surrounding hall of fame trainer bob baffert whose horses failed five tests in more than a year. he denied any wrong-doing. eric: baffert is calling this a gut punch. charles watson is live in atlanta with more on the latest development. charles, what a surprise. >> reporter: hi, eric. the trainer, bob baffert, says medina spirit was found to have traces of a steroid in his system following a post race drug test. batchest says his crew -- baffert said his crew was notified on saturday about the failed drug test. medina spirit has not been officially stripped of his crown and baffert is denying any wrong-doing. baffert said he never treated medina spirit with the steroid and has no idea how it could have gotten into the horse's system. take a listen. >> yesterday, i got the biggest gut punch in racing, for

something that i didn't do. and this is really -- it's disturbing. it's an injustice to the horse. >> reporter: this follows medina spirit's win at the kentucky derby a little more than a week ago which gave baffert his record setting seventh victory in the race. there are questions about whether or not he's pulling off the wins fairly. last november, the new york times reported 29 of baffert trained horses failed drug tests and last month baffert won an appeal before the arkansas racing commission after he was suspended 15 days for a pair of his horses, for a pair of his horses who tested positive for a pain killer, lidoc aim ne. we saw a statement from churchill downs who said they will immediately suspend baffert from entering any horses at that race. as for medina spirit, baffert says this morning that he does

expect the horse to compete at the preakness next saturday. eric. eric: well, it's less than a week away. this is an earthquake in the world of horse racing. we'll see what happens, charles. thank you. jackie. >> critics continue slamming the biden administration as high grants including thousands of unaccompanied children keep crowding border facilities. one of the critics, congressman greg steube eave of florida, -- steube, of florida, said this on "fox & friends" this morning. >> there's no evidence that they're taking the crisis at the border seriously. it's kind of the opposite, almost as a if they're allowing it to happen. they say don't come to the border but says we're going to give amnesty to illegals in the country. they're inhibiting i.c.e. and cbp from doing their jobs, from arresting people, from deportation. >> let's go to bill melusian live at the border in del-rio,

texas. >> reporter: we've been talking about how del-rio is a hot spot along the u.s. border and that's playing out in front of us right now. this is the rio grande. we have a few people that crossed right now and are presenting themselves to the custody of local sheriffs department and local state troopers. this is a small group. this group just came across literally 10 minutes ago. this is a group of 46 migrants. we watched them come across the border within the last 10 minutes or so. [speaking in spanish] >> reporter: so guys, take a look at the hands in the air. all of these folks have family here in the united states. [speaking in spanish] >> reporter: everybody is saying they're from venezuela and they say they have family here in the united states. you can see this is just one of the groups we witnessed crossing the border since yesterday. we saw a smaller group of 26 do this exact same thing yesterday. also a group ovens way lains.

the -- of venezuelans. they say they're leaving conditions in their home country and they're coming here for a better life. i talked to a young man yesterday who said they left venezuela on may 1st and got here yesterday. this is a bigger group than what we saw. there are some young children, adults, families, border patrol and local law enforcement telling us the venezuelans come across in larger groups. we've seen cubans coming across as well. coming across in smaller family units. you can take a look, a small little boy right here. thankfully, a lot of the younger kids were seeing with the venezuelans are coming across with family units. what you don't see right now is border patrol. that shows how over-stretched and overwhelmed border patrol is here in the del-rio sector. they've been averaging 700 apprehensions every day. if we can pan to the right, we showed you this yesterday. the folks process he'sing the my grants, -- processing the migrants, they're local

sheriff's deputies. just two deputies, a it's a small department, they have to do the job of the federal government because border patrol is stretched so thin. sometimes they have to wait three hours for a border patrol vehicle to show up and pick up the migrants and process them. these migrants weren't running, weren't trying to flee. they crossed the rio and a presented themselves to local law enforcement. many of the folks will be trying to claim asylum. you saw how many raised their hands, saying they have family in the united states. one guy was trying to go to houston. many will be processed, will be released and will likely try to link up with their family in the united states depending on if i.c.e. validates their asylum claims. this is not unique. we've been seeing this happen -- we've been here for an hour. and all of a sudden we see three vehicles pull up on the other side of the rio and all these people get out and cross thely owe in front of us.

