mayor pete gets a new best friend. president biden creating a commission, we know what that is like. it is called court packing, adding justices, how many? who knows? an idea the old joe biden as a senator and chairman. >> president roosevelt had the right to send to the congress a proposal to pack the court but it was a boneheaded idea. it was a terrible terrible mistake to make and put in question for an entire decade the independence of the most significant body in this country, the supreme court of the united states. >> he was sharp in 1983 in his

young days but that was before joe became a captive vessel of the radical left. now he is attempting to give democrats cover to pack the court with far left judges who will legislate your rights away from the bench. the white house is trying to obfuscate what this new commission is really all about. >> the panels being asked to take a number of steps, looking at the court's role in the constitutional system, the length of service and turnover of justices on the court, the membership and size of the court and selection rules and practices that will have a report at the end of hundred and 80 days. >> all the wonderful things in 180 days, joining me as congressman leaves open who just announced his candidacy for governor of new york and also

with ms. greg jarrett, fox news legal analyst, thank you for being here, appreciate it. feels like the contrast this committee up however they like calling it reform but the true purpose has always been feet clear, your thoughts. >> the president doesn't have the mandate to do this because during the campaign what he was telling this was the opposite position. he can't claim the voters elected him to pack the courts. president biden as a candidate was promising not to do this. what donald trump do by appointing supreme court justices, his job, there were vacancies and he put forward nominees who got confirmed. president biden, he wants to score vision for the court, talking about our rights not being absolute in the constitution even though the constitution uses words like shall not be infringed, president biden is indicating that shall be infringed.
12:04 am
>> some are absolute but not the ones he likes. justice stephen breyer this week issued the stark warning to democrats on court packing. >> i'm trying to make those whose instincts may favorite important structural change or other similar institutional changes such as court packing think long and hard before they embody those changes in law. structural alteration motivated by protection of political influence can only feed that latter perception. eroding that trust. >> he knew exactly what he was saying. ruth bader ginsburg said the same thing, folks on the left are calling for him to step down because they want a replacement now. what will happen? >> it is a tortured canvas, packing the supreme court and it won't happen and the reason is simple. to accomplish it democrats would have to kill the filibuster and they don't have the votes to do that but president biden is officially and clearly surrendered to the progressive
12:05 am
woke crowd led by his vice president, the woke rest of the work. there's a reason why breyer and ginsburg were against this and that is because they see it for what it is. a naked paragraph that would erode the public's trust in the supreme court designed by the founders to be a backstop against governmental access, abuse of power and foolish ideas and if you try to pack records, what you are doing is setting a new and dangerous norm. anytime a political party gains power they will try to alter the composition of the court for their political desires and when they use power the other party takes over and they will either add even more justices or retract the ones that were added but the net effect is you would have a whipsaw of our laws. it would be in constant flux. one year something is lawful and constitutional, the next year is

12:13 am
32.5%, guess what china's corporate tax rate is? 25%. we will be so far above china. in my judgment that is not something this country can afford to do. we will lose capital, lose investment, lose factories to china of all places. we will provide funds for them to expand their military. this is a very unwise thing to do and i will later on one more thought, you hear this from yellen and biden, we have to stop taxes, the race to the bottom, taxes are falling too much, they are not falling too much. they have followed a little bit. most taxes, corporate taxes around 23, 24, 25%. second point, really, this is

marty mc harry from johns hopkins university and fox news contributor. why are we still putting our lives in the hands of people who keep getting the science wrong? >> the cdc got it right just 11 months late to the game. when we were telling people to wash their hands like crazy we should have been telling them to wear masks. when the guidance was to stay home we should have been telling people get outside. the evidence was there. if you think about it the one job of the cdc and doctor fauci is to warn us of a pandemic and help us manage an infection and covid 19 is transmitted just like sars, when it came around 17 years ago it was the exact same mode of aerosolized transmission. how did that not know it was the mechanism of transmission? it is important for people to have some degree of humility. pete: it is a little different but wouldn't you generally know here are the steps you would take?
12:17 am
>> they hedged their bets that this was an influenza-like surface transmission and got that wrong big time and that's costly because in new york you saw the density, the buildings, the elevators and when people went inside they were watching everything like crazy and doing the deep cleanings, turns out was floating in the air. that was a big miss. pete: today they made clear they are not ending lockdowns anytime soon. >> the vaccines are effective but because they are not perfect is why we are still urging people to be cautious, we still have an emphasis on wearing masks, keeping distance, washing hands and avoiding gatherings. >> perfect, they have to be perfect? how does this not discourage

people when the vaccine is supposed to be our hope? >> the pandemic is regional. look around the united states there are places that have achieved heard immunity already, the transmission is lower the risk to engaging in regular activities is really low and came out with recommendations was a routine was to tell everybody to do one thing, everybody's aware a mass, their recommendations to a country that is immune, why are we not seeing that humility, the we will give you two sets of guidance depending on whether or not you are protected? pete: humility is in limited sky supply across the board in many ways. personal responsibility as well which i appreciate you emphasizing when people in this country can think for themselves, thank you, appreciate your time. turns out the real public health

