mind-boggling to me. >> i will give you that congresswoman waters may have given you some appeal that may result in this trial would be overturned. i wish elected officials would stop talking about this case especially in a manner of the rule of law and the branch of our function. i think if they want to give their opinion they should do so in a respectful and in a manner that's consistent with our constitution to respect the branch of government. >> harris: lawrence jones? >> the court is frustrated, the judge is frustrated. he is one that is strive to take control of this trial early on in the process. he issued a gag order telling not only the defense, but elected leaders to not comment on this case at all. because of pushback from the media saying, the court was

being prejudiced towards them, that he needed to protect that. they ended up taking that away and he said the gag order did not work because people started to leak information to the public and the case was almost being litigated before the public eye. he did not want that. he took that gag order back and now you have an elected democrat from california getting involved in something that she doesn't have to deal with in the sense of, if minnesota is on fire she gets to go head back to her home. they're putting the pieces back together. all the people and activists that you see online saying, why aren't the local officials saying anything, the reason they're not saying anything is because the judge has instructed them not to! it can tamper with the jury.

although he got rid of that gag order, that is contingent on elected officials, don't say anything because you're going to tamper with my jury! >> harris: you make such an excellent point. i want to come to you on this. i've been saying it often. she didn't say this outside of her office. she went to the scene, needed a police export to get in there. the people that are at the center of this that she would want to defund and her political ideas, a politician goes to the scene but to tell people to get more confrontational while on the ground, the escort says, she gets to go home and not deal with any of this. >> it's unsurprisingly hypocritical from maxine waters. you see that with the squad as well who hired security while calling for them to be defunded.

that hypocrisy is notable. also notable is her history of justifying violence with the l.a. riots where 53 people died. excusing that as a spontaneous uprising. she has a history of doing that, anti-semites who perpetrated that horrible attack that resulted in the death of billy evans. she is a history of controversy, it's not just isolation, you have to step back and ask him a when do they hold their members accountable? we saw kevin mccarthy strip him of his committee assignments, calling out someone and his party. when do democrats start not engaging in hypocrisy and going after their own when they make mistakes? you have nancy pelosi saying, no apology necessary! i think voters see the difference. >> i'm guessing it's because the

woke crowd like that sort of thing. there capitulating. a lot to ask. maybe some of them will have nuanced answers. congresswoman maxine waters ripped republican lawmakers and an interview saying "they will jump on any word, any lien and try to make it to their message in their cause for denouncing us and denying us, calling us violence. anytime they see an opportunity. they do it and they send a message to all the white supremacists, the proud boys and all of that. this is a time for republicans to raise money. she has a lot to say these days. >> emily: she does indeed. jonathan turley argued she would be the best defense witness against former president trump's lawsuit where she's a plaintiff for his "incitement." she is arguing her words are being overblown, it hasn't

resulted in something. it's merely a reflection about how others feel about her. shouldn't she be the first person to see how that does as well apply to the insurrection on january 6 and president trump's alleged participation. i want to point out that to support to support xs and os, a quick comment on the trial. we've talked about the possibility for appeal. we know there is a concurrent federal investigation and i have to point out that impasse trials depending on if there is a conviction, perhaps that federal trial will never -- the investigation will never result in charges. take south carolina, he was acquitted, a hung jury for his trial. the killing of walter scott. and the federal government did bring charges for deprivation and he pled guilty. i have to point out that this

verdict, the upcoming verdict, it's not necessarily the last word for other avenues for derek chauvin. >> lawrence: really quick, there's been a a lot of conversation about why you have seen a race being injected into that. the prosecution made a call early on to lead that to the civil rights division, to use that claim. that is why it hasn't been injected into this case. >> harris: maybe it wasn't injected because the evidence didn't show it necessarily. the evidence they were pointed to, the death of george floyd and all of that. if you bring in a race that put something else into it and it doesn't exactly -- and i'm not kayleigh mcenany. she's the harvard attorney, but if you bring in too much to this, and makes it hard for the jury to say, that sits in this

