beginning with that shocking video showing thousands of migrants, unaccompanied children crammed inside a texas facility. griff: marianne rafferty joins us with more including the rescue of a 6-month back child from the rio grande river. >> reporter: shocking images from inside craft border facility, many unaccompanied children waiting to be processed. the facility in donna, texas, is overrun. >> the capacity for this location, 250, previous capacity was 1000 and we are holding 4100 in this location, we are way over capacity, 700% overcapacity. >> reporter: of the 4000 being held in donna, several are unaccompanied minors and 39 held for 15 days. 250 to 300 unaccompanied kids being taken into custody daily and an average of 5 days during

when crossing a mother through her 6-month back from a raft into the rio grande river, the infant was rescued by a texas ranger. the mother telling that her leg was broken by smugglers who attacked her, a scenario that happens all too often according to one senator who visited the border last week. >> when interdicted they will throw a child overboard into the rio grande. they sell children. the biden administration knows these things. they completely dismantled what worked. >> they found temporary shelters tuesday, 500 boys were left to a facility in el paso, texas and 82 teens at makeshift shelter. kamala harris tasked with

plan in pittsburgh, $2 trillion and they have a breakdown of what is expected to be inside the plan. $620 billion in transportation, rebuilding roads, highways, $400 billion to home care for elderly and disabled, $580 billion in research and development manufacturing and training including $180 billion for clean energy jobs and another $650 billion on electric grid improvements, broadband internet access, water systems. the biden administration, the goal of the american jobs plan was to create millions of good paying jobs and position the us to outcompete china. to pay for this the biden administration will introduce a made in america tax plan which will raise the corporate tax rate from 21% to 28%, something the president talked about on the campaign trail. what happens when you raise the

corporate tax rate? they will not just take it on the chin. >> that is exactly the point. the white house talking point, un-embargoed, that is the whole notion that this is going to make us more competitive. no bones about trying to become the most dominant powerhouse on the planet. 21% to 28% stops that in its tracks. you will hear so many republicans attacking it in the coming days and weeks. an interesting thing is even as we talk about that, a whole group of democrat senators urging president biden to include recurring direct payment. the democrats in a letter wrote this. we urge you to include recurring

direct payments and automatic unemployment insurance to economic conditions and build back better long-term economic plan. we are pleased with the 1-time direct payments, an extension of federal unemployment insurance programs that will not last long for most families. carley: some of this will receive bipartisan support and is needed but larry kudlow was talking yesterday about what might be in this plan that is hidden. he says the infrastructure plan could lead to universal basic income. take a listen. >> something called social infrastructure which will be a massive expansion of the welfare state with no work incentives. way less incentives pushing continued automatic extensions called direct stimulus checks and unemployment insurance.

more unemployment insurance gets you more unemployment. we are looking at a universal basic income plan before all is said and done, 3 or $4 trillion price tag, end to fossil fuels, the biggest tax hike since 1942 along with a gigantic expansion of the welfare state. this is a pivotal transformational bill. griff: this is we are getting as the president travels to pittsburgh, the second part of the plan we will learn about in april. we will have a republican member of congress respond to this a little later this hour. carley: another fox news alert breaking right now police arrest a suspect in the attack of an asian american woman on her way to church in new york city, brandon elliott charged with assault. he faces a crime charges.

elliott is on lifetime parole after he was released from prison in 2019 after being convicted of murdering his mother. in 2002. off-duty minneapolis firefighter will return to the stand in the george floyd murder trial. after a teenager who filled floyd's arrest took the stand with an emotional testimony. >> not doing more, not saving his life. carley: derek chauvin's attorney argues please were distracted by the crowd surrounding them during the encounter with floyd be chauvin faces 40 years in prison if convicted. griff: matt gates under investigation by the department of justice for sexual misconduct. the republican speaking out on tucker carlson tonight.

disease, public health official says they have a sense of impending doom about coronavirus in spite of the vaccines, the impact all those children and then disperse them throughout the country. the children themselves may not get sick but could be carriers of the disease. and central american countries, the remain in mexico policy, the title 42 restrictions put in place for the past year did the trick, did solve the problem. until you take care of this, the present problem, you can't fix anything. griff: we have the details of

president biden's infrastructure plan, $2 trillion plus, what is the reactions what you have seen? >> as reports of the news it is a massive plan that includes things that people may very well want but a great many other things that are over-the-top and unnecessary. the economy was doing well year ago until the coronavirus hit. thank goodness we have the vaccines getting the economy back on track. there is a problem in fusing too much cash into a system the right now is absorbing it. griff: let me show you the things that are in it, the

corporate tax rate raises 21% to 28%, a tax on profits, increasing capital gains tax for wealthy folks and 39.6% personal rate for those making 400,$000. will that make it up? >> absolutely not and we have learned that lesson in the past. capital gains taxes. and if you want to do something. and the regular order of the congressional committees, using reconciliation methods they use. most of the money hasn't been spent. griff: we have to leave it there, thank you for taking time. we will be right back.

griff: the white house defending the move to teach migrant children in person while california students learning online. griff: parents call a slap in the face. >> the white house is defending teachers volunteering to teach migrant children in person before returning to the classroom to teach their own students. >> context is important and these kids are going back to school and also on spring break, i am not sure if it is volunteer or paid, you would have to ask the local school district but the concept is crazy.

>> reporter: fox news reporting teachers from san diego unified school district are instructing migrant children where their own students are learning in an online only format. the district is supposed to move to a hybrid model of in person and online learning on april 12th. a spokesman for the district shares volunteer opportunity with the staff saying, quote, all children in california regardless of immigration status have a constitutional right to education. parents are slamming them. >> what does it say to me, not a political thing, not about safety. >> reporter: the program for migrant children, english language development and social emotional learning opportunities. carley: thank you. griff: 25 after the hour, universal basic income but only for women of color, where that is happening.

you see where the cold front is an warmer temperatures relatively speaking ahead of that are and potential for strong storms including flash flooding for middle tennessee. they got historic rainfall, any rain will cause major problems over the rivers and streams that are already swollen. there is the severe threat through this area tonight for the gulf coast towards the mid-atlantic, large hail, damaging wind, isolated tornadoes and flash flood threat over portions of middle tennessee towards the midsouth to the mid-atlantic and the same front will bring heavy rain and snow to the interior northeast, that is a big story as we get into tomorrow where we have winter storm warnings in effect. not an april fool. sometimes it happens. >> katie pavitt slams vice president harris for laughing

griff: and a report shows new jersey students falling behind at alarming rates, struggling to reach grade level benchmarks, many being kept out of classrooms. a new jersey parent sued his district to do that. thank you for taking time. i want to get to the most stunning number, students failing, math and language arts 2 of every 5, we are told that is 143,000 students.

this is quite a stunning report. >> thanks for having me and you are right, the numbers are staggering and depressing. new jersey students falling behind yesterday as you indicated, falling behind benchmark levels for language arts, masks and as you go across the numbers, black students, 43% in language arts, 50% in math, latino students, 37%. these are tremendous declines largely the results of in person learning, critical resources provided in the classroom.

>> that was based on 15 school districts but if you look at new jersey 2021, 108,000 in classrooms, 900,000, 317,000 still fully remote. as a parent i don't think we have begun to realize the long-term damage to the students who are not allowed to get back into a classroom. >> you were a parent as well going through this, these numbers suggest in new jersey, it was designed as temporary, not an acceptable surrogate for in class learning and we are seeing irreparable harm it is
