just watching democrat-run kim of the assembly in new york speak. i want to get your reaction to some of the things he said. we know, congressman zeldin, this is a person governor cuomo has gone after personally.

>> yeah, kudos to assemblyman kim a democrat willing to courageously speak up on what he has been experiencing. he has been the target of the governor's bullying directly. this rally that is taking place is made up of numerous democrat state legislators, numerous democrat new york city council members. this isn't a republican rally that is taking place right now. it is being led by a democratic elected officials. that's one of the many things that feel different about this. whether it's alexandria ocasio-cortez calling for an investigation or new york city mayor bill deblasio calling for accountability. what kim was discussing is a whole other issue with regards to the campaign contributions provided to governor cuomo, the people who made the donations about drafting legislation they were able to get passed into law and assemblyman kim wants it looked into. his request to congressman jerry nadler, the chair of the house judiciary committee i

absolutely agree there should be a house investigation to dig deeper into what is going on. if you don't, then you are actually part of the cover-up. >> it will be interesting to see how many democrats stand with him. he seems like he has been out there alone for a bit. waint to get to this. a new poll finds that 61% of new yorkers say they believe cuomo did something wrong in handling nursing homes. it is hard to get 61% of people, congressman zeldin, to agree on a food item. this is a bigger problem for cuomo than he might have ever imagined. >> totally misplayed. one thing with the directive itself being fatal and leading to the loss of lives. rather than apologizing, saying he made a mistake, showing remorse, choosing to confront it head on early on, he decided to cover it up and then lied to the public about it. he said the reason why he wasn't providing this information was that he was too

busy. the problem is at the same time what we saw earlier this month was the admission from the secretary to the governor that the reason why this information wasn't provided was because they were concerned about a department of justice investigation and the public is also well aware while the governor is saying he is too busy to provide the information he had time to write a self-congratulatory book on leadership and accept his emmy award on communications. one of the reasons he got that award was for his ability to communicate. the cover-up, admission and the bullying you are seeing the chickens coming home to roost with democrats speaking up on what they have experienced on the receiving end of governor cuomo's wrath. he has misplayed this from the beginning and why you're seeing the poll numbers. >> harris: coverage of cuomo's style from new york leaders, a former cuomo aide says escaping cuomo is tough. he has to exercise total

control. a democratic assembly woman tweeted this. a state senator writes people don't speak out. people are afraid and it goes unchecked. congressman zeldin, this seems like it is more than just as you were describing, this is more widespread than this one particular issue. >> 100%. there is a lot more where that came from with the stories we've heard in recent days. members of the media now speaking up. democrats, one ran for congress. another one is a democrat running for manhattan, members of his own staff and legislature. >> harris: why is this such a critical part of the story? it is always eye opening to peel away the layers of someone with so much power and control but he has emergency power in a pandemic. so talk to me about how critical it is that we learn about all these people who were pressured, bullied. >> for one there are people out

there who may be listening who believe in karma and i'm one of those people who believe that the way that he lacks respect for individuals around him whether on his staff or members of his party or legislature or media. no one wants to help cover for him because ultimately at the heart of this is the loss of life. everything about this feels different than what we've seen in the past. this isn't governor cuomo's style for the last year since the pandemic hit or his style since he first became governor. this was his reputation when his father was the governor and he was a young adult. now he is a man in his mid 60s trying to get the fourth term and democrats have had enough, too. >> harris: i know some high profile republicans want you to be the person to run for the governor of new york. yes or no would you do it? >> what i know for sure i am going to do everything in my power to make sure he doesn't

called for governor cuomo's impeachment and accused the governor of threatening to destroy his political career is now holding a rally alongside other elected officials and family members and seniors. we saw him talking with our reporter bryan llenas and now he is live. let's watch for a moment. >> told them to spend every cent they had in hiring staff, buying ppe, making more space for residents and patients. instead of getting out of jail free card he could have told them the state would prosecute any nursing home that fails to spend every delay they had to protect our older adults. today we are giving cuomo a chance to go back in time and do the right thing. first, return all of the 10 million to the greater new york hospital association. second, fully repeal corporate immunity. third, we ask that you return

association. on that list he wants all the communications between the lobbyists, the governor's office and hospitals and medical professionals. remember, the governor making that decision, the policy that was to put covid positive patients among the weakest among us in elderly facility care and drove up the death rate. we know that from the new york attorney general. far above the number the governor was clear and transparent about giving. he didn't give the right numbers. he said he didn't want to give them to the trump administration. we're following that story. now this. >> monday is 1,124.95. tuesday's bill is $1,449.32. so right now i owe a negative $3,000. okay, do i feed my family or do

i run the heat? which one do i do? >> harris: texans struggling with sky high energy bills. millions are still without safe drinking water today. president biden will visit the state on friday after approving a major disaster declaration for only a portion of the state well into this. it didn't happen until sunday into monday. five board members of texas's power grid resigned today. the "wall street journal" editorial board is out with a dire warning on green energy quote, progressives want to make americans even more dependent on the grid by banning gas hooks-ups in homes and mandating electric cars. this is a recipe for black-outs nationwide as coal and nuclear plants require because they can't compete against subsidized renewables. texas lieutenant governor dan patrick joins me now. thanks for being with me. i first want to just get your

reaction to the renewables part of that and i want to drill down into what makes life better for texans. let's start with renewables. >> congratulations on the new show, harris, been with you many times. happy for you. first of all this issue about renewables and reliables is very clear to america and texas that you cannot count on renewables wind or solar. they can be part of your portfolio as they are in texas. what got our power back was natural gas, nuclear and clean burning coal. you heard the numbers that texas has 25% of its energy in renewables. that's when the whether is nice, sun is out, wind is blowing. in tough times in the coldest days in the winter and hottest days in the summer we can't rely on them. we lost half of our renewables going into this storm. when i hear aoc say that texas should have had two or three times all renewables, we would still be without power.

