todd: it is thursday, august 12th. the most complicated crisis, that's how officials are describing the situation at the southern border as we're told brand-new numbers set to break records. jillian: plus the white house ramping up the battle with florida governor ron de santis over masks in schools, after a new fox news poll sends a clear warning to president biden. todd: new video found on hunter biden's laptop raising national security concerns, so why isn't the media covering it?

yankees and white sox take to the field at 7:00 eastern. there will be pregame at a 6:00. and it will probably be one of the most iconic major league baseball games, if not in years, ever. jillian: we're going to check back in with you a little later. thank you. todd: there's other news, the white house vowing to fight florida governor ron de santis and the threat to cut teacher salaries over mask mandates. jillian: the biden administration is doing a double take after using incorrect data to back up their logic. ashley strohmier joins us with more. >> reporter: the white house denied it was waging war against governor ron de santis. take a listen. >> our war is not on de santis, it's on the virus, which we're trying to kneecap. and he does not seem to want to participate in that effort to kneecap the virus, hence our concern. >> reporter: the white house pointing the finger at the alarming spike in covid cases in the sunshine state. >> that's literally adding insult to injury. we have policies that are being

implemented now that are not safe for students. look at the data. i mean, we're talking about the rates in florida going up. it's dangerous. and we want to make sure our schools are reopened for our students and that parents feel confident sending their children to school. they've been through enough already. >> reporter: the cdc scrambled to adjust the state's number of cases after officials pushed back on that number. its website showed a record high sunday of more than 28,000. the cdc adjusted the number to 19,584. that's when florida put the number at a little more than 15,000. now in texas, governor abbott is threatening legal action again mask mandates, tweeting any district, public university or local government officials that decides to defy g838 which prohibits government entities from mandating masks will be taken to court. in california, governor newsome makes it the first state to require teachers to be vaccinated. >> we think this is the right

thing to do and we think this is a sustainable way to keeping our schools open and to address the number one anxiety that parents like myself have. i have four young children and that is knowing that the schools are doing everything in their power to keep our kids safe. >> reporter: as i said at 4:00, there's a lot going on in all different states. jillian: absolutely. ashley, thank you. we want to talk about this fox news poll here, this is from august 7th through 10th and you'll see here, i want to -- i like to keep people on their toes, start on the bottom. approval rating, 35% approve of how the president is doing on immigration, 39% on crime, 47% approve of his job on the economy, but look at that number, 54% approval on coronavirus. now, on its face you see that and you think okay, well, that's good. that's positive. because only 42% disapprove. now let's step forward and show you another poll here and this

really tells the story. that approval rating is down 10 percentage points from june of 2021. so as you can see, 10 points, that's a big deal in just a matter of time. todd: you can understand why, though. people are scared. jillian: and confused. todd: they're scared an confused, they thought we would be past this by now. clearly if you look at the data, delta is there and delta is scaring a lot of people and the president is going to pay for that. i'm more focused on the other issues in the poll. people are scared for their safety. that's why you saw that crime number the way it was. people are frustrated with what they see at the border. it seems it's a situation that if biden did nothing we wouldn't be in this situation, yet he did something and look where we are. it is an absolute disaster down there. people look at their wallet. it always comes down to the economy, james car veal said it's the -- carvell said it's the economy, stupid. people are paying more for things that a month ago weren't that against i've. jillian: if you're a small

business owner and you're trying to get employees, a lot of business owners are paying more money for hourly workers. in addition, the cost of a lot of their products are going up right now. todd: so how do republicans take advantage of this? ari fleischer says, this is often a problem for republicans, it's all about the messaging. here's his warning. >> republicans have the ability to communicate and express what's wrong and when joe biden goes on this massive redistri because of income, allowing people to come into the country illegally, not handling covid properly, republicans have a great case to make for why the democrats and joe biden should be thrown out. .todd: republicans need to keep this in mind right now. jillian: we brought you the poll numbers a few minutes ago. let's take a look at one more before we move on. this is the favorability rating of vice president kamala harris. 45% in this poll amongst registered voters view her at

