who took to the streets after george floyd's death last may while ignoring the deadly violence including rioting, looting, arson and killings that shattered many cities. >> president biden: the murder of george floyd launched a summer of protest we hadn't seen since the civil rights era in the 60s. protests that unified people of every race and generation with peace and with purpose to say enough, enough, enough of this senseless killing. today -- today's verdict is a step forward. >> harris: more than 140 american cities saw violence in the three weeks following george floyd's death. the overall cost hit more than $1 billion with some estimates as high as $2 billion. many businesses as you know, we watched it all.

many of those business owners lost everything. kristin fisher is live at the white house. kristin. >> let's start with this big news from attorney general merrick garland who announced a sweeping investigation into the minneapolis police department. now remember the justice department was already investigating the officers involved in george floyd's death to see if they had violated his civil rights but now what this new announcement is going to do is expand to the entire police department to see if it is taking part in a pattern of unconstitutional or unlawful policing. here is the attorney general about an hour ago. >> the investigation i am announcing today will assess whether the minneapolis police department engages in a pattern or practice of using excessive force, including during protests. the investigation will also assess whether the mpd engages in discriminatory conduct and

whether its treatment of those with behavioral and health disabilities is unlawful. >> this comes less than 24 hours after president biden's remarks saying the verdict is a step forward but still much more work to do to reform this system and he had this message for what he describes as the agitators and extremists, listen here. >> president biden: agitators and extremists who have no interest in social justice, who seek to carry out violence, destroy property, fan the flames of hate and division will do everything in their power to stop this country's march toward racial justice. we can't let them succeed. >> so now the attention turns to capitol hill where democrats are trying to pass the george floyd justice and policing act which would ban choke holds and end qualified immunity for police officers. it has already passed the house. now stuck in the senate. the president says he will not rest until it is on his desk but harris, as of right now it

served yesterday. so why are they in the streets harassing people who are not of color at restaurants saying get out? why is that even happening? what does it have to do with the death of george floyd? >> i think part of it, harris, if we're honest, many of the leaders on the left have asked them to do it. we have leaders like maxine waters who is calling for more violence in the street. there is no interest, really, in healing this country that joe biden talks so much about. we see more of more of this false narrative there is a systemic police racism problem in america. the reality is it's not. statistics don't bear that out. when we looked at what happened with the george floyd case, his murder and death. it was a crime, we all witnessed it. putting your knee on a person's neck for nine minutes is wrong. the system worked and the guy has been tried and convicted and sentenced. the reality is this. in america it is still a land of opportunity. not a place of systemic racism.

unfortunately we have race baiters out there who will continue to churn that wheel and to tell that story. it is done at the peril of law enforcement as well as minority communities. >> harris: jason, would you describe what these people were doing at this restaurant last night any other way than harassment and badgering? >> i would describe it as an isolated incident. i would describe it as something that's not going on around the country. we had to go and pick one incident at one restaurant in one city of a country that has 300 million people. so i actually don't think this is some sort of major deal. i think it was unfortunate particularly if the diners didn't have the experience that they were looking for that night. but at the same time, i think this is an isolated incident. >> harris: let me step in one second. i want to know if you can actually see the video. this is important to say. you are saying it's an isolated incident. what i don't want you to miss is how many people have come up

to the isolated incident and are cheering and part of what is going on. and clapping. look at it. it isn't just this one person on that band stand thing that he or she is standing on but it is all those behind that person. and so you can say well it didn't play all over the country but all over the street. if you are those diners and you know what's happened when black lives matter protestors have shown up at people's homes, you know what has happened in those instances. people feel fear. you don't think the people in the restaurant legitimately are concerned? >> sure, i think the 20 people who were there were pretty disturbed and i'm sure they had a bad experience and i wish they had a better experience dining that evening. but i don't think that this is something that we should blow out of proportion. this is not something that happened nationwide. this is not something where people were hurt.

this was not something where hundreds and hundreds of people were harmed. it was an unfortunate evening for some diners. i've been in situations where i've been dining and i've seen things happen that i didn't particularly like. but -- >> harris: you have been harassed like that when you were dining? >> sure. absolutely. protests, i've seen people walking by and screaming things and seen upheaval but that's one restaurant. if you can show me this going on around the country, if it's 20 cities. >> harris: i don't want to encourage it. i'm not congresswoman maxine waters and walk outside and tell people to intentionally get confrontational. i'm not going to do that. if you ask me to do that on air not going to happen. >> i can't let that slide. this is not an isolated incident. conservatives have been under siege for the last probably 10 years if truth be told. we see it happening in people's

homes. we see it happening on university campuses. conservatives have been under siege from the left for a long time. black lives matter have profited off of dead black men who have died as a result of many other crimes that have been committed. the idea this is isolated is not. it is happening all over the country. there are stories. you can look at any news story that happens around the country every single night. there is a story about a conservative who has been disenfranchised. conservatives are under siege. one of many examples. we have people on the left who try to act as if this is an isolated incident. it is not. it is happening and i can tell you i have friends who have experienced it. i've experienced it. it is happening on airplanes and unfortunately no one from the left is standing up and it needs to stom. >> harris: that's where i've seen it. very tight corners and not

