running these social media platforms are practically communists, they're common carriers, they aren't companies, they're countries. we need to regulate them just like we regulate telephone companies and utility companies. >> harris: how are republicans going to respond to all of this? i will talk with congressman ken buck on that question moments ago. he has been part of this conversation to protect conservatives and their first amendment speech rights. we'll get into it. first to gillian turner with much more on the top story. before i go to you i want to point out facebook didn't have to listen to this board. it was advisory. they took their advice. i'm curious to know how it works its way into story. >> that's right, harris. let's start with this. the decision from the oversight board is a big deal not just because it is going to impact the former president's ability to connect with his own

hundreds of millions of followers but also sets a precedent for the power of big speech -- big tech versus free speech in america and beyond america. lawmakers are starting to react. republicans so far deeply skeptical of the board's decision to uphold the ban on trump. u.s. senator marsha blackburn tweets it is clear that mark zuckerberg views himself as the arbiter of free speech and mccarthy. facebook is more interested in acting like a democrat super pac. if they can ban president trump, all conservative voices could be next. facebook says as you mentioned harris they're upholding the ban. we don't know for how long. it could be permanent but also have a time limit, months or years. facebook has six months to consider and decide for itself about this question. facebook issued this statement just now. they write we believe our decision was necessary and right and we're pleased the board has recognized the

unprecedented circumstances justified the exceptional measure we took. politically republicans have become frustrated by inaction so far here in washington on capitol hill. they're starting the take matters into their own hands. governor desantis is going to sign a deplat forming bill targeting facebook and twitter. >> there are people who aren't necessarily republicans who see the danger of going down a road in which the discourse in our country is controlled by oligarchs in silicon valley. >> harris, finally to answer your top question here, you are right. the decisions from this board are voluntary for facebook. facebook has said they're treating all the decisions they make as binding but the reality is that legally they are not -- they can choose to ignore them if that's what they ultimately decide to do. harris. >> harris: and some might even read it as kind of a punt because if they can blame the board on its findings then they have a little more time to take a look at this. it is just a question about how

were under fire. the suspect later shot and killed himself. and in minneapolis, the former police officer derek chauvin is asking for a brand-new trial. his attorney says the convicted officer's constitutional right to a fair trial was violated. the request comes after a photo surfaced showing one of the jurors from his trial wearing a blm shirt raising questions about impartiality. semi retired nascar driverdale earnhardt junior will return to the speedway 20 years to the day after the 9/11 attacks. his car's paint scheme pays tribute to the lives and heroes lost and front line workers helping with the coronavirus today. just how much influence did a powerful teachers union have on school reopening policies? the white house is defending the input the cdc got from

>> harris: one-third of students across the country are still not in classrooms full-time, yet many districts are focused on changing the name of columbus day on school calendars. new york city now lists the october 11th holiday as italian heritage day, indigenous people's day. aishah hasnie is live for us in new york. >> you are absolutely right. we didn't see this kind of swift action from department of education officials when it came to getting kids back into school buildings. and that's why folks are upset. they feel like the officials made this decision to cancel columbus day without having a discussion with the public about it. so the department of education at first decided to change columbus day in 2021-2022 school calendar to indigenous people's day. after an uproar they've added

italian heritage day. discussions about renaming columbus day began last year to better reflect and honor more than just one person. as you know, harris, dozens of cities across the country canceled columbus day last year following protests where people were destroying christopher columbus statues and choosing to honor native americans. some say it should have been left to the legislators. >> there is no reason why any cultural group should compromise on what holiday they celebrate. he is a national hero of the italian republic. where a million people in new york city immigrated from. >> as far as objective getting kids in the classroom the mayor says he expects schools to be fully reopen by september. but we shall see, harris. >> harris: there is always a but it feels like. we'll cover it, that's for sure.