favorable while 51% view her as unfavorable at this point. todd: there's a scathing op-ed out there right now. i know we make fun of the fact that i use the word scathing, but there's no other word for it. it's in the new york post. it's as follows, the problem proper the democrats is that she, kamala harris is unelectable. it's the fake laughter, the car crash interviews and complete inability to succeed at any of the tasks she has been handed from immigration to vaccination. she is so unpopular that hillary clinton staffers of all people reportedly have been consulted for likability lessons. i don't think it's any surprise that democrats assumed she was going to take over the run in 2024 because joe biden will be in his 80s at that point. joe biden is not showing that he can handle the job from a stamina perspective at this point. it's not going to get better over the course of the next three and-a-half years. i think democrats thought kamala's our gal. if you look at the numbers, they're very worried right now

todd: today, homeland security secretary alejandro mayorkas is headed to the southern border amid calls for his impeachment over the covid crisis. jillian: -- border crisis. >> reporter: good morning. that revelation comes from the incoming border patrol chief, raul ortez who takes the reins of the agency on sunday, confirming to jonathan hunt that these july numbers will break records in the most difficult conditions he's ever seen. >> in my 30 years, this is the most complicated situation i've ever experienced. we have heard that the official july figures for apprehensions are going to be north of 210,000. >> we've seen steady increases over the last four or five

months. >> over 210,000? >> yeah, i believe it's going to be over that. >> reporter: this as secretary mayorkas does head down to the border where he last visited in may. he's headed to the rgb and he's tweeting wheels up for south techs adhs is executing the plan to rebuild the safe, orderly and humane immigration system. he's met by harsh criticism. chip roy tweeting at secretary mayorkas and president biden, calling for impeachment, showing video of overcrowded conditions inside a hold hoing -- holding facility. the sheriff is sounding the alarm in kenny county. >> i don't see an end in sight. they need to secure the border. we need to get boots on the ground. we're working 12 hour shifts to try to get ahead of this. when we explain they were criminal trespassing, they were going to jail, they said that's impossible.

>> reporter: i.c.e. is announcing they will not deport illegal immigrants who are victims of crime, saying they will support them through immigration benefits. todd: dr. nicole saphier says biden should be consistent when dealing with covid-19 from foreign countries. >> when it comes to infectious disease and the migrants crossing our southwestern border, that's always been an issue. it doesn't really make sense that we're going to put travel bans on the u.k. and other of places across the globe because of certain variants circulating, yet we do have people coming from the southwest border. if we do not have the resources to test, trace, quarantine and to ensure follow-up, then, no, that would be irresponsible and then that could lead to further spread. todd: the city of laredo texas found that 40% of migrants who were puffed in tested positive for covid-19. jillian: a minneapolis democratic leader defending rioters who burned a police precinct as a, quote, act of pure righteousness as the

minnesota supreme court refuses to review an order to hire 700 police officers. nolan wecht is here to react. thank you for being here. here's the headline it says, quote, the cops started it. south side pride. it says like it or not, setting the third precinct on fire was a genuine revolutionary moment and act of pure righteousness to open new worlds of understanding, the youth of minneapolis carried all of this. the cops started it. here's what the minneapolis democratic farmer labor party chair, devin hogan said to fox news, quote, people seized on the word righteousness as if i'm the one assigning it moral value. that's not the case. it's meant to convey how the protesters felt at the time in response to their conditions, this is obvious to anyone in minneapolis who was paying close attention when it happened. i think a lot of us who were watching what was going on, covering what was going on, living in minneapolis, i think

that it's going to be a long time until we forget the images of that third precinct on fire that night and everything that's hand since. so what -- happened since. so what is your response to that article? >> it's just completely insane. and the democrats have been trying to push down the defund the police rhetoric as much as they can but it shows that this is indeed what they believe. i mean, it's a party chair that's saying this. not to mention like the one duty of a government is to protect its citizens but the democrats don't seem to believe so. so it's gotten so sad over here in minnesota, it's like -- i liked when we had attention for the super bowl, not for the city burning. and the fact they were trying to blame this on outside agitators for months and months and months and then they have prominent party members saying stuff like this, tells you that was all them trying to get political cover. it's absolutely ridiculous. jillian: let's talk about this before we let you go.

