elizabeth city, north carolina. chris. >> it's been almost a month since andrew brown junior was killed in a deputy-involved shooting on april 21st. now you can see the scene outside of the public safety building here. a handful of protestors chanting no justice, no peace a few minutes ago because the district attorney here, is holding a press conference any moment now where he is expected to give us an update on the investigation. the shooting was being investigated by the north carolina state bureau of investigation. now we do not, harris, expect to see video. remember under north carolina law that video is subject to a court order and a judge ruled that it would not be released until the f.b.i. had completed an investigation. maybe we'll learn more about that. you put your finger at the center of what's happening today and why there is so much media here. when the judge was deciding whether or not to release the

body cam video the brown family first saw about 20 seconds of it and then last week last tuesday saw about 20 minutes of it. the district attorney during that hearing said that the car that brown was driving made contact with deputies. the family has a very different characterization of what they saw. they say it wasn't the case and why it's an execution-style video of what happened to brown. the reason why that matters is here in north carolina, officers can use deadly force if they perceive a threat of deadly force to them. we'll see whether or not the district attorney addresses that or not. one thing is for sure, the update on whether there could be any charges or indictments coming for any of the officers involved, that will be news that many of the protestors out here want to know. a total of seven deputies after the shooting on april 21 went on administrative leave. four were brought back to work because they didn't discharge

weapons. we don't know exactly what kind of update we might get. one of the options that we could see develop here is whether or not it goes to a grand jury. we have to wait and find out from the district attorney. >> harris: we'll come back to you as soon as it warrants. let me get to this president biden with a stark warnings for americans who choose not to get the covid-19 vaccines. he says, quote, they'll end up paying the price even as the cdc continues to face backlash over shifting guidelines for all americans and despite the good news -- i want to say it again -- good news. they didn't lead with this. covid-19 cases are now down in all 50 states. the president cautions that those numbers could tick up again and he is already blaming states where americans may choose not to get vaccinated. watch. >> president biden: if the unvaccinated get vaccinated, they will protect themselves and other unvaccinated people

around them. if they do not, states with low vaccination rates may see those rates go up. may see this progress reverse. ultimately those who are not vaccinated will end up paying the price. >> harris: the confusion over mask wearing is raging. as states and cities and businesses are left to sort it all out through that maze of cdc guidelines. joe concha, fox news con trib tore joins me now. it seems like a missed opportunity. you have people across the country by the millions fully vaccinated now. you don't lead with the good news that the cases are down in 50 states? it makes no sense. >> oh, i've got some good news to share here, harris. first when the president says paying the price, if everybody doesn't get vaccinated. let's look at what is going on

in texas and a good news story. 33% of the state is fully vaccinated. just 33%. yet on sunday the state had 0.0 coronavirus deaths. if you recall march 10th is when that governor, republican, lifted those mask mandates. as they did in mississippi. the president of the united states said it was neanderthal thinking said and it was very dangerous. dr. fauci echoed those statements and the cdc. in mississippi on sunday there were 0 covid deaths. so we should be making note of that. there is tremendous progress being made. cases are down. we're talking in that state 85, 90% in terms of hospitalizations and cases. it should be a lead story. >> harris: you mentioned it and everybody can remember for themselves president biden and what he said back in march. >> president biden: i think it is a big mistake.

governor andrew cuomo's tax returns show he could make $5 million off the covid leadership book. the same one he wrote as thousands of people died in nursing homes during the pandemic that he was leading here in new york. the feds are investigating claims his office covered up those nursing home deaths. republican candidate for governor lee zeldin let it rip. >> the nursing home order and cover-up, you profit off blood money, profiting off of the suffering physically, emotionally, financially of your constituents of new yorkers. >> harris: i'm going to go one more here with you joe. a warning to people it gets graphic. cuomo accuser karen hinton writes in an op-ed this is a quote, i spoke openly about my own experience with cuomo in the "washington post" recently but witnessed his misconduct with other women at hud.

