order while democrats are focused on spiteful opposition. jillian: two baltimore police officers working on a us marshal task force are shot by a homicide suspects. authorities say the officers were looking for the suspect to serve an arrest warrant when they spotted him in his car in the mall parking lot when they tried to approach he got out and started firing. the officers returned fire striking the suspect to later died at the hospital. the two offices are said to be in stable condition and are expected to recover. todd: the taliban claiming to capture a key trade route between afghanistan and pakistan. that could for the extremist group with funds from customs revenues. it comes as the taliban prepares for peace talks with afghan officials in the video shows militants executing unarmed security forces. a warning, this video is extremely disturbing. american history that is truthful and inspiring. how unsettling it is it that a statement like that is viewed by the left as controversial? >> we all use to agree on that. at least i thought we did and i do. i think the vast majority of americans do but there's apparently a concerted effort to cancel our history, transferred to our kids the idea not that america is unlimited but the contrary idea that somehow their individual future is limited by our collective past. that's not true. we have to fight back against this. president reagan said freedom is one generation away from extinction and this is our time to pass on the truth about america to our kids. todd: how dangerous is it to democracy that the media which always leaned left is becoming so increasingly 1-sided, left-sided if you will but without any apology.

chance? >> i'm saying there is actually a food chance if he makes the right arguments in court. the media didn't love his lawsuit when it came out because normally, they are right. the first amendment applies to the government, not to private companies. but here's the thing in this case. these private companies. the big tech giants, did their work in part on behalf of the pig government. they responded to government threats. they willfully cooperated with the government in deciding that speech could and couldn't stay online. best of all for them, they were protected by a form of federal immunity in the form of section 232 c 2 of the communication decency act. when you combine both carrot the legislative threats -- carrot which is section 230 as well as the stick which would be legislative threats and finally the coordination between these companies that is not the action of a private company that is state action in disguise.

the basic principle i articulate in the op-ed if it's state action in disguise then the constitution still applies. that's what i think could have the states go all the way to the supreme court and give trump a chance of actually winning. carley: interesting. you have got to think if trump does win, what does that mean for the social media companies and how they operate and also what does it mean for users? >> absolutely. look, i think that the implications for the social media companies could be deep. there is a path by which they could actually find in the high court that section 230 is actually unconstitutional when it's applied to, for example, preempting state laws that say you can't discriminate on the basis of political viewpoint. states like florida have recently passed such statutes. i think that could have deep seeded implications for eliminating social media companies to ability to engage in censorship. it also could mean that the social media companies are no longer immune from liability. if they're taking down users'

don't willy-nilly. now, for everyday users, i think it could have the effect of really unlocking speech in this country in a way that's been chilled over the course of the last couple of years. in fact, even just a year ago, if you had said online, on facebook, or on twitter that you believed that the coronavirus originated in a lab in wuhan, you would have been censored, possibly deplatformed. now that is increasingly the predominant he theory how this virus originated. implications are deep not only for freedom and democracy not only for companies but for the pursuit of truth itself for open debate and deliberations. that's personally why i'm interested in this case. not about president trump. more about the stakes of open dialogue for democracy. todd: is this case considered a success even if trump loses but forces trump to pick a lane are you date are you private? >> has influence on the state and private companies to say each does their work separately and big tech companies think