the biden administration defending a teachers union's role in developing new cdc guidelines for schools saying it is standard procedure for the health agency to consult outside groups when making recommendations. white house press secretary jen psaki here. push >> it's actually longstanding best practice for the cdc to engage with organizations and groups that will be impacted by guidance and recommendations issued by the agency. doesn't mean they take everything they want or even a percentage of what they want. it is important to understand the implementation components. >> harris: communications obtained by the "new york post" show numerous emails between top cdc officials and the american federation of teachers union just days before they released opening guidelines in february. two instances when union suggestions were used nearly word for word in the cdc's guidelines. former trump white house chief of staff mark meadows says it's

as you laid out. certain recommendations from the teachers unions were taken as gospel to the cdc. nothing to do with science. not recommendations about in our classrooms our teachers are this far or that far maybe this many feet. these aren't the type of recommendations being made by the teachers unions. they were making recommendations about exemptions for certain teachers and their family members which meant, harris, anyone could claim an exemption to be back in the classroom which means all the power is with teachers unions to decide whether schools reopen or not in liberal and inner cities teachers are leveraging that and kids already behind falling further behind because they are still on zoom when we know what the science is. they are rejecting it. it is a scandal. they will deny it right out front in the open saying of course we talk. that's what we do. they did the same thing with the trump investigation and spying. of course we thought they were

really doing it. that's how they admit it and then say it was all for the kids when ultimately we know that's a sham. >> harris: critics also taking issue with the cdc summer camp guidelines. i mean really. parents can read to their kids but can't read science? don't buy that. it is calling for masks to be worn at all times and children to remain still three feet apart at all times. one expert told the intelligenceer the rules are are unfairly draconian. children can't be running around outside in 90 degrees wearing a mask, period. dr. fauci responded with this today. >> i wouldn't call them excessive but they certainly are conservative. you are right, it looks a bit strict or stringent and they keep looking at it and re-evaluate in realtime. >> harris: it has been a good doctor signed his kids up to

camp. you have to do that far in advance. all the guidelines in place now that's all we know and he thinks the ball will keep moving. will it? >> will it keep moving? no idea. the goalposts have moved every time with king fauci. at this point what he says means almost nothing. these guidelines, thankfully have is an exception you don't have to wear a mask while swimming. that's a bonus. we aren't water boarding our kids in the lake. your kids go to camp and want to play football. they can't without a mask on. they want to -- they can't play tag and get within three feet of anybody. can't put your arm around your good friend at camp. if camp counselors and administrators are vaccinated they don't need to wear masks and kids aren't at risk of covid per cdc guidance. they are contradicting their own guidance and putting parents in an impossible

situation. if i had a kid going to summer camp with these rules i wouldn't send them. >> harris: the democratic party has rejected the resignation of the -- the lamarr county democrats met yesterday to consider the man's rest nation. gary o'connor, lamarr county democratic party chair. gary o'connor apologized both publicly and in a letter to senator scott. however they said in a statement that they decided not to accept his resignation after taking, quote, unquote, the last few days to reflect upon this incident. chair of the texas gop alan west says this. >> i just think that i'll just walk over to the texas democrat party a nice little package of oreos, until this guy is honest i will stand out and speak out

against the party of systemic racism. the party of the soft bigotry of low expectations. >> harris: pete. >> bill: the double standard is the standard. you know this. look at ralph north am and other democrats who have done things that anyone on the other side would be canceled, rebuked, fired and resigned for and in this particular case good on alan west. republicans should keep doing this. if this is the way you treat people and the sinless world where one infraction gets you canceled then let's all play by the same rules. i can't believe i'm saying this. i agree with what the democrats are saying. let's take two or three days, step back, forgiveness is a real thing. people make mistakes. that's never applied equally. so it is a race to the bottom to condemn people. grace is gone. when you are an entire party that doesn't believe in grace and redemption, then how are you allowed to give it to your own when they do something

overtly racist about a black u.s. senator? >> harris: when they say reflect it would be really transparent and helpful since we're having these discussions about race, racism. all of it across the country, particularly among our leaders in washington, right? it would be helpful to have them explain what they reflected on and if they even understand the term. and what was that apology like to senator tim scott? do they really understand what was being said? because as you see, allen west and why he does carry that albatross to them. it is symbolism of really, you want to accept these? that's what you are doing. you are accepting that racial slur. explain it to us. >> so true. if you want this forgiveness, if you believe you are reflecting tell me what did you mean you said you believe tim scott is black on the outside and white on the inside. what does that mean?