from lebanon as things are heating up on the west bank. all of this complicating a potential peace cease-fire. trey yengst is live in western israel. what aid will the people in gaza say at this point and what exactly is happening on balance with the violence? >> harris, good morning. today is the ninth day of fighting between israel and hamas and the palestinians this morning with the permission of the israeli government received much-needed aid and supplies though as that aid was being delivered to the gaza strip hamas fired on trucks. ultimately they closed the border once again. rocket fire resumed again this morning after six hours of quiet. it looked like a window of opportunity for calm but these rockets slamming into southern israel today killing two people. take a look at the scene of one impact in southern israel.

at least two people are dead and many more injured after a rocket slammed into the regional council along the israel/gaza borders. first responders say those killed are foreign workers here on work visas. off in the distance there are israeli artillery rounds being fired into the gaza strip in response to the attack. at least two people were killed when a rocket slammed into this area. heavy israeli air strikes targeted gaza overnight. 214 palestinians have been killed so far and hundreds more injured. the scenes of destruction and devastation coming in sda are significant. more sig and a half can't the voices of civilians caught in the crossfire. >> what does this at 5 lun 30 in the morning? people are still sleeping. our lives, we have no idea where we want to go and where to run.

terrorists in places, targeted places to keep them from doing it immediately. how much time strategically. what is he talking about his military needs to do and what kind of time do politics give him to do that? you know both. >> well, we've seen a familiar pattern before. some kind of unrest in israel. the terrorist organizations, two of them in gaza fire rockets and missiles at the israeli citizens. in return and response to that certainly air attacks go into gaza and there are casualties on both sides and calls for cease-fire. what prime minister netanyahu is up to and i commend him for doing it and he is determined about it. he wants to significantly degrade hamas and the palestinian islamic jihad's capabilities.

their military capabilities. rockets and missiles they have, the launchers themselves and the infrastructure that is supporting them. he has a nine-mile tunnel network in gaza where fighters move back and forth and move ammunition away from the bombing. he is focused on that as well. this is critical to deterring these attacks happening again. that is what the prime minister is about and why he is not prepared to go to a cease-fire right now, which would give hamas a winning hand. he is very much opposed to that. they'll know when they've achieved their military objective. they aren't going to foreclose that before it happens. but once that does happen, then i think we'll see the prime minister seek a cease-fire. >> harris: i've heard criticism against some of those in the left that the president is clearly, clearly hearing from right now in his party. the criticism is that they are tone deaf on what really needs to happen here and maybe they

are not seeing the clear picture of who is on the other side of israel. this is not about the palestinian people who by the way are being killed in droves because among them are the terrorists from hamas. talk to me a little bit about how hard it is to deal with an enemy across the line like that and what biden needs to be doing right now. >> well first of all, yes, it certainly is challenging. but let's look at what hamas and the palestinian islamic jihad actually do. they fire the rockets and the missiles using their launchers in and around civilian population. they know full well israel has no choice but to do the best they can in attacking those sources of these rockets. they have to do that or else israelis will take unnecessary casualties. hamas is fully aware of that. and they take no measures to protect their own people.

they know that people are going to suffer casualties. they want those casualties to take place, harris. that's the reality and the truth of it because they want the world to react to those casualties. otherwise they would be building bombshell tears all over gaza like israel has all over its major cities. what they have is tunnel networks but they're for the fighters. they're for moving the ammunition. they aren't for the people. >> harris: quickly because we want the move on here the president seems to sit in the middle. yesterday through his press secretary she said we'll stand back from the politics of the moment and they didn't aggressively go after a cease-fire. then i have to imagine like fire they heard from the progressives in their party and now the president is saying to benjamin netanyahu yeah, we'll entertain the idea of a cease-fire meanwhile the people on the left are saying immediate cease-fire. can he stay in the middle of the road? >> well, he shouldn't be in the middle of the road. i applaud him for defending israel's right to take protect

its own people and his bipartisan support for that despite some of the people on the far left who are opposed. here is where he is dead wrong. the sponsors of this proxy war that we're seeing take place right now is iran. they provide all the rockets and missiles. not just to these two terrorists groups in gaza but hezbollah and tens of thousands in lebanon and last week iranian missiles were falling on saudi arabia fired by the houthis, their proxies. it is iran leading and sponsoring this activity. the president should be calling them out. but what are we doing? we're negotiating with iran in vienna to give them more money once again, which they will use to buy more rockets and more missiles for these proxies that are in gaza, that are in lebanon and also in yemen. and that is the reality of it. a lot of the money that they received as a result of the original nuclear deal in 2015,

