the latest? >> they are determined this is a rescue operation they have been digging deep through the rubble overnight there has not been a rescue since thursday. the numbers w cited stand at nine confirmed deaths we've seen that go up 156 people still missing a day for so the death toll could climb dramatically as they continue to go through the rubble. in engineering report three years ago getting quite a bit of attention that report detailed breaks in the concrete and significant cracks in the building and last thursday 1:30 a.m. is not being cited as a direct cause but there were $9 million of repairs that were not done before the collapse right now mandatory inspections are underway along the beach 40 years or older one building very similar in design and structure to the one that collapsed getting quite a bit of attention here is the mayor of surfside. >> i don't know if i would be comfortable staying in the building until he knew for sure

that they had done a comprehensive top to bottom study on what is going on with the systems in the building. >> a number of families of those still missing have asked to tour the scene where the destruction rubble is some to say prayers over their loved ones we expect that to take place in the hours ahead. back to you. mike: steve harrigan from side florida. learning more about the victims of the tragedy charles watson live in surfside florida with the latest on that front. >> there is really a flurry of emotions among everyone affected by the building collapse particular family members of the missing who are angry, sad and downright frustrated as they wait to learn the fate of their loved ones, the latest is nine kim victims confirmed dead the

name of four of those have been identified as 83-year-old antonio and his wife 79-year-old gladys 53-year-old manual and 54-year-old stacy fang whose teenage son was pulled out of the rubble a few days ago at this hour it is unclear what the exact number is of how many people are missing but that has been hovering around 150 people and officials tell us rescue crews are fighting human remains as they sift through twisted metal and you can imagine that is unwelcoming news to family members that were forced to wait and wonder throughout the rescue mission that is now on day four. >> i am hopeful and praying and i try to stay positive that's what i tried to do but every hour that goes by you feel a little less hope leaving and its devastating. family and friends set up a

memorial with some of the missing not far from the collapse site you seen the red cross on the ground going door to door handing care packages delivering food and clothing for victims and officials here in miami-dade, they acknowledged the surf and rescue mission is a slow and frustrating process not only for family members but for the first responders who were sifting through the collapse site they were asking folks to be patient, hold on to hope and continue to pray that is certainly something that we need. mike: the power of prayer, thank you very much. a live look at the southern border as we look ahead to two visits to the region schedule this week, mission texas with a closer look.

good afternoon. >> president biden is trying to reassure reese gunter republicans he wants to see the agreement with congress on the infrastructure proposal, the president is at camp david but on saturday he put out a statement try to clarify his plans that reached 1.2 trillion dollar proposal this is what the president had to say i intend to pursue the passage of the plan which democrats and republicans agree to run thursday with vigor, it would be good for the economy, good for our country, good for our people and i fully stand behind it without reservation or hesitation. biden didn't seem to speak republicans after he strongly indicated that he would not sign off on infrastructure until an much larger spending bill were closely tied to democratic priorities reached his desk, republicans are saying after the president has reassured them the infrastructure that they reached with him stands. >> this is a bill that stands on its own the president will sign if it comes to his death, the

senators the other day at the white house and it seemed like they have a deal struck there is 11 republican senators and that's really the number that they will need to get over the 60 that they need to pass the senate side, i think that is the plan if it gets through the senate side i believe it will get to the house and he will sign this bill and it's going to be a win for the administration. the values, the american values plan is something else, that's an enormous amount of money and that will be tougher not to crack. mike: but will they take for you to get to the superstructure bipartisan agreement. >> i voted against the 2.3 trillion original number because there was garbage and had nothing to do with infrastructure, we don't have to sell this infrastructure package to the american people we present and they will support it but it actually has to deal with roads and bridges and asphalt

and concrete a meaningful infrastructure to help the people in this country move around the great country of ours it cannot be everything but. i did not support the first package and i don't know truly what is in the bipartisan bill from the senate side but i'm looking forward to look at it, reading it and seeing exactly what it encounters. mike: do you worry about how to pay for? >> the fact if it gets through the senate side, of course this administration is spending a ton of money it was 6 trillion over covid now you're looking at 1.9 the family you american rescue plan now you're looking at this and not to trigger dollars of the family plan, the spending is out of control and we need to put a stop to any conservative voices get involved and say enough is enough. mike: is a texas lawmaker and former sheriff let's talk about the southern border, you saw our report from alex hogan and saul