we have been here an hour and we saw this. yesterday within an hour, we saw a group of 26, we saw a group of you cubans. this is happening every hour. the situation here continues to just, you know, the secretary of homeland security yesterday said the border is closed of. .which have him take a look at what's going on down here. >> obviously incredible reporting. are you able to ask some of the migrants what it was that compelled them to come across the border right now? was it some circumstance in their home country? was it this administration, any messaging they received from them? can you ask? >> reporter: yes. so i've talked to a few, most of them told me it's persecution in their home countries. i speak limited, broken spanish. doyle what i can here. >> reporter: he has fear of the government in venezuela. so that's something that we have heard from several people when they talk to us after they cross rio. the currency there is worth almost nothing. we've seen the families in the last two days have been from venezuela. i want to and it over to eric. eric: this is absolutely astounding. what as expose, standing right there, seeing them come across the river there. president biden said the border is closed. are you able to ask them if they listened to the message and is there a leader in that group? how do they do this? it's unbelievable. >> reporter: [speaking in spanish]

just 266,000 jobs were added to the economy last month. that was well below the expectations. the unemployment rate ticked up to 6.1%. this morning, former trump economic advisor, steven moore, he said that he thinks many workers would rather stay home. >> i think the big problem right now, bill, with respect to the labor market is businesses, restaurants, construction companies, manufacturing, bars, stores, they can not get workers back on the job. the problem is we're paying too much money for people to stay unemployed with the unemployed benefits, the food stamps, the medicaid, all of the other money we're paying to people. eric: and that was friday, talking to bill hemmer, mark meredith live at the white house with the he very latest right now. >> reporter: good afternoon. april's jobs report caught a lot of economists off-guard. when you talk to lawmakers and folks at the white house and ask them why was growth slower than

>> when you look at google and facebook, they have more power over what we read and what we see than any in the media, whether it's six months or six days, what we see in this decision is really about chilling free speech and so it is time that we break up big tech, not just regulate them. eric: that's former trump chief of staff, mark meadows on facebook's oversight board's decision to keep the former president, president trump, off the social media platform and instagram for now. the board's co-chair told fox news sunday this morning that that board also believes facebook imposed an improper penalty which was not aligned it says with its own rules. >> mr. trump is subject to the same rules on facebook as everyone else and the oversight board held that this was in fact a violation and thus facebook

was justified in taking them down. what we did say, though, was that they were not justified in taking them down indefinitely. they needed some time because their rules are in shambles, they're not transparent. they're unclear. they internally are inconsistent. so we made a series of recommendations about how to make their rules clearer and more consistent. eric: so will they be a allowed back on? republican congressman of colorado, ken buck, joins us now. also a ranking member of the house judiciary subcommittee and anti-trust. congressman, that gives you oversight into all the insight on how monopolies work. what do you think of the ban and what do you think facebook will do? >> well, facebook's a private corporation and they can do what they want to do and in this case they are discriminating against conservative speech. the answer is not to form some sort of government agency to oversee a private corporation in how it applies its rules. the answer is to make sure that we have competition in the

marketplace and have four or five facebooks and three or four googles and five or six twitter companies and when we diversify the social media platforms, we will get more economy tigs and we will also -- competition and get more diversity and viewpoints. eric: facebook says it's not conservative speech, it says it's violating the rules over violence and encouraging violence and an insurrection against this country, an attack on our democracy. what is your view of that? >> i think that's the biased view of a certain group of californians who don't like president trump and don't like conservatives and they say it's violent. they have bashar assad from syria on, he has 250,000 followers and he is spewing anti-israeli and anti-american hate and yet that's fine with them. but president trump somehow is a

