san diego county office of education statement first and get your reaction. they fail children in california regardless of immigration status have a constitutional right to education and a moral obligation to ensure a bright future for our children. your reaction? >> my reaction is i agree. why are kids not in school? carley: you speak for a lot of people. the other element is 700 girls in the convention center, 82%, or 82 of them tested positive for covid 19. that is a 9% positivity rate, that is 82 students in the san diego high school tested positive for covid, the school was shuts down in these teachers would understandably be upset

got a plan for education in place, in person. a slap on the face. griff: i want to show that staff, 9% of kids in that convention center test positive while 0.00.8% of residents are infected. for the year that you fought to get it reopened teachers said we can't go into the school because we are worried about covid but yet now as soon as the convention center opens up with 10% infection rate they rush in. what message does that send from the teachers? >> as a former public school teacher i am pretty disappointed. teachers know how important what they do is to them. seeing how these teachers jumped

into service these immigrant kids who need caring adults. if it was not safe i doubt they would have done that. to me it says a political thing, not about safety and that is disappointing because one more thing i want to bring up, i know from first-hand accounts our icu is pulling kids out of attempted suicide, getting addicted to drugs, having fentanyl overdoses. they need to be back in school. >> the mental health aspect of this on kids cannot be overstated. how much it has affected them. schools will reopen in san diego april 12th on a hybrid model. maybe this will push teachers to enter classrooms 5 days a week. thank you for joining us, appreciate it.

at taxpayer expense and the exemptions in this bill are merely lipservice, there are no legitimate exemptions to this bill at all. this is straight up gun-control which is a step in the direction of greater gun-control and murphy said himself this was just the first step. griff: for viewers to explain, this is a bill passed by the house that has new background check requirements or transfers between private parties and the background check review from 3 to 10 days. what do you predict becomes of these bills in the senate when the senate splits 50/50? >> we will put everything we've got behind us, arm our members with the fact so they do what they always do, email, text, right there senators and tell them gun-control is not the answer.

students to make their decisions now so the students know what is expected of them and if a student is skeptical of the vaccine they can make their college decision accordingly. this vaccine is wonderful progress, there are students telling campus reform they have questions about it or may be holding off for religious or medical reasons. rutgers's policy allows for that and i would hope other colleges would do the same because if there is anything we have learned in the past year in this country it is mandates just don't work. there are too many unique human situations for one rule to apply to everyone. colleges need to stake their claim early and students deserve the right to make their decisions based on that information. >> i believe schools have a right and can and should require

vaccines as a condition for students attending in person. we have all seen the public health risk that covid has created killing over 500,000 people. i believe the schools have the ability to make this decision if they want to as a condition to those attending school in person. this is not a new concept. this has been decided by the supreme court in 1905 with jacobson versus the commonwealth of massachusetts case where smallpox vaccines were required to attend schools. the supreme court decided states can enact laws like this to consider the public health and safety of those inhabitants within the state. rules can certainly require this. it is necessary to protect to those students at the school and more schools should follow their lead. carley: some rutgers students were asked how they feel about requiring to get vaccines.

>> it is really quiet. you don't see a lot of people -- >> i just want to have everything back to normal. if we get this then it will go back to normal. carley: they just want things to go back to normal, just two people, no discussion of infringement on rights. >> personal rights don't disappear when there is a public health emergency and students know that. they told campus reform they believe extended school closures are motivated by politics, not science. students want to be back in the classroom and if there shot in the arm is part of the cost of admission to do that they are going to be willing to make that happen. it is important to remember schools are reopening successfully even before there was a vaccine. schools like notre dame, liberty university bring students back to campus and do it in a way

before anyone receives the shot. carley: critics vaccine passports on a federal level say it is just another government infringement, first it was masks, then business closures, then restrictions on gatherings, holidays and now vaccine passports mandating people get a vaccine. what do you say to that? >> i do not think it is a political decision. it is a scientific decision. we have seen colleges like duke university have an outbreak, students are required to be in dorms and quarantine. we know that schools and states want to enact laws and the federal government to protect the public health and safety of those individuals. these colleges and universities want to make sure laws are enacted and protecting students health overall.