breaking news is this. it's on the investigation into the shooting of andrew brown by sheriff's deputies. he said brown's death was justified. and that brown did indeed try to drive his vehicle into sheriffs deputies trying to serve a warrant. they are serving a warrant. he is driving his car and now that shooting and killing of andrew brown being called justified. at that news conference some of the police officers body cam video was finally released. we warn viewers some of it is disturbing. we're going to play out what we have for you now.

governor parson, i'll come to you first. >> first of all, we're on the right track in this state because we're bringing people back to work and we know those federal unemployment enhancement has created problems for the workforce and for the business of this state. right now we're number one in the state for small business wage growth in the united states. we're second in the nation for apprenticeships and top five for recovery and top seven for manufacturing jobs in the state. the jobs and business are there but we didn't have the workers there. why we made the decision to bring people back. it was the thing to do. this was supposed to be temporary, not a full-time type unemployment situation. yes, it was a crisis but the crisis is well under control now and people need to get back to work and we need them back in the workforce and that's where they should be. we'll do everything we can to make sure we bring people back to work in this state. >> harris: governor kemp. i'm curious whether the president or anybody in the white house has consulted with all of you.

you are there leading through the pandemic when he was running. joe biden said he would check in with you on vaccinations and that sort of thing. this is a big, important job, the economy. >> no doubt about it. harris. they know what the numbers are. in fact the american rescue plan, the state of georgia and other states that have lower unemployment rates are actually getting penalized. they know what our unemployment numbers are here. we're well below the national average. literally everywhere i've been the last three weeks people need more workers and it is not just in the service industry. it is in great manufacturing jobs, across all sectors. i continue to hear that. which is one reason that we're ending the federal subsidy trying to get folks back to work. we have got a lot of things that governor parson mentioned. childcare, other things that we've done but i've talked to childcare agencies.

they can't hire anybody either. people are getting the extra benefit and they want to stay home versus getting in the workplace. >> harris: it is pervasive, the pebble in the water and a ripple effect. senator to turn expanded unemployment benefits into signing bonuses. you talk about all the different ideas to try to get things moving again. governor parson, your thoughts? >> i don't think it's government's place to be doing that. the private sector wants to do bonuses to bring people back to work i think that's exactly what needs to happen. they need to make those decisions. i don't think it's government's place to start giving bonuses to people to go back to work when they should be in the workforce in the first place. government's place we're the ones that control the benefits. that's our part. i don't think you start another government program to enhance people to go back to work. you just make sure people understand you can't live off the government for a tremendous amount of time for a long period of time. you have to go back in the

workforce. >> harris: certainly not forever. gas pumps running dry to several states after the recent colonial pipeline pack. governor kemp declared a state of emergency last week and suspended the gas in his home state of georgia, the gas tax. 39% of the pumps in atlanta were still out of gas this morning when we checked. the biden administration continues to portray the incident as a non-issue. the crisis is also raising additional concerns over the president's decision to halt the construction of the keystone pipeline. governor kemp. >> well thanks, harris. listen, our quick action by the team here in georgia not only suspending the fuel tax to keep the price inflation because of the shortage from hitting our hard work en georgians are trying to get to work and medical appointments and schools.

we also reduced load limits on trucks. the hours that they can drive were expanded. we worked the agriculture commissioner to get a federal waiver to use the winter blend fuel to help give every drop we could get into the marketplace. we're seeing it coming. yesterday 50% of the pumps were out. today around 40. >> harris: forgive me for cutting in. i need to let you both go. what would you say to president biden and the white house right now? they don't think this is a big deal but 50%, 40%, any of those numbers in gas distribution and access. it's frightening actually. >> first of all let me tell you this. i would go back to 9/11 and let's talk about it was a serious time when prices got inflated at a massive rate and a couple of months ago in the wintertime with a shortage of natural gas and prices went up at extremely fast pace and nine
