have you seen these rock climbers? it's a great sport. you have to tune in. check it out. >> bill: what was the favorite part of your week in the half being away from -- >> dana: i certainly missed everybody but jasper, peter gets to be with jasper. it was great to have a week after but great to be back. >> harris: mask mandates are on the verge of going right back to where we were. critics say confusion is coming from the white house, though. i'm harris "the faulkner focus" and you are in "the faulkner focus". white house chief medical advisor anthony fauci says it's time for everybody to mask up indoors. some cities are making it mandatory. >> do you think masks should be brought back for vaccinated americans? >> this is under active consideration. you are in a situation where we
8:01 am
have a lot of dynamics of infection so even if you are vaccinated, you should wear a max. >> harris: here is an example starting today. the nation's eighth largest city, st. louis, missouri, is following the lead of los angeles requiring masks for everyone over the age of 5 in indoor public places, even if you are older and been vaccinated. city leaders have a fight on their hands. missouri's attorney general announced he is going to sue over that mask mandate. >> they are doing this under the guise of public safety. it is about control and people have had enough. this is anti-science if you ask me. it will discourage people to be vaccinated and have the opposite effect because to have this sort of mask mandate for people who have already been vaccinated and kids when the science tells me this is not an issue is ridiculous. >> harris: several cities are
8:02 am
requiring masks in schools including the nation's three largest school districts. seven new jersey students have signed onto a lawsuit looking to block any possible mask mandates in their school systems. alex hogan is live in west orange, new jersey. >> hi, unlike other mask lawsuits that center around the freedom of religion, this one centers around freedom of speech and expression. 20 parents and students have come together saying that this mask mandate for schools is limiting the distance, putting them between children and infringing on children's rights to communicate and interact. children make up 14% of all cases to date. this lawyer says his clients have a very strong case.
8:03 am
>> can sit on one side of a basketball stadium packed together and yet 20 students have to be masked. the state can't justify this and i think we'll win. >> los angeles was the first county was to require mask mandates. other schools will require face coverings in class this fall. class action lawsuit named new jersey governor phil murphy, head of the state department of education and the state commissioner of the department of health and it's aiming to prevent a similar mandate here in new jersey. families involved say they fear long-term psychological and social development effects on kids. one mom says mask wearing caused her son to regress during the pandemic. >> he basically missed his junior year. he is very active in school, very sociable in school. he was involved in drama.
8:04 am
he ran for class president and with his asperger's he needs to see people's faces to read social cues and to communicate. >> so far this group has raised more than $47,000. we did reach out to state officials and they say they will not comment pending litigation. harris. >> harris: thank you very much. i want to bring in dr. marc siegel. fox news contributor and professor of medicine at nyu langone medical center. always good to get your expertise. my good friend, trey gowdy, talking about another topic but we lean in on this one. if you want to persuade someone, start making sense. what is up with all of the confusion over the mask? >> that's a very good way to start, harris. the confusion is that they are making it all like one way or the other and that's what is confusing people. here is the science.
8:05 am
it is a diversion airy tactic. masks are of limited value. if you wore an n-95 mask tested for leaks the way i do it would protect you but the surgical mask or cloth mask that isn't fit properly is extremely limited help. then you are asking a vaccinated person to take it when you just finished telling them that the vaccine protects them. we love the vaccine, harris. it does protect you. the chances of you being hospitalized with covid-19 after getting that vaccine is probably less than 2%. it is a really powerful at decreasing severe disease and decreasing rate of spread. if you're vaccinated it is unlikely the mask would add anything. they're trying to say we don't know if you are vaccinated or not so we can't tell you not to wear a mask, we must tell you to wear a mask because you
8:06 am
could not be vaccinated and we can't prove it. that's what it is about. they aren't messaging it properly. unvaccinated people should wear masks. >> the president stepped in it on that message, too. he accused we parents of lying when directly asked whether our 12 and older kids have been vaccinated. just assume, i guess, and go forward. you could just ask us and we do tell the truth. i mean, i'm not so sure how we got to this point. but look, here is another element to put in all of this that really has people worried. when we see surgeons wearing masks they're getting tested for leaks and making sure both sides of the masks are safe. the person on the surgery table who is getting operated on and the doctor behind the mask. we aren't doing that in the wider public. isn't it meant to protect when you cough somebody else more than it is when they cough you being protected? >> that's a great point, too. it's exactly why it is those
8:07 am
that aren't vaccinated that i think should be wearing masks indoors. that's exactly why. if you are vaccinated and coughing you aren't coughing covid-19, extremely unlikely. regarding schools, i want to add another point. people that are vaccinated in schools of course there is no really added value to masks, very little. a big downside as alex reported. what about teachers? 100% of teachers aren't vaccinated yet. we initially said we were worried about spread within schools because we didn't want to get teachers sick. teachers can get vaccinated. >> harris: they ran into teachers unions making the lists longer how they would get back this fall. some things came off the list and other things came on like money. i'll move to this. the white house is facing growing questions about its strategy to convince skeptical americans to get vaccinated. they should talk to dr. siegel. chief of staff ron klain
8:08 am
tweeted this. vaccinations are picking back up. about 790,000 in the past 24 hours per cdc report might be the biggest 24-hour period since early july. thanks to everyone involved. dr. anthony fauci says the unvaccinated are causing america to go in the wrong direction. let's watch. >> it's like we have two kinds of america. we have the very vulnerable unvaccinated part and we have the really relatively protected vaccinated part. so if you are vaccinated, you are really in a very different category than someone who is not vaccinated. >> harris: before i get to the next thing i want you to give me your thought line thoughts on what you've just heard. >> i think he is not taking into account the emotions and fear of the situation. it is not about scolding people. it is about asks asking them why you aren't taking the vaccine. someone that i think should have it. this person -- is a healthcare
8:09 am
worker that seen everybody getting sick with covid found out someone in her family had a side effect from the vaccine. that's what is in her head. we have to find out why people are nervous and reluctant. 80% of those not vaccinated say they won't get vaccinated. a lot of them if they have a conversation, harris, could probably be brought around. >> harris: people are too busy hitting each over the head with a club do what i do. former trump white house press secretary sarah sanders is running for governor of arkansas. dr. fauci and the because science says so crowd of arrogant condescending politicians and bureaucrats were wrong about more than their mandates and shutdowns that have inflicted harm. no one did more to undercut public confident in the vaccine than joe biden and kamala harris. dr. siegel. >> even now that's true. even now that's true. the other night on the town

