but here is who you are. this is your flag, it's a separate entity within this framework. that's always bothered me. i think it's great whatever you are going to do in private business or at home as a signature fire of how are and i think that's important in this world to stand out with who you are. but, what is your take here when we are dealing with the executive branch and the judicial branch, government buildings, et cetera? >> well, this particular request, tammy, came from the executive branch to the judicial branch. and i think it's awfully bold that some bureaucrats at the gsa or political advisers in the biden administration think they have the power to tell federal judges what flags to display. the judiciary is a coequal branch of government. they do not report to bureaucrats in the executive branch. and they don't have to put out flags that they don't want to. now, on the merits, i would say the only flag that should hang over our united states

courthouse is the flag of the united states and possibly the flag of the state in which that courthouse sits. i think that it's even more offensive to ask a courthouse to display the flag than it is an executive branch building. and here's why. federal judges are supposed to be neutral arbiters of disputes. they are not in any way political. and federal courthouses shouldn't be used as billboards to celebrate any particular cause or group or holiday, whether that's breast cancer awareness month, whether that's supporting the troops, or black lives matter or the pride flag or saint patrick's day. >> tammy: that's an excellent point because even though, of course, people are not -- are not perfect, obviously, we can at least try to not signal to the external element that we are taking a position on effectively a social issue. is it -- and i thought this as

well with the black lives matter flag over diplomatic missions around the world. that seemed to signal a political message to other countries that either we have to make something, you know, up for being bad people or our nation is still trying to signal that we're worthy of anyone's respect because that's what flags do, right? that's a signal of who you are and what seems to matter to you. what would you say though to someone regarding social issues? that, in fact, being pro-gay rights is in fact a neutral position, if you will, especially for the court system? that should be the centered position for where you come from when you are looking at legal issues. >> well, tammy, judges wear black robes. they don't wear rainbow robes. they don't wear red robes or blue robes, they don't wear green robes on saint patrick's day. they wear black robes to signify whatever their sex, whatever their race, whatever their ethnic background, whether they put on that robe.
