mcgowan is making against governor newsom's wife as voters prepare to head to the polls in california's recall election. todd: you are watching "fox & friends first" on this monday morning. i am todd piro. jillian: i'm jillian mele. let's begin with this, the fight against the president's vaccine mandate heating up as republican governors vow to challenge the order. todd: lauren blanchard live with the backlash as new york city begins enforcing its own mandate. lauren, good morning. >> reporter: good morning. the list of governors continues to grow by the day, they say vaccine mandates are an attack on personal freedoms and are uncons fusional. >> this is egregious overreach of federal authority and as we see what these rules are, we will be able to know exactly how we will be able to challenge them in courts. >> reporter: here's what the president announcerred last week, businesses with 100 or more workers must require vaccination or weekly tests. employees at medicare or medicaid funded nursing homes must be vaccinated plus almost

all federal employees and contractors must get the vaccine with no option of testing. the surgeon general says the administration believes the mandates will hold up legally and they'll only allow for religious or medical exemptions. >> we've got to be vigilant there and make sure that people are using them in the spirit that they're intended and not abusing them or asking for exemptions when they don't aply. that's one of the areas we continue to monitor in the days and weeks ahead. >> reporter: and today if you want to eat, work out or attend an event inside in new york city, be prepared to show your vaccine card or face fines, although mayor bill de blasio said they won't begin collecting immediately. vaccine requirements also apply to kids over 12 who want to play school sports and teachers in the classroom. in texas the attorney general announced his office will sue at least six school districts for mask mandates. the state supreme court sided with the governor's ban on mask requirements by schools.

coming up, attorney general paxton will be right here on the future of those lawsuits and the vaccine mandates by the biden administration. todd, jillian, i know you will ask him about it. jillian: thank you. todd: to the fox news alert, secretary of state antony blinken will face tough questioning today on the botched withdrawal from afghanistan. jillian: this comes as the wall street journal slams the administration for leaving americans and allies behind, writing the biden administration wants nothing more than to wash its hand from the debacle in afghanistan, but the world of shouldn't forget thousands face arrest, torture or death because of the white house rush to the afghanistan exit. todd: we have more on what blinken can expect. >> reporter: house republicans are expected to press the secretary of state on exactly how many people are stranded in afghanistan and how evacuees are being vetted. congressman michael mccall says blinken has a lot of explaining to do. >> why did this go so bad?

how did he get it so wrong? why didn't he listen to the intelligence community warnings that the taliban was going to take over this rosy dream that they were going to somehow negotiate a last minute deal with the taliban was absolutely fantasy world. >> reporter: the taliban has been cementing its power in kabul, raising its flag above the presidential palace on 9/11. and despite promises had they have changed, the group declared women cannot attend the same schools as men, have beaten reporters and tortured an afghan interpreter in front of his family. former acting cia director michael moralesaid their victory made americans less safe and afghanistan into a terror hot spot. >> not only will jihadists be inspired but a lot of them are going to come to afghanistan to be part of the celebration, to be part of jihadist central.

>> reporter: now, former president trump who spent 9/11 meeting with new york city first responders says the military withdrawal from afghanistan is, quote, the most embarrassing event in the history of our country. >> it's the most incompetently handled withdrawal in history. we should have saved those 13 people and we should have taken out all our equipment. i believe they're incompetent. they didn't do it on purpose. >> reporter: the former president says america now needs to focus on moving forward and hinted at a possible 2024 run, telling me the country is getting to a point where he's going to have no choice. jillian and todd. todd: thank you very much. in the piece you heard congressman mccall list three questions that i think we're all wondering, why did this go so wrong, why did he get it so wrong, of course being joe biden, and why did he not listen to the intel community. another question, where's the transparency. it's not like everybody that's

american or an ally is out of afghanistan but seems like over the last week we stopped hearing of rescues by and large. what about the six planes we reported on, are they still grounded. if so, why? do we have that number yet of how many americans and our allies are still there. is it still 100? is it many more, as many guests on our show have said. so many questions that we're not getting answers to, hopefully we will today. jillian: i don't know how we don't have that number yet. it was basically almost immediately once we departed afghanistan we stopped getting the specifics of those number, day if and day of out. some of our reporters have been in the white house briefing room and been asking for those numbers on a daily basis and we just don't really have them. the wall street journal editorial board says this. quote, americans, u.s. residents and endangered afghans are still scattered throughout the done can tri, the special immigrant visa program offers a path had to u.s. citizenship for afghans

