"outnumbered" right now. we begin with trouble mounting for new york governor andrew cuomo from a major city hall anti-cuomo rally to a new poll out with some pretty disappointing numbers. of course those growing calls for cuomo's impeachment. first let's get to that rally. i brought together families who lost loved ones in nursing homes and your lawmakers. assemblyman ron kim, one of cuomo's fiercest democratic critics one after the governor for shielding those facilities for granting them legal immunity. >> nursing home workers told the

governor. what was cuomo's answer? he give them a license to kill. that's what the criminal and legal immunity is. a license to kill older adults through substandard care knowing they can't go to jail or be sued by families. >> harris: a new poll finds the majority of new yorkers say they believe cuomo failed at handling covid-19 in nursing homes. a whopping 61% say he is guilty of some wrongdoing. all of this as an old interview from nearly a year ago has resurfaced. governor cuomo was asked about the safety of nursing homes. watch. >> would you advise a friend to put their parents and a senior facility if they thought it was time right now? >> you have a vulnerable person. best to keep them at home i'm not put them in a congregate

pressure on the president and the future. >> emily: that's exactly right and two data points on settling in kim's rally this morning. he's also calling and it's important for viewers. he is calling for united states congressional investigation, calling on representative nadler to open an investigation into that end and also he pointed out that the greater new york hospital association, that is who wrote the immunity clause. they were the ones who crafted and drafted that language that made it into the omnibus bill. harris, tr and lee zeldin's point, the article yesterday for "the new york post," he said he recounted a threatening phone call at 430 in the morning in 2014 when he endured abuse for "being a journalist." he points out, the albany press corps knows i'm talking about. during this pattern of abuse at either at the hands of the governor himself or his henchmen and he calls upon them as a call to action he said it's up to the

press to hold him accountable. come forward. share your stories because the reputation everyone is touching on seems to have been and openly, poorly held secret for many years that he points out the public is just now getting to know. quick final point on that, alex greene also made that this diction. he said there's a tv cuomo and a newspaper cuomo. that's why the public only new tv cuomo but the newspaper cuomo, he points out, far more mysterious and he says has an elaborate back story completely unfit for tv. >> harris: this is a marist poll which shows respondents what they think of governor cuomo and whether or not he should be reelected. 58% say no. 36% yes. 6% uninsured. those are some pretty damning numbers. dan. >> dan: who are these 36%? >> harris: i knew you were going to ask that.

>> harris: we come in with this fox news alert. new allegations against new york governor andrew cuomo breaking right now. lindsey boylan, former aide to cuomo accusing him of harassing her. including unwanted kissing and touching. boylan claims governor cuomo constantly sought her out and had staffers arrange meetings with her were he made inappropriate comments, including one instance where he allegedly asked her to play strip poker back in october of 2017. i want to fill in some gaps right now because this is just coming to us. this is what boylan is telling media. she has written an essay on medium published today. among the details in another encounter she says cuomo arranged through his handler to meet her in his albany office where she reluctantly agreed to go. she said he gave her a tour of the office, smirked, and showed off a cigar box he was given by

former president bill clinton where he served as secretary for housing and human development. boylan said she interpreted that as an innuendo referencing the fair between bill clinton and monica lewinsky. she said she had been warned by staffers which he joined governor cuomo's administration to "be careful around the governor." this is interesting. we knew about lindsay boylan a few months ago, a couple months back but we didn't know this detail. dan said earlier this is what can happen when certain things start to come apart. more comes out. i believe you called it momentum. what is the legal momentum here? emily? >> emily: to start with, the governor himself is responsible for enhancing the sexual harassment workplace laws in the state of new york. he himself eliminated the restriction that harassment be severe or pervasive in order to

be legally actionable. meaning one isolated incident is enough to be legally actionable. he also eliminated the requirement that employees have to provide comparative evidence of another employee's treatment to prove a claim of harassment or discrimination. that's really important here because it means someone can come forward with their story. not have to also bring into treatment other remote employees. a sort of providing a bottom line which is that if it's just construed as trivial, then it will not be enough to rise to the level. certain neutral objective interpretation of this will not rise to the level. petty slights or trivial inconveniences. her description of what occurred is laid out in medium and published about two hours ago.

