the biggest class action the world has ever seen because of how many americans he argues were censored by these big tech platforms. >> jesse: i was struck by the very presidential presentation in bedminster. the lawn of reporters, the entourage in the background. the only thing missing was the presidential seal on the podium. >> kayleigh: and look like the white house, the backdrop. >> jesse: i forgot he wasn't president all the sudden, it was good to see him back in action. the president is an adventure and he's doing it now only himself, but on behalf of the american people. that's why it's a class action lawsuit. he and the american people have been treated very unfairly by these big tech giants, and it's not just the shadow banning in the censorship. there was a conspiracy involving these corporations to suppress the republican october surprise. they had the biden family out there exposed in terms of taking big wires from china and moscow,

and holding ten for the big guy. that would have blown up the race and taped it in the president's favor. there is a study on that. they also suppressed factual information about the lab leak, and they said anybody telling the truth about that was lying. and that was also very wrong. they are engaged in a ton of anticompetitive practices, antibusiness practices, and need to be held accountable. that's what the president is doing. they just ripped this guy's vocal cords out of his throat is a very critical time in our nations history. do i think the lawsuit is going anywhere? i've got to be honest, these guys have so much cash to burn, they could tie this thing up for years in litigation. i don't think you will see. the point is the president is trying to do something to correct an injustice for the american people, and this is something we expect our leaders to do, and we'll see how it

announce, or play golf and have dinner with melania? either way, he has options and i support in whatever he decides to do. steel and kayleigh, digging into a bit of what we understand about this complaint being premised on, it's based on a justice thomas concurrence in a case that came out of the supreme court earlier this year. that was actually about the president when he blocked users. but the arguments that came out of that case indicated that essentially it could be used as a public forum. but justice thomas dug in and said, first of all, there are unanswered questions. private companies that can be seen as because i government forums that, when granted the special considerations, they act as an arm of the government. therefore, he says, the power to quell speech and sensor actually lies in the hands of the few. those if you guys that control digital platforms that in turn control not only fact dissemination but public

response to it. that's exactly what the president was arguing here in his speech when he said this is about censoring americans. in the end of the concurrence by justice thomas, he said that this here in this moment, we don't have the opportunity to address it. clearly president and his team are seem to have those questions answered now with this lawsuit. what are your thoughts on that element? >> kayleigh: that's exactly right. he lay that out well, emily. i want to point out that my sister runs social media for the people supporting his lawsuit. he watched them there with the president. that aside, let me point out what you're saying they paid these entities are becoming because i government entities. when you have, let's say, youtube saying, "we will block you because you're not in line with health authorities." who are the health authorities connect the cdc? is that a government entity? of course it is. it's an immense amount of power youtube has when they can say, "governor desantis, we know you've done a panel with medical

experts from harvard and stanford, but we'll take it off the platform because you talk about the efficacy of children wearing masks." which, the w.h.o. says children under five should not wear masks. so they modeled the waters, to become government entity or because i one themselves, it's the legal argument. jesse made this point, this is the president fighting for every day americans. when i was banned from instagram i had a public platform, a megaphone. they should me a public apology. i was banned alongside "the new york post" for sharing the hunter biden story. later, we see jack dorsey apologizing. both of us have an enormous megaphone. who doesn't have one is one of the plaintiffs that president trump -- she merely put up a video and was blocked and censored. this is giving a megaphone to thousands of americans across the country, and good for the

president. >> emily: morgan, this is against the landscape of doj talking about new attorneys in the fight which they argued as a monopoly of these big tech giants. could this be a full frontal scale assault on these guys from all aspects of the public here, through all the forums possible? >> that's a good point, emily. when we look at the actual lawsuit, it'll depend on lawyers like you and kayleigh to give us the facts. i will tell you from a p.r. perspective, zooming out of the big picture and all of this, there is a monopoly on information by all of these major social media companies. and that is really, i think, getting to the heart of what seat in the stack met earlier. that former president trump is trying to address. whether the lawsuit is successful or not, i think this is part of the plan and part of an ability to try and break up this monopoly on information. so we will certainly see if they're able to do that. we all remember back in history