the portion of this, the supreme court denying the request to review a judge's ruling that the city must hire at least 730 more police officers. why do you think this is happening? i mean, you look at these images, you look at the crime numbers, we'll pull them up on the screen now, seems like more officers are needed on the streets of minneapolis, correct? >> definitely. i mean, they need 700 some more officers according to the judge's order and it's -- government does a lot of things it's not supposed to do. the one thing it is supposed to do is protect its citizens. imagine living in a city where you need to get your neighbors together to file a lawsuit in order to get your city to hire adequate numbers of police officers. it's just upside down world here and returning to murderappolis because in 2020 we had a record number of murders in minneapolis, it's a horrible public safety situation and the obvious answer is just to hire more police. the people are asking them to do

todd: new york governor an drew cuomo on his way out in albany. taxpayers could be paying big for his scandals. joining us now, criminal defense attorney gianna. you placed the difficulties in three buckets, administrative, civil and criminal. walk us through what happens. >> the first bucket is basically the bucket that's going to be behind us and the bucket that cost taxpayers a whole lot of money and that was the administrative bucket. in other words, the entire war

and peace size report by la at a james is an administrative proceeding that we taxpayers paid for. that thankfully is behind us. if we don't move forward with a formal impeachment, taxpayers will save a few bucks and that would be a good thing. the second thing that cuomo needs to worry about is being sued civilly by these individual accusers. while that can happen, there's a little bit of a challenge there because to sue somebody civilly for an intentional tort and in this case it's sexual touching, they have a short shelf life, a one year statute of limitations on that. that will pose potentially some challenges for people that want to saw him for money. the last bucket is the criminal bucket. the criminal bucket while it seems to be kind of scary if you're cuomo it's really not as scary as it seems because right now the only charges that he is likely facing are low level misdemeanor charges and ones that wouldn't even have him --

cause him to register as a sex offender. so i don't think cuomo's losing too much sleep right now to be honest with you. todd: it is an interesting state on misdemeanor versus felony, also the fact that you don't have to register as a sex offender. we were talking about the tax implications, my intro, your thing there. let's go through these quickly. pop them up on the screen when we have them, guys. $2.5 million the amount that taxpayers in new york state could pay for cuomo's legal defense. already almost 9 million paid by taxpayers for the legal defense. cuomo made about 225,000 as governor and get this, $900 per hour is the fee, he's getting a reduced fee of about $600 per harks but still a lot. i think people are wondering why will this be so drawn out, why is this happening. explain to us a quick lesson of hearsay. all the prosecutors can't use

the report from latisha james. >> the report from latisha james is not going to be evidence that's used against him in a criminal court. it's one big giant hearsay exception. where taxpayers will have to foot the bill some more is when prosecutors -- if pros you cue tores want to -- prosecutors want to actually file charges and prosecute him it's on the prosecution, i.e. the taxpayers, to bring those individuals back into court, the subpoena fees, the witness fees, the expert fees, et cetera. so we're going to be paying for that. but the good news is, cuomo would be privately paying for his own defense if criminal charges are eventually brought. so that's a little bit of good news for us taxpayers. todd: it was a lot. we appreciate you plowing through it for us. >> thanks so much. jillian: if you build it, they will come. the yankees, white sox and our own will cain are all in iowa where the mlb is bringing a baseball classic to life. todd: will joins us live ahead

will, thank you. todd: obviously all eyes on the weather forecast for the big game. are the yankees and the white sox going to get it in? jd has your answer. jillian: pressure, janice. >> it's a little humid out there in iowa. we did have storms to the west of the region but you know what, pretty good. so humid, yes. but we're not going to look at any thunderstorms so that's great and i can't wait to watch the game. it's going to be spectacular. we had a couple of reports of tornadoes for wisconsin and some thunderstorms of moving through the mid-atlantic, same risk in some of these areas today across portions of the plains, the great lakes, and the northeast. so hail, damaging winds, maybe some isolated tornadoes. here's fred, tropical depression fred. we're going to have to watch this system over the next couple of days as it moves over cuba and then perhaps sets its eyes on florida, eastern gulf of mexico. we're not thinking about a hurricane yet but we're still going of to have to monitor it