vice president kamala harris go to el paso not the rio grande valley, your thoughts on the border crisis right now and are you relieved that the vice president actually went to texas. >> it's 93 days when she was appointed by the president to address the border, there was an and norma some out of people telling her you have to visit the southern border so she went to el paso but i'm not going to give her a break on this one. she did not visit the border and she took it to her on her way to california because she did not visit the wall the wall was several miles south of where she was she did not go to fort bliss to visit the migrant detention facility she sat around with border patrol agents at a checkpoint area station and had a conversation with a few of the nongovernmental organizations, no, she did not have a meaningful order visit and it

certainly fell far short in my expectation. mike: many thanks for your time. >> thank you. mike: let's bring in rhode island democratic congressman the foreign affairs committee, welcome. >> good to be with you. mike: what is your assessment of the current crisis of the southern border and what can be done to address it? >> i think the administration is approaching this in the right way really focusing on the underlying reasons for migration and understanding what's happening in the region that is good to read into that helping to make investments that will reduce those challenges in those countries in guatemala, honduras and el salvador they've also done a very good job of managing the surge at the border, the reports now children are in custody a border patrol for 30 hours as opposed to 120 hours a significant reduction which means are being placed properly in settings that are appropriate for children but this is a

complicated difficult challenge and we wanted immigration system that is orderly, fair and reflects our values of our country and the administration doing that but this is a difficult problem to solve people are fleeing persecution, crime tremendous hardship looking for a better life in america. in dealing with underlying causes of them migration why people are coming here is the right way to approach it and that's what the administration is doing. mike: the vice president took a lot of heat for not going to the border until the past week, did she in her staff make an unforced error and waiting that long? >> i think the administration from the very first day that they took office and they understood they inherited a broken immigration system in real challenges that the border and they began to work immediately to be sure that we were putting in place an orderly and fair and humane system to

deal with the immigration challenges they've done that from the very first day i don't think that visit changes that an understanding what is happening at the border is a goal and the administration has demonstrated a deep understanding of the challenges in approaching in the right way reflects who we are as a country in the values. the immigration has been described as a crown draw of american humanitarian position and we have to protect the system in a way that people can access an affair and humane way. mike: to for structure how do you assess the agreement president biden has struck with bipartisan senators. >> them for structure agreement is a good start it's a little over $1 trillion of investment in roads, board under bridges imports and other transits it's a good proposal the president has another proposal that relates to childcare in early childhood education and higher education and paid family leave,

those are cargo parts of our recovery but the infrastructure plan that the president has announced is a good one it will be transformed to our country and create millions of good paying jobs and it will address the deficit in our infrastructure spending which is gone for too long anyone who travels around any part of our country knows that we need to make investments in rebuilding the infrastructure of our country to compete around the world who are literally racing bias, this is critical, it's bipartisan support to rebuild the country and i look forward to the terms of a fallen agreement. mike: you been around as a lawmaker for quite a long time does coupling these two bills together the one the progressives want in the infrastructure package make it more complicated, more difficult to get them to the finish line? >> i don't think so the president says there's bipartisan support for the infrastructure bill in the deal

he's described, there's tremendous support in the democratic party for investments in families and working families in particular to help you get to recover after covid the republicans are continuing to oppose paid family leave, sick leave, affordable childcare, investment in community colleges democrats will keep fighting for that and will fight for investment housing and fight for investment school construction, again the president has reached a compromise on part of it and the democrats will keep fighting for those which we know are essential to working families and we can do both things. mike: we will see where the votes are, david cicilline, thank you for your time. coming up after our show chris wallace talks abiding senior advisor senator richman over the confusion of the president's intention with bipartisan infrastructure plan and that and more at the top of the hour. a school board meeting in