looking at the breakup of standard oil, right? in the 1890s, whenever the the american supreme court really started going after a big monopoly. i think, comparatively, these social media tech monopolies and oninformation or even bigger thn those monopolies in american history. i think it's incredibly important. i would also note -- and this is breaking news, this press conference was light before he came on. senator rubio introduced a bill where he is saying that fact-checking labels, trending topics, and algorithms should not be subject to section 230, which is what we all know these tech companies hide behind as it relates to lawsuits. we should really watch this bill in addition to the president's lawsuit. >> emily: what i see coming out of that bill is the point being made there, that the laws right now are archaic and don't really apply to the flexible new

arena of social media that everyone keeps trying to be shoved into the laws as written now, but congress are on one side of the table and the public are crying out for these laws to be changed, to catch up, essentially, with what social media has been doing in part, which is dominating and censoring. >> gillian: it's not just when it comes to big tech and social media that congress is fighting the fight of 50 years ago. they're still building the maginot line at this point. that's not surprising. former president trump kind of beat a dead horse a little bit today when he brought up section 230 again. during the last month of his presidency we heard over and over again at section 230, from him, as a special favor that congress essentially grant city social media giants. it's not enough to rejigger the law, to rewrite it. he wants a complete and total appeal of that section. he put that on the line. congress did not go for it, even

when his party was in the majority. he's bringing it up again here, though, because he wants to bring congress' culpability front and foremost once again. in a sense, listening to him today, i was reminded that all along one of his biggest beef through us and all of this is with lawmakers. that they are the ones enabling big tech to have the power they do. what we've seen over the last -- how long has he been out of office now? january, february, march... six months since he's been out of office, congress has held a hearing after hearing with a continued to drag these high-profile celebrities, they make these threats, then they go home and literally do nothing to rein in the power. so part of the issue here is, when are they finally going to step up and do something? i think this lawsuit is little more self-serving than maybe jesse and kayleigh laid out for us a moment ago. we know you love the former president like family. i think this is more about his

political prospects going into the next election. he wants to keep this issue front and center. he opens, by the way, not by saying it's for the american people, but by saying, "i want to fight back because they ban me after january 26th when they unilaterally declared me a public safety threat." i think it's about a personal beef with the companies, but some good things may come of it despite that. >> emily: jesse watters, final words? >> jesse: it's personal but he's acting on behalf of the millions of americans that feel basically shaken down by these large corporations. and you're right, it is a play that we are all watching right now. they have these people come up in front and testify with black t-shirts and long hair, and then they go back to silicon valley and they laugh at us, because congress doesn't do anything, because their lobbyists shower these congressmen and women with thousands and thousands of dollars in donations. and they spend the money around to the republicans, to the

>> kayleigh: the head of one of the nation's largest teachers unions, randi weingarten, warning her group will defend teachers accused of pushing critical race theory amid the growing battle in states over a far left agenda being forced on students. in this hour, first lady jill biden is said to speak at a convention for the teachers union asap just a day after weingarten vowed to target and push back against critics of critical race day. weingarten says the union is beefing up legal funding to defend teachers as some states ramp up efforts to push back against the far left agenda in classrooms. >> cultural warriors are labeling any discussion of race, racism, or discrimination as crt to try to make it toxic. they are bullying teachers and trying to stop us from teaching students accurate history. mark my words, our union will

defend any member who gets in trouble for teaching honest history. >> kayleigh: at least six state legislatures have banned the teaching of critical race theory, including the state of florida. hello that plant legally when you have them saying that they will defend teachers who continued to teach these controversial practices? >> emily: they have either banned or restricted high schools can talk about race or sex. i think it remains to be seen, but the prospects don't look at for having this be a legislative ban. he is a lie. the supreme court ruled against a similar law in new york state that required teachers to sort of a firm and oath and prescribed them, meaning prevented them, from teaching a certain curriculum they deemed was unhealthy for the

constitution, and since then there have been numerous decisions that have affirmed it. so i sort of come back to the conversation we had with former secretary bill bennett where he said the other avenues are likely the ones that will work better, which is school choice, parents joining their school boards, then having more control over the subject matter and these other ways. because at this point, legally, to actually pass a law that bans critical race theory from being taught, that is where the prospects don't look good in the public school system. quick final point about that union, however, a reminder that the supreme court recently ruled against teachers automatically having to pay membership and be represented by the union. she talks about representing all of them but in fact she does not. >> kayleigh: jesse, meanwhile you have terry mcauliffe running for governor of virginia. he says critical race theory is just a fallacy. his exact words are, "critical race theory as of right wing conspiracy totally made up by donald trump." but here we have the teachers