who worked with the american government for at least a year during the war. the process can take years and hundreds of applicants and family members have been killed over time. a state department official acknowledged that the majority of siv applicants remained after u.s. forces departed. this is one of the worst war time betrayals in u.s. history. there was a plane that departed last week. there were some americans on-board. it was very few number of americans but one is even incredible to be able to get out of there at this point. but we should be able to get all of them out because that's what was promised to them. todd: it is what was promised to them. underpinning all this is the administration's misguided trust of the tall a ban. i think that's the easiest word, the lightest word you can use on this add administration, trusting the tall a ban. congressman -- taliban. congressman michael wants attacks it here. >> blinken said we'll judge by their actions. let's look at their actions, let's look at the beatings and

killings of journalists who are covering protests of women that have been told you can't go to work, you can't go to university, that taliban spokesman when asked why aren't we seeing women as ministers, he basically said they can't handle it and need to stay at home and have babies. so here we have the democrats that are the defenders of minorities and women's rights and yet they're silent and they're engaging with a terrorist regime. todd: with that silence, the democrats, this administration basically sanctioning the subjugation of women, that's in such stark contrast to what the democrats have said. it's so hypocrite call, it doesn't make sense. jillian: women have made so many strides over the last 20 years since we've been there and now they're devastated. everything they worked for, schooling, career, things like that, it's all gone.

the volunteers who worked for months in that rubble in lower manhattan, exposing themselves to god knows what. this person literally said two weeks ago that afghanistan and the handling of that withdrawal will just be a momentary blip, his words, as far as in the minds of the american voter. and his role as that activeist is to deflect from afghanistan because that's a bad for the party he serves at the pleasure of. afghanistan as you were talking about earlier with isis and al-qaida and other bad actors using it as a terrorist playground to plan the next 9/11 is the story. it's a catastrophe of the biden administration's own making. but some in media want it to go away because they see the president's poll numbers and they want to make it all about trump again who isn't in power and it's so pathetic to watch. i hate starting my monday like

make the story about him again instead of judging this administration, the people that are in power, on their performance in terms of economy, inflation, crime, foreign policy and the border all of which are going horrifically right now. jillian: it goes back to a problem we've been talking about where right now we're in this point in time where people are grouping everyone into one category, into one box, you know, like you listen to that sound bite and he's talking about maga supporters and most people on the left would say mag a a supporters are republicans, right, so you're grouping everyone into one category. how dangerous is it when we're doing that nowadays. >> 74 million people voted for donald trump in 2020. that wasn't enough to get him over the finish line. joe biden is now your president and just to paint those 74 million people as all horrible people who are insurrectionists and all these sort of hyperbolic words, of course it doesn't help anybody. i'll repeat the poll because it

bears repeating, jillian, and that is that gallup found in a poll last year that 83% of americans believe that the media bears some of the blame for the divide in this country, when you hear rhetoric like that, that is exhibit a, the top of the syllabus, if you're teaching a class on how to divide a country. todd: i worry the things that we heard from capeheart and things we heard over the last several years, in terms of being scared about actually terrorism and lefting these other -- letting other thoughts pop up in people's minds, you have to hope we have our eye on the ball. i don't want to say it, but god forbid it happens again. >> i know what i'm thinking, by the way. i want to end on a happy note. i'm trying to get the color. i can't identify it. todd: it's red. jillian: salmon maybe. >> salmon, that's good.

with our diplomacy, the military mission is over, a new diplomatic mission has begun. jillian: greg steube will question blinken at today's hearing and he joins me now. thank you for being here. >> thanks for having me. jillian: i want you to take a listen to what john ratcliffe had to say, this is on what happened in afghanistan and he questions that remain. take a listen. >> the challenges here that we are facing for the next three years is a president who is not listening to the intelligence. our intelligence was crystal clear about what was going to happen in afghanistan if we withdrew without conditions based terms that we had negotiated. jillian: 0:how important is it that we find out about that intelligence? who knew what, when and who knew that this could potentially be the end result, what we've seen fall out here and is that one of the things that you want to ask? >> yeah, it's absolutely find