recruitment video and critics are tearing into the video saying it pushes woke propaganda and identity politics. tucker carlson on our air last night mocking one part of the ad where a woman says she is not about box checking. >> box checking? come on. just a cisgender latina mom of color. not a hint of box checking there. that sounds like pure -- a system in which narcissism is the highest achievement. >> harris: they said 2020 was a stand-out recruitment year for the c.i.a. despite the pandemic. 2021 incoming class is the third largest in a decade. what is at issue for you, congressman, with the way the c.i.a. is recruiting? >> well, i think the problem really is that this cancel culture has seeped into so many of our institutions in this country.

west point has changed its curriculum and obviously the c.i.a. may have a banner recruiting year in terms of quantity. i question what the quality of the individuals who are attracted to this kind of recruiting technique are all about. the c.i.a. has always been in so many ways above question in our country for their patriotism and for their willingness to risk their lives to gather intelligence that keeps us safe. i question whether they are actually continuing the high standards that they've had before. >> harris: interesting. just a quick follow up. i want to get to rachel campos-duffy and her take on it. i'm curious to know on the hill this is a bigger issue because you could play a role in informing the c.i.a. what i just said. is there a thirst to do that and an eagerness to let the c.i.a. know there is concern? >> i think absolutely.

i think oversight is critical and i think that is the role of congress. we have an obligation to give feedback. now, if they are justifying and saying they've gotten based on objective measurements they've gotten better candidates applying, that's great but if all they're doing is attracting people who won't get the job done down the road, that absolutely is congress's role to weigh in and make sure the taxpayer dollars are being used efficiently. >> harris: i want to show quickly rachel campos-duffy from "the faulkner focus" yesterday on this because her bigger ideal was that our enemies may have a point of view on this. let's take a quick peek. >> i don't want her to work out her problems at the c.i.a. i want her to work out america's problems with china and all the other problems we have in national security. the c.i.a. is about service and very quiet service, very few people know what they do and

program today. politofact are insisting they are nonpartisan fact checkers. four years ago they offered 52 fact checks with a ruling of president trump in his first 100 days. but offered just 13 fact checks of president biden during the same time period. on its website they split its biden verdicts into fact checks of biden and fact checks about biden. mrc's review of the first 100 days shows 13 fact checks of biden and 106 fact checks about biden. that's an 80 to 1 disparity. in other words, the organization appears to be much more sensitive about someone lying about biden than they are about the president potentially not being truthful. i want to bring in jason meister now, former trump 2020 advisory board members and richard good steyn, former

advisor to bill and hillary clinton. jason, i will come to you for your top line thoughts on this. >> i'm not surprised by this but it is a very scary thing that in a time when all of our news is opinionated and editorialized and people go to these sites to check what they are reading is accurate and true and the media is lying to them all day long, it is a very dangerous thing. the fact that they care more about people lying about biden than biden lying himself is a very dangerous thing. >> harris: richard. >> let's not forget how donald trump began his presidency. on day one talking about the crowd size which was nonsense. talking about millions of illegal immigrant voters which was nonsense and 20,000 lies later yes, we have a record of somebody who is not prone to telling the truth.

