thanks, fred. great to have you next week. sunday at 10:00 p.m. i have an interview with george w. bush and laura bush about his book coming out this week, out of one, many. america's immigrants. painted 43 portraits and their store staoes. >> harris: we begin with a battle over the u.s. supreme court and republicans are sounding off against democrats and their latest push to pack the court. now with four additional justices whom president biden would nominate. in fact, amid the political fury president biden is facing pressure to say something, respond. i'm harris faulkner and you are in "the faulkner focus". the president when he was a senator called court packing a bone-head idea. now members of his own democratic party are embracing it calling it a step that is needed and in their words to

save our democracy. critics say their proposal would do quite a opposite. >> our friends on the left are really drunk with power. if you want to destroy confidence in the rule of law, do what they are proposing. every time there is a power shift in washington when one party takes over from the other, the number of justices change, the makeup of the court changes and it becomes a political institution. >> harris: the "new york post" editorial board is calling the proposal a full front assault on our democracy. the "wall street journal" warns it's a dangerous game. tucker carlson with this cake. >> liars with no principles. say anything for power, got it. now in real life the bill we're talking about may not pass. the sad thing is it doesn't matter whether or not it does. the damage has already been done. we've just watched people who are paid to care about the country prove that they don't.

>> harris: we could hear from the president on this issue during his joint news conference with the japanese prime minister that is scheduled for later today. we'll be watching. jackie heinrich is live at the white house. jackie. >> could is the key word there, harris. white house press secretary jen psaki snuffed out expectations that president biden will want to weigh in on this until the commission he created presents their findings on reforming the supreme court. >> he will wait for that to play out and wait to read that report. i expect he will not have more to convey about any recommendations or views he will have until he reads that report. his view is that he wants to hear from this commission that has a range of viewpoints. >> trace: some democratic lawmakers see it as an unforced error and frustrated progressives move forward when the party needs to maintain a united front during talks on

infrastructure. the sponsors said it would take a lot of debate and they want to start now. nancy pelosi stifled the momentum yesterday saying she has no plans to bring the bill to the florida. republicans are pointing to how president biden's own position has evolved over time once called it a bone-headed idea. ed markey five years ago stood on the supreme court steps with a sign reading we need nine as he pushed for president obama's nominee merrick garland to get a hearing and vote. >> it is not seeking for a more just justice system but seeking for a liberal court. >> and if you go back in time, i remember a time when many of these democrats were saying nine is the right number. but now they've changed their tune. >> this bill has no shot of passing without filibuster reform but the expectation is that if democrats can't work

with republicans to pass more of president biden's agenda, more democrats may warm to that idea. harris. >> harris: jackie, thank you very much. republican senator tom cotton of the senate judiciary and intelligence committees joins me now. great to have you on the program. thank you. >> good morning, good to be on with you. >> harris: so explain to me what the whole point of this is if democrats actually might not be able to get court packing passed? and those democrats who were pushing against it, what is the political play here for them? >> the whole point is the democratic power grab. they're angry they don't have a liberal majority on the supreme court and they want to add four justices, shocking the exact number they need to get democratic appointed justices into a majority on the court. they may not be able to pass this in congress right now in part because the senate is evenly divided. part of this the democrats

trying to push the boundaries of what is possible. if they win larger majorities at some point in the future they'll put more pressure on their colleagues to vote for this and ultimately to pack the court. you've seen that some from the obama era to the biden era. the campaign last year it was the conventional position for all democratic candidates to include joe biden. that's why it's essential we denounce it today as an illegitimate attack on the foundational principles of this country, the rule of law and constitutional government. and that we win back the house and senate next year to make sure it has no chance of happening. >> harris: as you read this and you start to understand, when we saw speaker nancy pelosi, we carried it live here on "the faulkner focus" simply say she has no intention at this point of taking anything like this to the floor. i mean that took some of the wind out of the sails a few minutes later democrats were

announcing the bill. so again is this intimidation to the court from democrats? oh, they may not get their way but can they intimidate the court by pretending that they might? >> that's another effort by the democrats as well. something they've done in the past. chuck schumer last year stood on the steps of the supreme court and said justices by name would reap the whirlwind if they ruled in a way he didn't favor. this is a long-term effort to not change the balance of opinion to ultimately pack the court but try to intimidate justices on the supreme court to hedge and trim and to make decisions based on something other than the law and facts of each case. >> harris: i just remember some including joe biden pushing against that maneuver that fdr was accused of and ruth bader ginsberg said nine are enough. people have fr* the left said