always a camera. we need to move to this. i mentioned congresswoman maxine waters and now she is lashing out at her critics after democrats blocked a republican effort to censure her over her call for protestors to get more confrontational if the jury in the derek chauvin case acquitted him. let's watch. >> the republicans love to use me as a target. they raise money on their backs. maxine waters, that black woman who is so uppity and who is someone we can't control and so you've got to make sure that i have enough money to keep her from getting reelected. >> harris: this morning house minority leader kevin mccarthy fired back. >> the censure resolution only quoted the judge. no politics involved. this wasn't a political situation. this was an opportunity to bring the nation toefmgt it was an opportunity to call what was right and what was wrong. to help us heal and make sure

the system works and continues to work for all americans. >> harris: jason. >> well, i'll tell you this, i've been to a lot of protests. never been to a violent one but for the violent ones i saw on television, i never saw anyone with a maxine waters flag. i certainly have seen other flags at violent riots and protests and insurrections but i've never seen anyone who was inspired by maxine waters. i think maxine waters is one congresswoman who the right again uses as kind of their scare tactic in order to get people riled up. maxine waters does not inspire a whole lot of people. maxine waters is one congresswoman and it's unfortunate that she said something about confrontation. i don't think she meant violence. she said that she was non-violent. >> harris: how would you know

what she meant? she said stay in the streets and be more confrontational. how would you know what she meant? you said yourself you weren't there and haven't been to something like that. you didn't see. i don't know that she has flags. i don't even know why that's part of the conversation. but what she did have was what she did have was the floor at that moment, right? she took in a police escort and then stirred up trouble. and i will go to t.w. for his quick response before i have to go. >> maxine waters is one of the most powerful women in congress. the fact that she has consistently called for violence not only is it dangerous and reckless, it is a stain on americanism. because this woman has continued to call for violence against our police. called for violence against conservatives. anyone who supported donald trump. she is unhinged and needs to be censured and i applaud the congressman for standing up against her. something has to be done with

this idea. we cannot go into a country governed by the rule of man. we have to have governed by the rule of land. we know what happens when we call for violence under the obama administration when police officers were under attack and killed base of rhetoric like maxine waters. >> harris: your last quick thought jason. >> yeah, i remember her comments about confrontation. i thought they were unfortunate but i will say i don't recall any violence there in brooklyn center after she said that. i don't recall you said she stirred up trouble. i didn't see any violence. i didn't see violence. >> harris: here is the question for you and you don't have to answer it but think about it. the judge in the chauvin case said it may open the door on appeal for the defense. right? and if the jury at that moment was able to hear any of that we don't know. if they had already been sequestered at that point. i lived in minneapolis. i don't know how fast they

positive. i've been reporting hundreds of positives that have come out of that testing at the border so it becomes a potentially dangerous situation that we bear the brunt of. we're trying to save lives in addition to trying to save lives. it is a layering effect of them coming across and coming across sick potentially. >> can i add it is also part of the deterrent? you have the president of el salvador going on tucker a few weeks back and saying you are drawing people out of my country and decimating my country. how about the 7-year-old girl i met at the border. we have talked about her before who was all alone, coming up through mexico. why? because the democrat administration is encouraging the biden administration is encouraging more flow instead of using the tools we have at our disposal to stop the flow at the border. that's what this is about. protecting americans, protecting immigrants, and not empowering cartels. unfortunately the biden administration doesn't do that.

overturn because public officials have reckless less undermind the integrity of the trial. i want to bring in saul wisenberg independent counsel and fox news contributor. lay it out how it works that this might be fodder or material on appeal. >> it could be fodder or material on appeal if you can argue that this affected the jury. that the jury first of all you would have to be able to show that they were aware of it. and would have to have some evidence that it affected their deliberations. i have to say i think the comments of congresswoman waters were reprehensible certainly given her history, not surprising. but i think it's extremely unlikely that it alone will result in a reversal. the same thing for president biden, who while his comments were nowhere near as inappropriate as congresswoman waters shouldn't have been made

grounds for an appeal. i'm not going to grant a miss trial right now but didn't couch it by saying. you would say we don't know the answer yet but should it not go the way you want you to use it on appeal. can you use that on appeal or not regardless of his intention? >> i don't think you can use that aspect of it on appeal. the jury wasn't there when he made that particular statement. i also want to say that i don't think his comments or his -- just his general comments you may have an issue on appeal are as significant as people think they are. i think judges say that much more frequently. you can take that up on appeal. now it's clear he was upset by her comments and criticized her which i think was very appropriate and her comments were very inappropriate. she never cares about that kind of stuff. it's obvious. she violated the curfew and said i don't care about the

curfews. if she had been of a different political persuasion at the michigan state capitol somebody might think differently about that. let's focus on what the effect is likely to be. judges say that all the time. that can be an appellate issue for you. the more disturbing thing was the judge's failure to change the venue in this case. even that isn't necessarily going the result in a reversal. >> harris: what about the other three officers who are up next in the legal proceedings against them who were with derek chauvin on the deadly day for george floyd? do these comments come into play for them and their trial coming up in august? >> i would certainly renew the motion given everything that has happened for a change of venue and i would perhaps ask that their juries be sequestered for the entire trial. keep in mind both of these officers from what i've read had been on the force for less than a week.

2018 election, georgia had the largest african-american turnout in the country when you look at those racists. for her to say things like there is no basis behind that, and georgia we've had accessible, secure fair elections for many years. we've seen a minority participation turnout even with the photo i.d. requirement that some people say is racist and suppressive. it is not. everyone has a photo i.d. if you don't we will get you one for free. even in the spell, they make them available. in georgia, 56 of those ids were given out. these numbers that they throw out just don't add up. people need to know that this group is lying to you and there profiting from that and from this campaign and it's only hurting hardworking georgia business owners and folks who work with them and we will stand up and fight.
