carley: keep us updated. fox news alert, the remains of a missing firefighter from the raging inferno at a new york nursing home escorted to a medical examiner's office. he was attempting to rescue residents. one resident from a home for adults was killed and several others injured. state and local police participating in the investigation. a nurse and correctional officer killed at an iowa prison. police say and minute attacked several staff members, the nurse and officer died from their injury. officials have not released his name or a motive. police say they are working to figure out what led to the attack. investigation is underway. a gunman, national guard soldier carrying covid 19 vaccine, the 11 soldiers arrived in 3 vans on a texas road. larry harris stopped them and help the soldiers at gunpoint. harris told officers he was

following them because he thought they were involving kidnapping. he is facing several charges, no one was hurt. turning to the border crisis president biden is set to meet with immigration advisors about the surge. carley: what are the administration's next steps on unaccompanied minors? >> reporter: some of those advisors include homeland security secretary alejandro mayorkas and xavier becerra. they will meet with president biden and vice president harris at the white house to talk about the surge at the border, no question that every single day these numbers continue to grow of migrants coming to the border hoping to get into the united states.

first thing i should say is when dealing with kids they are innocent. we should set politics aside and take care of kids but doesn't mean we can't question how we got here. carley: opening the convention center the children emphasizes the problem that this is. you need a large space to house these kids. each child is expected to stay for over a month. this does sound like a pretty big undertaking. >> i have a lot of concerns because the article came out in the local paper saying xavier becerra called two of our local politicians and they got on the phone with each other that they would do this. where's the process? they didn't go before city council, in the convention

center, is a public asset, paid for by hotel dot dollars. the public has a right to know what is happening and what the plans are. >> a quote from the san diego mayor on tuesday, quote, our children, some of them are very young and vulnerable. what i know about my hometown, san diego, we are welcoming cities in this is a time to prove that. that goes to what we are proving, children are innocent victims in all this so there is such a problem at the border that they need help and they need space to stay. i want to circle back and ask about the vaccination. as you just mentioned the public has a right to know what is going on, it popped up without many people being involved in this conversation and this decision. how can you do both?

is there another site where you could help some children and also have a vaccination site, for people who need help right now? >> there were several other sites. you have several colleges being used right now as dorm rooms, a convention center in the sports arena. lots of other places in the convention center is the best place but it seems the public should be involved in this and when talking about vaccinations and all the other problems with this it does seem we should have a chance to go through different scenarios. jillian: a great point with the pandemic and this surge of illegal immigrants coming into your neck of the woods creating a space that you have to deal with. thank you for joining us this morning. appreciate your time. still had miami businesses

orders. the cheeseburger baby and miami beach joins me. good to see you. this is one of the first things i thought of when this was coming to fruition, what about those restaurants and bars, in fairness florida has been open and business owners got more opportunities than other states throughout the country the last few months or so but that being said, when you have to shut down because of the 8:00 pm to 6 am curfew and are not getting that business how is that impacting you? >> it is tough. obviously there are some causeway closures, drivers delivering food and things like that and obviously tables and chairs, those with outdoor seating and some of us. i don't have my dining room close to keep my employees safe

but some have to shut down completely. right now, monday, tuesday, wednesday, thursday, friday, saturday, sunday 8:00 pm. we are allowed delivery after 8:00 pm. i am thankful for that. jillian: do you pay delivery fees? are you making the money you would otherwise? >> no. yes. we passed in article delivery fees at 30% and that is killing us. our deliveries are at 80%. before covid they were 30%. taking 30% and 80% of my sales is just not sustainable. i brought it up to the city and to state level as well to see what we can do about this. during a state of emergency those fees should be capped. i have seen other cities bring it up.

i'm asking for the state of emergency, we are in a state of emergency and it is only fair, people are more comfortable eating in than out. jillian: more than 1000 arrests during spring break time in miami where some of the video we have seen has been wild to watch. have you ever seen anything like this? >> know. never. i have been in miami beach since 1997 and never seen this much chaos and god bless our police. i can't imagine being in miami beach right now. i have no words. i have no words. jillian: must be frustrating a business owner. do you worry about looting, your restaurant getting damaged? anything like that? >> absolutely. that is why are brought it up because there was such chaos