it would be a dangerous idea. i wonder what has changed for them? >> what's changed they're drunk with power and they'll do nothing to seize more control and power over the lives of americans. you're right joe biden has taken the position we shouldn't expand the court. the late justice ginsberg and breyer another liberal on the court a couple of weeks ago gave a speech to say we shouldn't expand the court. the democratic politicians in congress see a center right majority on the court and worry that majority might uphold the constitution as it is written and constrain their power or the power of democratic powers to lock down their economies to the prejudice of say people who are simply trying to have a bible study in their home. it is the ultimate power grab, it is dangerous and threat ens to undermine the rule of law in america. >> harris: that's interesting. so you see a bit of mission creep with this among democrats.

it would creep into every avenue they would want to take more progressive. jackie mentioned this and we do want to get to that. republicans trolling senator markey a bit for that we need nine photo back in 2016 and here are a few more. senator marsha blackburn tweeting is this you? ken buck on with me yesterday posting, i thought we only needed nine. it is hard to take those pictures away. we'll move to the next topic. senator. president biden declaring the threat from russia a national emergency issuing sanctions against the country over its hacking and election meddling and recently called russian president vladimir putin a killer. despite all of that the president says he still wants to leave the door open for dialogue. let's watch and i get your reaction on the flip. >> president biden: we could have gone further but i chose not to do so. i chose to be proportionate.

when i spoke to president putin i expressed my belief that communication between the two of us personally and directly was to be essential in moving forward to a more effective relationship and he agreed on that point. to that end, i proposed that we meet in person this summer in europe for a summit to address a range of issues facing both of our countries. >> harris: russia has responded with this. such aggressive behavior will undoubtedly trigger a retaliation. washington should realize it will have to pay a price for the degradation of the bilateral ties. what does that mean, senator? >> well, it means joe biden in that very speech announced he was emotion employing half measures. he could have gone farther but he didn't. if he really wanted to punish russia for the solar winds hack and so many of our governments and companies if he wanted to send a message he would have shut down russia's pipeline to

germany. in the final stages of development. the most important foreign policy objective in russia now to get the pipeline finished so they can sell gas to germany and it is terrible germany is doing this to our nato allies in eastern europe. congress has given the administration the tools on the books to impose sanctions on the russian firms finishing the pipeline and european firms are insuring it and financing it. they should have been imposed months ago to stop the final miles of the pipeline being built. i have reports his administration is dragging its feet on it and it's the way you would have punished russia for its activities. that's the way you would have sent the right message. as joe biden admitted this is nothing but half measures. >> harris: so interesting you have given us a tangible way to take a look at whether or not this president is serious in this matter. we'll move to this. the u.s. intelligence community is backing off reports from last summer that russia put bounties on the heads of u.s.

troops in afghanistan. and officials say there is only low to moderate confidence in those reports. a "new york post" op-ed with the headline the russian bounty story was one more deep state attempt to hurt trump. democrats, including president biden, attacked president trump for not acting on the report which he called a hoax. here is jen psaki on that, the press secretary. >> president have any regrets about how he attacked trump about not taking action against russia on this issue. >> i won't speak on the previous administration. we had enough concern about these reports and about the targeting of our men and women serving, the men and women proudly serving around the world we wanted our intelligence community to look into it. >> harris: senator, what is your reaction to this retraction basically? >> joe biden owes president trump an apology.

he used that line of attack multiple times in the campaign to include in the presidential debate. i remember when it first surfaced last summer i was open minded to it. it sounds like something that vladimir putin and the russians would do. i sit on the intelligence committee and reviewed it carefully and i could not see where these reports in the media were coming from. we have the biden administration itself confirming they only had low to moderate confidence. pretty low in terms of the intelligence community's assessment. so joe biden really owes donald trump an apology has does every democrat that attacked him on the basis of unsubstantiated media reports. >> harris: low to moderate confidence in intelligence. what does that mean? why even float the stuff out there? how did this get going once you and others took a look at it there wasn't enough there there? >> so it refers to the quality of the sourcing and methods.

