court. as a neutral institution applying the rule of law. it would just mean that every time one party gets control of both houses and the presidency, they add justices to the supreme court. get up to 25, 35, who knows. maybe a hundred. the president has appointed a commission. some are moderate. good. some are extremists like a former colleague. he's not a newt which you will objective constitutional scholar. he is a result oriented constitutional manipulator for whom the constitution and the supreme court always come out, according to his own political preferences. and if his views were to prevail, he's already announced that he favors court packing, he already announced he wants more judges appointed now so that the democrats can appoint these judges and these are judges who i'm generally in favor of, i'm a liberal democrat but i don't want to see the supreme court

power. democrats change institutions when they don't get their way. the filibuster, they want to eradicate being utilized since 1800, get rid of it so they have total and complete one party control of the legislature. let's pack the courts. since 1869 it's been a nine justice supreme court. let's get rid of that so we can control the courts. then finally let's get rid of the electoral college so we once and for all can have one party rule and win elections in perpetuity. that's what it's about and you're right to say they are distracting from this with immigration, infrastructure and the like. >> sean: those who want to end the filibuster, professor, those who support court packing, d.c. and puerto rico statehood, you put it altogether. and to me what we're looking at is a raw eliminating of the electoral college, you're looking at a power grab, i've been doing this for 33 years, professor, i have never seen anything like this or as radical

as this is in my lifetime. thoughts? >> well, what we're seeing is the lack of respect for institutions. the electoral college, you can argue for it or against it but it's in the constitution. the filibuster has been with us for a long time. it was introduced largely by democrats, southern democrats, but it was designed to make sure that the senate isn't just like the house of representatives and doesn't always get its way simply by a majority vote. look. if i could change things i would require 2/3 vote to nominate a justice to the supreme court. it's so important, i would want consensus, but you need a constitutional amendment for that. you have to respect institutions. our institutions have served us well for 200 and something years and the idea of radically changing it just to achieve short term results is exactly what people like professor tribe have advocated for years and we cannot let them get their way. we have to stand up for

obtained by laura showing a stash house near the border. now our own sarah carter last night talked to migrant families about their journey to the u.s. take a look. >> you say you feel very, very ill right now. you have asthma. he says he's not feeling well. he coming here with his daughters. they are from honduras. obviously you can tell they have been through a lot. right now border patrol is taking care of. this we have some people on the way here. apparently there were two large groups. this group was separated from another group. there are children here as young as three or four years old, and, of course, adults in this group, and i think this group had a really rough time. i would not be surprised that they have been through a lot according to the people that i spoke with and i'm talking about smugglers, coyotes, the elements, being out here with their children, and also being sick. >> sean: sarah carter joins us now. i want you to expand on that

interview, number one. and number two, this cache of weapons that we see is beyond dangerous and it shows a level of absolute lawlessness that, you know, we would expect from these cartels. human traffickers and drug traffickers. >> yes, sean, it was devastating. we spent the entire night into the early morning hours, roughly around 2:00 a.m. when we wrapped up, and people were pouring across the border. the tragedy there was that that father was very, very ill. his oxygen levels dropped to about 72%. he was immediately taken by national border patrol council vice president chris cabrera to the facility. him and his family were loaded up. he could have had covid. we don't know. everybody suspects anything out here. it could have been anything else but he was very, very ill and immediately taken to an emergency facility. we saw other children that were sick, that were dehydrated. children that were crying.

there was a little girl that apparently was his daughter, allegedly his daughter, that was crying and she was telling me, she's only six years old and she was saying to me i'm so scared. i'm so scared. i'm so scared. you know when you see this type of humanitarian crisis, it's much different than just when you're there, than seeing it on television. you really understand the toll that this is taking not only on the people that are crossing, but on the american people and on our law enforcement officials. you mentioned this stash of weapons. i was just talking to a texas department of public safety officer. they were talking about a stash of ar-15 rifles that they intercepted as well, moving towards mexico. so we see the crisscross back and forth, drug cartels are at their height right now. they are fighting each other. you've got one of the biggest u.s. drug cartels in mexico, and guess what they are fighting

for, sean, they are fighting for our territory. they are fighting for our highway systems coming into the united states, and the people in the middle, that are the pawns, are these children, and these migrants. and the american people, and the law enforcement officers. i spoke last night as well with a delegation that was at the border. congressman devin nunez, the ranking member of the house intelligence committee as well as steve scalise, the house whip who led the delegation to the border where we were at. take a listen to what they had to say. >> what is your biggest concern right now as far as national security issues related to the border considering we saw two men from yemen on the terror watch list? >> in this particular area of the rio grande valley, this is an area where a lot of children and families are coming so the danger in this area is they are overloading the border patrol. the texas governor has put in some national guard and brought in also local law enforcement, state law enforcement to try to beef that up.

but it's really, if you overload the border patrol, then it makes it easier for the bad guys to sneak through so as you see these families coming across with young children, we don't know who is sneaking through the rest of these areas. >> do you have a message for president biden and kamala harris, what would that be? >> we're waiting for harris to be here. supposedly she's in charge of this and i don't think she's been here. >> would you call this a crisis? >> this is more than a crisis, yes. it's a catastrophe. >> what do you hope will change? what are you going to demand of the biden administration? >> we're demanding that the biden administration reverse this failed policy. this is a crisis that was exclusively created by joe biden's actions, and he can reverse it tomorrow. this isn't some law that congress passed. this is something joe biden did the day he became president. he was telegraphing it before he took the oath of office but now you can see the result of it. >> sean, greg abbott as well as members of the law enforcement

already been convicted of assault, robbery and drug offenses. our system is being overwhelmed by the biden administration's inaction. >> sean: if i aided somebody to enter the country illegally in your state of arizona, could you prosecute me or would that be a federal offense? >> usually the federal government has jurisdiction over those crimes. there was actually a case here last year where during the trump administration where the u.s. attorney's office tried to do that. they decided not to refile that case. but at the end of the day we're considering all of our options. i just sent a letter to the secretary urging him to come to arizona to meet with us. he's another former a.g. we talk about what's not only happening with the children that are being exploited but literally the long term impact that this will have on our communities because right now it's a catastrophe. let's not make a mistake. people are going to die as a result.