8:11 am
proposal that was peer-reviewed and given a very high rating for the importance of why it should be done. it was almost as if you didn't pursue that research you would be negligent. >> harris: dr. siegel. >> let me tell you what the problem with this is. we have a covid investigation unit looking into origins of the virus. dr. fauci told me on the radio they were frightened by sars in 2003 and had to do a deep dive and wanted china involved. he was naive about what involving china means. it means the chinese communist party. three possibilities here. one a bioengineered virus which dr. collins said he definitely has ruled out. but this virus could have been played with in a lab, too. it could have been in humanized mice and leaked out of the lab which it is looking for like that. china is refusing to cooperate. it is making dr. fauci look very naive when he said we needed to go after sars. it would be irresponsible. it is irresponsible to work
8:12 am
with scientists when you don't know who is bossing them around. >> harris: the awkward part of this we learn more about dr. fauci than we are about the origins of covid-19. his naivety, we don't care about it. how it started and how we've been damaged by what china was allowing to happen in their own country is what we care about. dr. siegel. you said before words today about the vaccine today. let's talk and listen to each other. that's huge. >> thank you so much. harris. >> harris: a mob of teenagers beating an off duty new york city firefighter. the latest brazen attack stoking fear in cities across america. what will it take to clean up the streets? and there is this. >> cori bush represents st. louis, misin congress. she wants to defind your police not her police. >> harris: he is so right about

8:23 am
at all. where is the biden speech that don't involve guns and democrats step up and say it is happening under our watch. we can't keep blaming trump for everything. we can't keep pretending there is a massive white supremacy threat when they aren't shooting and killing these folks in our cities. certainly what we know is not the case, cops aren't committing these crimes. yet the national narrative coming from democrats on another network police are involved in all this and police are ones responsible for the crime in our streets. it is nonsense. >> harris: while you were talking and i told everybody this is daytime and want to give people a chance to pull away. this violence is going viral in so many different places it is hard to get away from it now. the beatdowns that people are taking particularly people over the age of 65. they are getting pummeled in some areas. some of the most beautiful places to shop, visit and live

8:25 am
that? wow. okay. >> of course not. they aren't about saving black lives. they are about dismantling police departments. we've seen the dismantling of police departments. yesterday we have a new laws that went statewide that remajs policing and there will be more victims as a result. >> harris: reimagine. yeah. according to a new poll only 39% of people approve of how president biden is handling crime. 37% approve of how he is handling gun violence. your quick reaction to that. just to throw in we have a lot of knife violence right now. the stabbing, subway, stabbings in times square. >> the polls are interesting. you can spin them either way. i imagine democrats will spin it saying the reason why they are unhappy with crime is because it impacts people of color and police are out of control. we have to start listening to people on the ground.

this is not about fact finding. this is the democrat anti-donald trump campaign being paid for by tax dollars manifesting as a fraudulent investigation and of course, harris, this continues to effect the legitimacy of government as a whole, whether or not american people can trust what congress is doing, and this puts another stake in that heart. and if you want antics, i think it's pretty clear that this is part of that. >> harris: republican senator pat toomey went after democrats saying they're keeping the investigations into january 6th at the forefront for political purposes. >> it is politically to the advantage of democrats to try to keep this issue in the forefront. james carville has been very candid about this. he urged the democrats don't let the election be about joe biden and his policies in 2022. make that election about january 6th and donald trump. it is very clear that democrats