i can't get into that but it is on a scale. pretty low on that scale of what we believe to be true. how did it get out there? unfortunately probably some people in the government who didn't like donald trump and wanted joe biden to get elected and leaked it without providing the proper context to it. >> harris: is there accountability for that, punishment? >> there should be. no one should ever leak classified information. a dangerous thing to get into. and the government needs to take more steps to try to insure on the one hand people who leak classified information are being punished. but also that classified information truly is classified. we have over classification problem in some cases. we shouldn't have so much information that is under classification standards but when the stuff is really classified, when it is truly sensitive there need to be consequences for leaking it. >> harris: senator cotton calling on the current president to apologize to the former president over this.

condemned what he calls senseless violence after eight people were killed. several others were wounded last night when a gunman police say opened fire at a federal express facility near the city's airport. that suspect has yet to be identified publicly. the f.b.i. is still there investigating at that crime scene and here is one witness who described it. >> we hear two gunshots and we think it's a car, a muffler. we start hearing six, around 10 shots. this made me stand up and actually look at the entrance door and i saw a man with a sub machine gun of some sort. automatic rifle and he was firing. i immediately ducked down and got scared. >> harris: i want to bring in correspondent laura ingle with more on this. laura. >> another sad story to report here. the shooting happened just in a matter of minutes.

according to those witnesses. as police continue the grim work of going through the crime scene there are still family members right now if their loved ones were involved and other family members got word their loved ones are okay. listen. >> they were able to give me she was in the other building. i'm so thankful. my heart goes out to all the people affected. i didn't know if i wasing -- wasing going to be able to go home. it was scary. i want people to love each other. >> they found five other victims with injuries. one in critical condition. several others took themselves to the hospital. we don't yet know exactly how many people were shot total. now we've been told by fedex

that fedex employees are not allowed to use their phones on the floor of the warehouse, which has made some of the preliminary information difficult to assess since those employees weren't able to call directly for help or call their family members. the indianapolis metro police department gave an update to the investigation saying there were moments of herroism by first responders and fedex employees who helped their fellow co-workers. >> this suspect came to the facility, and when he came there he got out of his car and pretty quickly started some random shooting outside the facility. there was no confrontation with anyone that was there. there was no disturbance or no argument. he just appeared to randomly start shooting. >> police say in this press conference they still don't know if this was a fedex employee, maybe a former fedex

employee. the question has been asked just not yet answered. we'll have more as the day develops. >> harris: laura, thank you very much. let's go to chicago now where that city is on edge headed into the weekend after a police review agency released the body camera video which now shows an officer shooting a 7th grader in an alley late last night. that 13-year-old died at the scene. a warning the video is tough to watch. police say the 7th grader had a gun. the family's attorney says his hands were up when he was shot. that video setting off mostly peaceful protesting in chicago. the mayor is urging people to stay calm. garrett tenney with more on that. >> based on the video that has been released it appears that both those statements are true. he had a gun and his hands were empty when he was shot by

police. the timing of when those two events changed is what will be key to this case. it was around 2:30 in the morning on march 29th when officers responded to reports of shots fired. when they arrived 13-year-old adam toledo was with a 21-year-old man and started running from the cops. body cam footage shows one of the officers chasing the teen and yelling at him to stop and he does. when the video is paused he has something in his right hand. the officer says show me your hands. drop it. a second later you can see his hands are empty a second later and when the officer shoots him in the chest. surveillance video shows that toledo threw whatever he was holding behind the fence just before turning around with his hands raised. body camera footage shows officers finding a handgun in the same area minutes after the shooting. the president of the fraternal order of police along with several offices agreed the paused video showing the teen's

hands empty being shot looks bad but the shooting was justified. there was a gun and the officer had less than a second to make the decision. the family attorney said they're now exploring legal actions against the officer involved. >> you asked if it is an assassination. if you shoot an unarmed child with his hands in the air it is an assassination. >> the officer who fired the shot is now on administrative duty while the case is being investigated. he is a marine veteran. according to the chicago sun times he joined the force in 2015. protests last night and the last couple of weeks have been peaceful in the city is hoping that continues. the city is still recovering and bracing from the riots last year. it's been a beefed up police presence across the city leading up to the video release. they say it will continue over the next several weeks