out as a nation when we had intelligence and what we knew. we knew we saw this coming. we have some of the best intelligence capabilities in the world. we have satellite imagery that you can see everything that's happening on the ground and they just stood by and watched the taliban take over afghanistan and actually didn't want to sound the alarm and get people out because they knew it would alert that afghanistan was falling. so they intentionally did things that stranded our american citizens behind enemy lines. we still have people there. and what's interesting is in the beginning when the administration was giving us numbers, they were saying, well, there's between 10 and 15,000 americans that are still left in afghanistan and the last number i saw is we got 5500 you out. i'm not a mathematician. i'm sure my 10-year-old son coffing out we have 10,000 people left there. the administration is saying we only have a couple hundred people. you see hundreds of people show up in all these places, either

they know and they're intentionally lying to the american people or they don't know because we don't have people on the ground anymore and he's negotiating with terrorists to get the american citizens out. jillian: do you think we get those answers from blinken? >> no, i think we're going to get more lies. what i'm curious to see today is are democrats who served in iraq or afghanistan, who served in the war on terror, going to be willing to stand up against their own party for the american people today and ask tough questions and say tough things about the complete debacle that occurred in afghanistan and that we don't leave americans behind enemy lines. that's not what we do and that's absolutely what this administration is doing and now it's trying to push our government to negotiate with the taliban. jillian: well, speaking of tough questions, our peter doocy as you know always asks tough questions of the administration, specifically jen psaki. take a listen to one of the questions he had about what's

going on at the southern border, this is about the vaccine, compared to the mandates on americans. >> it's a requirement for a business for more than 100 people, it's not a requirement for migrants at the southern border. why? >> that's correct. jillian: what's your reaction? >> not surprising, the hypocrisy of democrats knows no bounds and it never has. it's becoming more apparent every day. the government is going to force upon private businesses over 100 employees that they have to get the jab but illegal immigrants that we know have covid, 35% of them in the last number we got from the judiciary committee, 35 to 45% of them have covid and they're putting them on busses and putting them on planes and shipping them all across the country and then refusing to answer the questions of congressmen like myself and other republicans on the judiciary commit -- committee of where they're transporting the migrants to.

they're refusing to answer questions, refusing to lay the same level of covid protocol on illegal coming into our countries, than private businesses and private citizens in our country. it's atrocious. jillian: well be watching today. thank you for joining us. todd: to fox weather now, parts of coastal texas under hurricane watch and tropical storm warnings as nicholas gains strength in the gulf. hurricane ida caused deadly flooding and thousands remain without power because of that. meteorologist adam klotz is tracking nicholas for us. >> this is going to be another rain maker and going to areas where they saw so much rain so that's one of the big concerns as we pay attention to this storm. currently winds at 60 miles an hour, gusting up to 75 miles an hour. the heart of the storm sitting about 45 miles off the texas coast, think south padre island. this will run along the coast throughout the day, this is

something that will linger throughout the day, if i can get this map to continue moving. there it is, winds up to 70 of miles an hour as you see this tracking its way up the coast, that's 7:00 p.m. overnight tonight likely making landfall. we've got the watches, we've got the warnings. i want to get here pretty quickly if i can to what we'll be talking about as far as rainfall. a lot of moisture pushing up in front of it. just because i'm talking about landfall across the texas coast, the rain stretches up to louisiana and mississippi. that's the big concern with the storm is going to be all the rain, happening not just today but tuesday into wednesday, 5 to 6 inches widespread, some areas up to 10 inches. todd: republicans lining up to fight against president joe biden's federal vaccine mandate. that list includes our next guest, texas attorney general, ken paxton, who says he will be suing the administration. plus this. >> don't make this a bernie

over the president's new vaccine requirements. >> this is egregious overreach of federal authority. todd: here to react, texas attorney general, ken paxton o you say this is the most unconstitutional thing you may have ever seen come out of a white house. why? >> well, look, the president cannot just make a law out of thin air and tell businesses that they have to require every individual that works in a business to get a vaccine. he doesn't have that authority. he has to go through congress. i'm not even sure congress could order it. this is unprecedented for a president of the united states to sit there and make up a law about our health. todd: here's what the president has to say about it. listen. >> many of us are frustrated with the nearly 80 million americans who are still not vaccinated. even though the vaccine is safe, effective and free. this is not about freedom or

