jillian: to the crisis on the southern border, a boy found abandoned on the side of the road in mexico. the national migration institute says he was found near a truck that had been filled with 100 migrants trying to come to the us. it was so hot inside the truck one man apparently suffocated to death. the boy is in the custody of child welfare authorities. that heartbreaking image of a child shirtless and alone is the latest example of the tragedy unfolding there. todd: donald trump will see the crisis for himself, he will tour the border with texas governor greg abbott. david spend has the details. >> reporter: donald trump's visit, days after the vice president kamala harris went to the border, went to el paso, she has been to the border, president biden has not been to the border yet. the former president right there with the governor greg abbott of

's office pushing to cut decades off of a 17-year-old in particular's prison sentence and keep his case in juvenile court after he shot and killed 41-year-old in 2015. the family attorney, thank you for being here. sorry to talk to you under these circumstances. can you tell me what happened to your cousin and what happened between then and now? >> my cousin was murdered in 2015, over a bike. just a bicycle. he was shot to death by andrew pachu. he went to the burger place just to get a burger and that is when his life ended. >> the suspect was two month shy of his eighteenth birthday, he

was sentenced to 50 years to life in prison. as i understand it as i bring you in this case has been remanded to juvenile court to determine if he should have been tried as an adult and if the case doesn't go to adult court he could be released from prison. is that right? >> that could happen if there is not a transfer hearing where a judge decides that he should be sent back to adult court and that is the tragedy in these cases. there are several of these cases where a person was charged and convicted in adult court as was allowed at the time in the cases been set back by the court of appeals ordering the juvenile court have a transfer hearing but gascon's policies require his office to not go forward with the transfer hearing which would keep the case in juvenile

court which would result in this defendant being released in short order. jillian: gascon's offices there are objective pieces of evidence that contradict the motion and the effect declaration namely the complete transcript of the jail call and the court proceedings. this motion lacks merit. back for one more. you say there are two defense attorneys and one prosecutor. what you mean when you say that? >> i disagree with gascon's statement. what i can say is a prosecutor's job is to do justice and to represent all people. unfortunately in this particular situation the person who has been selected or appointed to represent the people, a former public defender, seems to be just representing one person and that is the defendant in this case. she has had many phone calls and emails with the defendant's

mother, and as the defendant's mother says, has her back and unfortunately she has not outreach to the victim's family before the court hearing and so the victim's family feels very much abandoned, this two defense attorneys and no one representing them. jillian: i want to bring you in, you are a relative. i had kathleen say your family feels abandoned. if andrew cashew were to get out of prison how you feel? >> this is a huge slap in the face. you are going to tell me you're not aware of what you did? you know what i mean? he is a coldhearted murder, he needs to be in jail for 50 years. that was the original sentence.

to us this is unbelievable. we are back again to square one, the killer is going to walk free. what about the family. we have no justice, no voice. we are living this nightmare all over again. there is no words i can explain. this is unbelievable. this attorney general to think it is okay to let criminals out like this just completely wrong. what about the victims, the families. there has to be justice. jillian: i can see the emotion in your face and i can tell you -- >> what we are living. >> your voice is being heard and hopefully will continue to be heard, that is the point of the story.

have been artificially low long before the pandemic, what do you think of what she had to say? >> even the most successful restaurant at the end of the day the profit margin is 5% and that is a national statistic. our industry typically creates jobs for people that are transitional. might be students going to college to pay their tuition. we have great paying jobs. the feeling that we are paying less is a misnomer. we are not meant to be the job of support the family of four, 89% are college kids, students doing this for a second job, we are paying high wages and trying our best to keep that profit margin where we can make a living. we would love to provide benefits but they are out of reach for us.