particularly with the derek chauvin trial concluding as well. >> harris: thank you very much. democrats unveiling their plan to pack the u.s. supreme court but not everybody among the democrats is on board. why some lawmakers are saying not so fast after that big announcement. >> the united states supreme court is broken. it is out of balance and it needs to be fixed. too many americans view our highest court in the land as a partisan political institution. >> harris: and this, coca-cola went after georgia's new voting law when the governor signed it. now the atlanta-based company is striking a new tone after taking some heat for that move. reaction from georgia congressman buddy carter who is in "the faulkner focus". he will make some of these companies pay, even the mlb.

politics after trashing georgia's new voter laws. coca-cola now says we believe the best way to make progress now is for everyone to come together to listen, respectfully. share concerns and collaborate on a path forward. it is time to find common ground. in the end, we all want the same thing, free and fair elections, the cornerstone of our democracy. but that's not sitting well with some. look at this op-ed in the "washington examiner". part of it says coca-cola ceo james quincey ignored the actual facts around georgia's bill which expanded opportunities for voters in the state choosing instead to join the democratic party's fact-free assault on georgia republicans. he called the bill a step backwards. now the company wants to make up with conservatives. fallout continues from major league baseball's decision to move its all-star game from

atlanta to denver. my next guest wants the mlb to foot the bill for the $100 million in lost revenue when they moved that game. congressman buddy carter, republican, joins me from georgia now. actually he is in d.c. but he is from georgia. congressman, first of all talk to me about the change in tune with these companies. what is driving that? >> well, certainly ceos have fallen victim to the misinformation and lies spread by joe biden, stacey abrams, warnock and other democrats. i think they realize that now. it really is appalling to me that these ceos who are smart people or they wouldn't be in the positions they're in, that they made these decisions before they actually read and understood the bill. you always want to do your homework first. they didn't do that. because of their actions, they are complicit in spreading the misinformation that has come about as a result of this election integrity act that the georgia state legislature passed that actually makes

voting easier and cheating harder. 75% of all georgia people said they wanted more election integrity. 60% of all democrats and 69% of african-american said this is what they want. that's exactly what they got when you read and understand the bill. >> harris: i took notes there. i'm a listening to the legal part of this. you said spreading misinformation. that is a problem for these companies and that's a problem for the mlb because i would imagine you are thinking that could be actionable. >> no question about it. it is actionable and listen, these companies, we understand they carry a lot of clout. when they speak and make statements like this then people listen to them and why they need to be more careful and understand issues. delta is so disappointing. the ceo of delta initially said hey, this is good and going to make voters safe and secure in the state of georgia and then back tracked and said it was

awful. all the while -- >> harris: why? >> evidently the pressure got to him and the misinformation and the lies that were being spread by these democrats including raphael warnock. he fell victim to that. hopefully now he understands and hopefully now coke understands all the while that delta on their website advertises themselves as being the most chinese-friendly airline out there while coca-cola just last week entered into an agreement with another company to advertise in the 2022 beijing olympics. we know what's going on in china. they're suppressing human rights and pounding hong kong and yet they say this represents their values? it is totally hypocritical. >> harris: i'm curious to know how you might get some of that money back. the salt in the wound they moved it to colorado which has fewer early voting days than georgia in its new law and

there is a little bit of boasting going on because they got the money from the all-star game, $100 million. >> absolutely and why i introduced the community protection in sports act. what it will do is allow the local communities to recoup some of the costs that have been lost by hard working people of georgia and small businesses that suffered the consequences of this. it would allow those local communities to recoup some of the financial loss and offer grants and also pay and recoup some of the costs. keep in mind a lot of advertising has gone into this, infrastructure improvements and it all costs. when you pull that out it impacts the very people, small businesses and minority small businesses, hard working georgians, it it pacts the people they're supposedly trying to protect. >> harris: it is a tangible way