threat to our country. it's nonsense. but again, the answer is not to have government oversee a private corporation. it's to make sure that that private corporation is competing in the marketplace against others. eric: here's what mr. mcconnell was on fox news sunday this morning, when the president talked about the rioters to go home, he said the president issued those statements, as the mob was ripping through the capitol and members of congress, your colleagues were cowering in fear. here's what the board said, citing the president's coming out saying they have very special people, that the people are up at the capitol, among them the rioters were patriots. the board said, quote, there was clear immediate risk of farm and the words of support for those involved in the riots legit legitimized their actions. the ayatollah is on facebook at

the same time they're citing president trump's works that they say inches gaited and caused -- instigated and caused the attack on our capitol. >> it's the inconsistency of how they apply the rules that's so concerning. i think president trump made it clear in his speech on the mall that he wanted peaceful demonstration and he's also made it clear in his video taped speech that he wanted to make sure that these people left the capitol building. that is not inciting a riot or inciting an insurrection or creating an immediate harm. the individuals who entered the capitol building and rioted should be held responsible for their actions but president trump should be allowed to speak in different forms without being censored by these private corporations. eric: what do you think will happen? they say they'll review this in six months. as a ranking them better of the anti-trust committee, what type of legislation do you see moving

friday and he blamed the trump administration for the crisis at the southern border but even some fellow democrats say president biden needs to do more to address the problem head-on. >> the reality is, is that this is a crisis. we all know it. and the federal government must do more to address this surge of migrants who are coming to the border with increasing numbers each year. what i'm waiting for, mike, and this will come as no surprise, is for the administration to take bold action to actually address these concerns. jacqui: tom homan is a former acting i.c.e. director and fox news contributor, he joins us now live for more on this. tom, secretary mayorkas said they inherited a broken situation from the former president. we saw the reporting earlier in the show, showing people still coming across, despite the border being closed in that messaging from the

administration. biden administration made its own policy changes too, particularly as it relates to children. i asked you, tom, was the surge at all self-inflicted? >> it was absolutely self-inflicted. look, there's no absolutely no integrity left in this administration. they're on national tv, lying to the american people. first of all, i agree with the secretary. they have a plan. the plan was open borders. they're carrying it out. when they say the trump administration dismantled the system, why doesn't anybody ask the question tell me exactly what they dismantled. please tell me what they dismantled. the only thing they got less of than the trump administration had was child beds and the reason they didn't have more beds with hhs because president trump secured the border. he had 80% decline in illegal immigration so we didn't need the beds. who dismantled what? they dismantled the three agreements from the central american countries that were working. they dismantled the remain in mexico program which was working. they dismantled the wall construction which was working. they dismantled 52,000 i.c.e.

press congress touting progress in the way they process unaccompanied children. he didn't address whether they plan to address title 42. president biden's not applying the rule to unaccompanied migrant children and some critics say it's causing parents to send their kids across the border alone and single adults who get expelled just try again. so what do you make of the fact that mayorkas didn't say whether they plan to continue or end title 42? >> well, if they end title 42, we lose the border. i mean, they've already lost control of the border, the criminal cartels of mexico control the border. if had they end title 42 and i think they understand that, that they will see a surge like we've never seen before. here's what i said months ago and here's what they're doing. they're going to get really good at releasing people very fast. so there's no overcrowding at border patrol facilities. the president said last week we have this under control they're

releasing people faster, building more facilities, hotel rooms at 370 of dollars a night to release children from border patrol quicker and families into the entireof of -- the interior of the united states. they're ignoring border security. over 1500 a day are getting away, criminals, drug smugglers are getting away. child trafficking and female trafficking is on the rise. they're addressing nothing about security. they're just getting really good at releasing people quickly and they call that a success. jacqui: vice president harris met with mexico's president on friday to discuss root causes of migration and the administration is sending vaccines to mexico, mexico is ramping up checkpoints and restrictions. the challenge is going to be figuring of out how to stem the flow of migrants from honduras, el salvador and guatemala, how do they do that in your flew. >> hopefully the mexican people told her that the surge is