union leaning in. so it seems to be an abject lie. >> jesse: when the democrats call something a conspiracy theory, that means it's true. just go look at history that. [laughter] i would say to randi weingarten, bring it on. she's a wicked person. if history is any guide, the teachers union is already in the process of embezzling the hundreds of billions of dollars we gave them to not be in the classroom during the pandemic. so they gave the kids of this country a lost year already, so now they are behind in the race against china. instead of trying to play catch-up with reading, writing, and arithmetic, they will inject a little brains with racism. it is sick, i am shocked that dr. jill biden, the first lady, would align herself with this kind of garbage in any way. critical race theory is not a hill to die on if you are the first lady. that is beyond comprehension. remember when you guys were in sixth grade, okay? hormones shooting everywhere, there's drama at school, you hate your parents, you are busy,

taught in our schools. it's called, "not my idea: a book about whiteness." that author is named anastasia higginbotham. she gave this quote. "whiteness is the reason these killings by police happen. the white cultural mindset that tells us why it is good and innocent while black is bad and dangerous. whiteness is the reason cops make split-second decisions to fire their weapons into the body of an unarmed person who is black while not even reaching for a weapon during interactions with armed and violent criminals who are white." doesn't seem like it's easy theory. >> morgan: well, also the big problem that i understand, these are elementary school children that really don't have the maturity or the mental capacity yet. they are children, they are tiny children. they shouldn't be talking about shootings and things that are just quite scary to them, and

totally beyond their comprehension. but i think emily hit the nail on the head of the beginning of this segment, something i'm so passionate about, and that is school choice. i am grateful that i have the ability, thank god, and i have the means, to determine where my daughter will go to school monday. but i also think that every parent in this country who doesn't have the same means that i have should have the same choice in the same ability. and that is why we've been doing school choice in florida where you are, kayleigh, for over 20 years. and that's why i encourage every republican legislature, governor, or even democrats, if you haven't been pushing school choice in your state, you should be. one final plea, 11. do you know they are 1.5 million less children in public schools in this country than they were a year ago? is a 22% drop in pre-k, and those numbers are because these parents are clearly deciding that these types of things going on in schools are not appropriate for their children.

this, as three undercover officers were shot and wounded this morning on chicago's south side. part of the crime waves rocking the windy city with 355 murders and more than 1500 shootings so far this year. max lewis is among those victims. after a stray bullet hit the university of chicago student while he was riding the train, he was left paralyzed from the neck down. the 20-year-old needed a ventilator to survive. and his parents say that he used his eyes to signal them to take him off life support, spelling out on a letter board, "if i have to live like this, pull the plug. please." gillian had a great guest on last hour and he pointed out the magnitude, put it into perspective for us. when you have a high number of homicides last year dating back to the '90s, and 30 children shot this weekend, it's an absolute tragedy. and a huge political enormity for the biden administration when you have just 38% of those polls saying he's doing a good job on the issue of crime. they know that this is a tough issue for them, which is why they are pulling out tactics they often do, which is number one, the blame game, and number two, strawman arguments. the blame game in the form of lori lightfoot saying the criticism is based on her race and gender. you have jen psaki at the podium saying it's seasonal. it's not seasonal in the number of homicides is dating back to the '90s, as and gillian's gas pointed out paid on the strawman argument, let's go after the guns. even though 90% of weapons using gun crimes are obtained illegally. as a strawman argument. if they don't get serious about this, it's going to be tough for

"oh, let's get after the guns." no, let's get after the guys who pulled the trigger on the guns. it's worked every time. it's like when they wanted to fight terrorism. "not terrorism, global warming is the bigger national security said. not border crisis, global warming." it doesn't matter, it's a dodge.

[laughs] here's the problem with her support is right now, agitating for these rules to be overturned in the next month. something like this, about whether to allow recreational drug use in athletes before an olympic game is something that's going to require a lot of conversation, maybe some studies, because as always you got to worry about unintended consequences. if the united states, the olympic committee, decides to allow recreational use of marijuana, it is sending the signal to athletes that it's healthy, that it is safe, when they don't know that's the case. sha'carri richardson must do what she needs to do for yourself as a human being. if i was an olympic athlete, i would be very worried about how that might impact my performance. seems logical. >> kayleigh: it does. aoc, jesse, is questioning if the rules are fair.