the difference, though, between donald trump and joe biden is when donald trump would be caught on saying something untrue he would double down and saw that as a badge of honor. when joe biden is saying something that maybe is unsubstantiated he drops it. that's the difference, i think, people should be cognizant of. donald trump reveled in telling lies and joe biden is actually not comfortable saying things that are found not to be consistent with the facts. >> harris: jason. >> look, i think it's very dangerous that we live in a society where the news is completely editorialized. you can't get any hard news. these sites serve a purpose if they accurately were fact checking. the fact is they're not. they have an agenda. they have a liberal left wing bias and the fact that americans are going on these sites to check what they are reading is true is a problem. >> harris: you know, jason, i'm wondering if you agree in any part with what richard is saying. what i understand you to say,

richard, is that one side deserves more of a fact check than the other. i would just say that you don't know that unless you are looking at both of them equally. you have no idea. i will give you one example. look, you can say these are mistakes or whatever but when the current president said that he was inoculated against coronavirus and that the vaccine never even existed before he was president, we had it on video from the day we carried it live on december 12th, 2020 when he got his first series of two shots. so you don't see that sort of correction in many of the mainstream media. and that's the kind of fact checking that i think we're talking about here, jason. >> you pointed out, cnn said that a pundit said biden was responsible for operation warp speed. the democrats talked about russia collusion for four years based on a dossier that was completely false and salacious.

we say that because we point out first of all your service and thank you, congressman mast a reminder that sacrifice comes with service. and so i want to come to you first, congressman. they held it last year in 2020 at the height of the pandemic. they just amended it a bit. how did it taken off the books completely by this administration? >> politics in my opinion. i think it boils down to that quite simply. if you look at the facts that blm can get a riot permit in washington, d.c. with covid going on at the exact same time, how do you not allow veterans into the parking lot? the 70 acre parking lot of the pentagon in this 20-year plus tradition. total politics in my opinion. >> harris: i'm glad you said parking lot a couple of times. you are saying outside. the cdc says that we don't need masks outside if you are fully vaccinated. joe, is there a way to communicate with people who

might participate? i'm certain that your answer will be yes. i'm wondering how you make it happen. have you been fully vaccinated? do you need help doing that? we serve our vets with all our hearts in america. what do we do to get them into the outdoor event? >> thanks for continuing to shine a spotlight on this important event. we will -- i want to be clear off the bat. we will have a demonstration on may 30th in washington, d.c. we won't be able to stage where this demonstration has staged for decades but we will have a central staging area in the district. it will be safe, it will be coordinated and we have a lot of protocols in place to make sure that the spread of covid doesn't happen there. and we are working with every other agency. there are a lot of agencies that are responsible for that region. we're working with all of those. the pentagon is the only one that wouldn't work with us. >> harris: can you say where you'll have it yet? do you have enough of your assets in place to make that

announcement? you know, you mentioned decades that this has gone on at the pentagon in the parking lot. are you anticipating a difference this year? >> we're actually seeing tremendous interest. we think participation will be up this year. that's the biggest difference we're seeing right now. as far as location itself, we have a plan b which is rfk stadium that used to house an nfl team. if the district of columbia doesn't provide a waiver which is what we're waiting now to have a gathering larger than 500 people, then the first amendment event we will be staging on the public streets with coordination and assistance of law enforcement. >> harris: well thank you for persisting in all of this. i can't imagine what the workload must be to try to pull into place now an event that's getting even more response. you might have imagined that would happen i would guess, right? people really want to show how much they love our military

veterans. congressman, i come back to you. you mentioned politics creeping it. it seems like it always does. why here? it would seem that the president of the united states, not that this necessarily made it to his desk, maybe it didn't, you know, he has a connection, a familial connection through a child who served. it would seem like we would all be on the same page as americans about an event like this, not so on capitol hill? >> not so on capitol hill. there are groups that get priority no matter what the circumstances like blm. and those that don't. our veterans are one of those groups that are not getting that priority. and you can see that in this and the pentagon forgot an important thing. they still work for we the people. the pentagon. they have serious work to do but they need to be responsible to we the people, especially we the people that went out and defended this country. that's not happening and i'm hopeful they can change their mind.