comfortable. mike: the school board says it does not teach critical race theory, parents and even teachers have quietly told me that they do or is being forced on them is a school board playing games? >> the absolutely playing games as i said before nobody is saying that their teaching critical race theory as they would chemistry or physics they have a consultant on contract they have been on contract for three years, their whole model is education through critical race theory it is all over the document there's invoices that they show to critical race theory in their teacher trainings and all you have to do is look for the buzzwords whether it's white fragility, white privilege, oppressor versus the oppressed those of the language of critical race theory in their using it through teacher training so the teachers will bring that down to the educational level with students and that's what we've been seeing that's what we've heard from parents and we've seen dozens if not hundreds of screenshots and documents and i think the school is trying to play in a wargame and that's one

of the things that is driving frustration and we cannot get honesty from our schools. mike: another issue is proposed transgender policy, take a listen to the former school board member. >> using the correct names and pronouns for transgender and binary kids is suicide prevention, you're going to hear a lot of voices tonight a few are likely to be very loud, this policy hurts no one and help some of our most at risk kids to feel welcome in their schools. >> does this policy hurt someone? >> look around look at how many people showed up to talk about the policy and their concerns with their policy whether it's religious nobodies, competitiveness in sports there is issues with ramming through policy that really they haven't listened to input from the community that's a problem that you seem they will not give

parents a seat at the table they will listen to the special interest friends, they will listen to a handful of activists and when parents come to speak out they shut down the meeting and ultimately what this really is about at the school board that is so hostile for the first amendment right in the vast majority in its community and that's where this movement continues to grow and growing girl. >> i remember getting struck by a student getting off she said i don't feel comfortable changing next to biological boy and i don't feel comfortable using a toilet next to biological boy does the argument from her resignation. >> it does, there's a lot more students out there that have the same thoughts and feelings that she does but the problem when you get into the school system young the anonymous reporting tools in all these ways to intimidate people from speaking out and they're afraid to say something in class or become a school board meeting they will be mocked and discipline and ultimately that is where we see the biggest problems that people

class-action lawsuit being filed against the condo association, are you. >> i am not surprised it was filed i think society tends to rush to judgment on different things in the lawsuit was premature because you don't even know the cause. mike: he responded that i would categorize as despicable the board focus is firmly on helping locate more than 150 unaccounted for people not dealing with an owner who has decided while there are still people buried under the building to file a class-action lawsuit. what is your take on her argument. >> i absolutely agree with that statement the number one focus is of the board should be accounting for the residence, filing this within a couple of days is a huge and unnecessary distraction at this point in time it will take months to unfold this and i'm determined of what the cause of the collapse without knowing what

the cause there is no basis to follow the lawsuit. it could've been subsurface and could've been existing construction on the building, short as possible it could've been by the association as well but at this point time we really don't know. mike: what's your reaction to 2018 report of the condo association noting failed waterproofing to significant deterioration of concrete, how could the condo association handle that. >> it's interesting there is a couple of reports the media is only focusing that indicated there was major structural damage no doubt there was the report but that report does not indicate the timeframe of when it should've occurred and it does not indicate that the building would collapse there was a report issued a month early in september 2018 and that report is a structural component of the building is quote unquote good with that knowledge the board should've taken some action they did take action and

hired an engineer they were in the process of making repairs what this case will come down to is is the board moving fast enough with information that they have and were they aware of the potential risk. mike: what should condo associations across the country be doing in the aftermath of this collapse. >> the one thing that condominium associations need to have a reserve study they should hire an engineer and take a look at elements every couple of years based on that they have long-term repairs and they will give them when repair should take place in the estimated cost so they can plan through this that should happen and keep up reserves to make sure that happens and this is a cautionary tale that rather than wait, don't be cheap do something sooner rather than later, another thing that you will see coming out of this is emergency plans a lot of associations out there may not have an emergency

plan and i think this is a cautionary if you have a natural disaster with anything like that the you should be prepared to have a plan in place to deal with that and as best as i can tell given the circumstances the condo association is doing a good job dealing with this. mike: the first priority to see if there is innocent life that can be saved and recovering those who have lost their lives but once that get work out and months ahead who could face liability in the tragedy. >> the association is the main of the defendant and the board members may be liable but it would be very difficult to establish liability against them they are volunteers and liability protection under the law typically speaking for volunteers to serve on boards like this their job is not to be the expert they are to rely on experts what i can tell they did rely on expert advice, the question will be whether the