personal choice. todd: you say you plan to sue the administration very soon, a number of other republican governors planning to sue as well. what is the crux of the case? >> it's really simple. constitution provides for certain responsibilities of different branches of government. the branch of government that can pass legislation that might be able to do this, i'm not even sure they could, is congress. the president cannot issue edicts, he doesn't get to decide whether it's personal choice or freedom or taking away free, this is something that has to be debated by elected representatives. we don't have kings here. he can't just make up the law and tell people they have to be vaccinated. it's not correct under the constitution. todd: meantime, from you suing them to them suing you, the biden administration suing texas over you new law banning abortions after six weeks after joe biden, a cat lick president, called -- catholic president be, called the statue almost unamerican. here's more joe. >> the thing about the texas

law, it creates a vigilante system where people get rewards to go out to -- it just seems -- i know his sounds ridiculous, almost unamerican. todd: ag merrick garland calls the texas law, quote, clearly unconstitutional. but ag paxton, where does the constitution guarantee a right to an abortion? >> it doesn't. and 1972 as you know they created a constitutional right to prosecute. there is nothing in the constitution that guarantees the right. the mississippi case we're involved in, we're directly challenging 24 other states whether roe v wade is constitutional. it's been a disaster. it's constantly changing. we think the state as they did in 1972 and prior to that should have control over these types of decisions, not the federal government and certainly not a court dictate whack the law should -- dictating what the law

should be. todd: there's been criticism over the private enforcement provision. are you worried that could doom the you. >> the courts are open to all different lawsuits. the legislature in their best interest, the people of texas, decided to give them a cause of action. there's no reason the court system shouldn't be open for a adecision like this to be made y a court as relates to people's rights if relation to abortion that occur in texas. todd: ag paxton, your state, the centerpiece of the legal world. not necessarily the football world. that was a mean dig. i shouldn't have said that. ut had a tough one. thank you, sir. have a good one. >> thank you. jillian: man, that was unnecessary. todd: i'm bitter about football. jillian: you're looking live at capitol hill whereby den's $3.5 trillion vision is in peril, leaving democrats

sparring over the monstrous price tag. todd: i ticked off casone as well. we're not really in-fighting, the democrats are. cheryl: we're not going to talk about football anymore. hi had a rough weekend as well. good morning to both of you. senator joe manchin is not backing down, he's making it clear he will not support a proposed $3.5 trillion spending package. he blasted progressive dems for holding up the bipartisan 1.2 trillion infrastructure package hostage and there is no way it will pass this month he says. >> there's no way we can get this done by the 27th. if we do our job, there's so much difference that's we have here and so much apart from us, where we are, as far as our -- i'm giving you different things, i'm talking, working with people, i'm willing to talk to people. makes no sense at all. cheryl: manchin saying spending between 1 and 1 and-a-half trillion is realistic for the spending package. progressive senator bernie sanders, however, says that

lower number is unacceptable. >> no, it is absolutely not acceptable to me, i don't think it's acceptable for the president, the american people and the overwhelming majority in the democratic caucus. cheryl: sanders saying one person is destroying two pieces of legislation, dems need 50 votes to pass it. todd: or he's doing his job. you could view it that way too. jillian: we're expecting an a inflation report that could be interesting. cheryl: it's a big one this week, a key economic indicator, it will be out tomorrow, the consumer price index. it's expected to rise again as americans are paying more for everything from milk to gasoline, trucks, cars, all kinds of consumer goods. you know it. you've seen it at the grocery store. used car and truck prices rose 7.3% in the second quarter of this year. economists believe prices will remain high through at least the beginning of next year. last week we got producer prices, that's what wholesalers

for younger children and even seeing when moderna might get for older children, was do you make of timing of this? when do you see this potentially happening? >> i think dr. gotleib is right on this. he is on the board of pfizer. he has inside information on this. we heard from other people from the government. we'll see the approval for 5 to 11 sometime in october, probably towards the end for pfizer. keep in mind, the fda has to look over the data and they've got to look over it very carefully because as you know the 12 to 17 crowd has had rare side effects. they're using a lower dose if the 5 to 11-year-old group which is really good. i would like to see the interval interlengthen between the first and second dose. via feeling that's part of the issue in terms of how long the vaccine lasts but the main thing is that they're giving a much lower dose of the vaccine which is really going to lead to much fewer side effects. i agree with your point. we saw 250,000 new cases among children last week alone.