she goes into detail. she has receipts in the form of emails written by stephanie, the then -- let's see. director of the governor's office, told her in an email the governor suggested she, boylan, look up images of lisa shields, rumored former girlfriend because we could be sisters and she was the better looking sister. multiple emails that she has screenshots of that she published and also she talks about situations where there were other people present. therefore there would be witnesses to this, including governor's aides and also in one example of the strip comment -- strip poker comment. lots to unpack here. >> harris: you're talking about the witnesses and how important it will be because of the ramping up of the law. to protect against sexual harassment, the governor was helpful in putting in place.

lindsay boylan in this medium post that she writes this essay, she says that the governor's behavior was also normalized particularly by melissa derose. she named someone. other top women around him that only now do i realize how insidious his abuse was. i tried to quote you earlier, the big mo was what dan bongino is talking about, the momentum that can sometimes happen for and against you and things start to break apart. dam. >> dan: this is really unbelievable. it really is. think about this, right? on this network, shows like mine and other conservative media outlets the story of andrew cuomo in the nursing home disaster in the story of andrew cuomo with his accusations of grossly inappropriate behavior directed at miss boylan, they were already out there. none of it is new. it isn't even breaking news.

these details. >> dan: i get it. >> harris: we didn't know she had problems with the governor but we didn't know that they involves the sort of thing. she wrote in her essay today that she expects the governor and his top aides will attempt to further disparage her just as they've done with assembly member ron kim who came forward in recent weeks with his own accusations against the governor of bullying and threatening him. so what is fascinating about what's happening today, emily, i want to come back to you on the legal part. kennedy, this is what we have been watching unfolds on a different issue, the nursing home issue. it took months and months and months of build up and then suddenly a trove of information from the attorney general of the state of new york, letitia james, to say this governor didn't report the right number of covid deaths in nursing homes which his policy affected.

his own ag. as you get more information, you ask more questions. with this we are getting details and asking more questions. no doubt if this has legal legs, they will talk with some of the other women that not only does lindsay boylan talk about in her medium essay. she names a few. kennedy. >> kennedy: she also said it was a pattern of abuse and abusive environment. the same kind of thing we're hearing from democrat lawmakers in new york state and also the media. this is a very clear pattern of bullying, and that's a tactic that was used for a long, long time by this governor that he probably learned from his political family that he employed very effectively. that's why people like ron kim are probably hesitant to come forward in the beginning because he knew that he was going to be maligned by a governor that was protected by the media for so long. it's scary because you're really putting your neck on the line.

same thing for lindsay boylan here because she knows the full weight of the governor's office is going to be used against her to destroy her reputation. i would not be surprised if, in fact, there is the pattern of abuse she's talking about and there were people around the governor, the governor horse toward rationalizing his predatory behavior. if that's true, then don't be surprised to see other women come forward with similar stories because the only reason powerful men do stuff like that is because it works. >> harris: they know they can get away with it. kim, to you for more on this medium essay. people who need legal help. you've worked with crime victims. it is brave. it is scary. it is jumping off the bridge without a net to know whether or not you'll hit the water safely and swim to shore. it's frightening to come forth and put everything on the line like this. when you read this medium essay, there's a lot in it. she's put herself on the line. >> emily: she has and she specifically recounts the tip of the iceberg that she released to the public and those tweets that dan reference that this network covered in the fall, that was frightening in and of itself. she received palpable blowback in the form of threats from the governor's office as well as others in her political field in the form of phone calls and public blowback and social media and the like. this is you point out, harris, goes into far more detail. we encourage all viewers to read this entire thing because it goes into including metaphysical evocation of the kids but she

"i am scared right now before she takes the elevator up. the governor sending roses on valentine's day to multiple female employees. these are things that are provable and as i said earlier, lots to unpack. a quick final point about the harassment laws the governor has changed. the affirmative defense that up until now employers could use if an employee alleged harassment and did not utilize an internal complaint system it provided the employer the opportunity to defend themselves in that way so here the fact that she did not complain internally no longer provides an affirmative defense for governor cuomo courtesy of himself passing the law.