we would be up a little bit but you cannot count on the wind and the sun. you have to have investments in natural gas, nuclear and in clean burning coal. so that addresses that issue. >> harris: you know, the other thing, too, the way i read it. i won't spend much time on this. you need some fossil fuels to get some of those renewables moving again. is that true? >> absolutely. you have to produce the power. one of the issues we had was that power went down at the power plant and we are going to address that. by the way, i saw the story about the high bills. let me explain that. we have in texas you can choose your energy plan and most people have a fixed rate. if they had a fixed rate per kill watt hour their rates won't go up. their bill may be up because they used more energy. the people getting those big bills are people who gambled on a very, very low rate and it would go up with the power.

but i've told those folks do not panic. we're going to figure that out. but going forward, people need to read fine print in those bills and we may end that type of variable plan. people were surprised. the bottom line i'm president of the senate. no bill comes to the floor unless i approve of it. we'll get to the bottom of this, find out what the hell happened and we will fix it once and for all. we had incredible weather. 20 degrees below in west texas with the windchill. never had anything like that. we were told by ercot they were ready. they were not ready. we'll go everywhere we need to go to get the evidence including something that we seldom do. that is use subpoena power. if we have witnesses we believe that need to come to the table and they will not come and testify, we have the opportunity to issue a subpoena to compel them. i told the public even though i work with the governor and speaker, we are all in this

together i'm personally taking this on my back as the president of the senate where the legislation will as well as the house come through. no nonsense, no excuses. we have to fix this. >> harris: i can tell you and i don't mean to cut in too much. i want to get to one more topic with you. i can tell you as people are watching this just hearing you say going forward you need to know what to do with your bill. for right now you will help them through. some people are getting $17,000 bills. that's got to be really good. thank you for explaining that. >> we are going to fix it and they shouldn't panic. we put out no disconnect notice during this time. >> harris: don't panic, excellent. i want to get to this. a federal judge is blocking the biden administration's 100 day pause on deportations indefinitely. the ruling extends to temporary restraining order, lieutenant governor, that granted to the texas attorney general who argued the move violated federal law and put the state

at greater risk. how is that the case and what needs to happen next? >> so what happened at the very end of the trump administration general paxton worked out an agreement with the trump administration and homeland security that no changes to the policy on immigration on any part of it could change without a 180 day notice to the state of texas. we have most of the southern border. so the biden administration broke the law right away and this judge has said you can't do that. first of all this is for 100 days, this stay. but secondly, anything that biden wants to do, we need a six-month minimum notice before he can do it. by the way, harris. i think fox did this maybe a year ago or so, they don't let cameras into federal facilities but i'm telling you, harris, i've been to the dilly, texas facility a year ago this month. that facility they are not cages. they stay in rooms. six bunks in a room,

television, three meals a day. they have school, they have soccer field. it is an absolute 180 degree lie of what aoc and anyone from the left says. it doesn't mean there aren't some holding cells as people come in in a small town somewhere. when those kids get transferred they're transferred to an incredible facility. and part of this problem with biden -- >> harris: excuse me for stepping in. both former president trump and president biden are taking heat over this facility. so either way the children are separated from their families. i know that that criticism is rather bipartisan. >> i'm happy to take fox on a tour, if we're allowed. >> harris: i would go if it happens. >> i will be happy to escort you. get permission from the feds and i'll walk you through. it is nicer than some of our

public school facilities where children are. the unaccompanied children, now what we're seeing are a lot of the coyotes, the people who smuggle the kids. it is not necessarily they come across the border with their parents. they are coming across often with a male adult that is the smuggler who is turned around and sent back. what do we do with these kids on the border? we can't trust -- a lot of them have a piece of paper go to this uncle or aunt somewhere in the united states. we don't know who these people are. we have to protect these children from child predators. the trump plan was working well. it was working well. we had control of the border. and it is protecting america, harris, but it is also looking out for those families and kids trying to get here. people should come to america legally. when they try to come across illegally the drug cartels are running all of that on the border and they are in the hands of criminals and they are not safe. so the biden administration needs to get back to what trump

on tiger woods' condition this morning. let's start with the very good news. a tweet sent overnight from tiger woods' twitter account said, quote, he is currently awake, responsive and recovering in his hospital room. thank you to the wonderful doctors and hospital staff at harbor ucla medical center, the los angeles county sheriff's department, and the fire department. and thanks indeed to all of those when you look at the video from the scene of the accident, it could clearly have been so much worse. woods is lucky to be alive according to the sheriff's deputy who was first on the scene. he was extricated from the vehicle with serious right leg injuries. the chief medical expert at the hospital gave what sounded like bad news, detailing the injuries saying fractures affecting both the upper and lower portions of the tibia and