box. you are trying to get manslaughter and attempted murder! i think that takes it someplace else. i do want to get to your thoughts on this. it has to do with maxine waters. was it free speech or something else? >> if you look up the definition of gaslighting you will seen maxine waters. what she said about republicans, in plain english telling writers and protesters to "get more confrontational." it's outrageous that she can turn this on republicans or conservatives. maxine waters represents everything that is wrong with the party and the left that has been wrong for several months. they been essentially saying if we don't get the verdict that we want then we are going to have to loot and burn the city to the ground and we are going to have

people like kamala harris supporting bail. the democrats have a lot on their hands. the people in minnesota don't want people coming in from outside and inciting violence. they don't want their city to be destroyed. the police officers are being defunded and having crimes spiking. and then you have a representative of the people and california no less coming and saying, let's wreak more havoc, let's have more fun. this is absolutely tampering with the jury. they know, regardless of all the measures to make sure they are impartial, they know that if they don't get the verdict, that city is going to burn. that's a whole lot on their shoulder and there's a whole lot that's going to happen in the next few days. let's hope we can maintain peace. >> harris: the governor has said they can't take much more. they are that point now, really

to free speech. i would like to start with you on this. as we outlined there, there are some mandatory jail time. there is no automatic relief. it begs that larger question, here on the west coast there is a a lot of freeway blocking that happens, but that's never a legal and never protected by constitutional rights. it puts the onus on law enforcement to protect protesters from traffic and everything else that happens and opens them up to causes of action when the protesters sue. your thoughts? >> lawrence: there some nuance there. the only saving grace. they will have to get the legislation right. the way that they actually worded it, they are going to be under scrutiny. the saving grace of this legislation was he was standing

right behind him and he picks up this photo of a protests, a peaceful protest and a violent one and he says, we understand the difference. i think it's important when we are talking about this george floyd case that is because the country to come together on this, many police unions came together and they condemned officer chauvin's actions, this is why the defense has made it clear that this is not a case against all cops, this is against derek chauvin. they made a quote saying "the profession is honorable itself come up with this cop dishonored the profession." this is what the governor is trying to do to make, a clear distinction. peaceful versus nonpeaceful and when you're not peaceful we will

lock you up. >> your thoughts on this? >> this is not okay and i think ron desantis is taking a page out of his book. there are people in this country that watched the entire riot season in towns across this country, wisconsin, people are looking around and thinking it would never happen there. they've never seen protest to the magnitude where it's turned violence. they've never seen vandalism and americans are saying, what do we do? our police force is being told to stand down. they're afraid to do anything. the message he is sending, law enforcement, we stand besides you. we stand besides you and we are not going to give this a pasts, were not going to let blm take over cities or appease them anymore and there's going to be consequences. that is part of this. when it comes to every issue in

this country, law and order matters! they need to be loud and that's exactly what he is doing here and good on him for doing it. i see 2024 written all over him. >> emily: some arguing come up protesters there that were charged with attacking police officers during a riot. they were let go and prosecutors have cut a deal, if they stand up trouble they get clean records, and contrast that with those who have been charged in the federal insurrection in january who are sitting in solitary confinement, charges up to 30 years and the same thing they are where they were charged with attacking law enforcement. the argument here is that some parts of the country, the citizens are being heard and listen to and others there is a discretion that's playing out. this larger vision, the governor

danny schaefer was shot in the back! timothy caughman died with a needle in his neck and there was no outrage. this is not speaking for all cops. when there's bad apples that kill white folks as well, people don't speak out. maybe this is just a conversation of how we view authorities. most of us respect cops and we believe that they will do the right thing. 90% of the time. when those bad apples get it wrong, sometimes we don't hold them accountable. the reason why they galvanize so many people, i believe is because we were in the middle of a pandemic and people saw it very different! when he saw mothers being on playgrounds, put in wagons, people didn't like that! look at the state differently. we came together.

were responding to possible shots fired, one person has died, two are wounded and have been taken to the hospital. they're looking for a suspect and if you look right now, they seem to be at a residence -- we have been following this. they have left the presence of the stop & shop and through witnesses or investigative work they've made their way to this residential area. if you watch this, police say they are looking the suspect who opened fire at the stop & shop out on long island, not far from the residence that you see here. a news conference moment ago, we have the confirmation of what we knew, but now we know for sure that one person has been killed. multiple people shot, two injured, one dead.