because of biden's policies. the mexican president even said that she don't need to meet the mexican president. they need to reimplement the agreements president trump had with mexico. they an agreement with mexico, patrolling the border. they had the stay in mexico program. they tore this down within the first two days of the administration. they're trying to reinvent the wheel. they purposely destroyed everything trump to get open borders. this isn't an accident. this is an open borders agenda. they opened the border up, got rid of the policies that work, at the same time they crippled i.c.e., at the same time they ended i.c.e. detension. this isn't by accident. this is by design. this is an open borders agenda. joe biden sold out our security to win the progressive left. this is what they want to do and this is not going to end. this is open borders. jacqui: well, it's immigration reform has been one of the

shot before we take this seriously? how many more kids do we need to be shot before we realize that bad policies have consequences and we need action and we need policies regarding laws to have consequences. >> what is the bad policy? jacqui: alex hogan is live in new york city now with more on this. alex. >> reporter: hi, jacqui. these three victims were not together. in fact, none of them knew each other. but they include a 4-year-old girl who was shot in the leg. there is video that we have of the time when a police officer was seen running through times square, carrying this 4-year-old child who at the time was toy shopping with her parents when she was shot. the other victims include a 23-year-old tourist visiting new york from rhode island. police say she hoped to see the statue of liberty which was closed so she decided to visit times square and then was shot in the leg. a 43-year-old was also shot. now, this is just the latest

shooting in the city as the number of incidents and victims has surged in recent weeks. the mayor responding, thankfully these innocent bystanders are in stable condition of. the perpetrators of this senseless violence are being tracked down and the nypd will bring them to justice. congresswoman nicole malliotakis firing back, writing in part, re-fund our police and untie their hands, let them do their job. other critics speaking out today on "fox & friends," calling for greater consequences. >> 88% of people who are arrested in 2020 for gun crimes were back on the streets without any bail. 55% of people who were arrested pulling a trigger back on the streets with no bail. >> reporter: now, as far as this specific shooting, police released security footage of a person of interest. they also recovered three shell casings but they have not recovered a gun just yet as they continue this search. now, as far as the victims, all three, the two women and this

million americans have gotten at least one of the shots. that leaves tens and tens of millions, maybe nearly 100 million without it. what would you say to those people who are still concerned about the shot and have not yet decided to get it? >> well, first i would say congratulations to the almost 34% of the americans who are fully vaccinated. because not only is this group of people protected against getting the coronavirus, we know they're protected against certain variants. for those who are on the edge, i would really encourage them to follow the science. these vaccines have been studied. this has been the most robust study of any vaccine in our history. we know the vaccines are say. we know they are effective. we are looking at the numbers, we see well over half a million people in the united states have died and that's not the only consequence of covid-19. we have the long haulers, people who have neurological problems, who have fast heart rates, who have blood clots.

i encourage them to understand the vaccines are safe. this administration is taking very, very seriously the safety of the vaccines and you should get it to protect yourself, to protect your community and to protect our globe. because what's happening in other countries like india, who is to say it can't happen to us. we have to be vigilant and get the vaccine. eric: yeah. but then again, you hear these stories of blood clots and the vaccine, women especially, you know, some isolated they say incidents. so how would you area sure -- reassure someone who hasn't gone, reassure those who are questioning. >> i would say the fact that the fda paused that johnson & johnson vaccine, even though the chances of getting the the blood clot at the time were less than one in a million, should be reassuring that safety is of the utmost concern. i would also let people know just look at life in general. you are more at risk of getting a blood clot if you fly on an

airplane, if you're pregnant, if you take birth control pills and you're not at risk of getting a blood clot if you get the covid-19 infection. the chances of getting a blood clot even with the johnson & johnson vaccine are very, very low. so overall, the benefits of the vaccine far, far, far outweigh the risks so people should get vaccinated and get pro the detectived-a-protected from covid-19. eric: a lot of people think it was so rushed. but the science behind this goes back like two decades. >> absolutely. the name warp speed gives people pause because they think you i don't want anything in my body that came at warp speed but the messenger rna technology has been studied for over three decades and coronaviruses are not new. the novel coronavirus is but the coronavirus is not. we've been studying them for years and years and so these vaccines are safe. these vaccines are effective and you should get vaccinated so we can get back to the new normal here.