>> harris: democrats are divided over court packing. alexandria ocasio-cortez told fox news i do think that we should be expanding the court. the idea that a nine-person court can overturn laws that hundreds of thousands and policymakers drew consensus on we have to ask ourselves how much does the current structure benefit us? and i don't think it does. however, some key moderates saying they aren't on board with the proposal. particularly speaker nancy pelosi swiftly dismissing the bill. >> i think it is an idea should be considered and the president is taking the right approach to have a commission to study such a thing. it is a big step. i have no plans to bring it to the floor. >> harris: power panel now. the host of the guy benson show on fox news radio guy benson and radio show host leslie

marshall both fox news contributors and friends. leslie, start with you. when aoc says doesn't benefit us and you see the speaker of the house saying we'll do a study, right? who is us? who is aoc representing? >> aoc is representing her district in new york and one of the squad as you know and she is a key leader in the more progressive further left leaning faction of my party. the majority of us, myself included and np and others are moderate. 1869 and changed six time and it has been done and looked at. if the house speaker says i won't even put it to the floor for a boat and two big name senators on the left saying manchin and durbin not in favor of it. the president had said he

wasn't in favor of it and has been looking into it since. >> harris: is that what he said? >> i'm not sure this would come about and a lot of things that aoc puts forth because it is not the majority of the democratic party don't necessarily bear out to end up in her favor or the progressive faction of the party. >> harris: i've heard you say that. you are not the us that aoc is representing today. guy benson, so you heard leslie talking about where we're going next in all of this. what is your take on where we are? it wasn't just the court packing. it was killing the filibuster, too. >> my head is still spinning a little bit from hearing leslie refer to speaker pelosi as a moderate and centrist. compared to aoc that's true. i find it interesting aoc saying it's outrageous that we

have nine people potentially overturn laws passed by hundreds or thousands of people to support it. i guess it would be okay if there were 13 people instead of nine? it is incoherent unless she wants to turn judicial review. i'm not sure she has thought that all through. this is just a raw power play, a power grab. it a outrageous and radical. those words are over used perhaps in our political parlance but they apply in spades to this situation. my attitude, harris, is this. it is so shameless and needs to be rejected so forcefully i think republicans should be demanding for floor debates and for votes on this legislation. let's get every person in congress on the record on this. it is that important. >> harris: on the record. that's interesting. okay. you know, i like a little hockey. things got chippy at a congressional hearing yesterday when jim jordan pressed dr. anthony fauci on when we might be able to say the pandemic is

political and that's what jim jordan was doing here. anthony fauci does not write laws, legislation on a federal or state level and states and their governors and state legislations make the decision. >> harris: why was he weighing in on the coronavirus bill? >> he weighs in because he is a medical professional who has been asked about this virus. the medical professionals i've spoken to because it's so fluid and we're learning things all the time. a few weeks ago we were giving johnson & johnson vaccines and now we have a pause. anthony fauci won't say what magic number that is and each state and their legislature and governor and state legislatures will determine that based on number of people vaccinated. and how they decrease numbers and based on what medical professionals and icus are telling them. >> harris: i have to get to guy before we run out of time. >> he was benefiting himself.

so greedy. >> yeah, it is, i'm to draw that distinction as you did between free speech when it comes to the first amendment and protection against retaliation from the government and just kind of our cultural view of those values. when it comes to our cultural view of those values we are getting to a really scary place. right? and it's something that should concern everyone, not just people who are conservative because if we have this precedent wanting to silence rather than encouraging more speech and having this open forum to debate all ideas, not just ones that we agree with or that maybe align with our values, that sets a precedent that could ultimately be used to silence anybody. >> harris: that is so true and look, we love capitalism but they can do business without shutting people down. >> yeah, absolutely and some of the justifications in these examples for why they shut them down, i read them over and over and they just didn't make sense.

conservatives must sit in silence and here are some of these examples of sports figures who faced backlash from breaking with mainstream liberal views. you see them there. kat timpf gets the last one for the hour. >> look, it's another example of something that's bad for everybody because calling it progressive is one thing but this is an any sort of progress, a lot of the stuff we are seeing is being motivated by a fear of being canceled. to have real progress on any issue be it race or anything else it requires honest reflection and conversation and open dialogue and that's what this actually discouraging more than anything else. >> harris: open dialogue. imagine that, just being able to say what you think, with people not just fainting from being snowflakes and not being able to take words that they might ever come back with their own good and strong words. i've heard certain kinds of words used over and over and over.