26% of all cases now of covid in the united states are children. we definitely need to have that vaccine available as soon as possible. jillian: okay. yeah. delta variant definitely kicking into high gear it seems like. let's talk about this for a second. this is shocking the vaccine mandate resignation force a lewis county general hospital to pause baby deliveries, this is a county in new york. we'll pull up the statistics on who is vaccinated at the hospital. 27% of the hospital's workers are not vaccinated, that's 165 people. i mean, doctor, to pause deliveries, how can you do that? >> i thought about this all night. it's a really important topic. i'm glad that we're doing it today. it's a hard one to have an answer for but i'll tell you this. i do think healthcare workers should all be vaccinated because god forbid somebody brought covid to a woman in delivery. so you've got to side on that. but what about the issue of

natural immunity, people, healthcare workers who had covid, who got over it who have antibodies now. what about somebody who had one shot, had a problem with the shot, has a partial immunity. all of that has to be factored in. the hospital will hire other people. what kind of conversation was had with the employees? is it a threat? what kind of conversation? i think this is an extremely safe vaccine and i have had a lot of success just talking to people about what their fears are. i hate the idea of somebody losing their job over this. i hate deliveries getting delayed over this. but i want healthcare workers vaccinated. jillian: dr. marc siegel, thank you for joining us this morning on these topics. appreciate it. have a good day. >> you too, jillian, thank you. todd: time now, 50 minutes after the hour. president biden headed to california for a final push of support for governor gavin newsom ahead of the recall election. how are the odds looking for the embattled governor? we'll take a look, next.

' ♪ todd: voters headed to the polls tomorrow in california's recall election. governor gavin newsom depending on mail-in ballots while in person turn out will be key for republican candidates like larry elder who want the democrat out of office. jillian: deputy district attorney john ha mattie joins us now to discuss the stakes behind the recall race. i would decide see you. we can't see you right now can we hear you sir? are you able to hear us? >> yes. i can hear you. jillian: all right. good morning. glad to have you here. >> good morning. jillian: the odds right now recent polling showing they are in favor of gavin newsom to stay in office. what do you think is going to happen? how do you see this playing out? >> you know, i think that isn't over yet. i think there are going to be a lot of people who are going to come out and vote on tuesday. i would like to tell all the

voters this: that the governor's main job is to help the people in california make the community and family better and safer and he has failed to do it. the governor has failed to do his number one job, which is to make life better for everybody here in california. we have a major increase in crime here in california. and the governor has supported defunding the police. a major increase in homicides, and assaults. governor newsom supported releasing 76,000 inmates from state prison and 60,000 of them are serious or violent felons and they are going to go into our communities he didn't allow our children to go to school

governor newsom has failed regarding the homeless situation. he hasn't had anything to say about improving the quality of life in california, especially with the homeless. most recently, governor newsom's parole board, who he appoints authorized the parole and release of the assassin of robert f. kennedy. if you look at everything he has done he has failed to be a good governor here. all he ever brings up is the issues of who is behind the recall and then he constant bely criticizes people running against him. i want the governor to stand up and tell everybody how you are going to improve all the deficiencies that we have brought up here in california. todd: to that point if newsom does survive, will he use the recall experience to change some of those unpopular policies or do you fear, jon, he will double down? the type of prime minister he appeared to be i think he will double down, which is sad. his main job is typically prove

the lives of californians. evidence hasn't done that he has also been very, very selfish, telling people to do things that he doesn't do them. especially sending his kids to school, private school and so many children couldn't go to school. and remember this: most of the children who couldn't go to school were children of color. and so he just left them all behind. you the type of person he is, i don't think he is going to. todd: meantime, sir, you are filing a lawsuit against liberal county d.a. george gascon, his or her is the crux of your case. quote gorge gascon has adversely affected my family and my children by calling me derogatory names, criticizing my character criticizing my cases negatively impacting my cases and salary and creating an environment that makes my job much more difficult than it should be. as someone who literally brings suits for a living why do you think the facts of your case jump over that very high bar of defamation? >> you know, the spokesperson

for the l.a. county district attorney's office actually went on tv and said i was unfit to practice law and i was delusional. that person represents the d.a.'s office and the county. that was shocking. first off does that not only permanently affects my career but it effects every case that i have handled. anybody who has any experience with prosecutors and criminal cases anies these cases go on for years. the majority are murderer he is. you have not only affected my reputation but have you affected all the cases, thousands of child abuse cases i have handled prior to that statement and then all the cases i'm going to handle after that. i have handled death penalty cases and major cases, so, first off, it's just inappropriate to say that to somebody who is a prosecutor for los angeles. and it was just shocking that somebody would say something like that. jillian: keep us updated.