12:25 am
wasn't so serious. a few weeks ago you probably remember the french so the greatest danger facing the was a woke america. that is where the real health crisis is going on. i was looking at a news story and they were interviewing college students from other parts of the world and one of the questions was would you like to come to america, they all said there was a time when they wanted to, that time is past. what happened to the shining city on the hill that was the goal for people all over the world. we have to be very concerned about what is going on. america the idea, not america the place, that is so important. as far as the cdc is concerned it used to be a place of science where people did things based on
12:26 am
evidence and facts and when you start injecting politics into it, it really damages the credibility of that organization and that is problematic for us all in terms of public health, that's the real hazard, injecting politics into science. >> like when you pack the court you delegitimize the institutional country requires and needs, same with the cdc, same with the word racism. when you call everything racist it dilutes the actual meeting but when democrats actually act like racists it seems they are forgiven for it. remember this? speech to the north is a barometer the most forward-looking virginia ever with real progress on the original sin of racism in the abolition of the death penalty. >> ralph moore subbarao was caught wearing black face and now single-handedly smell removed the original sin of racism. you can be forgiven if you

sufficiently bends to the woke folks for mistakes you have made, never the other way around. >> what is so serious here is we are doing exactly what needs to be done to move to socialism and communism and that is replacing god with government, as government expands, as ronald reagan said, our freedoms decrease. that is what is really going on. people need to wake up and that is why we developed america cornerstone institute, to bring back those principles to remind people of who we are as americans. a godly principle is to love your neighbor. a woke principle is to cancel your neighbor. is that where we want to go? when you look down the road those two pathways lead to very different places. we still have a chance to change the direction of this country to

save it for our children and grandchildren we need to stop being selfish, that means not massively raising the debt because who has to pay that? not us older people, we will be dead and gone. we are ruining their lives. that's not fair. it is immoral. pete: we are all sinners, then we start pointing fingers in ways we never should have been can't walk back from it. i love the idea of the american cornerstone is about god and thank you for talking about it. have a great evening. appreciate it. if racism is such a pervasive problem why do so many hope profile -- high profile incidents turn out to be fake? the virginia dreadlocked cutting hoax, the nascar noose that wasn't in the latest example comes from michigan where a black male student has taken
12:29 am
responsibility for racist graffiti that was discovered on campus last week but the most bizarre part of the story is not what the student did but how the college responded. we know the acts of racism that occurred this week are not about one particular person or one particular incident, we made a significant history of racial pain and from on campus and we are taking action to repair our community. joining me is dennis desousa, conservative commentator and filmmaker. what we do know about this case is that was a 21-year-old black male who acted alone yet it is a community thing and the school is acting like this was not a hoax in the first place. >> if you step back and look at the incident you realize how bizarre this is. you have to ask why would anyone
12:30 am
stage a racial incident, if racism is a serious problem, if the incident occurred by themselves, if you go back a century blacks didn't get to stage lynchings because lynchings were going on, they had to fight against the lynchings that were very obvious to the naked eye. what happened on campus is racism has become extremely rare particularly on progressive college campuses, people bend over backwards to accommodate minorities and so it is almost like the economic fear, the demand for racism exceeds the supply and since the demand for racism exceeds the supply racism has to be manufactured to satisfy the demand and like you say it is not just the pathological behavior of the student who is obviously disturbed in some way but the college is now pleading guilty to a crime which was committed by the kid who said he was the victim of it. pete: the deans of diversity and
12:31 am
others ultimately exist because of this pervasive racism and if there isn't a supply of it then what are they doing there in the first place. >> that is the key point. there is a whole racism industry in place in this industry exists to service the cause of antiracism. if there's not racism around why do they exist. this is why the college is pleading guilty and some sort of pathology on the part of even white students because they are very eager to plead guilty to crimes they haven't committed. almost as if there is a desire psychologically to dissociate themselves and say i'm not the racist, it's all these other fictitious or hypothetical other white guys who can never be identified, but racism sneaks institutionally and has this effect. >> there's a bill that could
12:32 am
lead to reparation proposal on the house floor. are you point were reparation could end critical race theory could be passed in the halls of congress? >> it is unlikely that will happen. there is a little bit of a precedent where they gave reparation to japanese families in world war ii but let's remember in that case the reparations were made to those who were in the camp. in this case we are talking reparations for events that ended 150 years ago. it is a whole different matter. pete: that supply and demand thing makes a ton of sense. thank you. move over, joe, your friends, the media, have a new biden to font over.
